Nature or purposes of the assembly: American Motorcyclist Association (AMA) sanctioned motocross races, held in conjunction with the Rocky Mountain Motocross Association's Spring and Summer series of races, held in Colorado. Leahy Family Farm and Two Rivers Racing hold a charter with Ole AMA, and All races are governed by national rules which apply to all other states and MX riders. 3. Dates and hours during which the assembly is to be held: see attacged list. 4. Maximum number of persons to be allowed at assembly at any one time: This permit is applied for when we believe we will have more than 500 people on our property for one of these events. There is no maximum number. 5. The maximum number of tickets to be sold, if any: No maximum number 6. Identify plans to limit number of persons to the maximum identified above: Not applicable. There is no spectator limit, as they are all outside, watching the races behind fences. The riders are limited to 40 per class by AMA rules. 7. Identify plans for supplying potable (drinking) water, including the source, number, and location of facilities: _Bottled water is available in vending machines in the sign-up building at the facility. It is supplied by Pepsi-Cola Company, Greeley, CO. There is also sport drink, fruit drink, soft drink and iced tea in 20 oz. plastic bottles. Most people bring water from home in large plastic containers. 2 8. Identify the plans for providing separate toilet facilities for males and females, including the source, number, and location, type and the means of disposing of wastes deposited: There are three permanent toilets in the sign-up building. These are marked either men or women. In addition, portable units are brought in and placed near the parking lot and starting gate. We have one port-o-let of our own, so we always have 4 toilets, in addition to the 3 or 4 we bring in. Accommodation Sanitation, PO Box 5261, Greeley, CO provides the . snits and services them. The ratio of men to women at these events is approximately 10 to 1. 9. Identify the plans for holding, collecting, and disposing of solid waste materials: There are approximately 20 fifty-five gallon plastic barrels placed around the parking lot, near the sign-up building, and along the edge of the fences and buildings. We empty the barrels in a large dumpster and that is picked up on Tuesday morning after the race (or once a week) by Imperial Disposal and Recycling, PO Box 816, Johnstown, CO 80534. Spectators and riders are VERY good about picking up their trash. 10. Identify the plans to provide for medical facilities, including the location and construction of any structures, the names, addresses, and hours of availability of emergency medical technicians and nurses and provisions for emergency ambulance service: All AMA sanctioned races require emergency medical units be on- cite for the entire d y. The contracted company for all RMXA events is Rocky Mountain Fire and Rescue Service, 8061 Quebec St. , Commerce City, CO 80022. If someone is injured, an ambulance service is called to trans- port, so the emergency unit never leaves the site. In addition, an injury report has to be filed with the AMA within 24 hours of the race. 11. Identify the plans, if any, to illuminate the location of the assembly, including the source and amount of power, and the location of lamps: Not applicable. Event is daytime only. 3 12. Identify the plans for parking vehicles, including size and location of lots, points of highway access and interior roads, including routes between highway access and parking lots: Approximately 4 acres has been leveled and graveled as required by Weld County Public Works Dept. In addition, vehicles may park further west along the fenced areas of the track, and to the north of the existing parking lot. In the morning, when arrivals are heavy, two lines are formed to allow those attending the gate to get the waiver signed and admission collected. All effort is made to keep County Road 19 clear. In the afternoon when riders' are leaving, they exit onto Cty Rd 19, but in a leisurely manner and in small numbers. 13. Identify the plans for communications with hospital, police, and fire services, including the source, amount, and location of communication equipment: Rocky Mountain Fire and Rescue notifies area hospitals and ambulance services. They have a plan for transporting and pickup which the Johnstown Volunteer Fire Dept. uses. The Johnstown Police Dept. has indicated they do not need special notification when we have races. As the entire event is out-of-doors, on dirt and gravel, there is little fire danger. 14. Identify the plans for camping facilities, if any: Families and riders who come to these races often drive long distances and many come in motorhomes or vans with their motocross bikes and related equipment in trailers. Our parking lot is level, making overnight parking easy for them. This year we would like to request overnight parking only for the Saturday night before the race. with no tents, no open fires as a requirement. There is no rowdiness in this group - they are here to race, and need a good night's sleep. 15. Identify the plans for fire protection: These events are held outside on dirt and gravel. They are not allowed to ride anywhere else on the property, parking is limited to the parking lots, and no one can have open fires. 4 16. Identify the plans for security, including the number of guards, their deployment, their names, addresses, credentials and hours of availability and description of peer group control, if any: We have hired Loveland Security and Patrol, Inc. , 530 W. Eisenhower, Loveland, CO to provide security for these races. The AMA requires that a referee be present at and make all arbitration decisions, and RMXA Board members are on-site at all races. By AMA rules, a rider or any member of his family or friends may be disqualified because of his/her actions either on or off the track. Loveland security personnel monitor parking, ambulance access, property rules, no parking along County Road 19, and pet and alcohol rules. 17. Identify the plans for sound control and sound amplification, if any, including number, location, and power of amplifiers and speakers: We have a small amplification system with one wired and one remote microphone, to make announcements and get riders to the starting gate. There are only 5 speakers, all near or on the sign-up building. Last year, Ron Baylor of KUNC, designed a very small FM radio system for us, which extends less than 1/2 mile, but allows people in their cars to turn their radios on and hear, instead of adding more amplification and speakers. It works very well unless the wind blows and moves the antennae. 18. If applicable, identify plans for meeting County health standards for food concessions and concessionaires who will be allowed to operate on the grounds, including the names and addresses of all concessionaires and their license permit numbers: Concessionaire for this year is: Hot Chili 's Catering. 2990 29th St. Suite 2. Greeley. CO 80634. Phone: 330-5163. License # 2467197-0000 They serve hamburgers, burritos. nachos. hot dogs and chili. For some of the races, they also bring assorted donuts, bagels, breakfast burritos, and coffee for early morning. 19. Identify the plans to ensure that trees, underbrush, large rocks, and other natural features shall be left intact and undisturbed, and natural vegetative cover retained, protected and maintained so as to facilitate drainage, prevent erosion, and preserve the scenic attributes; and the plans to abate dust on the site: We are required by Weld County to control fugutive dust on the site at all times. For races, the track is plowed, disced, and watered for several hours, to make sure dusty conditions will NOT occur. We have planted hundreds of trees and bushes, and those are staked, marked, fenced to keep people from running over them. In addition, signs are posted about no riding, driving off-road, and parking is fenced off so cars cannot drive on vegetation. Riders are only allowed to ride from their parking area to the starting gate on race days, and the announcer reminds people of the rules several times during the day. 21. Attach a statement by a bonding company licensed to do business in the State of Colorado indicating its intent to furnish a bond to ensure performance by the applicant of each of the terms and conditions of the temporary assemblage Wel mit. 22. Attach a statement by an insurance company licensed to do business in the State of Colorado stating its intent to provide liability insurance to protect against injury to persons or property occurring as a result of such an assembly. The Company shall have the right and duty to defend any suit against the insured seeking damages on account of such bodily injury or property damage,even if any of the allegations of the suit are groundless, false or fraudulent, and may make such investigation and settlement of any claim or suit as it deems expedient,but the Company shall not be obligated to pay any claim or judgment or to defend any suit after the applicable limit of the Company's liability has been exhausted by payment of judgments or settlements. 5. PERSONS INSURED: Each of the following is an insured under this insurance to the extent set forth below: (a) The named insured and any executive officer,director,employee,trustees,or stockholder thereof while acting within the scope of his duties as such and any officials required or permitted by the rules for competition of professional race meet while acting in their official capacity in the conduct of such race meets. (b) Officials required or permitted by the rules for competition of a race meet while acting in their official capacity in the conduct of a race meet. (c) Any person or organization engaged in operating, managing, sanctioning. sponsoring, or providing the premises for a motorcycle/(ATV) racing meet. (d) Any participant, motorcycle owner/(ATV). or motoicycle/(ATV), sponsor but only with respect to bodily injury or property damage-to-parsons other than-any other participant,mutu,cyctet(ATV) owner, or motorcycle/(ATV) sponsor. (e) With respect to the operation,for the purpose of'locomotion upon a public highway,of mobile equipment registered under any motor vehicle registration law: (i) an employee of the insured while operating any such equipment in the course of his employment,and (ii) any other person while operating with the permission of the insured any such equipment registered in the name of the insured and any person or organization legally responsible for such operation, but only if there is no other valid and collectible insurance available,either on a primary or excess basis,to such person or organization:provided that no person or organization shall be an insured under this paragraph (e) with respect to: (a) Bodily injury to any fellow employee of such person injured in the course of his employment, or (b) Properly damage to property owned by,rented to,in charge of or occupied by the named insured or the employer of any person described in subparagraph (ii). This insurance does not apply to bodily injury or property damage arising out of the conduct of any partnership or joint venture of which h the insured is a partner or member and which is not designated in this Policy as a named insured,except this does not apply to American Motorcycle Association/American All-Terrain Vehicle Association. The insurance afforded applies separately to each insured against whom claim is made or suit is brought,except with respect to the limits of the Company's liability. II EXCLUSIONS This insurance does not apply: (a) to bodily injury to any unauthorized person in the restricted area during a racing meet unless a reasonable effort has been made to prevent entry. Restricted Area means the racing surface and any area where a competition motorcycle is being ridden or any area requiring special authorization,credentials,or permission to enter,or any area to which admission by the general public is restricted or prohibited. (b) to properly damage to (1) property owned, used or occupied by or rented to the insured,or (2) property of any participant or employee,and/or any automobile except when in the designated general public spectator parking area,or (3) any motorcycle/(ATV)while racing or practicing,or (4) property in the care, custody or control of the insured or as to which the insured is for any purpose exercising physical control; (c) to liability assumed by the insured under any contract except an incidental contract: (d) to bodily injury or property damage which may arise from the sale,consumption,handling or use of any refreshment or goods,of any nature supplied by the insured at the location or locations covered hereunder,occurring after the insured has relinquished possession thereof to others.This exclusion does not apply to coverage provided by the Insuring Agreement— Refreshment(food and drink) Products Liability; (e) to bodily injury or property damage arising from structural alterations. new construction, or demolition operations; (f) to the ownership, maintenance, operation, or Use of elevators; any amusement ride or device: fireworks or any material Intended for use as any explosive;any jet propelled,rocket propelled,or nuclear powered vehicle or by means of jet or rocket propulsion or nuclear powered for locomotion (including demonstration, practicing acceleration,testing or racing of any description);aircraft landing strip or strips,runways or fields designed or designated as aircraft landing and/or takeoff areas unless specifically agreed and endorsed hereon; (g) to bodily injury or property damage for which the insured or his Indemnitee may be held liable (.1) as a person or organization engaged in the business of manufacturing, distributing, selling or serving alcoholic beverages,or (2) if not so engaged, as an owner or lessor of premises used for such purposes, if such liability is imposed (i) by,or because of the violation of,any statue,ordinance or regulation pertaining to the sale,gift,distribution or use of any alcoholic beverage,or (Ii) by reason of the selling,serving or giving of any alcoholic beverage to a minor or to a person under the influence of alcohol or which causes or contributes to the intoxication of any person; (h) toranya oobli�tion fornt which thn insured or disability arri r as law,his insurer under any similar e d lilawable under any workmen's compensation, u(I) to bodily injury to any employee of the insured arising out of and in the course of his employment by the Insured or to any obligation of the Insured to indemnify another because of damages arising out of such injury. (j) to bodily injury or property damage arising out of the ownership, maintenace or use of any (1) motorcycle/(ATV)which is not authorized by the named insured or the insureds to actually perform and compete in the racing meet,except this exclusion shall not apply as respects the named insured. (2) motorcycle/(ATV), automobile,aircraft, or watercraft by an Insured away from the premises Insured herein; (k) to bodily injury or property damage due to war,whether or not declared,civil war,Insurrection,rebellion or revolution or to any act or condition incident to any of the foregoing,with respect to (1) liability assumed by the insured under incidental contract,or (2) expenses for first aid under the Supplementary Payments provision; (I) to bodily injury or property damage arising out of and in the course of the transportation of mobile equipment by an automobile owned or operated by or rented or loaned to any insured. (m) to bodily injury or property damage arising out of any racing meet,event, or meet other than a covered meet; (n) to bodily injury or property damage,arising out of the discharge,dispersal,release or escape of smoke,vapors,soot,fumes, acids,alkalis,toxic chemicals,liquids or gasses,waste materials or other irritants,contaminants or pollutants into or upon land, the atmosphere or any water cuurse or body of water;but this exclusion does not apply if such discharge,dispersal,release or escape Is sudden and accidental; (o) to bodily injury to a participant unless the Insured shall deliver to the Company simultaneously with the notice of a participant's claim a valid"Waiver and Release from Liability and Indemnity Agreement"in the form prescribed by the Company dated and signed by the participant prior to the time of occurrence in which said participant was Injured.The Company's maximum limit of liability of loss herein as a result of bodily injury to any participant is the limit of liability in effect for the Insured event. (p) to bodily injury or property damage arising from ice breakage including loss,injury,or death by drowning resulting thereform. 7. COVERAGE C—PERSONAL INJURY LIABILITY The Company will pay on behalf of the insured all sums which the insured shall become legally obligated to pay as damages because of injury(herein called Personal Injury) sustained by any person or organization and arising out of one or more of the following offenses committed during a covered meet. Group A — false arrest,detention or imprisonment, or malicious prosecution; Group B — the publication or utterance of a libel or slander or of other defamatory or disparaging material,or a publication or utterance in violation of an individual's right of privacy;except publications or utterances in the course of or related to advertising, broadcasting or telecasting activities conducted by or on behalf of the insured. Group C — wrongful entry or eviction, or other invasion of the right of private occupancy: If such offense is committed during the policy period within the United States of America,its territories or possessions,or Canada, and the Company shall have the right and duty to defend any suit against the Insured seeking damages on account of such Personal Injury even if any of the allegations of the suit are groundless,false or fraudulent,and may make such investigation and settlement of any claim or suit as it deems expedient.but the Company shall not be obligated to pay any claim or judgment or to defend any suit atter the applicable limit of the Company's liability has been exhausted by payment of judgments or settlements. EXLCUSIONS—PERSONAL INJURY LIABILITY This insurance does not apply: (a) to liability assumed by the insured under any contract or agreement; (b) to Personal Injury arising out of the wilful violation of a penal statute or ordinance committed by or with the knowledge or consent of any insured; (c) to Personal Injury sustained by any person as a result of an offense directly or indirectly related to the employment of such person by the named insured; (d) to Personal Injury arising out of any publication or utterance described in Group B,it the first injurious publication or utterance of the same or similar material by or on behalf of the insured was made prior to the effective date of this insurance; (e) to Personal Injury arising out of a publication or utterance described in Group B concerning any organization or business enterprise,or Its products or services, made by or at the direction of the insured with knowledge of the falsity thereof.
