RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH
LEGAL ACTION AGAINST RICHARD AND DANIELLE STROUD FOR VIOLATION OF
THE WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Richard and Danielle Stroud, VI #0000227, are allegedly in violation of the
Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 9th day of January, 2001, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation,
and
WHEREAS, Richard and Danielle Stroud were not present or represented at said
hearing, although all parties were notified of said hearing by Department of Planning Services
staff, and
WHEREAS, the Board deems it advisable to bring legal action against those individuals
as hereinabove named to correct said violation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Weld County Attorney be, and hereby is, authorized to
proceed with legal action against Richard and Danielle Stroud to remedy the violation of the
Weld County Code, and any other persons occupying the properties, any persons claiming an
interest in the properties, and any persons acting in active concert with the identified parties.

August 10, 2000 Received a letter from a neighbor complaining that the roof
had partially blown off.
August 10, 2000 Ten day letter sent.
August 22, 2000 30-day violation letter sent.
November 3, 2000 Violation hearing letter sent .
November 14, 2000 Public Hearing, Board of County Commissioners deems
- advisable to continue to continue said violation to December
12, 2000 .
November 27, 2000 Certified hearing letter notice return unclaimed after the
first and second notice attempts by post office.
Phone calls
and contacts : Numerous phone calls and contacts from May 19, 1998 Through
December 11, 2000 .
December 11, 2000 Site inspection by Adolph Diaz , contact was made with
Danielle at approximately 2 :30 pm to confirm hearing
schedule on December 12, 2000. Mrs Stroud acknowledged having
received the forgoing Resolution dated November 14, 2000 .
Mrs Stroud said she would attend this hearing. I gave her

The is a violation of Section 83 of the Weld County Building Ordinance and
Sections 31.2 .1, 31.2 .2, 31.3 .6 and 43 .1.1 of the Weld County Zoning Ordinance.
To close this violation, appropriate building and zoning permits must be
obtained.
The Department of Planning also recommends that the County Attorney authorize
legal action against any other persons occupying the properties, any persons
claiming an interest in the properties, and any persons acting in active concert
with the identified parties.

Dear Mr. & Mrs. Stroud:
The property located at 18556 Fox Haven Ct remains in violation of the Weld County Building Code Ordinance.
Your property is in violation of Section 83 of the Weld County Building Ordinance. I have scheduled a meeting with
the Board of County Commissioners on November 14, 2000 at 10:00 a.m.,to consider the violations occurring on
the property. This meeting will take place in the County Commissioners' Hearing Room, first floor, Weld County
Centennial Center, 915 Tenth Street, Greeley, Colorado. It is recommended that you and/or a representative be in
attendance to answer any questions the Board of Commissioners might have concerned this violation. This hearing
would give you an opportunity to explain all issues regarding this violation. By making contact with me prior to this
hearing to acknowledge your willingness to comply with this matter,we will not proceed with the hearing. If no
contact is made, we will proceed with the hearing.
The Department of Planning Services'staff will be recommending the Board of County Commissioners authorize the
County Attorney to proceed with legal action to remedy the violation if you and/or a representative are not available.
Our records indicate that you were made aware of the nature of this violation, the action necessary to correct the
violation, and that you were given sufficient time to remedy the violation. If you have any question concerning the

The building official has determined that the property located at 18556 Foxhaven Ct is in violation of
Section 83 of the Weld County Building Ordinance, which requires all inspections to be inspected within
180 days from the date of issue or within 180 days from the last approved inspection. A final approval
must be completed within 180 days after the permit is issued. At this time, we kindly ask that you call in
for the final inspections if the work is completed on the 300sf Wood Frame 4 Stall Barn.
It is not necessary for you to contact me personally to schedule the inspection(s) when ready. Our 24
hour inspection request line number is 356-8016 or 1-800-234-2534 if the phone number is long distance.
If you call before 4:00 P. M., you may schedule the inspection(s) for the next working day. Please make
reference to your name, building permit number and the inspection(s) desired. Inspections needed are
Footing/Caissons.Framing &Final Approval.
It is the intention of this office to assist and cooperate with you without imposing undue hardships;
however, we have no discretion in this matter. If you fail to correct this violation by September 21, 2000,
it will be scheduled for a hearing before the Board of County Commissioners to consider whether to refer
this violation to the County Attorney's office for legal action.
Any information you have that may help to resolve this matter will be helpful. This office is ready to be
of any assistance in clarifying or answering questions concerning this matter. Please call or write the

I am writing this letter in reference to building permit BC-9600942 that has been issued to you. Our
records indicate that there has not been any work activity within the last 180 days since your last
inspection. This is a friendly reminder that all permits issued by the building official under the
provisions of Section 83 of the Building Code Ordinance, are required to be have regular inspections
conducted within 180 days of issue or from the time of your last inspection. Your building permit has
exceeded the time period allowed and if not completed in a timely manner, a violation will be issued for
this permit, in which it may be scheduled for a hearing with the Board of County Commissioners, and if
necessary,referred to the County Attorney's Office to proceed with legal action. We encourage you to
complete all necessary inspections or contact our office with a status of completion on your building
permit before August 20, 2000 to avoid receiving a violation. We also ask that you please call us
regarding any difficulties you may encounter with completing all necessary inspections.
