NELSON WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , the Board of County Commissioners, pursuant to its authority under Section 30-28-101 (10) (d) , CRS, as amended, did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Recorded Exemption No. 685, does not come within the purview of the definition of the terms, "subdivision" and "subdivided land" , and WHEREAS , the request for Recorded Exemption No . 685 was sub- mitted by Earl E. Nelson for property being located in Part of the Wh, Section 4, Township 7 North, Range 66 West of the 6th P.M. , Weld County, Colorado being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A" , said plat to be recorded, and WHEREAS , this request is to divide the property into par- cels of 3. 4 acres and 128 acres, more or less, to allow the applicant to sell the property as two separate parcels. NOW, THEREFORE , BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the hereinabove de- scribed parcel of land be, and hereby is, exempt from the defi- nition of the terms, "subdivision" and "subdivided land" . BE IT FURTHER RESOLVED by the Board that this approval is conditional upon the applicant submitting a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be drawn in accordance with the requirements of Section 9-2C. (4) of the Weld County Subdivision Regulations. Nelson for a recorded exemption. The parcel of land on which this request is being made is described as Pt. 1.O1 Section 4, T7N, R66W of the 6th P.M. , Weld County, Colorado. The property is located 1 3/4 miles southwest of Pierce on WCR 29. The property contains approximately 132 acres of Class Ile, IIIe, Ills, IVs and IVe irrigated and IVe, VIe, and VIs nonirrigated soils. The parcel of land under consideration is the total contiguous land holdings of the applicant. The request is to divide the property into parcels of 3.4 acres and 128 acres, more or less. Mr. Nelson would like to sell the cropland to a neighbor adjoining the property to the west and the residence and farm improvements to a separate party. Based upon the submitted information and policies of the County, the Department of Planning Services staff recommends the request be approved for the following reasons: 1. The request complies with Section 9-2C. of the Weld County Subdivision Regulations submission requirements; and 2. The request complies with Section 9-2E. of the Subdivision Regulations as follows: - The property will continue to be used for agricultural production. The uses will be compatible with surrounding land uses. The use be will compatible with future development as projected by the Weld County Comprehensive land use plan. - The proposal was reviewed by the city of Pierce and was found to comply with their long-range Comprehensive Plan. Board of County Commissioners Page 2 - The proposal is in compliance with Section 1-3 of the Weld County Subdivision Regulations and the proposed land division complies with the Weld County Comprehensive Plan. Therefore, the proposed use is consistent with efficient and orderly development. - The proposal does not exist in an overlay district area. - The proposed lots meet minimum lot size requirements for land division. - North Weld County Water District has indicated adequate water service is available for this proposal. - The proposed lots are not part of a recorded exemption within the last five (5) years. - The two lots proposed will have adequate access from WCR 29. The Department of Planning Services staff recommendation for approval is conditional upon the following: 1. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be drawn in accordance with the requirements of Section 9-2C. (4) of the Weld County Subdivision Regulations. The plat shall be submitted within ninety (90) days from the date of approval by the Board of County Commissioners. This ground will remain in agriculture production. This landlord has a farm just west of my place across the road. His primary crops grown are pinto beans sugar beets, corn, alfalfa, and small grains. A contract has been signed but contingent upon planning & commissoners aprovel. This leaves me with a farm yard consisting of 3.40 Acres & my home labor house, machine shed & corrals. I would like to sell this yard and buildings to a young couple from Ft. Collins who Have wanted to . live in the country and ride there horses & bring up there family. I have signed a contract with them contingent upon a recorded exemption being approved by Planning & Commissoners. This couple both teach at C. S. U. in Ft, Collins, I know they will be good for the area and will be no public menace to the County. My personal reason for asking for the recored exemption is that Im losing my equity in my farm to poor agriculture prices plus large losses on livestock. I have a loan on my land and my farm operating line of credit & my carry over of principle & interest are going to mean a loss of my farm if I do not get this burden off of my back. I have lost my wife to death, I have a 6 year old dauther to raise & it has been very difficult to get house keeper & baby sitter at a nomenal fee plus not wanting to come to the country to work.
