Pursuant to the definition of SETBACK in the Weld County Zoning Ordinance (Ordinance 89, as amended),the required setback is measured from the future right-of-way line. 2) Any future structures or uses on site must obtain the appropriate zoning and building permits. 3) All construction or improvements occurring in the flood plain as delineated on FEMA Community Panel Map 080266-0627C dated September 28, 1982, shall comply with the Flood Hazard Overlay District requirements of Section 26 of the Weld County Zoning Ordinance. 4) The installation of any septic system within the 100-year flood plain shall comply with the Weld County I.S.D.S.flood plain policy. Regulations, no septic systems shall be installed within the floodway. 5) Should noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Ordinance 169A. a • 6) RIGHT TO FARM COVENANT Weld County is one of the most productive agricultural counties in the United States. The rural areas of Weld County may be open and spacious, but they are intensively used for agriculture. Persons moving into a rural area must recognize there are drawbacks, including conflicts with longstanding agricultural practices and a lower level of services than in town. Agricultural users of the land should not be expected to change their long-established agricultural practices to accommodate the intrusions of urban users into a rural area. Well run agricultural activities will generate off-site impacts, including noise from tractors and equipment; dust from animal pens, field work, harvest, and gravel roads; odor from animal confinement, silage, and manure; smoke from ditch burning;flies and mosquitoes; the use of pesticides and fertilizers in the fields, including the use of aerial spraying. Ditches and reservoirs cannot simply be moved "out of the way" of residential development without threatening the efficient delivery of irrigation to fields which is essential to farm production. Weld County covers a land area of over 4,000 square miles in size (twice the State of Delaware) with more than 3,700 miles of state and county roads outside of municipalities. The sheer magnitude of the area to be served stretches available resources. Law enforcement is based on responses to complaints more than on patrols of the county and the distances which must be traveled may delay all emergency responses, including law enforcement, ambulance, and fire. Fire protection is usually provided by volunteers who must leave their jobs and families to respond to emergencies. County gravel roads, no matter how often they are bladed, will not provide the same kind of surface expected from a paved road. Snow removal priorities mean that roads from subdivisions to arterials may not be cleared for several days after a major snowstorm. Snow removal for roads within subdivisions are of the lowest priority for public works or may be the private responsibility of the homeowners. Services in rural areas, in many cases, will not be equivalent to municipal services. Children are exposed to different hazards in the county than in an urban or suburban setting. Farm equipment and oil field equipment, ponds and irrigation ditches, electrical power for pumps and center pivot operations, high speed traffic, sand burs, puncture vines, territorial farm dogs, and livestock present real threats to children. Controlling children's activities is important, not only for their safety, but also for the protection of the farmer's livelihood. 7) Any disturbance of wetlands shall require the applicant to contact the Army Corps of Engineers for appropriate permits pursuant to Section 404 of the Clean Water Act. 3. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11.7 of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty (60) days from the date of approval by the Department of Planning Services. The applicant shall be responsible for paying the recording fees. 4. Planning Staffs approval of this recorded exemption is based upon satisfying the above conditions. Should the applicant be unwilling or unable to meet any one of these conditions, within 60 days of approval, this case will be forwarded to the Board of County Commissioners with a recommendations for denial. Water supply statements addressing the following: a. Domestic use; Domestic water is from an existing well and could be provided by North Weld Water District, based on a previous "will-serve" letter in the RE- 2044 case file. b. Irrigation water; Irrigation water associated with the site will remain with the parcels appropriately. 2. A statement explaining that the proposed lots will have an adequate means for the disposal of sewage in compliance with the requirements of the underlying zone district and the Weld County Health Department. A copy of the septic permit or a letter from the sewage disposal facility must accompany the application. The proposed lots have an adequate means for the disposal of sewage and will maintain compliance with the requirements of the zone district and the Weld County Health Department, A septic system is located on Lot C and the proposed 5E Lot and was reviewed with the previous recorded exemption application. A copy of the septic permit is included within the application materials. 3. A description of how the property is being used. When the parcel(s) is located in the agricultural zone district, the description shall include approximate acreage of prime and nonprime farmland as defined in the Weld County Comprehensive Plan, number and types of livestock and any existing improvements such as the principal residence, labor home, mobile home, manufactured home, barn, outbuildings, irrigation ditches, and oil well production facilities on the property. Proposed Amended Lot C is in agricultural production and has an existing residence and out buildings. The proposed 5E Lot has existing improvements and will remain consistent with existing uses. Irrigation ditches are located on the property. There are existing oil facilities located on Lot C. (see attached site map) 4. The reason for the proposed recorded exemption with an explanation how each lot will be used. The purpose of this application rs to separate the two existing structures without creating an additional building site. The amendment will reduce the amount of maintenance for Lot C while maintaining adequate acreage for the existing uses and give the existing property owners the ability to stay in their existing house and sell off the farm and other improvements. As stated above, Lot C will remain consistent with the existing uses, which are residential and agricultural. The 5E lot has the ability for the uses by right, as listed in the agricultural zone district of the Weld County Zoning Ordinance. • 5. A description of the location, size and present use of the area where the proposed new lot(s) will be created. Amended Lot C will be approximately 153 acres, more or less and the 5E lot will be approximately 3 acres, more or less. The actual acreage will be determined at the time of the survey. Access exists to both parcels and no new access is requested, at this time. The existing access is shared and is from WCR 7O. 6. A statement describing any unique physical characteristics on the site, if applicable. This site does not have any physical characteristics that are unique only to this site. 7. A statement indicating that all proposed or existing structures will or do meet minimum setback and offset requirements for the zone district in which the property is located. All proposed structures will meet the minimum setback and offset requirements for the agricultural zone district. 8. A statement indicating whether the applicant is willing to place a conservation easement on the property to maintain farm production or open space. A conservation easement is not applicable to this proposal. 9. A statement indicating whether a building envelope will be designated on any of the lots. A building envelope is not applicable to this proposal. Amended Lot C has existing residential and accessory structures and the SE lot has an existing residential structure and accessory structures. 10. A statement explaining how the proposal is consistent with the Weld County Comprehensive Plan and any adopted municipal plan, and any approved intergovernmental agreement(s), if applicable. This proposal is not taking any "prime" farmland out of production and allows the property owner to retain their existing residence and a small acreage. Planning Staff should have directed the SE lot under the review of the previous application. The property lies just outside the referral boundary of the Town of Eaton. The uses of the property will continue as residential and agricultural. 11. A statement explaining how the proposed uses will be compatible with existing surrounding land uses. The existing surrounding land uses comprise of mainly large residential/agricultural lots to the north, south, east and west (see attached site map). The Town of Eaton lies north and west of this property. This proposal is very compatible with the existing surrounding land uses and does not create any additional building sites. 12. A statement explaining how the proposal is consistent with the intent of the district it is located within as expressed in the Weld County Zoning Ordinance, as amended, and the Weld County Comprehensive Plan. This proposal is consistent with the intent of the Agricultural zone district in the fact that the proposed split will not take any truly "prime" agricultural land out of production. As stated above, this proposal does not create additional building sites. The applicant believes that this proposal meets the intent of the Agricultural zone district. 13.A statement explaining how the proposal is consistent with efficient and orderly development as defined in the Weld County Subdivision Ordinance, Section 1.3. This proposal is consistent with efficient and orderly development by splitting the property based on the existing uses of the land. This proposal does not take "prime" agricultural land out of production. Shared access exists to both Lots C and the 5E lot from WCR 70 and no additional access is requested, at this time. This proposal does not affect Lot A or B of the previous RE 2044 application. The review and conditional approval of this proposal will insure the health, safety, and general welfare of the residents of Weld County. AmRE-2044) and Subdivision Exemption(Case Number SE-816)by Robert and Jane Miller. Resolution 7, 1985 by the City of Greeley Planning Commission gave administrative review authority to the Greeley Planning staff for review of recorded exemptions (RE). Although subdivision exemptions are not addressed by Resolution 7,the same density requirements in Resolution 7 may be used to evaluate them. Resolution 7 indicates we cannot recommend approval on any application where the overall gross density exceeds one dwelling unit per 20 acres outside of the 2010 growth ring. Since these applications do not create a density of more than one dwelling unit per 20 acres,we can recommend approval of the requests based on Resolution 7. The Greeley Public Works Department noted a reservation of a minimum of 50' of right-of-way from the centerline of WCR 70 would be appropriate to facilitate future development of this area if the proposal is approved. Also, the appropriate setbacks under the applicable zone should also be maintained within the subdivision.
