HomeMy WebLinkAbout20000657.tiff In response to the notice we received regarding Docket#2000-15-J.E.R. a partnership dated for April 12, 2000, we are against the project and concerned. ,: • ', First, when most of no bought lots off of Mr. Lundvall, we were told that nothing would ever go in that area as it was a green. When we were given;drip O14 fourth filing, we were told we could choose any lot we wanted. We picked ow' lots, had paperwork done on that lot, and sent it to the title company with our lot numbers on it. Then they took that lot away from us as they said'Muses had to be built there. So, in turn, we had to pick another lot frost mother little section. We were also told that all manufactured houses had to be put on a cement:foundation, unfortunately there are only 8 or 9 out of 25 lots that have this type of foundation. The rest are wooden surrounds. We also were handed covenants which we were to follow. Few people have abided by those covenants. We also have no association. With no association it seems that covenants have no bearing and cannot be enforced. In turn the sheriff's department as county cannot help us enforce the cxwbienants. We have landscaping problems. It seems that on each lot the houses don't sit even. Some sit higher than others, then the next lot sits low and the bock yard landscaping slopes down to the other person's back yard and causes flooding not only to that person's yard but to others around. According to covenants, it states "Natural drainage associated with any lot shall not be altered so 8ffi to drain onto the adjacent properties." People figure then that nothing can be done on their lot so they don't fix it and they cause other people to eat their water. We also have problems with street flooding. Front yards along Mesa Verde Dr. get flooded and washes everything out. It comes off 47th Ave. to North&South Shenandoah St. to Lake Mead and then urns down Mesa Verde Dr. We have seen Mesa Verde road completely flooded down to the corner of Arches them it goes across to the north as there is a pan there to divert it. There are no curbs or a pan on the corners of Lake mead & Mesa Verde to help curb the flooding. Additionally, we have only 1 street light on the corner of Arches and Mesa Verde Dr. in almost 3 years, none on Lake Mead and Mesa Verde Dr. According to covenants, there are also supposed to be no trucks over 5 tons on the streets. We have tractors & tractor trailers, both, some even loaded coming in from 47th Ave. down Mesa Verde constantly. It is already breaking down the pavement. Each filing has different covenants on fences, sheds, foundations, etc.... I believe all filings should have the same covenants as people seem to think they can do as someone else does in a different filing. It won't take long for this area, 1st filing through 4th filing, to start looking like the older part of the park. In all (4. EXHIBIT &ow-o(057 s z$ filings, there is nothing that coincides with the covenants. If the 5th filing is allowed and maybe different covenants it will be the same as the rest of the filings. There will be no covenants enforced as no association will be filed. We would so much like to see nothing going in on those lots, but they should maintain that piece of property with grass and a nice walkway for people to enjoy. There is also wildlife down by the stream (American Bald Eagle, Black Foxes, owls, falcons, hawks, coyotes, and sand cranes) and we feel that they should be protected. Since we were told in the beginning that this area was to be a green, we believe it should stay that way. MEMORANDUM TO: Board of County Commissioners April 7, 2000 O C oRADO From: Chris Gathman - Planner "' ±- SUBJECT: Additions/Amendments to the Resolution approving S-523 - West Hill-N-Park, Fifth Filing, Final Plat Planning Services staff is requesting the following additions/amendments to :his resolution: Condition 1C shall be changed to: * A certificate from the Weld County Treasurer showing no delinquent taxes for 1999 shall be submitted to the Department of Planning Services. Add the following conditions to Section 2B of the resolution: * No permanent disposal of wastes shall be permitted at this site. * Waste materials shall be handled, stored, and disposed of in a manner that controls fugitive dust, blowing debris and other potential nuisance issues. * All construction shall occur in accordance with the recommendations contained in the Geotechnical Engineering Report (April 1998) prepared by Terracon for the West Hill-N- Park 5th Filing, including implementation of a Groundwater Monitoring Plan, and the Colorado Geological Survey referral. * Each structure shall require an engineered foundation per the Weld County Building Inspection Department. * The open space & drainage detention area on this plat is not a buildable lot.
