The State Highway Department has stated they have no objections to the request providing the applicant pave U. S . 85 frontage road leading from the intersection of Weld County Road 48 and Highway 85 . In view of the permanent nature of the frontage road access , the Planning Commission feels that this is a reasonable request and has incorporated this request into Development Standard #6. 5. The Town of LaSalle has stated they have no objections to the request providing the comments in their letter dated January 23 , 1980, are incorporated into the attached Development Standards. With regard to the recommended change to Development Standard #9, the Planning Commission feels (based on the comments of the Weld County Engineering Department) that the current form of the development standards would provide sufficient protection for the Town of LaSalle. The Planning Commission recommendation for approval is conditional upon the following: 1 . The attached Development Standards being recommended and adopted for the Unit Development .area. 2. No building or electrical permits shall be issued on the Unit Development area until the Development Standards for the Unit Development have been placed on the amended Unit Development plat and said plat has been delivered to the office of the Department of Planning Services. 11 i f Mil 1 T I NM 1 • H S S CON_^'ERCIAL UNIT DEVELOPI<ENT STANDARDS 1 . PERMITTED USES: The uses permitted on the herein described property within this Commercial Unit Development shall be those uses described in the Commercial Zone District in the Weld County Zoning Resolution adopted by the Weld County Board of County Commissioners. A The proposed uses will not produce effects such as industrial e noise, smoke, vibration, odor , fumes, radiation, and other environmental impacts which will be readily observable with the natural senses at or beyond the property line of the Planned Unit Development area. 2 . INTERIM LAND USE: Agricultural production will be permitted. If agricultural production is not pursued on all or any portion of the PUD area, all or any portion of the PUD area not in agricultural production shall be maintained in a manner so as to prevent fugitive dust, erosion, growth of noxious weeds, and non-ornamental ground cover shall not exceed 12 inches in height. 3. PARKING: Parking is to be provided as off-street parking. Specific parking plans shall be submitted for review and approval by the Board of County Commissioners . The following standards shall -generally apply: Banks and Offices 1 space for each 300 square feet of gross floor area Retail Sales and Service 1 space for each 200 square feet of gross floor area Wholesale Sales and Service 1 space for each 600 square feet of gross floor area Manufacturing and Industrial 1 space for each 2 employees determined on the basis of the greatest number of persons -- --employed at any one period of time, `and 1 additional space for each company vehicle based at the location Where a use is not defined above or the standards are insufficient for a given use, the specific standard will be established by the Board of County Commissioners prior to issuance of any building permits. 11 FT Ill ] CUl Him- • ' 4 . LANDSCAPING: A minimum of 10% of each lot shall be maintained as landscaped area, and a minimum of 5 feet adjacent to the public right of way shall be landscaped. 5. SIGNS : The installation of signs shall conform to the specifications and requirements of the Weld County Zoning Resolution. Applicable permits shall be obtained prior to installation. 6. ACCESS : Access to the area within the subdivision shall be from the state highway frontage road located between U.S. 85 and the eastern boundary of the property. The access shall feed onto the internal subdivision road which stall terminate in a cul-de-sac. At such time as the Town of LaSalle extends and constructs the proposed public road on the west side of the subdivision, those subdivision lots which are -contiguous to the road shall have one access per lot off of and onto said road, as well as to and from the internal subdivision road. _.'he developer shall be responsible for paving the U. S. Highway B5 front road to -extend from the existing pavement between the intersection of Weld County Road 48 and U.S. Highway 85 to the internal _subdivision road. 7 . FIRE PROTECTION MEASURES : Fire protection measures shall conform to the requirements of the LaSalle Fire Protection District which shall be determined in the site plan review prior to the issuance of any building permits . Water availability must also be adequate to meet the requirements of the Fire Protection District. 8. EXTERIOR LIGHTING: Exterior lighting must be maintained for security purposes provided it does not obscure the vision of highway traffic or create -a nuisance for adjacent properties . 9. INTERNAL ROAD DEVELOPMENT: Internal roadways , as set out in the plat of the H S S Commercial Unit Development shall be installed and constructed with "roll-over" curb and glitter throughout the project. As I stated in a memo dated September 12, 1979, "The developer will be requited to bond 100% of the required improvements. That bond will not be released until the improvements are wcvlete and accepted by Weld County." Paving will be a part of those improvements. Section 11-2, Improvements Guarantee, of the Suhivision Regulations addresses this matter. I would also advise that annexation or occupancy not establish the schedule for paving.
