WATER AND SANITARY SEWER LINE PARTICIPATION RIGHTS
NOTICE IS HEREBY GIVEN TO ALL PERSONS OWNING PROPERTY WITHIN THE SERVICE
AREA/DRAINAGE BASIN OF ASHCROFT HEIGHTS SUBDIVISION WATER/SANITARY SEWER AS
FOLLOWS:
ASHCROFT HEIGHTS, LLC, A COLORADO LIMITED LIABILITY COMPANY,CARE OF VINTAGE
CORPORATION WITH AN ADDRESS OF 5801 WEST 11Thi STREET #202, GREELEY,COLORADO 80634 IS
DEVELOPING ASHCROFT HEIGHTS SUBDIVISION, LOCATED AT THE NORTHWEST CORNER OF THE
INTERSECTION OF 35TH AVENUE AND 37TH STREET,AS PLATTED IN THE CITY OF EVANS, COLORADO
AND RECORDED ON OCTOBER 1, 1999,UNDER RECEPTION NUMBER 2724127,WELD COUNTY,
COLORADO RECORDS.
THE CITY OF EVANS HAS DETERMINED THAT THE ASHCROFT HEIGHTS SUBDIVISION IS A
"NON-CONTIGUOUS DEVELOPMENT" THAT REQUIRES THE CONSTRUCTION OF "OFF-PREMISE
WATER AND SANITARY SEWER MAINS",AS PROVIDED IN TITLE 13, CHAPTER 28,EVANS MUNICIPAL
CODE,AS ADOPTED BY ORDINANCE NO. 1000-96(THE "ORDINANCE").
ASHCROFT HEIGHTS,LLC INTENDS TO EXTEND THE EXISTING WATER AND SANITARY
SEWER MAINS OF THE CITY OF EVANS TO ASHCROFT HEIGHTS SUBDIVISION BY CONSTRUCTING
OFF-PREMISE WATER AND SANITARY SEWER MAINS. ASHCROFT HEIGHTS,LLC.'S CONSTRUCTION
OF ASHCROFT HEIGHTS SUBDIVISION WATER AND SANITARY SEWER WILL BE AT ASHCROFT
HEIGHTS,LLC SOLE EXPENSE AND IN ACCORDANCE WITH CITY OF EVANS SPECIFICATIONS,AND
IS ANTICIPATED TO COMMENCE AFTER IT IS APPROVED BY THE CITY OF EVANS. UPON
COMPLETION,THE ASHCROFT HEIGHTS WATER AND SANITARY SEWER SHALL BE DEDICATED TO
THE CITY OF EVANS FOR USE AS PUBLIC WATER AND SANITARY SEWER IN ACCORDANCE WITH
THAT CERTAIN DEVELOPER'S AGREEMENT BETWEEN THE CITY OF EVANS AND ASHCROFT
HEIGHTS,LLC.
THE CITY OF EVANS HAS FURTHER DETERMINED,PURSUANT TO THE ORDINANCE,THAI
THE OFF-PREMISE ASHCROFT HEIGHTS SUBDIVISION WATER AND SANITARY SEWER IS ELIGIBLE
FOR REIMBURSEMENT OF CERTAIN CONSTRUCTION COSTS ASSOCIATED WITH THE OFF-PREMISE
ASHCROFT HEIGHTS SUBDIVISION WATER AND SANITARY SEWER,ALL AS PROVIDED MORE
SPECIFICALLY IN THAT CERTAIN REIMBURSEMENT AGREEMENT TO BE ENTERED INTO BETWEEN
THE CITY OF EVANS AND ASHCROFT HEIGHTS, LLC.
NOTICE IS HEREBY GIVEN TO EACH PERSON OWNING PROPERTY WITHIN THE SERVICE
AREA/DRAINAGE BASIN OF THE ASHCROFT HEIGHTS SUBDIVISION WATER AND SANITARY SEWER
THAT YOU HAVE THE RIGHT BUT NOT THE OBLIGATION TO PARTICIPATE IN THE COSTS OF
CONSTRUCTING THE OFF-PREMISE ASHCROFT HEIGHTS SUBDIVISION WATER AND/OR SANITARY
SEWER. YOUR SHARE OF SUCH COSTS SHALL BE AS SET FORTH IN THE REIMBURSEMENT
AGREEMENT,A COPY OF WHICH MAY BE OBTAINED FROM THE EVANS WATER AND SEWER
DEPARTMENT.
IF YOU ELECT TO PARTICIPATE IN THE COSTS OF CONSTRUCTION, YOU MUST MAKE
WRITTEN APPLICATION TO THE EVANS WATER AND SEWER BOARD AND TENDER YOUR SHARE OF
THE ESTIMATED COSTS AS PROVIDED FOR IN THE "ASCROFT HEIGHTS SUBDIVISION OFF-SITE
SERVICE AREA STUDY-37TH WATER STREET AND 37T"STREET/35TH AVENUE SANITARY SEWER"
SUBMITTED WITH THE REIMBURSEMENT AGREEMENT AS PREPARED BY DREXEL BARRELL & CO.,
GREELEY, COLORADO. CURRENTLY,CONSTRUCTION IS EXPECTED TO COMMENCE MAY I,2000.
IF YOU ELECT NOT TO PARTICIPATE IN THE COSTS OF CONSTRUCTION,NO ACTION IS
REQUIRED. HOWEVER, PLEASE BE ADVISED THAT YOUR FUTURE ABILITY TO OBTAIN WATER
AND/OR SANITARY SEWER SERVICE FROM THE CITY OF EVANS WITH RESPECT TO THE OFF-
PREMISE ASHCROFT HEIGHTS WATER OR SANITARY SEWER WILL BE SUBJECT TO THE TERMS OF
THE ORDINANCE AND/OR THE REIMBURSEMENT AGREEMENT.
