The Weld County Health Department has reviewed this proposal. We have also observed the site.
The application has satisfied PUD Ordinance No. 197 in regard to water and sewer service. Water will
be provided by the North Weld County Water District and sewer will be provided by individual sewage
disposal systems. The minimum proposed lot size of 1.3 acres is smaller that the current Department
policy. The Department would normally recommend primary and secondary absorption field envelopes
and language to protect and/or preserve the second envelope for future use. However, the Department
understands this is a replat of an existing PUD for lot line adjustment purposes and that homes exist on
Lots 16 and 17. Therefore, the Department would encourage the property owners to preserve a portion
of Lots 16 and 17 for placement of a secondary absorption field. Any proposed lot line shall'not separate
a septic system from the property is serves.
Prior to recording the amended Plat the Department requires:
1. Any existing septic system(s)which is not currently permitted through the Weld County Department
of Public Health & Environment, Environmental Health Services will require an I.S.D.S. Evaluation
prior to the issuance of the required septic permit(s). The review shall consist of observation of the
system and an evaluation of the systems ability to handle the p proposed hydrol'iic load. In the event
the system(s) is found to be inadequate, the system(s) must be brought into compliance with current
Individual Sewage Disposal System regulations.
2. Sketch of the septic system(s) layout in relation to the proposed lot line for Lots 16 and 17.
The Department recommends approval with the following conditions:
1. A Weld County Septic Permit is required for each proposed septic system and shall be installed
according to the Weld County Individual Sewage Disposal Regulations.
1. Each septic system shall be designed for site-specific conditions, including but not limited to
maximum seasonal high groundwater, poor soils, and shallow bedrock.
2. The "Right to Farm" covenant shall be recorded on the plat.

The Weld County Public Works Department has reviewed this re-plat request.
COMMENTS:
According to my records lot 16 was created in the second re-plat of Gilbaugh's Appaloosa acres. The only
possible access at that time was from either of the section line roadways. With this re-plat it would be
possible to access lot 16 from the internal roadway (Appy Road).
It is unclear why the full 50'right-of-way was not dedicated to Weld County on the previous maps. WCR 74
is designated as an arterial and will require 50' of right-of-way with a provision for turn lanes as needed.
RECOMMENDATION: Approval
DEVELOPMENT CONDITIONS (If Approved):
Lot 16 be required to close all existing access driveways on WCR 74 and WCR 41 and be provided an
internal access from Appy Road.
The remaining 10' of right-of-way along Lot 16 and an additional 10' reservation along lots 16 & 17 be
dedicated and granted to Weld County.

The only concern I have is setbacks from property lines. Depending on the use of the building a 20
foot distance may be needed. Buildings closer than allowed would require fire-resistive protection for
exterior walls and opening protection. (See Table 5-A of the 1997 Uniform Building Code.)
I would recommend a detailed plot plan showing distances to property lines and adjacent structures.
The use of the buildings should also be indicated.
