HomeMy WebLinkAbout20001951.tiff '/5 RESOLUTION RE:: APPROVE CANCELLATION AND RELEASE OF COLLATERAL FOR USE BY SPECIAL REVIEW PERMIT#1214 FOR TD MACHINING, INC. -TONY DILLER, BRUCE VICTOR, AND JEFF GIACOMINO WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, by Resolution dated August 11, 1999, the Board did approve an Improvements Agreement According to Policy Regarding Collateral for Improvements (Private Road Maintenance) with Tony Diller, Bruce Victor, and Jeff Giacomino, concerning property described as part of the N1/2 NW1/4 of Section 32, Township 2 North, Range 66 West of the 6th P.M., Weld County, Colorado, and WHEREAS, pursuant to said Improvements Agreement, Escrow Account #4043011872 has been opened in the name of Anthony Diller at Norwest Bank Colorado, N.A. Brighton Branch, 15 South Main Street, Brighton, Colorado 80601-1609, with a hold on it stating "No withdrawals without a request from Weld County Board of Commissioners," was submitted to Weld County, and WHEREAS, staff from the Weld County Departments of Planning Services and Public Works have conducted a visual inspection of the project and recommend cancellation and release of said collateral without retainage, and WHEREAS, the Board of County Commissioners deems it advisable to cancel and release Escrow Account#4043011872 in the name of Anthony Diller at Norwest Bank Colorado, N.A. Brighton Branch, 15 South Main Street, Brighton, Colorado 80601-1609 NOW,. THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that Escrow Account #4043011872 opened in the name of Anthony Diller at Norwest Bank Colorado, N.A. Brighton Branch, 15 South Main Street, Brighton. Colorado 80601-1609, be, and hereby is, canceled and released. A site check done July 22 by Planning Services staff verified that all landscaping has been completed. The pavement required for the parking lot was completed in September, 1999, and approved by Public Works staff on October 26, 1999. Since eleven months have elapsed from the time the pavement was completed, the Department of Public Works is not asking for fifteen percent to be withheld. The Weld County Public Works Department recommends the release of the transportation collateral for the pay',d parking lot. No distress or repairs are needed to the asphalt. This paving item shall be released in flail. TI is paved parking lot is considered a private parking lot, non county maintained.
