WHEREAS, Section 24 . 4 . 2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS'' , the Board of County Commissioners heard all of the testimony and statments of those present, has studied the re- quest of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence pre- sented in this matter, and having been fully informed, finds that: 1 . The submitted materials are in compliance with the application requirements of Section 24 . 7 of the Weld County Zoning Ordinance. 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 . 4 . 2 of the Weld County Zoning Ordinance as follows : a. The proposal is consistent with the Comprehensive Plan policies in that the use does not infringe on continued agricultural use in the vicinity or County. The proposal does not encourage urban use to expand in a rural area. b. The proposal is consistent with the intent of the Agricultural Zone District and is provided for as a Use by Special Review. c . The activities proposed will be compatible with existing agricultural and rural residential uses in the neighborhood, as well as the projected de- velopment in the future . The future uses will be of rural residential and agricultural in nature. The intended proposal will not have significant traffic or noise impacts . In a letter dated August 23, 1983, the Town of Erie Planning Commission recommended approval of the proposal. e. No overlay districts affect the site . :E. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado, that the application for a Use by Special Review for a dog kennel for eight dogs on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions : 1. The attached Standards for Use by Special Review be adopted, as amended. 2 . The plat for the Use Permit be placed of record by the Department of Planning Services staff prior to any building permits being issued on the site . The permitted use shall be a dog kennel operation for one (1) mixed breed and seven (7) Malamute dogs as described in the application materials on file in the Weld County Department of Planning Services office. 2. A perimeter fence shall be constructed around the entire property. A chain link fence shall be constructed around the kennel facility. The fence on the eastern property line shall be a privacy fence. 3. All phases of the operation shall comply with all county and state health standards and regulations pertaining to noise emission and sanitary disposal. 4. Animal waste shall be removed daily from the kennel and stored in an enclosed container. The waste shall be removed on a weekly basis. 5. The Use by Special Review Permit shall not be transferrable to any successors and interest to the described property shall terminate automatically upon conveyance or lease of the property with others for operation of the facility. 6. The proposal shall comply with Section 24.5 et seq. (Design Standards for Uses by Special Review) and Section 24.6 et seq. (Operation Standards for Uses by Special Review) as listed in the Weld County Zoning Ordinance. 7. The Use by Special Review shall be limited to the plans shown hereon and governed by the Standards as stated above and all applicable Weld. County Regulations. Any material deviations from the plans and/or Standards as shown or stated above shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans and/or Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 8. The property owner and/or operator of this operation shall be responsible for complying with all of the above stated Standards. Noncompliance with any of the above stated Standards may be reason for revocation of the Permit by the Board of County Commissioners. * 9. All dogs shal.l be kept inside an insulated soundproofed building or buildings from 10:00 p.m. until 6:30 a.m. Dogs may be permitted outside between the hours of 6:30 a.m. and 10:00 p.m. The building and/or build- ings shall be constructed within forty-five (45) days after final approval by the Board of County Commissioners. RA:dg * This Operation Standard was amended at the hearing on October 5, 1983, with the addition of the following statement: 'The buildings shall be constructed in accordance to the planned dog house sound proofing designs submitted by the applicant on September 21, 1983. " HEARING CERTIFICATs 4 DOClun #83-56 RE: USE BY SPECIAL REVIEW, DOG KENNEL FOR EIGHT DOGS, SCOTT AND KAREN DECKER A public hearirg was conducted on October 5 1983 at 2:00 P. M. , with the following present: Chuck Carlson Chairman John Martin Pro Tem Gene Brantner Commissioner Norman Carlson Commissioner Jacqueline Johnson Commissioner Also present: Acting Clerk to the Board, Mary Reiff Assistant County Attorney, R. Russell Anson Planning Department Representatives, Rod Allison and Michael Mullen The following business was transacted: I hereby certify that pursuant to a notice dated September 12, 1983, and duly published September 22, 1983, in the LaSalle leader, a public hearing was held for the purpose of considering the application for a Use by Special Review, dog kennel for eight dogs, for Scott and Karen Decker. Russ Anson, Assistant County Attorney, read this proposal into the record. Rod Allison, representing the Planning Department, read the favorable recommendation of the Planning Commission into the record. Mr. Allison also read the proposed Operation Standards into the record and presented the Board with pictures which had been submitted to the Planning Commission as well as information on sound proofing, including a design which has been submitted by the applicants. Wayne Kauffman, representing the applicants, explained the request. He stated the applicants have purebred malemutes as a hobby only, receiving no compensation. The Deckers have had a kennel for six years, with no complaints. He submitted exhibits to the Board indicating the support of the neighborhood. Charles McWilliams, architect, explained the sound proofing planned for the existing dog horses, stating that the need for ventilation makes complete sound proofing impossible. Gayle Tanaka-Montoya, of the Alaskan Malemute Club of America, spoke concerning the malemute dogs. She stated that she had seen many dog kennels and was able to affirm that the Deckers have taken good care of their dogs and the kennels. James Tacke, Jewell Russell, Terry Lewis, and Dwayne Bowen, neighbors and forcer neighbors of the Deckers, testified that they had not been bothered by the dogs. Eileen Guyer and Ray Guyer both stated they have been opposed to any Use by Special Review in their neighborhood, but the recommended Operation Standards seemed to assure them of their rights being protected. James Davis spoke in opposition, urging the Board to uphold the zoning laws in order to keep order. Lynn Peterson presented the pnard with a letter from Sue and Mary Thompson objecting to the noise of the dogs. She further stated that her husband has spoken with the Deckers concerning the noise of the dogs, with no response. Mary Brooks commented on other dog kennels in the area. • • Tape change 83-104 Martha Lozinski stated that her brother-in-law had complained to the County about the noise and she opposed the dog kennel. Betty Morris, Dave Morris, and Glenda Tacke commented in favor of the dog kennel operation. Commissioner Johnson stated that she had received a call from Dorothy Shriner in favor of the request. Wayne Kauffman stated that a number of persons who previously objected to the proposal, now have no objections if the sound is controlled. Commissioner Martin raised a question as to other dogs in the neighborhood. Mr. Decker stated that there is a lot of variety of care of dogs in the neighboncmn1--some are allowed to run loose at night, and may be from a distance away. Commissioner Brantner stated that Mrs.Krueger had contacted him as being in favor of the proposal. He husband had previously signed a petition in opposition, thinking it would allow more dogs. Dwayne Bowen raised a question as to whether the proposed operation standards had been read and was assured they had been read early in the hearing. Commissioner Johnson moved to approve this Use by Special Review, including the Operation Stan- dards, and that Operation Standard 49 be amended to state that the buildings shall be constructed in accordance to the planned dog house sound proofing designs submitted by the applicant on September 21, 1983. Commissioner N. Carlson seconded the motion, stating that he noticed the support for this proposal from the surrounding property owners. Camn issioner Martin expressed LHR 2204 Page 2 HEARING CERTIFICATION -DECKER the feeling that perhaps may people who originally signed the petition opposing this proposal had no idea of the operation standards which were proposed, stating that he will vote in favor of the proposal, but he has listened to all the people--the opposition has been heard. Chairman C. Carlson commented on the agricultural nature of the area, admonishing the Deckers to live up to the standards. Commissioner Johnson made comments concerning the Use by Special Review prnress. She stated that the Board pays close attention to the individual circumstances making it allowable or not allowable and indicated that she felt the issues have been well met and complied with in this case. It is the opinion of the Department of Planning Services staff that the applicant has shown compliance with Section 24.3,.1.1 et seq. of the Weld County Zoning Ordinance as follows: - The proposal is consistent with the Comprehensive Plan policies in that the use does not infringe on continued agricultural use in the vicinity or County. The proposal does not encourage urban use to expand in a rural area. - The proposal is consistent with the intent of the Agricultural Zone District and is provided for as a Use by Special Review. - The activities proposed will be compatible with existing agricultural and rural residential uses in the neighborhood, as well as the projected development in the future. The future uses will be of rural residential and agricultural in nature. The intended proposal will not have significant traffic or noise impacts. Odor impacts are addressed in the Operation Standards. - In a letter dated August 23, 1983, the Town of Erie Planning Commission recommended approval of the proposal. - No overlay districts affect the site. - Use by Special Review Operations and Design Standards provide adequate protection of the health, safety and welfare of the neighborhood and County. The Department of Planning Services staff recommendation is conditional and based upon the following: 1. The attached Standards for Use by Special Review be adopted. 2. The permitted use shall be a dog kennel operation for one (1) mixed breed and seven (7) Malamute dogs as described in the application materials on file in the Weld County Department of Planning Services office. 2. A perimeter fence shall be constructed around the entire property. A chain link fence shall be constructed around the kennel facility. The fence on the eastern property line shall be a privacy fence. 3. All phases of the operation shall comply with all county and state health standards and regulations pertaining to noise emission and sanitary disposal.. 4. Animal waste shall be removed daily from the kennel and stored in an enclosed. container. The waste shall be removed on a weekly basis. 5. The Use by Special Review Permit shall not be transferrable to any successors and interest to the described property shall terminate automatically upon conveyance or lease of the property with others for operation of the facility. 6. The proposal shall comply with Section 24.5 et seq. (Design Standards for Uses by Special Review) and Section 24.6 et seq. (Operation Standards for Uses by Special Review) as listed in the Weld County Zoning Ordinance. 7. The Use by Special Review shall be limited to the plans shown hereon and governed by the Standards as stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Standards as shown or stated above shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans and/or Standards are permitted. The existing dog kennel contains eight (8) dogs and the kennel is located on the east part of the lot, parallel with the east property line. The east property line fence screens the kennel from residences to the east. An outbuilding and open pasture buffer the kennel from residences to the north. Landscaping and open pasture buffer the kennel from residences to the west. The Decker house, fence and Spruce Street buffer the kennel from the residences to the south. The kennel was clean. There was no indication of odors from the kennel. The Malamute dogs were well taken care of and were not barking or howling uncontrollably. This is a very small kennel operation and does not appear to be incompatible with surrounding residences and their uses. During the entire time we have resided in Carmacar we have never had one complaint , be it in the form of a phone call or a personal visit. In fact, our surrounding neighbors have oftentimes commented upon how much they enjoy the dogs and also that our dogs seem to be quieter than some households with fewer dogs. Kee-Too' s Spartan Warrior - Spartan was purchased from a highly regarded American Kennel Club judge and breeder in Anchorage. Besides being a show dog, he has attained two of the necessary three requirements towards the prestigious Working Pack Dog certification. Yukon Pride' s Tag-Line Tillie - Tillie is our two year old female from Fairbanks. She also enjoys a successful show career and was ranked #5 among Rocky Mtn. Area puppies in 1982. Yukon Pride 's Toklat of Kalluk - Toklat is also an "import" from Fairbanks. He is a former freight puller in Alaska and has successfully rroven himself in the show ring, too. Scott 's Hondo of Agila & Honcho' s Klassy Kiska - Our two "oldsters", Hondo and Kiska are nine and seven years of age, respectively, and are retired from showing and recreational working. They enjoy their position as the backyard rulers . Tristan - Tristan is the property of the University of Washington and we were selected as his custodians by the Alaskan Malamute Club of Aaerica 'f which we are members. At the Commission meeting on, August 18 , 1983 , it was decided by the Commission that it, had no objection to the application . However , the number of requests for USR permits by residents in Carmacar Ranchettes in recent months ( i . e . Quint , and Dubois applications ) has raised some concerns as to the County ' s intentions for development in this area . Are USR permits being used to circumvent zoning requirements and will this result in changing the character of the area? The Planning Commission is disturbed that this may eventuate and requests that the Weld County Planning Commission and Board of County Commissioners carefully review each permit application for nuisances which may disturb surrounding neighbors and reduce the liveability of the area . We are concerned with the permission given to a certain party, to keep an unlimited number of dogs on their property. We are aware that property owners are allowed up to four dogs per household, and depending upon the acreage (10 acres) of property they may own more. But, this particular party was previously given 30 days to clean up their property, build a fence, improve overall living conditions for the dogs, and seclude them from neighboring homes. This was done before the 30 days, when the premises were inspected, they were considered up to standard - but still to this day there is howling and barking , the premises are very unsanitary (there is a terrible stench) and the the dogs in our opinion, are being neglected. We, as the, citizens of this County, feel we have a right to complain; would like to have immediate action taken to solve this problem. We also feel if you issue this permit, it should be the Countys responsibility to investigate the Party concerned, and to see if the permit is being violated. We hope you will take into consideration not only the rights of the citizens. but also the rights of the animals. We do not feel debarking will solve this problem, it is cruel to the animals and we have reports to prove that they can grow back after a short period of time. Zoning seems to be an issue of importance here and some confusion exists when agricultural zoning is discussed. We realize that agricultural zoning opens a lot of doors but we have hope that common sense and caring for one's fellow neighbor will close some of those doors . The barking and howling and smell from one or two dogs tests one' s patience and when that condition is multiplied by eight or ten it will become unbear- able. The applicant, no doubt, promises to keep the dogs quiet and clean, but I submit that while it is possible to keep them clean it is impossible to keep them quiet.. We had hoped that the Weld County Ordinances would offer some protection to us but it seems as long as an individual can apply for Use by Special Review the County bends over backwards to make sure that individual 's rights are not violated. Please consider the individual rights of all adjacent property owners as well as all property owners within hearing distance. I was appalled learn that the County allowed ten horses on a property in this subdivision and now many other homeowners have decided to apply for permits for such businesses. In addition, a petition was circulated expressing objection to the dog kennel and a rumor was started that we, Duane and Charlotte Kramer,had signed two different petitions , one in favor and one objecting. Let it be known that Duane and Charlotte Kramer have signed the petition against the dog kennel .
