s - 8829 RESOLUTION RE: ACTION OF BOARD CONCERNING MOBILE HOME PERMIT, ZPMH #2239 - RONALD AND VIRGINIA RAINEY AND RANDALL DUNCAN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the request for Mobile Home Permit, ZPMH #2239, was submitted by Ronald and Virginia Rainey and Randall Duncan, 7172 Weld County Road 6, Brighton, Colorado 80601, for a mobile home to be used as a Temporary Accessory to the Farm on property which is located in part on the following described real estate, to-wit: Part of the NW1/4 of Section 29, Township 1 North, Range 67 West of the 6th P.M., Weld County, Colorado WHEREAS, after reviewing Department of Planning Services concerns and hearing the testimony presented, the Board determined that said request does not comply with Section 23-4-170 of the Weld County Code and shall be denied for the following reasons: 1. The mobile home would be occupied by persons not principally employed at or engaged in the operation of the use where the mobile home is located. 2. The mobile home is not necessary for the effective and economic operation of the use and/or protection of the agricultural use. 3. The mobile home would be used as an income source by the applicant for rental to persons who are not principally employed upon the lot. It is the opinion of the Department of Planning Services' staff that the applicant has not shown compliance with Section 23-4-170 of the Weld County Code. a. The mobile home is necessary for the effective and economic operation of the use and/or protection of the agricultural use. The Department of Planning Services has determined that there is not enough justification to warrant two mobile homes on the site for farm use. The parcel size is forty (40)acres with a horse facility, and appears to be dryland pasture, with no apparent crops, and is classified as irrigated land. According to Chapter 22 of the Weld County Code, (Comprehensive Plan), lots of less than 80 acres are not generally large enough to retain viable farming operations. The question as to whether or not a parcel of this size can house three dwelling structures is not under consideration. There are other options the applicant may seek to obtain this objective. The applicant has failed to establish just cause for the issuance of this structure. 2001-2419 Should the Board of County Commissioners approve this request,the Department of Planning Services'staff recommends the following conditions be attached: 1. The applicant shall apply for a building permit for the mobile home prior to locating the mobile home on the property. 2. Prior to the occupancy of the mobile home, the mobile home shall be connected to an approved sewage system and a legal water supply. 3. The mobile home shall not be occupied until such time that the applicant has complied with Conditions 1 and 2 stated above. 4. Effective December 1, 1999,Building Permits issued on the proposed lots will be required to adhere to the fee structure of the Southwest Weld Road Impact Program Area 3. (Chapter 20,Article II of the Weld County Code) 5. The mobile home will be occupied by persons principally employed at or principally engaged in the operation of the use where the mobile home is located. Accessory farm use of the mobile home shall be established and revalidated on an annual basis as follows: evidence shall be submitted by the applicant or property owner by the first of each year for review and acceptance by the Department of Planning Services verifying that the mobile home occupant is principally employed at or engaged in the farming operation on the subject property. The evidence shall consist of tax records,employment agreements or other documentation as determined suitable by the department of planning services. Failure to submit the required documentation may result in cessation of the allowance of the mobile home for temporary accessory farm use. 6. The mobile home will not be used as an income source by the applicant for rental to persons who are not principally employed upon the lot. 7. A Weld County Septic Permit is required for the proposed home septic system and shall be installed according to the Weld County Individual Sewage Disposal Regulations. 8. The applicant shall use the existing access to the property. No additional access shall be granted. 9. WCR 6 is designated on the Southwest Study Area Capital Improvement Needs as a collector status road, which requires an 80-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Code,Section 23-3-50,the required setback is measured from the future right-of- way line. 10. WCR 15 is designated on the Southwest Study Area Capital Improvement Needs as a paved rural road,which requires a 60-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Code, Section 23-3-50, the required setback is measured from the future right-of-way line. 11. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or become established as a result of the proposed development,the applicant/landowner shall be responsible for controlling the noxious weeds. 12. The applicant shall maintain compliance with Section 23-4-170 of the Weld County Code at all times. Our comments and requirements are as follows: COMMENTS: WCR 6 is designated on the Southwest Study Area Capital Improvement Needs as a collector status road,which requires an 80-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning Ordinance (Ordinance 89, as amended), the required setback is measured from the future right-of-way line. WCR 15 is designated on the Southwest Study Area Capital Improvement Needs as a paved rural road, which requires a 60-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning Ordinance (Ordinance 89, as amended), the required setback is measured from the future right-of-way line. On my site visit, I observed that there were two existing trailers, an abandon home, and the primary residence. The applicant is asking for an additional mobile home to be located in the southwest corner of the parcel. Employees are responsible for providing feed and water for the cattle and horses,for exercise and training of the horses, and for food and water for the dogs. Addition responsibilities are as follows: I. Irrigation of trees and grasses. 2 Repair of fences. 3. Construction of new fencing. 4. Repair to stalls. 5. Maintenance of equipment. 6. Planting of trees. It is necessary that the employees live on the property and be available 24 hours a day for care of the animals and security for the farm.
