My home is less than a mile (8/10ths) from the Hathaway property, as the crow flies. I am asking the County Commissioners to deny this request for the following reasons: 1. Noise. During summer evenings when I am sitting on my deck I can hear the voices of my neighbors who live over a 1/2 mile from my home. 150 dogs barking less than a mile away would destroy the peacefulness of the countryside that we currently enjoy. 2. Water. My understanding is that the Hathaways obtain their domestic water from the Mountain View Water District. If Mountain View was unable to provide water at a level sufficient to support this operation where would the Hathaways obtain water? It is my understanding the Colorado Department of Water Resources will nor automatically issue a permit for domestic and livestock use for landowners with less than 35 acres. Generally, a permit for a well on a parcel less than 35 acres is issued for household (inside) use only. Probably a permit would not be issued for this type of commercial use but it would depend on how much water they would propose using and the condition of the aquifer(quality and quantity of water available) in their location. 3, Waste. How are the Hathaways planning to dispose of fecal matter? It seems to me that with so many animals this would be a considerable problem and ground water contamination and odor problems could occur if the fecal waste is not disposed of offsite. How many people, on average, would be coming to and from the kennel each day? Weld County Road 6 is not a very wide road and routinely has cars going 65 mph in the posted limit of 55 mph. Large numbers of vehicles turning into the Hathaways property could be hazardous, particularly if they were making a left turn. 5. Labor. It would seem to me that more than two people would be needed to properly care for 150 dogs and 40 cats. There is a labor shortage in this area at this time, Do the Hathaways have a reliable labor source to ensure that the animals would be properly cared for? I would not want to see an operation in southern Weld County similar to some I have seen on shows like "60 Minutes" and "Twenty-Twenty" where animals are suffering due to inadequate facilities and care. 6. Intended Use. If the Hathaways purchased this property with this sort of use in mind it seems to me that they should have applied for a special use permit prior to completing the purchase. The land was zoned agricultural when they purchased it and they should be prepared for it to remain agricultural. I believe that the issuance of special use permits should be the exception rather than the rule. Our agricultural area will not remain agricultural if there is a commercial non-agricultural business on"every corner" which, it seems, is becoming the trend, Very truly yours, )(- Cct-Jc-, Hazel K. My mother,Zella Glardon, and I reside at 6989 Weld County Road 6, and have lived their all of our lives. We VEHEMENTLY OPPOSE this request and ask that it be DENIED. This is an agricultural area and has been for years. We certainly don't need barking dogs and the stinch of such an operation, let alone more traffic on Road 6. We would like to keep this area as quiet and in the country as possible,despite the rapid growth as found in all parts of the front range. I pose this question. To those on the Planning Board, would you approve this if this was to be in YOUR area—just down the road? I ask Barbara Kirkmeyer,who is a neighbor and lives just to the south---would she want and approve such an operation just down from her new home? I hardly doubt it. I understand they have requested water from Mountain View Water District,which to my understanding is not permitted for a commercial operation. This water system has trouble enough,now, to supply the needs of its customers, especially in the summer_ If the Hathaways lived on a big acreage and were mostly to themselves,then I could see this being approved,but not in this area where it is populated with farm homes. I hope you will seriously think about what has been said and DENY this request at the hearing on May 17. Weld County Commissioners, I've recently learned that the planning commission has approved a plan _ to put a boarding kennel for 150 dogs and 40 cats west of the intersection of Roads 6 and 17. Imagine my shock, since I didn't even know the property had undergone a use hearing, even though I regularly travel past the property on Road 6! I'm hoping that the county commissioners will be able to right the wrong visited upon us by the planning commission. Here are my thoughts on the subject. Many folks assume that those of us who live in the country don't care about our neighborhoods. In reality, we are a closely-knit community. We rely on each other for support, emergency help, information, etc. I see many of my neighbors two or more times a week. We love the country and would not want to inflict the rigors of town living on ourselves. Nevertheless, we care about our homes and communities too. In discussion with my neighbors, I found that none of them knew of the hearing on the land use until after it was over. There is concern about sound pollution, waste disposal, chemical disposal, vermin, water use, and traffic patterns in addition to the usual concerns of loss of property value. I'm sure that many of the commissioners would feel the same concerns that we have if they were to have a similar facility threaten their homes. Please have the same concern for our homes that you would have for your own. Help the concerned neighbors of this area keep the lovely neighborhood that we have by denying this request to use this land as a boarding kennel. As a homeowner near the location of this kennel I am offended and insulted that my nearby neighbor would begin to destroy the peaceful, tranquil and privacy of the surrounding area without consulting neighbors first. Realizing that the kennel will be located on the owner' s private property, it is still close enough to our property to be a great disturbance. Most people move to the country for several reasons but one of the biggest is peace and quiet. Certainly this tranquil surrounding should not be destroyed by the sound of sixty• plu:; barking dogs, antagonized by forty or more cats in close proximity to their cages. The construction of these kennels would cause additional unnecessary traffic in addition to the noise. Working together to keep our neighborhood peaceful and private is what we all work together to create. Surely you would not choose this kennel for your own neighbor and neither would we. With such a protested and unwelcome operation, it would cause a negative reaction among the neighborhood. No one likes conflict and only you, the Commissioners, can prevent this from happening and in keeping a happy neighborhood peaceful and private. It is my understanding that the proposal is for a kennel to house 150 dogs and 40 cats. Subjecting our neighborhood to another kennel,no matter the size,raises concerns of....noise,water usage, rodents/flies,and waste removal. I have experienced living near a kennel in this area. It also started as a boarding kennel,but progressed from 10-15 dogs to a puppy mill,housing 30-40 dogs,or more. It was a nightmare for the surrounding homes and families living nearby,including homes that were 3-4 miles away. Sound carries a long distance in a rural setting that has few trees. Entertaining was impossible, inside or outdoors. Our sleep was interrupted at night, and windows had to be kept closed,even though the dogs were sometimes housed inside the kennel in the evening. Imagine the annoyance of one neighborhood dog,barking incessantly,then multiply that by 150 dogs. Kennel owners may tell you that they won't allow that to happen,but in reality,how can they control that many dogs? It is also impossible to control the factors that will start the barking. In a rural area there are many triggers....a person, a stray cat,a rabbit, a coyote, a raccoon,to mention a few. Water has always been a precious resource,and it is becoming more so as each year passes. A kennel uses large amounts of water daily for hosing the walls and runs....usually two or more times a day, if they are going to manage a sanitary facility. What would that usage amount to? I would question if that is a good use of communtiy well water. Waste and uneaten food can be a problem, even if a kennel has a separate septic system. When hosing runs, often times, food and waste is washed outside of the pens. This attracts rodents and flies. Our barns and outbuildings had rats in them when the previously mentioned kennel was not well managed. The odor from the food and waste that was washed outside was unbearable. There will be no guarantees for the kind of management the proposed kennel will have. What, if any, inspections would be done by Weld County and how frequently? I ask that you consider the negative impact this proposed kennel will place upon our community,and the stress it will place upon the families living here. I've given you a sketch of the 4 sections with the homes marked. There will be over 60 homes impacted should this kennel be sited. A kennel is not a use by right therefore it requires a special use permit. It is not compatible with existing or future neighboring property. It is too intensive a use for the zone district and there are a number of problems with locating this kennel in this area. The file says "it will provide a valuable service to the surrounding community". Wrong -farmers don't board their cats and dogs. Their neighbors care for them in the owner's absence. The file says "a kennel primarily for dogs and cats" Does this mean that they entertain the possibility of boarding other types of animals? There is a wetland on the fence line with the property to the east and a permanent lake which supports migratory waterfowl. These birds are protected by the Federal government. Any urine or fecal material from the kennel which contaminates the groundwater will pollute the lake. Across the road is a continuation of the wetland. It would seem an environmental impact study should be done. The high water table is a fact. One mile north of the kennel site was a proposed landfill. After the geological studies were done, the ground water contamination problem was given as the reason for the denial of the application. Many of us in the area have permanent sump pumps in our basements where the ground water is only three feet below the ground level. The contamination of the ground water will have a severe, negative impact on the neighborhood. The Weld County Comprehensive Plan does not allow for additional accesses on an arterial such as Weld County Rd. 6. Over one thousand vehicles use this road every day and changing this use from residential/agriculture access to an access for commercial use would appear to be inconsistent with the Comprehensive Plan. We do not need the increased traffic from this commercial business. What type of runs do they plan to have? I understand they'll be gravel which is hardly a sanitary solution. The property is full of alkali, an extension of the wetland next door. Alkali means too much water and that is a poor base for gravel or structures. Noise is another factor. In an agricultural zone, we prefer livestock businesses. Carnivores, i.e. cats and dogs are quite different animals with different needs. Their housing and feed requirements are totally different as are their vocal capabilities. We frequently hear coyotes at times from 5:30PM until 3:00AM and so do farm dogs who make an appropriate response. I can't imagine the appropriate response from 150 kennel dogs unless of course there are soundpr000f walls which brings up problems of adequate housing, ventilation, heating, cooling, etc. I am absolutely opposed to this kennel application Thank you. I live within 1 mile of the proposed kennel site. My first response is for the care of animals in general. I have had three dogs in the past that were purchased from Kennels. The first two dogs were terribly abused. One was kept in a cage and when I purchased the animal, she had been starved, neglected and had open sores on her paws. The second one was kept outside in a gravel bottom cage. This dog was nearly crippled due to spending her life on this surface. To watch these animals walk on grass for the first times in their lives was amazing. The reason we purchased these animals is first we liked their breed, and the second reason was to get these animals away from the owner. The third dog came from a puppy mill. This dog I still own, and has genetic deficits. She is deaf. I did not return this animal because by the time we found out our puppy was deaf, we loved her. We did not want her to go through a life of abuse because another owner may not of realized her problem or gotten her proper medical attention. This is a massive amount of animals these people are proposing to house. Care for these creatures is the utmost concern. Gravel surfaces are not acceptable for or healthy for a dog to live on. Even if other facilities have this, it doesn't make it right. Water is a problem in this area. Not having proper water facilities will endanger these animals. Does this land have proper drainage? As I understand it does not. The feces and urine of these animals could very well contaminate my drinking water as my farm is ran on a well. This includes the water used in my home. I do not have piped in water. I rely on my well not only for my family, but for my animals as well. The small area that will house these animals will be consolidated in a six-acre parcel. The content of these animal's defecation would show up in my water eventually. Maybe not the first year or even the first few years, however within ten years it will probably become my problem, as the ground water is crucial to our survival. Who will become responsible then? These proposed animals have no agricultural value. This is a farming community. We raise pigs, cows, horses, sheep, goats and various other livestock animals in this community. 120 dogs barking at 40 cats will in no doubt cause noise. When coyotes g. EXHIBIT d Umtata KO/ Auker howl at the moon it is bothersome at best. When these animals start howling back at the wild dogs, the noise pollution will become outrageous. I enjoy living in the country. 1 do not want to listen to barking dogs all night long. No one can keep 120 dogs quiet. It would be impossible to keep 20 dogs quiet. In the event that these dogs become loose or breakout, not only would our livestock be in jeopardy of attack, but our children and ourselves as well. These animals can not be contained at all times. At some point one will get loose. We do not have animal control in this area. We already have a large stray dog and cat problem as well. Traffic is another concern. An establishment of this size will undoubtedly bring people. Which in turn brings more traffic to our area. Yes it appears there is a good road on WCR 6 however just 2 miles east, the railroad tracks on WCR 6 & 11 are dangerous. Before we bring people into this area, we need to have our roadways assessed for dangers. These are live tracks and until they are properly gated with barricade arms and alarms, traffic should be kept at a minimum in this area. You can not see a train coming from either direction at this intersection. The county would be wise at a minimum to put stop signs in both directions to keep someone from being killed, even if the kennel is not put in. We as a community are not ready for traffic in this area. WCR 8 & 15, 4 & 15, and many other intersections within 2 miles have no stop signs at four way intersections. These two areas are extremely close to the proposed kennel site. Most people from the Denver area do not know this area. We in the community watch our intersections very carefully and always give the other driver the right of way, we treat our intersections as four way stop signs if other vehicles are present. This is a danger that needs to be addressed in south Weld County prior to our area growing. We as a community are not ready for outside traffic. I do not wish to have my name made public in this matter, as I do not want to be contacted by these people. I will be willing to speak with the County Commissioners if that is your will. I have known Heather Hathaway for approximately 13 years. During that period, I have many times been honored to have Heather assist me with veterinary problems at her family's horse farm. Heather has proven to be an excellent assistant because she is so extremely diligent. When veterinary problems arise, she is quick to seek professional assistance. Unfortunately, many professional animal people rely only on their own experiences to treat medical problems and often error because of lack of veterinary consultation. Heather is so politely humble to seek the best answer in any situation that she has more successful treatment results. Heather Hathaway is diligent to follow through with any task. Quite often I prescribe a treatment mode for a sick animal and later discover that the treatments were not accomplished because the responsible person got busy with something else or just forgot or even had to quit to get rest. Heather diligently follows through for me under any situation even if it requires that she must to slay up all night or stand in a freezing storm and, SHE DOES HER WORK TO PERFECTION. Heather Hathaway has the character of a leader. Name, Objects, Purposes and Principal Place of Business The corporate name, the objects and purposes and the principal place of business of this Company shall be as stated in and provided by the Certificate of Incorporation of the Company heretofore filed in the office of the Secretary of State of Colorado and the office of the Clerk and Recorder of Adams and Weld County, Colorado, as required by the laws of the State of Colorado. ARTICLE II. -- Seal The seal of this Company shall have inscribed thereon the name of the Company and the words "Corporate Seal" and "State of Colorado". ARTICLE III. -- Membership Section 1. Section 3. _Dg.ties of the Secretary-Treasurer: The Secretary-Treasurer shall keep a record of the proceedings of the Board of Directors and shall keep the books and records of the Company and the seal of said Company and shall attest the signature of the officials of the Company executing documents on behalf of said Company; shall collect all assessments and moneys due the Company and deposit the same in the depository designated by the Board of Directors and shall disburse funds on the proper order of the Board, and shall make a report of the business transacted by the Secretary- Treasurer annually, or more often as deemed necessary if so required by the Board of Directors or the President, and shall do and perform such other duties and functions as may he required of the Secretary-Treasurer by the Board of Directors or the President. The Secretary-Treasurer shall be covered in the performance of these duties by a surety bond in an amount to he determined by the board of Directors. The premium for such bond shall he paid by the Company. Section 4. Ditties of the Members: Members of the Board of Directors shall attend the meetings and participate in all business that confronts the Company. They shall be entitled to one vote at the Board of Directors' meeting. Section 5. Appointment and Duties of Superintendent: The Board of Directors may appoint, in addition to the officers above named, a superintendent of the domestic water system who will be in charge of the work of construction, maintenance and repair of the system of the Company and of the distribution of water. The Superintendent shall make to the Board of Directors a monthly report showing the condition of the system and the amount and character of work done during the previous month. The Superintendent shall certify to the Secretary-Treasurer, monthly, the time spent by the Superintendent personally and by each laborer in performing work in behalf of the Company. The compensation to be paid for the performance of the duties of the Superintendent and any laborers, or assistants the Superintendent may hire, shall he in an amount to be determined by the hoard of Directors. ARTICLE VII. -- Assessments Section 1. Water Charges: The membership, at its annual meeting, shall establish a schedule of rates of charges to be made for water delivered to its members. Such rate schedule shall establish a minimum charge for each service connection for each month or other stated period of time, the amount of water to which each service connection shall be entitled for the stated period of time upon payment of the minimum charge, and the rates for amounts of water delivered during such period in excess of the maximum limit set for the minimum charge. Section 2.. Assessments: If, at any time after the establishment of the schedule of water charges by the membership, it appears in the judgment of the Board of Directors that the amount of money derived from the collection of water charges during the year will be insufficient to pay when due all costs incident to the operation and maintenance of the system and the payment the debts and obligations of the Corporation, the Board shall make and levy an assessment against each membership held in the Corporation, so that the total amount of such assessments, together with the amounts collected, or reasonably expected to be collected from water charges is sufficient to insure payment of all costs of operation and maintenance and payments on indebtedness or other expense of the Corporation which will become due during the ensuing year. Section 4. Collection of Water Charges and Assessments: In the event payment, by any member, of water charges and assessments remains delinquent for a period of 30 days after the clue date of water charges as fixed in the rate scheduled adopted by the membership, or for a period of 30 days after the due date of any assessment, or for a period of 30 days after the due date of any assessment as stated the notice thereof, the Board of Directors is authorized to withhold the delivery of water to such delinquent member until such delinquent water charges or assessments are fully paid. Should the delinquency in payment of either water charges or assessments continue after the above stated 30 day period, the Board of Directors, on 60 days notice of the delinquency, given by mail addressed to the delinquent member at the member's latest post office address as shown in the records of the Corporation, may bring suit in a court of competent jurisdiction against the delinquent member to recover the amount of such delinquency and the cost of such suit, or may sell the membership of the delinquent member, paying any surplus above the amount of delinquency and the cost of the sale to the delinquent member. ARTICLE VIII. -- Membership Certificate Section 1. Form: The Membership certificate of this company shall be in such form as is provided and approved by the Board of Directors. Section 2. Membership Book: As a part of the records of the Company, there shall be kept a Membership Book, which shall contain a list of the certificates of membership which have been issued, noting the number of certificate the date thereof and the name of the person to whom issued. Section 3. Transfer of Membership: Certificates of the Membership may be transferred and the transfer shall be noted on the Books of the Company to such transferee upon the surrender of the certificate properly endorsed. No transfer of membership shall be valid until all of the indebtedness own'ed to the Company is paid ' or adjusted to the satisfaction of the Board of Directors.
