HomeMy WebLinkAbout20010073.tiff RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST RICHARD AND DANIELLE STROUD FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Richard and Danielle Stroud, VI #0000227, are allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 9th day of January, 2001, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Richard and Danielle Stroud were not present or represented at said hearing, although all parties were notified of said hearing by Department of Planning Services staff, and WHEREAS, the Board deems it advisable to bring legal action against those individuals as hereinabove named to correct said violation. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Weld County Attorney be, and hereby is, authorized to proceed with legal action against Richard and Danielle Stroud to remedy the violation of the Weld County Code, and any other persons occupying the properties, any persons claiming an interest in the properties, and any persons acting in active concert with the identified parties. 2001-0073 PL0824 pc . December 11, 2000 Site inspection by Adolph Diaz , contact was made with Danielle at approximately 2 :30 pm to confirm hearing schedule on December 12, 2000. Mrs Stroud acknowledged having received the forgoing Resolution dated November 14, 2000 . Mrs Stroud said she would attend this hearing. I gave her 2001-0073 Directions and my phone number. The is a violation of Section 83 of the Weld County Building Ordinance and Sections 31.2 .1, 31.2 .2, 31.3 .6 and 43 .1.1 of the Weld County Zoning Ordinance. To close this violation, appropriate building and zoning permits must be obtained.
