HomeMy WebLinkAbout20000910.tiff RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST HILDA CORTEZ, DBA AVALOS RESTAURANT AND EL VALLE (AVALOS MEXICAN RESTAURANT) FOR VIOLATIONS OF THE COLORADO RETAIL FOOD ESTABLISHMENT RULES AND REGULATIONS WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, El Valle Restaurant, dba Avalos Mexican Restaurant, is allegedly in violation of the Colorado Retail Food Establishment Rules and Regulations, and WHEREAS, despite efforts by the Weld County Department of Public Health and Environment staff to resolve said matter, the violations have not been corrected, and WHEREAS, on the 24th day of April, 2000, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violations, and WHEREAS, Hilda Cortez, owner, was present at said hearing, and WHEREAS, the Board deems it advisable to bring legal action against those individuals as hereinabove named to correct said violation. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that said violation be, and hereby is, referred to the Weld County Attorney's Office for legal action against Hilda Cortez, El Valle Restaurant, dba Avalos Mexican Restaurant to remedy the violation of the Colorado Retail Food Establishment Rules and Regulations, and any other persons occupying the properties, any persons claiming an interest in the properties, and any persons acting in active concert with the identified parties, with an instruction for delay of action upon such referral for 24 hours to allow adequate time for the property owner to execute an agreement with the Weld County Department of Health and Environment to voluntarily close the restaurant until all health issues have been resolved and, if such agreement is reached, to defer legal action so long as the restaurant remains closed or is in compliance with said agreement. 2000-0910 ‘I de' Z 1 de.LT cz1 CA HL0027 HEALTH VIOLATIONS - HILDA CORTEZ PAGE 2 The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 24th day of April, A.D., 2000. Hall / nttyy Attorney l//teS Glenn Vaad a 2000-0910 HL0027 Chronological Synopsis of El Valle (Avalos Mexican Restaurant) Prepared: March 6, 2000 Revision dates: March 22, 2000, March 24, 2000, April 17, 2000, and April 21, 2000 This synopsis will attempt to establish the perpetual lack of compliance with the Colorado Retail Food Establishment Rules and Regulations by El Valle (Avalos Mexican Restaurant) located at 630 26th Street, Garden City, Colorado, owned and operated by Hilda Cortes. Files maintained by the Weld County Health Department date back to November of 1999. The following history from health department files illustrates the history of noncompliance up to the present date. November 18, 1999-El Valle opens to the public. A Pre-Opening inspection is performed. Items noted, such as providing all hand sinks with soap and paper towels, replacing domestic equipment, providing refrigeration units with thermometers,providing sanitizer test kits, storing utensils correctly, and repairing holes in walls in the dishwashing area. December 17, 1999- The first regular inspection after opening is conducted. El Valle fails due to nine critical violations and five non-critical violations. Examples include mouse droppings and mouse tracks in sugar, improperly reheating food, improper hot and cold holding temperatures, lack of hot water, no back siphonage devices, blocked handsink, no soap or single use towels provided,mouse droppings and a dead mouse present, lack of thermometers in refrigeration units, food debris on equipment, and garbage not contained in a dumpster. The facility is slated for re-inspection in 10 to 15 days. January 3, 2000- The follow up inspection reveals that sanitation levels are still below average. Five critical violations are noted and ten non-critical violations are reported. Critical violations included improper cold holding temperatures, improper dishwashing,no handles on a hot water faucet, and mouse droppings in the restaurant. Non-critical violations were food not protected from contamination, food debris on equipment,walls, and floors,no thermometers in refrigeration units, lack of sanitizer test kits, improper storage of knifes, a plugged vegetable sink drain, garbage not contained in the dumpster area, and floors and walls in the bar, dishwashing area, and ceilings in the dining room that were in disrepair. All violations noted to be corrected by January 13, 2000 (the date of the next reinspection). January 5, 2000- The First Letter of Non-Compliance is sent to Ms. Cortes. January 8, 2000- Prescilla Perez signs for the certified Non-Compliance letter. January 14, 2000- The follow up inspection again reveals that sanitation levels are still poor. There are five critical violations and five non-critical violations items noted. Examples of these critical violations include improper cooling of potentially hazardous food, improper hot holding of potentially hazardous foods, lack of soap in the men's bathroom, mouse droppings present, and improper sanitizer levels in the three compartment sink. Non-critical violations included food (ice in this case) being protected from contamination, the door in the kitchen and bar not being -09/0 sealed, an excessive amount of food debris on floors, a plugged vegetable prep sink,and walls and ceilings with holes in them. Reinspection would take place in the next 10-14 days. January 28, 2000- Second Letter of Non-Compliance is sent to Ms. Cortes. February 2, 2000- First unclaimed notice of the Second Letter of Non-Compliance is noted by the Postal Service. February 9, 2000- Second unclaimed notice of the Second Letter of Non-Compliance is noted by the Postal Service. February 15, 2000- Environmental Health Specialist Butch Horner and Environmental Health Technician Shana Baker are unsuccessful at performing a follow-up inspection because the restaurant appeared closed. February 16, 2000- Environmental Health Specialist Butch Horner and Environmental Health Technician Shana Baker are again unsuccessful at performing a follow-up inspection because the restaurant appeared closed. Mr. Horner left a card in the door indicating that Environmental Health Services be notified. February 17, 2000- The Second Letter of Non-Compliance is returned to Environmental Health Services by the Postal Service. On the envelope, "closed 2/2" is written. *Environmental Health Technician Shana Baker called El Valle regarding a follow-up inspection. There was no answer. February 18, 2000- Environmental Health Technician Shana Baker called El Valle regarding a follow-up inspection. The phone appeared to be disconnected (no ringing took place). February 23, 2000- Environmental Health Technician Shana Baker stopped at El Valle for a follow-up inspection. There was no one present at the restaurant and the restaurant appeared closed. February 26, 2000- Environmental Health Specialists Butch Horner and Dan Parkos drive by El Valle and notice cars at the establishment and that the "OPEN" sign is on. February 27, 2000- Environmental Health Specialist Dan Parkos drives by El Valle and notices again that the establishment is opened to the public because the "OPEN" sign is on and cars are in the parking lot. February 29, 2000- Environmental Health Specialist Dan Parkos and Environmental Health Technician Shana Baker.stopped at El Valle for a follow-up inspection. There was no one present and the restaurant's sign was painted over: Beer bottles were noticed on the table indicating that it might be open. March 1, 2000- Environmental Health Specialist Dan Parkos and Environmental Health Technician Shana Baker did a follow-up inspection at El Valle. Ms. Cortes informed us that she had been away for awhile and that the restaurant was now called "Avalos Mexican Restaurant". Records indicated that she had not changed the restaurant's name with Environmental Health Services. Five critical violations and three non-critical violations were noted. Critical violations noted were spoiled potatoes, hot food that was not being held at proper hot holding temperatures, that there was no hot water in the men's bathroom, soap and drying devices were not provided, and mouse droppings present in the establishment. Non-critical violations were that the three compartment sink's floor drain was backed up, the women's bathroom was flooded with water, and that walls and ceilings were in disrepair. March 6, 2000- Third Letter of Non-Compliance is sent to Ms. Cortes. March 7, 2000- Informed Garden City Town Clerk, Janice Walters, via facsimile about the persistent violations occurring at El Valle (Avalos Mexican Restaurant). March 10, 2000- First unclaimed notice of the Third Letter of Non-Compliance is noted by the Postal Service. March 15, 2000-Second unclaimed notice of the Third Letter of Non-Compliance is noted by the Postal Service. March 22, 2000- Records indicate that Avalos Mexican Restaurant has yet to pay for their 2000 Retail Food Establishment License ($110.00). Environmental Health Technician Shana Baker tried calling Ms. Cortes, but the phone was still disconnected. March 24,2000- Informed Ms. Cortes that El Valle's (Avalos Mexican Restaurant)persistent violations were going to be discussed at a hearing in front of Dr. Mark Wallace, Director of the Weld County Department of Health and Environment on April 5, 2000. *The Hearing Letter and a copy of the Third and Second Letter of Non- Compliance were hand delivered to Avalos Mexican Restuarant and given to Avalos Mexican Restaurant employee Letty Landeros (Ms. Cortes was not in). March 25, 2000-The Third Letter of Non-Compliance is returned by the Postal Service. April 4, 2000- The Third Letter of Non-Compliance is returned to Environmental Health Services by the Postal Service. April 5, 2000- Ms. Cortes failed to appear at the hearing scheduled to discuss her establishments persistent violations. This matter is turned over to Weld County Attorney, Lee Morrison April 13, 2000- Informed Ms. Cortes that El Valle's (Avalos Mexican Restaurant)persistent violations will be brought in front of the Weld County Board of County Conunissioners to authorize the County Attorney to proceed with legal action to rectify the violations on April 24, 2000. *The County Commissioners Hearing Letter, Hearing Letter, a copy the March 24, 2000 Hearing Letter, and a copy of the Second and Third Notification of Non-Compliance Letter were hand delivered by Charlotte Davis and Shana Baker to Avalos Mexican Restaurant employee Latty Landeros (Ms. Cortes was not in). *Informed Janice Walter, Garden City Town Clerk, about the status of El Valle (Avalos Mexican Restaurant)via fax. April 17, 2000- Ms. Cortes leaves a message on Shana Baker's voice mail inquiring about her food license. April 19, 2000-Shana Baker returns Ms. Cortes's call. Ms. Cortes was concerned about her food license. Ms. Baker told her that she has yet to pay for her 2000 food license and that she payed for her 1999 food license in November when she took over ownership of the food establishment. Ms. Cortes is asked, by Ms. Baker if she received the hand delivered letters concerning information about the hearing scheduled and past Non-Compliance Letter. Ms. Cortes indicated • that she did receive the letters and that she was aware of the April 5, 2000 informal meeting in front of Dr. Mark Wallace. Ms. Cortes also indicated that all violations are correct and that we were unaware of this because we haven't done an inspection for awhile. She was then informed, by Ms. Baker, about the County Commissioner Hearing on April 24 (she was provided with information on why it was taking place,the time, and location) *Dan Parkos contacts Ms. Cortes concerning the upcoming Weld S.T.A.R. food safety training, scheduled for Thursday April 20, 2000. Ms. Cortes indicated to Mr. Parkos that she was given information on Weld S.T.A.R. and that she and/or staff members would be in attendance. Ms. Cortes asked about the hearing on April 24 and Mr. Parkos provided her with information on why the hearing in front of the County Commissioners, when the hearing was taking place, and where it would located. April 20, 2000-Ms. Cortes and/or El Valle (Avalos) staff members fail to attend Weld S.T.A.R even after indicating on April 19, 2000 that she would be in attendance. April 21, 2000-Shana Baker and Dan Parkos inspect El Valle (Avalos). Sanitation levels have not improved since the previous inspections (March 1, 2000). Five critical violations and four non-critical violations are noted. Critical violations were cross-contamination with a knife, employee's and staff needing food training, cold food not at proper temperatures, no sanitation rinse in the three compartment sink, and evidence of rodents. Non-critical items were no wiping cloths, utensils improperly stored, the three compartment sink's floor drain was overflowing, and ceiling in disrepair. The following items were found in violation of the Colorado Retail Food Establishment Rules and Regulations: VIOLATIONS # Indicates violation sited at last inspection. 1) 03-e # Chicken, oysters and Shrimp were being held at room temperature. Internal temperature was discovered to be 46 degrees Fahrenheit for the chicken and 50 degrees Fahrenheit for the shrimp and oysters. All potentially hazardous food must held at 41 degrees Fahrenheit or below or at 140 degrees Fahrenheit above . (Section 2-201) 2) 03-f No probe type food thermometer was found in the food establishment. Indicating thermometers shall be provided and used. (Section 4-401 3) 04-f Three compartment warewashing sequence in wrong order The dishwasher told us that they wash-sanitize-rinse the dishes. When a three compartment sink is utilized for warewashing, the operation shall be conducted in the following sequence: wash-rinse- sanitize. Adequate, uncontaminated, safe potable water for the needs of the retail food establishment shall be provided from a source constructed, maintained and operated according to law. (Section 5-101) 5) 05-a # Excessive amount of mouse pellets were found on the floor of the dry storage area. Rodents shall be controlled within the physical facility and its content. (Section 8-101)(a) 6) 09-b Plastic bags were used to cover bulk ingredients. Use only approved containers designed for this purpose. (Section 4-101) 7) 10-a # Refrigerators and freezers have excessive amount of food debris on interior surfaces. At all times, including while being stored, food shall be protected from potential contamination by unclean equipment. (Section 3402) 8) 10-b Walls and kitchen floors have excessive amount of food debris on surfaces. Cleaning of walls and floors shall be done as needed. (Section 6-302)(a) 9) 11-a # No thermometers were found in the refrigeration units. All refrigeration units must have accurate thermometers. (Section 2402)(a) 10) 11-b No test kits for sanitizer on premises. A test kit that accurately measures in parts per million shall be available and used. (Section 4-402) 11) 12-d Wiping clothes were not found soaking in sanitizer solution. Sanitizer solution should be 100-150 parts per million bleach solution. (Section 5-102)(b) 12) 13-a Several knives were observed between the crevice of the cutting board and prep table. Knives should be stored on a magnet or approved knife holder to prevent possible contamination. (Section 5-202)(a) 13) 14-a Vegetable prep sink not draining. Plumbing shall be maintained in accordance with applicable state and local plumbing codes and standards and kept clean and in good repair. (Sections 5401-2) 15) 14-c # Floor and wall in bar area, wall in dishwashing area and the ceiling in the dining room are in need of repair. All walls , floors and ceilings. (Sections 6-101 and 6-202) On December 17, 1999 Butch Homer of the Weld County Department of Health and Environment conducted a follow-up inspection of El Valle, at 603 26th Street in Garden City, Colorado. The following items were found in violation of the Colorado Retail Food Establishment Rules and Regulations: 1) 01-c Mouse feces and tracks in stored sugar. At all times while being stored, food shall be protected from cross-contamination by rodents. (Sections 3-302) 2) 03-b Potentially hazardous foods reheated on the steamtable. Potentially hazardous foods that have been cooked and then refrigerated shall be rapidly reheated to a uniform internal temperature of 165 degrees Fahrenheit or above. (Sections 3.403) 3) 03-d Precooked hamburger held at an internal temperature of 110 degrees Fahrenheit. The temperature of potentially hazardous foods shall be 41 degrees Fahrenheit or below or 140 degrees Fahrenheit or above. (Sections 3-401)(a) 4) 03-e Precooked rice held at an internal temperature of 78 degrees Fahrenheit. She called, on Monday afternoon, regarding her food license(which she yet to pay her 2000 license). I was out of the office on Tuesday, so I called her back this morning (she was not in) and got a hold of her a few minutes ago. I explained to her that she payed for her 1999 license and we have not recieved payment for her 2000 food license. I then asked her if she recieved all the hand delivered letters (the County Commissioners Hearing Letter for April 24, the Informal Hearing Letter for March 24, and copies of the Second and Third Notification of Non-Compliance Letters concerning violations of her establishment). She told me that she did receive all of these letters. I asked her if she was aware of the informal meeting on April 5 (which she did not attend). She told me that she didn't attend because of her daughter(who was burned) and that we knew about the injury to her daughter. Ms. Cortes told Dan ( Environmental Specialist who accompanied me on the inspection) and I on March 1 (the last inspection at the facility) that her daughter was burned but did not go into medical detail about this situation with her daughter. I informed Ms. Cortes that she should of informed me about not being able to attend the hearing on April 5 and that legal proceedings concerning her establishment would continue. Ms. Cortes informed me that everything is correct and that we don't know that because we haven't been in to conduct an inspection in awhile(March 1, 2000). I told her the reason was because we were proceeding with enforcement because of the lack of compliance dating back to December. She then wanted me to come out and do an inspection to see all of her improvements. I told her that we were already proceeding with legal action because she was given sufficient time to correct the violations. I then reminded her about the County Commissioner Hearing on April 24 (I provided her with the time and location). So, she is fully aware of the situation based pn this conversation. But, I had question. Should I go out and do another inspection of this establishment(before Monday) because she states that everything is corrected? Also, is there anymore information you need for Monday? Do I need to provide visual aids (transperancies) of past inspections or anything else related to this matter (this is my first hearing, so I'm just inquiring)? Thanks!!!
