Home My WebLink About20001138.tiff RESOLUTION RE: APPROVE AGREEMENT CONCERNING PURCHASE OF RIGHT-OF-WAY FOR CERTAIN IMPROVEMENTS TO WELD COUNTY ROAD 126, ACCEPTANCE OF DEED OF DEDICATION, AND AUTHORIZE CHAIR TO SIGN - LAZY D GRAZING ASSOCIATION, C/O ARVID DE PORTER WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with an Agreement Concerning the Purchase of Right-of-Way for Certain Improvements to Weld County Road 126 between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Public Works, and Lazy D Grazing Association, do Arvid De Porter, Secretary, Carr, Colorado 80612, with terms and conditions being as stated in said agreement, for property described in Exhibit A, a copy of which is attached hereto and incorporated herein by reference, and WHEREAS, after review, the Board deems it advisable to approve said agreement, a copy of which is attached hereto and incorporated herein by reference, and WHEREAS, pursuant to said agreement, Laze D Grazing Association, do Arvid De Porter, has presented the Board with a Deed of Dedication for property as described in Exhibit A, and WHEREAS, after review, the Board deems it advisable to accept said deed, a copy of which is attached hereto and incorporated herein by reference, and NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners Or Weld County, Colorado, that the Agreement Concerning Purchase of Right-of-Way for Certain Improvements to Weld between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Public Works, and Lazy D Grazing Association, do Arvid De Porter, Secretary, be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board of County Commissioners of Weld County, Colorado, that said Deed of Dedication be, and hereby is, accepted. WITNESSETH: WHEREAS, County finds it necessary to rebuild and improve a bridge on WCR 126 which is known as Bridge 126/19A, Weld County Project No. 322, and WHEREAS,Owner own the Right-of-Way described in the attached Exhibit"A",hen cilia fter referred to collectively as "Right-of-Way", and WHEREAS, County needs the right-of-way in order to complete said rebuildi ig and improvement project, and WHEREAS, said rebuilding and improvement project involves the construction o a new bridge for WCR 126, and realignment of said roadway, and WHEREAS, Owner wishes to cooperate with County in said rebuilding and impro✓entcnt project. NOW, THEREFORE, the parties herein agree as follows: 1. Owner agrees to sell and County agrees to purchase the Right-of-Way shown and/or described in the attached Exhibit"A,"herein referred to as "Right-of-Way," for the sum of One Thousand Six Hundred Seventy-eight Dollars and no/100 ($1,678.00). The sum is calculated as $1,000.00 per acre multiplied by 1.678 acres. 2. Owners agree to grant the Right-of-Way to County by Deed of Dedication Irce and clear of all encumbrances. 3. County agrees to install, at no cost to Owners, a new barb wire fence on th south side of the new right-of-way. Fence will be reconstructed with the same nut nber of wires as the existing fence. Posts will alternate with one wood post, then two steel "T" post. 4. County will install, at now cost to Owners, one access at the same statior as the existing access. The access will be approximately thirty-two feet in width. 7 he gate will be constructed of two sixteen foot steel gates. 5. County agrees to pay the costs of title insurance and recording fees if necessary as determined by County. 6. The parties hereby agree that neither has made or authorized any agreement with respect to the subject matter of this instrument other than expressly set forth herein, and no oral representation,promise,or consideration different from the term.;herein contained shall be binding on either party, or its agents or employees, heret b. Although the date of the transfer of the Right-of-Way shall be the date of the dcli‘cry o f the documents of conveyance,it is expressly agreed by the parties hereto that upon execution of this Agreement by County and Owners, County, its contractors, agents, employees, and all others deemed necessary by County shall have the irrevocable right to possess and use all of the Right-of-Way for the purpose of said rebuilding and improvement project. 8. Owners warrants that he/she are the owners of the Right-of-Way and will defend title thereto against all claims. 9. General taxes for the year 2000 for the Right-of-Way shall be apportioned to the date of delivery of the deed based on the most recent levy and the most recent asses sment. 10. Owners represent and warrants that all general taxes levied prior to such year have been paid in full by Owners. IT IS MUTUALLY AGREED that the terms and conditions of this Agreement shall extend to and be binding upon the heirs,executors,administrators,successors,and assigns of the respect ive parties hereto.
