RE: APPROVE LEASE OF PROPERTY TO THE WELD LIBRARY DISTRICT AND
AUTHORIZE CHAIR TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Lease between the County of Weld,
State of Colorado, by and through the Board of County Commissioners of Weld County, and
the Weld Library District, with terms and conditions being as stated in said lease for property
described as follows:
A tract of land being 60 feet by 24 feet and located in the southern
portion of Lot 1, Block 4, Maplewood Subdivision, Filing 1, Town
of Frederick, Colorado, according to the recorded plat thereof,
including the parking lot located immediately east of said library
building and the walkways leading thereto
WHEREAS, after review, the Board deems it advisable to approve said lease, a copy of
which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Lease between the County of Weld, State of Colorado, by and
through the Board of County Commissioners of Weld County, and the Weld Library District be,
and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said lease.

LEASE
I
THIS LEASE is made this /S4 day of ,Tu, , 2001, by and between the
COUNTY OF WELD, a political subdivision of the STATE OF COLORADO, by and through
the BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF WELD, whose address
is 915 10th Street, Greeley, CO 80631, the "Lessor," and the WELD LIBRARY DISTRICT, a
library district organized pursuant to the laws of the STATE OF COLORADO, whose address is
2227 23`d Avenue, the "Lessee."
WITNESSETH:
WHEREAS, the Lessee has petitioned the Lessor for the lease of sufficient ground for the
location of a library building on property described as follows: A tract of land being 60 feet by
24 feet and located in the southern portion of Lot 1, Block 4, Maplewood Subdivision Filing No.
1, Town of Frederick, Colorado, according to the recorded plat thereof, including the parking lot
located immediately east of said library building and the walkways leading thereto, hereinafter
referred to as "the Demised Premises," and
WHEREAS, said library building has recently been transferred to the Lessee, and
WHEREAS, said library building is currently located on the Demised Premises, and
WHEREAS, the Lessee has offered to lease the Demised Premises for the purpose of
continuing to locate the library building thereon, and
WHEREAS, in the opinion of the Lessor and Lessee, there is no other appropriate site for
said library building, and
WHEREAS, parties hereto have mutually agreed upon the rent, terms and conditions for
which the Demised Premises shall be leased for such purpose.
NOW THEREFORE, in consideration of mutual promises, covenants, agreements herein
contained and the payment of the rent of One Dollar($1.00) annually, the Lessor hereby leases
the Demised Premises unto the Lessee, to have and to hold from the date of signature hereunder
to and until the 31s` day of December, 2020, subject to the provision for earlier termination hereof
by the Lessor as stated below, at and for a rental described above.
It is mutually agreed and understood, as follows:
1. That the Lessee shall use the Demised Premises for the location of a library
building only.

2. That the Lessee shall perform all acts necessary to maintain the library building at
its sole expense, including, but not limited to, snow removal from the walks
and/or steps leading to the library building. Maintenance of the parking lot and
landscaping around the library building shall be performed by the Lessor at its
sole expense. Lessor shall, at its sole expense, pay the costs of all water used at
the library building.
3. That the Lessee shall protect and save Lessor harmless from any claims or
demands whatsoever by reason of any accidents which may occur upon the the
Demised Premises, and shall keep and maintain in full force and effect sufficient
liability insurance for this purpose wherein the Lessor and the Lessee are named
insureds.
4. That the Lessee may not assign this Lease or any of its interest herein.
5. That it is hereby agreed that this Lease may be renewed for successive twenty (20)
year terms without notice, subject, however, to the provisions for cancellation as
provided herein.
6. That after the first ten (10)years of the primary term of this Lease, and anytime
during subsequent renewal terms of this Lease, the Lessor may cancel the entire
Lease if it determines, in its sole discretion, that the Demised Premises is
necessary for use by the Weld County HeadStart Program. In that event, the
Lessor shall provide the Lessee with written notice of such cancellation at least
one (1)year prior to the anticipated cancellation date.
7. That in the event that Lessee determines not to use the Demised Premises for the
purpose of locating a library building thereon during the primary term of this
Lease or subsequent renewal terms of this Lease, the Lessor may then cancel the
entire Lease, and Lessee shall, upon such cancellation, return the Demised
Premises to the Lessor. In that event, the Lessor shall have a first right of refusal
to purchase the library building from the Lessee at its then appraised value.
Written notice of such determination by the Lessee not to use the Demised
Premises for the location of a library building shall be provided by the Lessee to
the Lessor no later than sixty (60) days prior to the anticipated date of cessation of
use.

attested to this 27 day of June , 2001.
