(RMS ) was engaged to perform ! a Phase 1 Environmental Site Assessment (ESA) for the Beebe Draw Farms by the Owners of the property for whatever use the Owners deemed necessary. This Site Evaluation was a non-intrusive and 4 f non-destructive research to evaluate the potential for significant on-site environmental impacts. 1 This ESA was prepared after RMS addressed, and/or investigated the following items: A. Other parties are prohibited from the usage of this Document without the written permission of Beebe Draw farms and Risk Management Services, Inc. 1 y 2 IEMAI BEEBE DRAW FARMS ENVIRONMENTAL, SITE ASSESSMENT PHASE 1 (PAGE 3 OF 12) SECTION A: OWNERSHIP AND SITE LOCATION The site is located East of County Road 39 and South of County Road 38 . �. The Beebe Draw Farms site is a collection of previously owned properties which were purchased, and or sold, by previous entities for the purpose of farming/ranching or development . A review of the records indicate that there was no activity on the properties, except for the drilling for gas and/or oil which would have an environmental impact on this property. A search of the 50 year ownership chain report of the property and adjacent properties is a part of this report . A copy of the legal description is included in this assessment. (See Appendix A) SECTION B: SITE DESCRIPTION AND CHARACTERIZATION The site is located east of County Road 39 and South of County Road, 38 southeast of Gilcrest and directly east of Platteville, Colorado. The site evaluated is described as Beebe Draw Farms, First Filing and Equestrian Center, a tract of land situated in portions of Sections 3, 4, 5, 8, 9, 10, 15, 16 and 17, Township 3 North, Range 65 West of the Sixth Principal Meridian, Weld County, Colorado. The site consists of an existing cattle ranch located north and west of Milton Reservoir . The topography of the property is gently rolling. The site consists of many small depressions typical of eolian or wind-blown deposit areas. Numerous oil and gas wells are located throughout the site and dirt and gravel roads that serve as access to these wells are also located throughout the site. An equestrian area has been planned in the northeastern portion of the site. A small reviewing tower has been built near the center of the equestrian site in the eastern 3 CMJ BEEBE DRAW FARMS ENVIRONMENTAL SITE ASSESSMENT PHASE 1 (PAGE 4 OF 12) portion of the property. Several small lakes axe located in the southeast corner of the equestrian center site adjacent to Milton Reservoir and the Milton Reservoir Dam which are located adjacent ( to the southeast corner of this portion of the property. The southern portion of the equestrian center extends to the shoreline of the Milton Reservoir, and Beebe Draw forms the west edge of the equestrian area. The Draw contains moderate to steep eroded slopes and is vegetated with brush and trees. The Evans No. 2 Ditch traverses the area of the equestrian center site . The western portion of the site in the area of the proposed first filing consists of rolling hills, vegetated with grass, weeds, and sage as does the majority of equestrian site area. The property is bordered on the west by Weld County Road 39 . The site acreage is approximately 4128 acres. A geologic investigation was made of this property by Empire Laboratories, Inc. Geotechnical Engineers, 214 North Howes Street, Fort Collins, Colorado. The report was dated May 30, 1985. Portions of the report which are pertinent to this report l' are as follows: "Geology "The 'site is located within the Colorado Piedmont section of the Great Plains physiographic province. The Colorado Piedmont, formed during the ' Late Tertiary and Early Quaternary (approximately sixty-five million ( 65,000,000) yearsago) , is a broad, erosional trench which separates the Southern Rocky Mountains from the High Plains . Structurally, the property being studied lies along the western flank of the Denver Basin. During the late Mesozoic and Early Cenozoic Periods (approximately seventy million (70, 000,000) years ago) , intense tectonic activity occurred, causing the uplifting of the Front Range and k' 4 °- CM� BEEBE DRAW FARMS ENVIRONMENTAL SITE ASSESSMENT (_ PHASE 1 (PAGE 5 OF 12) the associated downwarping of the Denver Basin to the east . Relatively flat uplands and broad valleys characterize the present-day topography of the Colorado Piedmont in this region. 1 The site is underlain by the upper Cretaceous Laramie formation. In the majority of the site, the bedrock is overlain by eolian, dune, deposits of Pleistocene age. Minor amounts of aulluvial sands and gravels of Pre-Bull Lake Age are encountered in the Beebe Draw area. "Bedrock outescrops were not noted in the site nor were they encountered in the borings drilled by Empire Laboratories, Inc. , or CTL/Thompson, Inc. to depths of forty ( 40) feet. However , bedrock was encountered in the deep borings drilled at the site at depths of sixty-seven ( 67) to one hundred twenty-three ( 123 ) feet below the surface. The regional dip of the bedrock in the area is slight in an easterly direction. Therefore, from a structural standpoint, the property should be relatively stable . To our knowledge, there are no active known faults in the area; however, epicenters have been located northeast and southwest of the project area. It is felt that the area may be located in a slightly seismic active area and this should be taken in account in designing structures built on the site. The majority of the property lies within the drainage of Beebe Draw. Flood plain studies have been done by others to determine areas subject to { flooding. In addition, some flood control dikes have been constructed and additional dikes are planned to minimize flooding caused by runoff and excessive filling of Milton Reservoir adjacent to the property. It is recommended that construction not be allowed within the one-hundred year floor plain or be elevated above the one hundred year flood plain of Beebe Draw. Construction also should not be allowed in overflow areas of Milton Reservoir . 5 CMI BEEBE DRAW FARMS ENVIRONMENTAL, SITE ASSESSMENT PHASE 1 (PAGE 6 OF 12) "The majority of the soils encountered, both visually and in the reports provided to us, prepared for the site indicate the soils overlying the site consist of silty and/or clay sands . lThese materials may be subject to erosion. Therefore, all areas stripped of vegetation during construction should be seeded to minimize erosion. With proper site grading around all structures and proposed roadways, and with proper revegitation erosion, problems should be minimized at the site. Due to the generally sloping nature of the topography at the site, mass movement due to gravity such as land slides, mud flows, etc. , should be minimal . To help minimize movement and erosion, all cut and fill slopes should be placed on minimum grades of 2 :1 or flatter . Groundwater levels in the area are expected to be at shallow depth adjacent to Milton Reservoir and Beebe Draw in the southeast portion of the area. It is anticipated that groundwater levels will be encountered at deeper depths throughout the majority of the site away from the Beebe Draw and Milton Reservoir area. Due to the sandy nature of the soils tencountered, it is anticipated that conventional-type spread footings will be feasible for the proposed construction. Percolation test run in selected areas throughout the project area indicate that soil percolation rates are either suitable or too rapid in accordance with Weld County Regulations. It is recommended that in areas where percolation rates are too rapid the subsoils in the area of the proposed soil absorbtion beds be mixed with silty of clay material to reduce percolation rates to acceptable rates. "Studies of economic deposits of coal and sand gravel at the site have been prepared by others. These studies indicate that the site does not appear to be suitable for economic extraction of coal and sand and gravel . In addition, theogeologic 6 EMA BEEBE DRAW FARMS ENVIRONMENTAL SITE ASSESSMENT PHASE 1 (PAGE 7 OF 12) conditions of. the site are such, in our opinion, that the site is i_ also not suitable as an economic source of quarry rock or limestone. Also, it does pot appear that the bedrock formations in the area contain uranium or other radioactive mineralsL and therefore, in our opinion, the site should pot be subiectyd to radioactive hazards as well . "It should be noted that the geologic investigation was [ based on a visual inspection of the site, interpretation of topographic maps, review of existing dates and literature, and a general knowledge of the geology of the area. It is recommended �. that additional test borings and percolation tests be made at the site prior to construction. Samples obtained from the borings should be tested in the laboratory to evaluate the physical properties and bearing capacities of the soils encountered. " SECTION C: CURRENT SITE ACTIVITY AND USES The site presently is utilized for grazing cattle. A number [ of gas well are located throughout the property and they can be ( termed "producing" at this time. The wells are served by above ground central station units consisting of a gauge house, a combination 3-phase separator/dehydrator and distillate storage tank . These stations may serve more than one well simultaneously. A network of underground piping which serves the wells, the central station units and the main gas lines are present throughout the property. The depth of these lines vary. It is not certain whether the exact location of these lines are properly charted and as to depth and location. The central station units were inspected by Marvin Estes, Risk Management Services, Inc. and Ron Herrin, Petroleum Production Engineer, formerly with Public Services of Colorado, Fuelco Division, which has, for several years, been involved in 7 CMJJ t 1 BEEBE DRAW FARMS 11 ENVIRONMENTAL SITE ASSESSMENT PHASE 1 (PAGE 8 OF 12) the field drilling wells and establishing natural gas fields throughout the Rocky Mountain Region. It was Mr . Herrin ' s opinion, after looking at several stations, that the units have been properly installed and maintained. In his view, the chances of any impact to the area in the proximity of the stations, and/or wells is remote. There was no evidence of any i_ environmental damage in any area. However, in installations of this sort there is a danger that the bottom of the holding tanks may become corroded and oil might seep into the soil . Risk Management Services, Inc.. closely inspected several of the existing tanks and found no evidence of corrosion. Drilling for natural gas is still taking place, and Risk Management Services, Inc. was advised that two or three more 3 additional wells were to be drilled in the near future. Risk i_ Management Services, Inc. was able to observe the drilling of a new well in Section No. 4, and was of the opinion that the work was in compliance with all existing regulations and that there was no apparent danger of contamination to the surrounding area C by the separator station installments. SECTION D. REPORTED HAZARDOUS SPILL ON ADJACENT PROPERTY Near the North east side of the property in Section 4, a { reported condensate spill of an estimated 4,000 gallons occurred and was first reported to the Leaking Underground Storage Tank Division, Colorado Department of Health on 03/06/90 . The address of the spill is listed as 20700 Weld County Road 38 Facility. Exact details of this occurrence are not clearly defined, or evaluated, in that there is a legal action pending between the Owner of the land, Aristocrat Angus Ranch, 9035 Weld County Road 34, Contact Mr. Ben Houston, Platteville, Colorado k 8 1 . EMAI BEEBE DRAW FARMS ENVIRONMENTAL SITE ASSESSMENT PHASE 1 (PAGE 9 OF 12 ) 80651, and Aristocrat Gas Products/Machii-Ross Petroleum Company �- as to the liability concerning this oil spill. The Attorney who is handling this legal action for Aristocrat Gas Products Company & Machii-Ross Petroleum Company is : Mr . Charles Hosakawa Angus Gas Products-Machii Ross 3420 Ocean Boulevard Santa Monica, California 90405 Tel. (310 )450-5666 Machii-Ross has addressed the situation and has made an effort to identify the area of contamination by engaging Industrial Compliance Inc. (IC) , 1746 Cole Blvd, Golden, Colorado 80401 . IC investiated the site and filed a report to the Hazardous Materials and Waste Management Division, Colorado Department of Health on May 17, 1991, and followed up with a subsequent Corrective Action Plan (CAP) on December 19, 1991, for l approval by this Department . The CAP included an estimate of the contamination of 50, 000 t to 74,000 square feet of surface area. Other pertinent information obtained from the report indicate that the water 11 table at the site ranged from 11 to 23 feet below ground surface . On January 21, 1992, records show that the Colorado fDepartment of Health' did not grant approval of the CAP as presented by IC on behalf of Aristocrat Gas Products Company. The stated reasons for the refusal of the CAP was to the effect that the proposed locations of the of the recovery wells were not I adequate and not properly placed. The monitoring program as presented was. also in question, as was the method of reinjection . The Department directed further action and a revised CAP be . submitted. before approval could be issued. 9 UMAI BEEBE DRAW FARMS ENVIRONMENTAL. SITE ASSESSMENT PHASE 1 (PAGE 10 OF 12) On July 11, 1994, Ben Huston received a formal request from Aristocrat Gas Products Co. to gain access to the property to drill additional monitoring wells the further define the extent I_ of the contamination. Aristocrat Angus Ranch sold off the adjoining land to Mrs . Jane Evans Cornelius, except for the forty acres on which the gas plan was located and where the spill occurred. Ben Huston :;till retains this property at this time. The location of this spill is to the east of the Platte Valley Canal which feeds into the Milton Reservoir . it is unlikely that the soil on the west side of the ditch, which is part of Beebe Draw Farms, has been contaminated by this condensate spill . An inspection of the drainage maps, substantiated by the IC report, indicate that, probably, all flow would be to the southeast, or toward the Milton Reservoir . There is no evidence known to RMS that hydrocarbons have been detected from this spill in either the Canal or the Milton CReservoir . It is the purpose of this assessment to identify the spill and to analyze its impact, if any, on the Beebe Draw Farms property. SECTION E. OTHER HAZARDOUS SPILLS There have been other reported spills in the area and these spills were, mostly, insignificant. A review of the records of a total of 35 spills reported to the Environmental Protection Agency (EPA) since 1977 was a part of this investigation. As a result of this review, RMS has concluded that none of these spills had any environmental impact on the Beebe Draw Farm property. 10 UM431 BEEBE DRAW FARMS ENVIRONMENTAL SITE ASSESSMENT PHASE 1 (PAGE 11 OF 12) SECTION F. ADJOINING PROPERTIES AND BOUNDARIES At the Northwest edge of the property there is a large ii farm/ranch which can be designated as the "Ludwig Ranch. " This 1_ ranch is located at the intersection of Weld County Roads No. 38 and 39 . An investigation of this property and a visual 1. inspection of the boundary separating the Ludwig Ranch from the Beebe Draw Farms did not disclose any possible environmental concerns . An inspection of the Platte Valley Canal did not reveal any evidence of environmental concern. There was no unusual discoloration of the bottom or the sides of the canal or in any standing or flowing water . An investigation of other surrounding properties did not cause any suspicion that there might be any environmental threat to the Beebe Draw Farms . The usage of these surrounding properties are for, primarily, farming/ranching and gas wells . t i.. SECTION G. SUMMARY OF FINDINGS AND CONCLUSIONS. Based on this investigation and the findings RMS presents the following summary and conclusions: These is not a great likelihood that the site has been contaminated by the condensate spill on the Aristocrat Angus Ranch across the Platte Valley Canal . However, in view of the fact that Machii-Ross is currently renewing investigation as to the extent of the spill, this action and the ultimate conclusion [ and subsequent action taken, when available, should be obtained for future reference. The site itself could almost be termed pristine except for the presence of the gas wells, piping and separation stations . There is no evidence, within the scope of this investigation, that any contamination of this site has occurred 7 11 I5BEEBE DRAW FARMS ENVIRONMENTAL SITE ASSESSMENT LPHASE 1 (PAGE 12 OF 12) through the activity surrounding the drilling for gas . t Further, there is no indication based on the nature, L strength and quality of the information collected, within the scope of this investigation, that this site has been contaminated by any other source. SCOPE OF WORK The scope of work to complete the project is outlined in this section and is based on the assumptions noted below. The following tasks may be completed, and you will be notified of any variations in the scope of work. The tasks in the project scope of work are: Recovery Well Installation The aquifer slug tests completed on selected monitoring wells in June of 1991 indicate that a cone of depression with an approximate 150-foot diameter will be created if a well is pumped at a sustained rate of 5 to 10 gallons per minute (gpm). The estimated plume width is 300 to 400 feet at its widest point. Pumping will be continued at the original recovery well RW-02 just south of the release site as there is still free-product present in this well. The pumping of well RW-02 is in addition to the following proposed ground water and product recovery plan. * Install two additional recovery wells to the east and southeast of the release site in a direct line with the ground-water flow direction (Figure 1). * The above locations are tentative based upon existing information. Corrective Action Plan December 19, 1991 Page 2 * These wells will be completed using 4-inch diameter, threaded, factory-slotted PVC casing. We will install an artificial sand pack in the slotted zone and seal this zone with a minimum 2-foot thick bentonite seal. We will then grout the remaining. annular space, and we will install a permanent surface seal and a locking well protector. * The wells will be properly developed prior to pump installation. * This scenario provides for capturing the majority of the free-product plume along its center line while still reducing the free-product from the source area. Please note that large volumes of water will have to be pumped and treated to create a sufficient cone of depression on the water table to 'capture' the greatest extent of ground water. * IC recommends that the pump-recovery and air lines be insulated and buried die to potential extreme temperatures during the winter months. Extreme winter weather may temporarily shut the system down due to freezing of the lines. Free-Product Recovery Free-product and ground water will be pumped from all recovery wells with Ejectors System total fluids, pneumatic, recovery pumps. The pump system will be setup to pump fluids from the wells into the onsite separator tank. The condensate will be utilized by Aristocrat and the water can be pumped off to another tank if desired and then reinjected to the subsurface. 1 Additional recovery well(s) may be necessary if free product has migrated too far or spread farther than the cone of depression created by the present recovery wells. • A small scale product/water separation test was completed with recovered ground water and product. This test indicated that the levels of BETX in the water after separation are all below Federal Safe Drinking Water Act (SDWA) Maximum Contaminant Levels (MCLs). A tank supplied by the client will be utilized to separate the free product and ground water. Ground-Water Reinjection The water must be returned to the subsurface through one of several possibilities. Reinjection by surface application or infiltration gallery are the most cost-efficient methods for reinjection. Mr. Larry Delin Corrective Action Plan December 19, 1991 Page 3 • IC is presently in contact with Region VIII EPA permitting personnel in regards to permitting for discharging the treated water back to the subsurface. If the levels of petroleum compounds in the discharged water are below Safe Drinking Water Act (SDWA) standards no degradation of the ground water should occur. The discharge location of the treated water to the subsurface should be located upgradient from the source as much as practical. This will assist in flushing residual hydrocarbons adsorbed to the soil particles. Due to the extreme weather conditions probable during the winter months in this area, an infiltration gallery represents the most practical option for discharging the treated water to the subsurface. The infiltration gallery would most likely be considered a Class V type injection well under the EPA's definition. The EPA requires a permit or authorization by rule for injecting treated water to the subsurface. The EPA requires daily lab analyses of the discharged water for the first week, weekly for the first month, biweekly for the next three months and at least monthly thereafter. There are also closure requirements under the EPA rules which must he adhered to. Surface application of the treated ground water may be possible during the summer months. A National Pollution Discharge Elimination System (NPDES) permit will be required by the State for this type of surface discharge. IC is presently working with the Colorado Department of Health NPDES Program. If petroleum compounds are detected above the SDWA MCLs, the separated water may have to be treated further prior to its reinjection or surface application. Carbon filtration prior to discharge represents the most economical option (depending on hydrocarbon levels) for additional treatment if necessary; All ground-water monitoring wells will be sampled on a quarterly basis for one-year from the start-up of the recovery/treatment system. IC will prepare quarterly reports on the status of the ground-water system. These reports will include monitoring results, free-product thicknesses, and discharge results. The ground-water monitoring program will be reevaluated after one year. y Mr. Larry Del in Corrective Action Plan December 19, 1991 Page 4 UST Closure A 6000-gallon, fiberglass UST will be closed in place. The subject UST is directly adjacent to a large aboveground storage tank. Excavating to remove the UST would potentially compromise the structural stability of the soils beneath the aboveground tank. The tasks include the removal of overburden soils (if practical) in an attempt to gain entry to clean the tank. Entry into the tank may not be possible due to a concrete slab in the subsurface directly over the top of the tank. The tank will be filled with an inert material (either sand or concrete) and capped. In addition, IC will complete a subsurface drilling/sampling environmental assessment of the UST area to fully delineate the extent of affected soils surrounding the UST. The assessment will be completed in accordance with State regulations regarding USTs, specifically The Colorado Department of Labor-Oil Inspection Section's 8.72 'Assessing the UST Site at Closure'. Obtain all required permits and notify appropriate agencies of the closure project. The Colorado Oil Inspection Section (OIS) requires a minimum notification of 10 days prior to tank closure. Onsite project supervision of the tank closure by experienced IC personnel. Laboratory analysis of four soil samples from the surrounding borings. The soil samples will be analyzed for total volatile hydrocarbons (TVH) Method 8015, and Benzene, Ethylbenzene, Toluene, and Xylenes (BETX) Method 8020. Preparation of a report, signed by a professional geologist (as required under the State Statutes Article :34-1-202), detailing all activities completed magnitude and extent of affected soils, and copies of the analytical results. Recommendations for further assessment or remediation will be included if necessary. TIME SCHEDULE • The length of time required for this type of ground-water remediation project is impossible to predict. The project length will depend on the complete extent of affected ground water that must be remediated, the actual capture zone created by the recovery wells, and the amount of residual petroleum that is released from the soil materials as remediation progresses. We feel that the following information/modification is necessary t consider granting approval of your corrective actions: -The proposed locations of the additional recovery wells do not appear adequate to intercept the ground water plume, more recovery wells or more suitable placement locations for the wells are necessary. -Specify wells to be included in the monitoring program. Typical monitoring requires a minimum of two downgradient wells be included, quarterly analysis for a minimum of one year after cessation of remediation, and submittal of quarterly analytical results. -Although pilot tests indicate discharge from the separator tank can meet EPA. reinjection permit requirements, what method of water treatment will be utilized if permit requirements cannot be met? -Please provide detail on the location of the reinjection gallery/wells. -Downgradient points of compliance need to be determined. These points of compliance may be utilized as, or incorporated into, the monitoring plan and must meet the ground water quality standards established by the Water Quality Control Commission. The discovery of contaminants above the limits for ground water standards will necessitate that additional remediation be performed. It has become necessary for Aristocrat to drill one or more additional monitoring wells to further define the condensate plume. Representatives of Aristocrat contacted Mrs . Jane Evans Cornelius, who we understand purchased the surrounding property. She has confirmed that all hay and cattle were removed from the area. She indicated , however , that you retained ownership of the immediate area of the spill and would also have to be contacted for permissions to enter and drill . We would appreciate your granting approval to enter and drill by executing a copy of this letter . If the attorney who represented you some years ago relative to the rent issue is representing you relative to his- matter , please have him contact us and we will deal with him.
