RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH
LEGAL ACTION AGAINST ENRIQUE JIMINEZ GONZALEZ FOR VIOLATION OF THE
WELD COUNTY BUILDING CODE ORDINANCE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Enrique Jiminez Gonzalez, VI #0000042, is allegedly in violation of the
Weld County Building Code Ordinance, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 11th day of July, 2000, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Enrique Jiminez Gonzalez, property owner, was represented by his brother,
Refugio Gonzalez, at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said
violation to the Weld County Attorney's Office for legal action, with an instruction for delay of
action upon such referral until August 11, 2000, to allow adequate time for the property owner
to remove the sixth mobile home from the property and for an inspection of the property by the
Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that said violation be, and hereby is, referred to the Weld County
Attorney's Office for legal action against Enrique Jiminez Gonzalez to remedy the violation of
the Weld County Building Code Ordinance, and any other persons occupying the properties,
any persons claiming an interest in the properties, and any persons acting in active concert with
the identified parties, with an instruction for delay of action upon such referral until August 11, to
allow adequate time for the property owner to bring the subject property into compliance.

February 25, 2000 A Site Inspection was conducted. A walk through was conducted on both the Orin ary
residential structure and the storage unit;all appeared normal. The only item of on' ern
was the 6"' mobile home on the property.
February 28, 2000 A Violation was issued for the 611 Mobile Home.
March 27, 2000 Received letter for 45 day extension to repair, sell and remove 6'1 mobile home from
the property.
May 14, 2000 Phone call was made to Mr. Gonzalez and a final extension was given for the mobile
home structure on the property. Sent letter for final extension until July 14, 2300
June 21, 2000 Extension was voided per Bethany by Monica. Violation to be scheduled for Next
Board of County Commissioners Hearing.
June 21, 2000 Phone call was made to Mr. Gonzalez but could not make any contact.
June 23, 2000 Phone call was made to Mr. Gonzalez but could not make any contact.
June 23, 2000 Sent BOCC Hearing Letter for July hearing.
Jure 30, 2000 Received phone call from Enrique's Brother stating that Enrique was in Mexico, but
brother will be present for the Board Hearing.

Dear Mr. Gonzalez:
The property located at 7750 Henry remains in violation of the Weld County Building Code Ordinance. I have
scheduled a meeting with the Board of County Commissioners for July 11, 2000 , at 10:00 a.m. to consider the
violation occurring on the property. This meeting will take place in the County Commissioners'Hearing Room,
first floor, Weld County Centennial Center, 915 Tenth Street. Greeley, Colorado. It is recommended that you
and/or a representative be in attendance to answer any questions the Board of County Commissioners might
have about the violation. This would be a prime opportunity for you explain all issues regarding this violation.
If you ran contact me prior to the hearing and take care of this matter, we will not proceed with the hearing. If
no contact is made, all plans will continue with the hearing.
The Department of Planning Services' staff will be recommending that the Board of County Commiss oners
author.ze the County Attorney to proceed with legal action to remedy the violation if you and/or a
representative are not available. Our records indicate that you were made aware of the nature of the violation,
the action necessary to correct the violation, and that you were given sufficient time to remedy the violation. If

Dear Mr. Enrique Jiminez Gonzalez:
I am writing in response to your request for an extension to complete necessary repairs, sell and have the
mobile home removed from the property prior the July 14, 2000. If the mobile home is not removed prior
to the extension date, the violation will be scheduled for a hearing with the Board of County
Commissioners, and possibly referred to the County Attorney's office for legal action. I hope that his
extension will give you sufficient time to complete all necessary repairs, sell and get the mobile hone
:removed from your property. If you encounter any problems prior to the extension date,please give me a
call to keep me updated and I will assist you in any way that I can.

The building official has determined that the above described property is in violation of Section 30 of the
Weld County Building Ordinance. No building or structure regulated by this code shall be erected.
constructed, enlarged, altered. repaired, moved, improved, removed, converted, or demolished unless a
separate building permit for each building or structure has been first obtained from the Weld County
I3uilding Inspection Department. Unfortunately, your property is not large enough for a 6th mobile home
on the property and will need to be removed.
It is the intention of this office to assist and cooperate with you without imposing undue hardships;
however, we have no discretion in this matter. If you fail to correct this violation by March 31, 2000. it
will be scheduled for a hearing before the Board of County Commissioners to consider whether t refer
this violation to the County Attorney's office for legal action.
