HomeMy WebLinkAbout20001688.tiff SUMMARY OF THE WELD COUNTY PLANNING COMMISSION MEETING Thursday, July 6, 2000 A regular meeting of the Weld County Planning Commission was held Thursday, July 6, 2000, in the Weld County Public Health/Planning Building, (Room 210), 1555 N. 17th Avenue,Greeley,Colorado. The summary of the last regular meeting of the Weld County Planning Commission held on June 20, 2000, was approved as read. CASE NUMBER: Z-543 APPLICANT: Daryl and Carol Propp (Long's Peak Estates) PLANNER: Julie Chester LEGAL DESCRIPTION: Part of the NW4 and part of the NE4 of Section 9,Township 1 North, Range 68 West of the 6th P.M., Weld County, Colorado. REQUEST: Planned Unit Development Change of Zone for thirteen (13) Residential Lots and 3.3 acres of Common Open Space. LOCATION: South of and adjacent to WCR 12, between WCR's 5 and 7. Julie Chester, Planner, read Case Z-543 into the record and noted that the Department of Planning Services is requesting a continuance until September 5, 2000, as the applicant has not yet supplied the memo asked for by the Department of Planning Services. Julie noted that the applicant is amenable to this continuance. The Chair asked if there was anyone in the audience who wished to speak for or against this application. No one wished to speak. Stephen Mokray moved that Case Z-543 be continued until September 5, 2000. John Folsom seconded the motion. REQUEST: Site Specific Development Plan and Special Review Permit for a Home Business,specifically recreational vehicle storage. Robert stated that the applicants have requested this continuance in order to allow the Greeley and Evans Planning Commissions to meet concerning this application. The Chair asked if there was anyone in the audience who wished to speak for or against this application. No one wished to speak. Stephen Mokray moved that Case USR-1274 be continued to August 15, 2000. Bryant Gimlin seconded the motion. REQUEST: Site Specific Development Permit and Special Review Permit for a business permitted as a use by right in the Commercial Zone District(Vehicle Service and Repair Establishment) in the Agricultural Zone District. LOCATION: North of and adjacent to WCR 28 Section Line; west of and adjacent to WCR 39. Kim Ogle, Planner, read Case USR-1275 into the record and noted that the Department of Planning Services is requesting a continuance to August 15,2000 to allow the applicant time to address water issues. Kim noted that the attorney of the applicant has requested this continuance. The Chair asked if there was anyone in the audience who wished to speak for or against this application. No one wished to speak. Stephen Mokray moved that Case USR-1275 be continued to August 15,2000. Cristie Nicklas seconded the motion. CASE NUMBER: S-534 PLANNER: Chris Gathman APPLICANT: Shawn and Paula Petersburg REQUEST: 3-Lot Minor Subdivision Final Plat LEGAL DESCRIPTION: Part of the SE4 of Section 9, Township 1 North, Range 68 West LOCATION: North of and adjacent to WCR 10, '/z mile east of WCR 5. For a more precise location,see legal. Chris Gathman, Planner, presented Case S-534 and read the Department of Planning Service's recommendation into the record. Chris noted changes to the recommendation, including the deletion of Condition of Approval#1. L and the addition of Conditions of Approval#1.J, #1. K,#1. L,#1. M and#3. F as well as some changes to the wording of Public Works and Department of Public Health requirements. Chris noted that the Department of Planning Services is recommending approval of this application. SUMMARY OF THE WELD COUNTY PLANNING COMMISSION July 6, 2000 Page 3 Bryant Gimlin asked why the applicant is responsible for snow removal on the cul-de-sac if it is to be dedicated to Public Works. Diane Houghtaling, Public Works, noted that the road will still be open to the public, therefore Public Works would prefer to have the road dedicated to them. John Folsom asked if there would be a condition concerning notification of buyers that the property was in a Geologic Hazard Area. Chris noted that the Geologic Hazard Development Permit had already been applied for and approved. John Folsom asked why the Colorado Geological Services did not receive a referral. Chris noted that they had received a referral and made their comments during the sketch plan phase of this application. Discussion dealing with the road not being paved followed,with the note that the road already existed and that it would only be serving these three lots. Shawn Petersburg, Applicant, noted that he wanted to see if there would be some way to keep the existing sheds that would be located in the right-of-way. Mr. Petersburg noted that he would prefer to apply for a Non Conforming Use than to tear them down or move them. Chris noted that the sheds would be in the right-of- way, but that they would not be in the road. Discussion followed concerning how to allow for these sheds to remain with Non Conforming Uses applied for. The Chair asked if there was anyone in the audience who wished to speak for or against this application. No one wished to speak. Cristie Nicklas moved that Case S-534 be forwarded to the Board of County Commissioners along with the Conditions of Approval and with the addition of "Or be designated as Non Conforming Uses," be added to Condition of Approval#2.C and the deletion of the words"60-foot"from Condition of Approval#2. M with the Planning Commissions recommendation of approval. Bryant Gimlin seconded the motion. The Chair asked the secretary to poll the members of the Planning Commission for their decision.
