Health Department SUBJECT: Z-539, Katherine Oliver/Meadow Vale Farm Phase II COLORADO The Weld County Health Department has reviewed this proposal. Our staff has also observed the proposed site. The application has satisfactorily addressed water and sewer service. Water will be provided by the Left Hand Water District and sewer will be provided by the St. Vrain Sanitation District. The application materials adequately address the potential environmental impacts as described in Section 6.3.1.2.1 of the PUD Ordinance. The application states that the surface water will be protected from sedimentation and pollutant run-off during development through best management practices. The application also states that no wetlands will be removed during development, and in fact will be preserved as open space. We recommend that the following conditions be a part of any approval: 1,---1) The applicant shall obtain water and sewer service from the Left Hand Water District and the St. Vrain Sanitation District. 2) In the event that 5 or more acres are disturbed during the construction and development of this site, the applicant shall obtain a stormwater discharge permit from the Water Quality Control Division of the Colorado Department of Public Health and the Environment. Silt fences shall be maintained on the downgradient portion of the site during all parts of the construction phase of the project. 3) During development of the site, all land disturbance shall be conducted so that nuisance conditions are not created. If dust emissions create nuisance conditions, at the request of the Weld County Health Department, a fugitive dust control plan must be submitted. 4) In accordance with the Regulations of the Colorado Air Quality Control Commission any development that disturbs more than 5 acres of land must incorporate all available and practical methods which are technologically feasible and economically reasonable in order to minimize dust emissions. a) If land development creates more than a 25 acre contiguous disturbance, or exceeds 6 months in duration, the responsible party shall prepare a fugitive dust control plan, submit an air pollution emissions notice, and apply for a permit from the Colorado Department of Public Health and Environment. 5) Wetlands shall be preserved as open space. ^a Our staff observed that a gravel mining operation and extensive residential-type development has been established near the proposed development. It is our opinion that any future property owner should be made aware that these uses exist and that they may be exposed to noise, dust, flies, m odors, etc. in excess of the common urban experience. Also, we recommend that the "Right to Z 1-- Farm" covenant be required to be placed on any recorded plat. Proper building permits shall be obtained prior to any construction or excavation. 2. Building permits are required for any accessory buildings being constructed or moved onto the property. Additionally, permits are required for any decks and patios. • 3. A building permit is required for the entrance sign to the development. • 4. All foundations of principal dwellings will be required to be engineered. Such foundation design shall be based on a site-specific geotechnical report or an "open hole" inspection made by a Colorado licensed engineer. Due to the high water table, perimeter drains are recommended around foundations. Any fill material placed to raise the elevation of the home must be of the type allowed by the 1997 Uniform Building Code (UBC) and compacted to a minimum of 90%. The test results of that compaction must be supplied to the Weld County Building Inspection Department. 5. The recreational center building, buildings used by fire, police, or sheriff personnel, and all other buildings shall be engineered. Foundations shall meet the criteria mentioned in item number four. 6. All buildings or structures shall maintain distances from property lines and adjacent buildings as outlined in Table 5-A of the 1997 Uniform Building Code. • 7. Complete drawings shall be submitted for review by the fire district serving your area. • 8. At the time an application is accepted for a building permit a plan review will be done. A complete review of the building or structure by the Weld County Inspection Department or the fire district may reveal other building issues or areas needing attention. While the middle school currently has a small amount of capacity, this development would impact the elementary school and possibly the high school which are currently overcrowded. In addition, there are other approved developments in these attendance areas which would, together with this proposal, have a significant cumulative impact on these schools. As the volume of developments increases in this area with no alleviation of the existing overcrowded conditions, the ability to provide the same quality education for these new students that is provided students in other areas becomes increasingly difficult. The District would typically oppose this development because it adds to the enrollment of an already overcrowded school. This developer has in the past agreed to work with the District in providing land and cash-in-lieu payments to mitigate the impacts of development. Should this be accomplished with this phase, the District would not be in opposition to this project proceeding. The proposed water source is Left Hand Water District, however, a letter of commitment for service has not been submitted. As required in Section 30-28-136(1)(h)(II), C.R.S., a municipality or quasi- municipality, upon receiving the preliminary plan designating said municipality or quasi- municipality as the source of water for a proposed subdivision, shall file, with the board of County Commissioners and the State Engineer, a statement documenting the amount of water which can be supplied by said municipality or quasi-municipality to proposed subdivision without causing injury to existing water rights. A report of this nature has not been submitted to this office. The "Water Supply Information Summary" form which was provided to the county along with the State Engineer's August 7, 1995 letter was not included with this submittal. As stated in the State Engineer's letter, this form is required to be submitted along with each subdivision referral in order for our office to respond to the county. Based upon the above and pursuant to Section 30-28-136(1)(h)(II), it is our opinion that the District has not submitted sufficient evidence documenting that the proposed water supply can be provided without causing injury to existing water rights. The original P-U.D- for this development had been approved for 12 residential lots (lots 97 though 108). The proposed water source is Left Hand Water District and a letter of commitment for service has been submitted. The District will supply treated water to the development. The applicant has obtained a contract from the District to obtain 15 taps (14 residential taps and 1 tap for a library)- As a condition of activation of the taps, the applicant must transfer 20 units of Colorado-Big Thompson Project water raw water, administered by the Northern Colorado Water Conservancy District, to Left Hand Water District It appears that the District can adequately supply this proposal. Oligarchy Ditch water had historically irrigated this parcel. The applicant proposes to continue using his shares of water to irrigate lawn and garden on this development. A pond to hold the ditch water has been constructed in the northwest corner of Meadow Vale Farms property and piping for sprinkler systems has been installed. Should the applicant propose to develop the 2nd commercial lot (parcel B), the County should require evidence that the applicant has obtained a commitment for a tap from the District prior to approval of any development. This PUD is located north of SH 119 and east of Weld County Road 5.5. The application indicates that there will be 14 single family lots, private open space, and two parcels near the entrance to the PUD that will be dedicated to the County, one for open space and the other for a library. There is also a parcel at the north end of the PUD labeled "Potential Civic Uses (i.e. Fire, Police/Sheriff, Recreation Center)." In August 1999, the City reviewed a sketch plan proposal for the Meadow Vale Farm PUD Phase II for development of this site. The City continues to have many of the same concerns expressed previously regarding the three sites proposed for civic uses(please refer to attached letter from me dated 8/23/99). The purpose of this letter is to provide updated comments regarding the parcel located at the north end of the site labeled"Potential Civic Uses i.e. Fire, Police/Sheriff or Recreational Center." The PUD site plan indicates that the intended use of the 1.7 acre parcel located at the north end of the site is for a civic use such as fire, police/sheriff or recreation center. This parcel is small in size and has some challenging topography for development of the site. For this reason, Weld County may wish to evaluate this parcel to ensure it can accommodate the projected use(s). In our experience, placing a template of a public facility over the plan at this point in the process has helped us with some of these decisions. Weld County may also wish to determine the potential impacts of these uses on the nearby residential development. Again, thank you for the opportunity to comment on this referral. Thank you for sending the Meadow Vale Farm PUD Phase II Sketch Plan to the City of Longmont for our review and comment. This PUD is located north of SH 119 and east of Weld County Road 5.5. The application indicates that there will be two parcels near the entrance to the PUD that will be dedicated to the County. one for open space and the other for a library. There is also a parcel at the north end of the PUD labeled "potential civic uses." The City of Longmont is pleased to see that land is being set aside for public purposes. However, we would like to encourage you to evaluate whether or not these parcels are best located and sized for their intended purpose. We have the following comments: Weld County may want to consider how the open space parcel will be used. e.g. trailhead for the St. Vrain corridor or other park uses, prior to it being dedicated to the County to ensure that it can serve its intended purpose. In addition, the open space parcel includes all of this phase of Meadow Vale Farm's frontage along SH 119. The City respectfully requests that Weld County ensure that landscaping be provided along State Highway 119 so that this development is a visual asset to the Del Camino area and the entrance to Longmont. Weld County may consider asking the developer to complete any necessary improvements, including landscaping as well as a bike path, prior to accepting the dedication of this parcel. The parcel intended for the library appears somewhat limited both in its size and configuration. Weld County may wish to evaluate this parcel to ensure it can accommodate a library facility that meets the needs for the area it is intended to serve, both in the short and long term. In our experience, placing a template of a public facility over the plan at this point in the process has helped us with some of these decisions. Weld County may also wish to determine the potential impacts of a library on the adjacent residential development. As currently proposed, there does not appear to be much room for buffering between the two uses. The application also indicates that there will be a private trail between the two public parcels. You may want to consider eliminating or relocating it so that there is public access between the open space and libran. The plan is unclear on who will own the parcel at the north edge of the PUD labeled "potential civic uses." You may wish to consider asking the applicant for a more detailed proposal on this parcel, so that you can determine what impact the proposed use will have on the adjacent residential area, and whether or not it will serve its intended purpose. That a street light be placed at all crossroad signs to help us locate an address in case of an emergency. That all addresses be located to where they can be seen from the road. If the house sits back then we would ask that the address be posted on a post close the road. This would help during an emergency in finding the location faster. That the addresses be consistent with Weld County addressing. If that is not acceptable that if a street name is chosen that it is not duplicated somewhere else in the county. This will also assist us in a faster response time to there locations. The mailboxes should be in a cluster in a centralized well lit area. This will alleviate possible vandalism to single mailboxes placed along side the roadway at each residence. That the contractor consider a possible location for a bus stop in case the population of this subdivision need to have one in a later date. This would be a big safety issue if the need ever arises for the kids waiting for and being dropped off the school bus. All these changes will help us in serving this community in a more pro-active fashion rather than in a re-active style. We have seen these problems in other areas and if we have a chance to change them now would benefit them as citizens as well as our agency. Please contact me if you have questions.
