Recorded exemption RE-3108 is located south of and adjacent to weld county road 4 and about
1/4 mile east of weld county road 59. The parcel is about 5 miles east of galeton. T e property
is owned by stephen and Joann cecil.
The applicants are requesting an exemption to create a 6 acre parcel and a 74 acre p cel. The
property is designated"prime if irrigated" according to the USDA soil conservation ervice map

RE: APPROVAL OF RECORDED EXEMPTION #3108 - STEPHEN AND JOANN CECIL
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its authority under
Section 30-28-101(10)(d), C.R.S., did determine at a public meeting held in the Chambers of
the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat
known as Recorded Exemption #3108, does not come within the purview of the definition of the
terms, "subdivision" and "subdivided land," and
WHEREAS, the request for Recorded Exemption #3108 was submitted by Stephen and
Joann Cecil, 37577 Weld County Road 57, Eaton, Colorado 80615, for property which is
located in part on the following described real estate, to-wit:

WHEREAS, this request is to divide the property into parcels estimated to be

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is,
exempt from the definition of the terms, "subdivision" and "subdivided land."
BE IT FURTHER RESOLVED by the Board that Recorded Exemption #3108 by

3. Prior to recording the plat:
A. The plat shall be titled: Recorded Exemption No. 0801-1-2 RE-3108
B. In accordance with Chapter 8, Article II, of the Weld County Code, Lots A
and B shall be granted one residential access. Direct access from a
public road shall be limited to one access per legal parcel for residential
use, no circle drives or additional accesses shall be granted. The road
shall be graded and drained to provide all-weather access. Accesses
shall be placed in such a location as to have adequate sight distance in
both directions, shall not be placed below the crest of a hill or where
physical obstructions are present, and shall be a minimum distance of 75
feet from any intersecting County or State roadway.
C. Lot B shall use the existing agricultural accesses necessary for
agricultural operations as no additional accesses shall be granted.
D. All approved accesses shall be clearly shown on the plat. The applicant
shall contact the Weld County Department of Public Works to determine
if a culvert is necessary at any approved road access. If a drainage
culvert is required, a 15-inch Corrugated Metal Pipe (CMP) is Weld
County's minimum size. If the applicant chooses to place a larger culvert,
contact the Weld County Department of Public Works to adequately size
the culvert.
E. Weld County Road 74 is designated on the Weld County Transportation
Plan Map as a paved road, which requires 60 feet of right-of-way at full
build out. There is presently 60 feet of right-of-way. A total of 30 feet from
the centerline of Weld County Road 74 shall be delineated right-of-way
on the plat. This road is maintained by Weld County.
F. The applicant shall provide the Weld County Department of Planning
Services with a certificate from the Weld County Treasurer showing no
delinquent taxes exist for the original parcel.
G. The following notes shall be placed on the plat:
1) All proposed or existing structures will meet the minimum setback
and offset requirements for the Zone District in which the property
is located. Pursuant to the definition of setback in the Weld
County Code, the required setback is measured from the future
right-of-way line. No building or structure as defined and limited
to those occupancies listed as Groups A, B, E, H, I, M, and R in
Table 3-A of the 1997 Uniform Building Code, shall be
constructed within a 200-foot radius of any tank battery or within a
150-foot radius of any wellhead. Any construction within a

is requested with the building permit applications. The legal
description on such deed shall include the Lot designation and
Recorded Exemption number.
4) Prior to the release of building permits, the applicant shall submit
evidence to the Department of Planning Services that the Lot has
an adequate water supply of sufficient quality, quantity and
dependability.
5) Potential purchasers should be aware that Lot A may not be
eligible for a domestic well permit which allows for outside
irrigation and/or the watering of stock animals. The State Division
of Water Resources issues all well permits.
6) Potential purchasers should be aware that groundwater may not
meet all drinking water standards as defined by the Colorado
Department of Public Health and Environment. The Weld County
Department of Public Health and Environment strongly

3,600 square feet, the applicant must comply with the

10) Weld County's Right To Farm statement, as it appears in the

The Department of Planning Services'staff has reviewed this request and recommends that this request be denied
for the following reasons:
1. It is the opinion of the Department of Planning Services'staff that the applicant has not shown compliance with the
following criteria as listed in Section 24-8-40.B.1 through 24-8-40.6.6 of the Weld County Code:
A. Section 24-8-40.B.3-Consistency with the intent of the zone district the recorded exemption is located within
as expressed in Chapter 23 of the Weld County Code.
Section 23-3-10 of the Weld County Code states"Agriculture in the county is a valuable resource which must
be protected from adverse impacts resulting from uncontrolled and undirected business, industrial and
residential land uses. The A(Agricultural) District is established to maintain and promote agriculture as an
essential feature of the county. The A(Agricultural) District is intended to provide areas for the conduct of
agricultural activities and activities related to agriculture and agricultural production without the interference
of other, incompatible land uses."
This recorded exemption is proposed on"prime if irrigated"agricultural land as delineated on the 1979 USDA
Soil Conservation Service Map. The majority of the parcel is located within an existing irrigation half circle.
The applicant also owns land to the west that is within the same irrigation half circle. Approval of this recorded
exemption would separate this 80 acre parcel from the remainder of the land within the existing irrigation half
circle and would allow the parcels to be sold off separately from the adjacent irrigated land. This would reduce
the viability of these parcels for agricultural production.
B. Section 24-8-40.6.4 - Consistency with the purpose of efficient and orderly development as expressed in
Section 24-1-30 of the Weld County Code.
1) Section 24-1-30...1-Preserving agricultural land and promoting its most productive agrarian use.
The applicants parcel is currently designated as"prime if irrigated"according to the 1979 USDA Soil
Conservation Service Map with a pivot sprinkler located on a portion of the property. The applicant was
approved for a recorded exemption adjacent to this request in 1995, RE-1793. The pivot in question
covers a portion of RE-1793 as well as the current request. Staff offered to the applicant to amend RE-
1793 and include this 80 acre piece. The result would be a 3 lot recorded exemption with the large
parcel containing the entire pivot. The 6 acre parcel would still be created as a legal, buildable site.
By amending RE-1793 the prime farm ground which is covered by the pivot would be preserved.
Should the Board of County Commissioners approve this request, the Department of Planning Services' staff
recommends the following conditions be attached:.

10) WELD COUNTY'S RIGHT TO FARM Weld County is one of the most productive agricultural
counties in the United States, ranking fifth in total market value of agricultural products sold. The
rural areas of Weld County may be open and spacious, but they are intensively used for agriculture.
Persons moving into a rural area must recognize and accept there are drawbacks,including conflicts
with longstanding agricultural practices and a lower level of services than in town. Along with the
drawbacks come the incentives which attract urban dwellers to relocate to rural area: open views,
spaciousness, wildlife, lack of city noise and congestion, and the rural atmosphere and way of life.
Without neighboring farms,those features which attract urban dwellers to rural Weld County would
quickly be gone forever.
Agricultural users of the land should not be expected to change their long-established agricultural
practices to accommodate the intrusions of urban users into a rural area. Well run agricultural
activities will generate off-site impacts, including noise from tractors and equipment; slow-moving
farm vehicles on rural roads;dust from animal pens,field work,harvest,and gravel roads;odor from
animal confinement, silage, and manure; smoke from ditch burning; flies and mosquitoes; and the
use of pesticides and fertilizers in the fields, including the use of aerial spraying. Ditches and
reservoirs cannot simply be moved out of the way of residential development without threatening the
efficient delivery of irrigation to fields which is essential to farm production.
Section 35-3.5-102,C. R.S., provides that an agricultural operation shall not be found to be a public
or private nuisance if the agricultural operation alleged to be a nuisance employs methods or
practices that are commonly or reasonably associated with agricultural production.
Weld County covers a land area of over4,000 square miles in size(twice the State of Delaware)with
more than 3,700 miles of state and county roads outside of municipalities. The sheer magnitude of
the area to be served stretches available resources. Law enforcement is based on responses to
complaints more than on patrols of the county and the distances which must be traveled may delay
all emergency responses,including law enforcement,ambulance,and fire. Fire protection is usually
provided by volunteers who must leave their jobs and families to respond to emergencies. County
gravel roads, no matter how often they are bladed, will not provide the same kind of surface
expected from a paved road. Snow removal priorities mean that roads from subdivisions to arterials
may not be cleared for several days after a major snowstorm. Snow removal for roads within
subdivisions are of the lowest priority for public works or may be the private responsibility of the
homeowners. Services in rural areas, in many cases,will not be equivalent to municipal services.
Rural dwellers must, by necessity, be more self-sufficient that urban dwellers.
Children are exposed to different hazards in the county than in an urban or suburban setting. Farm
equipment and oil field equipment, ponds and irrigation ditches, electrical power for pumps and
center pivot operations, high speed traffic, sand burs, puncture vines, territorial farm dogs, and
livestock present real threats to children. Controlling children's activities is important, not only for
their safety, but also for the protection of the farmer's livelihood. Parents are responsible for their
children.

1)a) Domestic Use: The smaller parcel by letter from water district will be capable of
having a NCWCD tap. The larger parcel will be large enough to apply for either a
domestic well permit or water tap if needed.
b) Irrigation Water: The smaller parcel is currently non-irrigated dry land corner and
will remain a non-irrigated site. The larger parcel is predominantly sprinkler
irrigated and will remain so to conserve water and maintain farm productivity.
2) The proposed smaller parcel has no existing improvements. The larger parcel has
no existing residences and therefore also no septic systems. Each parcel will have
adequate size and soil type to support a septic system as required by the Weld
County Health Department.
3) The property is currently being operated as a sprinkler irrigated farm with no
improvements. The existing property consists of a total of 80 acres of non-prime
farmland as defined by the Weld County Comprehensive Plan. The proposed
smaller parcel is to be approximately 6 acres dry-land corner and the larger parcel as
proposed will remain approximately 74 acres of sprinkler irrigated land.
4) The owner/applicant desires the legal splitting of this land to best utilize the
property's highest and best use and desires to build a new house on the small parcel.
This will allow the property to be split into two lots of approximately 6.0 acres and 74
acres, to best utilize the property's highest and best uses for both a rural home-site
and sprinkler irrigated farmland.
5) The subject parcels are located east of Galeton, on rural WCR 74 approximately .3
miles east of the intersection of WCR 74 and WCR 59. The smaller parcel will be
approximately 6 acres, while the larger parcel approximately 74 acres. The area in
which the new parcels will be created consists of a combination of irrigated farms
with some dry land farms, from 80-160 acres, with some scattered small rural
residential 5-10 acre tracts.
6) There are no other unique physical characteristics on the site that need to be
addressed.
7) There are no existing improvements located on either proposed lot. Any future
improvements on either lot would require that all future setback requirements be met
when or if any building permits are applied for.
8) Because of time constraints and potential financial consequences,the owner does not
wish to pursue a conservation easement at this time.
9) A building envelope will be designated on the larger parcel in an area that would not
interfere with the proposed sprinkler for irrigation. The smaller parcel will not take
any prime agricultural land out of production.
10)The proposed partitioning of this property is consistent with the Weld County
Comprehensive plan and will not detract from its long-range goals or any other
intergovernmental agreements.
11) The proposed uses of all parcels will be compatible with existing surrounding land
uses. The larger parcel will continue to be used as sprinkler irrigated farmland and
the smaller lot will be a rural residential home site.
12) The proposed partitioning of the property is consistent with the intent of the
agricultural district as expressed in the amended Weld County Zoning Ordinance, and
the Weld County Comprehensive Plan. All parcels will remain zoned agriculture and
will allow utilization of each parcel's highest and best use.
13) The proposed partitioning of the property is consistent with efficient and orderly
development as defined in the Weld County Subdivision Ordinance, Section 1.3. It
will not create any known hazards or environmental problems to the community.

The Weld County Public Works Department has reviewed this proposal. This project falls primarily underihe Weld
County Recorded Exemption Standards. Our comments and requirements are as follows:
COMMENTS:
WCR 74 is designated on the Transportation Plan Map as a paved road, which requires a 60-foot right-of-way at
full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the
definition of SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-3-50, the required setback
is measured from the future right-of-way line.
WCR 59 is designated on the Transportation Plan Map as a local gravel road,which requires a 60-foot right-of-way
at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to
the definition of SETBACK in the Weld County Code, Chapter 23,Article III, Section 23-3-50,the required setback
is measured from the future right-of-way line.
REQUIREMENTS:
The Weld County Public Works Department recommends approval of this application.
The access shall be placed in such a location to have adequate sight distance in both directions and not below
the crest of a hill or where physical obstructions are present. (Lot A)
If a drainage culvert is required, a 15-inch corrugated metal pipe is the County's minimum size requirement. If the
applicant chooses to place a larger culvert, please contact the Public Works Department to adequately size your
culvert. (Lot A)
Direct access from a public road shall be limited; only one access is allowed per legal residential parcel. No circle
drives will be allowed. In accordance with Chapter 8, Article II of the Weld County Code, this policy shall apply
to all new and existing accesses within the unincorporated areas of Weld County. Properties within municipalities
or other counties that access Weld County roads are also subject to this policy. (Lot A)
Utilize the existing agricultural, oil and gas, and ditch roads that are necessary for your agricultural operation. No
additional accesses shall be granted. (Lot B)
Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or
become established as a result of the proposed development, the applicant/landowner shall be responsible for
controlling the noxious weeds.

Environmental Health Services has reviewed this proposal; the following conditions are
recommended to be part of any approval:
1. A Weld County Septic Permit is required for the proposed home septic systems
and shall be installed according to the Weld County Individual Sewage Disposal
Regulations.
2. Prior to the release of building permits on lots A and B, the lot owners shall verify
with the nearest Town/City or Sanitation District to determine the location of the
nearest sewer line. In accordance with the Weld County Code, if a sewer line
exists within 400 feet of the property and the sewer provider is willing to serve
the proposed structure, a septic permit cannot be granted by the Weld County
Department of Public Health and Environment.
Additionally, please note the following:
1) This application is proposing wells as its source of water. The applicant should
be made aware that while they may be able to obtain a well permit from the
Office of the State Engineer, Division of Water Resources, the quantity of water
available for usage may be limited to specific uses, i.e. domestic use only, etc.
Also, the applicant should be made aware that groundwater may not meet all
drinking water standards as defined by the Colorado Department of Public
Health and Environment. We strongly encourage the applicant to test their
drinking water prior to consumption and periodically test it over time.

This letter is in response to your inquiry regarding water service to the following described property,
Approximately 29250 WCR 74, in a portion of the
E 'h of the NW '/<of Section 1,T6N,R64W of the 6'h Prime Meridian
1. Water service is presently being provided to the above described property.
2. North Weld County Water District is able and intends to provide water service to the above mentioned property,
provided all requirements of the District are satisfied. Before a water tap may be purchased, the applicant must
provide a copy of a Warranty Deed,a Physical Address and this letter. The applicant should also bring a copy of a
surveyed plat of the property(required for a recorded exemption).
If contracts have not been completed with North Weld County Water District within one year from the date of this
letter,this letter shall become null and void. The Tap Fees quoted below,shall be valid for ten(10)business days from
the date the applicant receives this letter. After ten days,the costs will be subject to the current cost established by the
District. The applicant can avoid the Raw Water portion of the Tap Fee, by permanently transferring one unit of
Colorado Big Thompson(CBT)Water to the District.
TAP FEES INSTALLATION COST ESTIMATE
Raw Water for an Acre-Foot Unit (MU) $10,000 Meter Set $500
Base Portion of Plant Investment Fee $5,000 Line Extension $7,920
Distance Portion of Plant Investment Fee $5,000
TOTAL Up-Front COSTS $28,420
After the water tap has been purchased(Raw Water AFU&Plant Investment Fee)the applicant has one year in which
to have the meter set. The District requires 45 days prior notice to setting a meter. If the meter has not been set within
one year from the purchase of such meter,the District shall refund the applicant 75% of the purchase price that was
paid by the applicant. If any line extensions,road bores or additional installation costs are estimated to be more than
$5,000,then Proof that"Loan Funds or a Line of Credit"are Available and ready to reimburse the District at the time
of completion, for 100%of the estimated cost. The applicant will pay such costs before the tap is activated(water is
turned on).
Water tap/service shall be placed on the physical property, defined by a legal description. In case of a Recorded
Exemption,the water tap shall only serve the parcel that the water tap is located on. Service shall NOT cross the legal
description of one parcel to serve the other parcel.
The District recommends that anticipated water usage be purchased through the District. The District guarantees
treatment and delivery of water purchased. All rental water and water that is delivered with surcharge is subject to
water availability and will be issued on a first come-first serve basis and is not guaranteed to be available. From
the information contained in the Water Consumption Survey the District requires that 1 Acre-Foot Unit (AFU) is
purchased. With 1 AFU purchased any usage beyond 228,000 gallons will be in surcharge.
The Plant Investment Fee shown above pays for the infrastructure required to deliver 1 AFU (228,000 gallons). If
usage exceeds the number of Plant Investments that were purchased, an additional surcharge will be applied to
your account. Plant Investments may be purchased to increase the amount of water to be delivered and avoid the
surcharge.
