COLORADO CASE: AmUSR-1199 NAME: Oliver, Katherine
Environmental Health Services has reviewed this proposal to amend out approximately 44.42 acres of a
gravel mining operation for fourteen residential lots. It appears that Western Mobile neglected to obtain a
septic permit for the septic system at the scale/office house for USR-1199. Once Western Mobile applies
for the septic system for the septic system which was already constructed, our Department will then
recommend approval.
Prior to recording the plat, the applicant shall:
1) Apply for a permit for the existing septic system for the scale/office that was installed
without a permit.
The following conditions are recommended to be part of any approval:
1) All liquid and solid wastes shall be stored and removed for final disposal in a manner
that protects against surface and groundwater contamination.
2) No permanent disposal of wastes shall be permitted at this site.
3) Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust,
blowing debris, and other potential nuisance condtions.
4) Fugitive dust shall be controlled on this site.
5) The maximum permissible noise level shall not exceed the industrial limit of 80 dB(A) as
measured according to 25-12-102, Colorado Revised Statutes.
6) The applicant shall remove, handle, and stockpile overburden, soil, sand and gravel from the
facility area in a manner that will prevent nuisance conditions.
7) The site shall operate in accordance with all applicable rules and regulations of the Water
Quality Control Division of the Colorado Department of Health.
8) The applicant shall submit any necessary air permit modifications or Air Pollution Emissions
Notices to the Air Pollution Control Division, Colorado Department of Public Health and
Environment. The site shall operate in accordance with all applicable rules and regulations of

9) The operator shall review the current dust abatement program and submit an updated plan for
approval to both the Weld County Department of Planning Services and the Weld County
Department of Public Health & Environment.
10) An individual sewage disposal system shall be utilized for any structure constructed on the
site in which people will be working, congregating, bathing, etc. Portable toilets may be
utilized on sites which are temporary locations of the crusher, etc. for up to six months at
each location.
11) A suitable supply of drinking water shall be provided for the employees.
12) The operation shall comply with all applicable rules and regulations of the Colorado Division
of Minerals and Geology.
13) The operation shall comply with the Mine Safety and Health Act(MSHA).
14) The operation shall comply with the Occupational Safety and Health Act (OSHA).

The Weld County Public Works Department has reviewed this PUD Final Plan request.
COMMENTS:
External Roadways: WCR 5.5 is designated a collector roadway in the MUD plan. Collectors require a minimum
80-foot right-of-way. Please label the right-of-way on the plat. It is my understanding that the right-of-way transfer
Was never recorded. If it has been recorded, please indicated the document number. If it has not been recorded,
• please revise the right-of-way dedication on this plat. Please include the typical section for WCR 5.5. One-half of
WCR 5.5 will be required for this development. Please revise the drainage and roadway plans. Please indicate
any tapers that may be required. Intersection sight distance triangles shall be shown on the plat. All landscaping
in the intersection sight distance triangles must be less than 3.5 feet high at maturity.
,Internal Roadways: The right-of-way for internal roadways must be dedicated to the County. Please label the
right-of-way on all streets. Stop signs and street name signs will be required at all intersections.
• Storm Water: The drainage study submitted did not address any of the issues left open at the change of zone.
A.review of the flood maps will be required. If a water surface elevation is not printed on the map, the engineer will
be required to calculate it.

Dear Ms. Best-Johnson:
At your request we have reviewed this application and made a field inspection of the site.
In addition to the information you sent us with this application we have consulted
available geological and topographic maps and the U.S. Geological Survey Map I-855-E
showing generalized flood-prone areas of the Front Range Urban Corridor. In addition,
we retrieved and perused the 1995 Rezoning Application from State Archives for the
Meadow Vale Farms, Inc, that we reviewed at that time.
In general, this seems to be a very acceptable site and it fits will with other filings of the
Meadow Vale Farms Subdivision. However, we have some comments that will need
attention as this tract moves through the subdivision process.
1) It is inferred that the 14 lots described as"Filing 3" of the Meadow Vale Farms PUD
will be served by municipal-type water and sewage service. This avoids several
problems, but the lower lying reclaimed sites will have shallow water table
conditions. This could be a problem with water and sewer mains and basements
construction feasibility. Additional fill might be needed to allow the proposed
development.
2) The land intended for residential sites has been reclaimed from a flood plain of St.
Vrain Creek. A formal flood plain study is needed to delineate the 100-yr. Flood Plain
with the new reclaimed surface topography of the proposed residential "Filing3." It is
possible that additional fill will be needed to provide viable building sites on some
lots. This and the administrative need to have the lots legally removed from the 100-
yr. Flood Plain is discussed in a letter from Rocky Mountain Consultants to Mr. Floyd
Oliver dated Jan. 23, 1995.

3) Foundation soils of the site includes miscellaneous backfill that will have various
properties and degrees of compaction. It is recommended that each site have a site
specific foundation study to address foundation and other geotechnical aspects of the
site. Mr. John White of the CGS discussed the general geological and soils conditions
of the adjacent filings of Meadow Vale Farms PUD in reviewing the Rezoning
Application on August 11, 1995. His letter outlines the rationale and need for site
specific geotechnical investigations and recommendations (Copy Attached).

RE: Meadow Vale Farms, Inc. Change of Zone from Agricultural to Planned Unit
Development. Case No. S-386.
Dear Mr. Hodges,
At your request and in accordance with S 8. 35 (1972) this office has reviewed the materials
submitted for the above proposed PUD and conducted a site inspection of the property on August
9, 1995. The property is bound by State Highway 119 to the south and Weld County Road 5 5 to
the east. Current usage of the land is irrigated farmland. Topographically the site occupies the
northwestern bluff of the Saint Vrain Creek Valley. There are minor swales that dissect the bluff chat
drain towards Saint Vr ain Creek. The bottoms of the swales show vegetation changes that indicate
wetlands. These wetlands are marked on the plat, the majority of which have been Icit as open space.
Geologically the site lies on the upper transition member of the Pierre Shale This member
is characterized by thinly interbedded sandstones, siltstones, and claystones. One can expect bedrock
to lie relatively close to the surface, especially near and on the bluff. Soils on the slopes are residual
in nature with the soils on the flatter portions of the property, above the bluff, derived from earlier
eolian (windblown) sediments deposited on bedrock and thin colluvial soils.
The potential hazards that can be expected at this site are hydrocompactive soils, swelling
sods and bedrock. and perched water tables. Eolian deposits can have low densities and strength and
have the ability to compact when wetted. While the history of irrigation on this land has helped if not
completely mitigated shrinking soils, pockets of hydrocompactive soils may exists Shallow bedrock
will probably result in some homes being founded on formational substrate. The site has been
mapped as having moderate to high swelling potential for soils and bedrock Appropriate careful
engineering design can mitigate the hazards listed above.

A comprehensive geotechnical investigation was not submitted to this office, only a soils
review report. The developer will be required to commission a detailed preliminary geotechnical
investigation that includes borings and soil testing. Further investigations will be warranted on a site
specific nature to ensure properly engineered home foundations. Care will be needed in landscaping
to prevent standing water near homes and the introduction of additional moisture to beating bedrock
or soils below foundations. Be aware that foundations partially on bedrock and partially on soil can
be susceptible to differential movement and are generally not recommended. In some areas of this
site, especially on the slopes, such conditions may occur. For those homes on the slopes seepage may
occur from permeable formational sources that may require perimeter drains for foundations and
basements. Perched water levels also in soils may impact home foundation design and construction
near and downgadient of the proposed irrigation storage pond and those lots that lie within or near
the drainage swales.
As stated earlier the potential geologic hazards mentioned can be mitigated with careful
engineering practices. Provided the developer is attentive to the observations and recommendations
listed this office finds no geologic concern that, of itself, would prevent this PUD as planned. [f you

Meadow Vale Farm
Dear Mr. Oliver:
Per your request. Rocky Mountain Consultants, Inc. has reviewed the 100 year floodplain
elevations for Saint Vrain Creek as it crosses the proposed Meadow Vale Farm site. This site is
located at the northwest corner of State Highway 1.19 and Weld County Road No. 7, Saint Vrain
Creek flows from the south to the north through the site. The proposed development on the east
side of the site will consist of a reclaimed gravel mine with lakes and open space, while
development on the west side will consist of roads and infrastructure for approximately 108
single family residential lots.
A ,e"iew of the Federal y Manage ,.ent Agency (FEMAJ 100 year floodplain mapping
in this area shows that the west edge of the floodplain runs along the east side of Weld County
3 u ^d uif! = !ca; ,t ct ?--11n3: town on your master- plan. The elevation of
the 100 year floodplain on the site varies from elevation 4852 as it crosses State Highway 119 on
the south to elevation 4843 at the north property line of the site This means each of the 12 lots
in the floodplain will need to be graded and filled to a minimum elevation I. foot above the 100
year flood elevation (elevations 4853 to 4849) to be taken out of the 100 year floodplain.
A Conditional Lester of Map Revision (CLOMR) should be obtained from FEMA prior to the
site grading being done. A Letter of Map Revision (LOMB) will also need to be obtained from
FEMA after the construction to legally remove the lots from the 100 year floodplain.

Dear Anne:
Thank you for referring the Ham Pit Ammendment Plan to the School District. The projected student impact upon the St.
Vrain Valley School District of what appears to be the possibilty of 14 new single family units on 44.42 acres is a total of
9 students. Any students living in this subdivision would attend Mead Elementary School, Mead Middle, and Skyline High
School under the present school boundaries. However, due to potential growth in these schools this development and
other existing developments in this feeder could be placed in another attendance area in the future. Bus transportation
would most likely be required of the District.

The District is on record as not opposing growth so long as the growth is planned and is manageable from a student
enrollment standpoint. This development would impact all levels of schools in the current attendance area. While there
are new schools planned in this area which should reduce overcrowding, there are other approved developments which
would, together with this proposal, have a significant cumulative impact on these schools.
As the volume of developments increases in this attendance area with no alleviation of the existing overcrowded
conditions, the ability to provide the same quality education for these new students that is provided students in other
areas becomes increasingly difficult. Therefore, the District would oppose this land use amendment because it would
add to the enrollment of an already overcrowded school. Should this proposal be considered for approval, the District
would request the cooperation and participation of the developer and County in working towards mitigating the impacts
on the schools. This mitigation would include the calculation and payment of an appropriate cash in-lieu of land
dedication fee to address the capacity concerns and the need for future school sites prior to recording the plat (per the
attached chart). Please let me know if you have any further questions.
