RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH
LEGAL ACTION AGAINST JULIAN GOMEZ AND JOSE AND FRANCES AQUIRRE
FOR VIOLATION OF THE WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Julian Gomez and Jose and Frances Aguirre, VI #0100003, are allegedly in
violation of the Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 10th day of July, 2001, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Jose and Frances Aguirre, property owners, were present at said hearing,
and represented by George Baxter, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said
violation to the Weld County Attorney's Office for legal action, with an instruction for delay of
action upon such referral until September 11, 2001, to allow adequate time for the property
owners to bring the subject property into compliance and for an inspection of the property by
the Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that VI #0100003 be, and hereby is, referred to the Weld County
Attorney's Office for legal action against Julian Gomez and Jose and Frances Aguirre to
remedy the violation of the Weld County Code, and any other persons occupying the properties,
any persons claiming an interest in the properties, and any persons acting in active concert
with the identified parties, with an instruction for delay of action upon such referral until
September 11, 2001, to allow adequate time for the property owners to bring the subject
property into compliance.

CASE SUMMARY
July 22, 1999 Zoning Permit for a Mobile Home (ZPMH-2156) was approved.
January 8, 2001 Initial complaint received via the Department of Public
Health and Environment.
January 8, 2001 Initial inspection completed.
February 5, 2001 Five day compliance encouragement letter issued.
March 16, 2001 Property inspected. Property still in violation.
April 17, 2001 Violation letter issued.
June 8, 2001 Letter sent to property owner indicating that the violation
case was scheduled before the Board of County Commissioners.
Currently, there is a violation of Chapter 23, Article 111 (3) , Division 1,
Sections 23-3-20 and 23-3-20.P and Article IV(4) , Division 3, Sections 23-4-140
and 23-4-200 and Chapter 29, Article VII (7) , Section 29-7-10 of the Weld County
Code. To bring the property into compliance the property owner shall complete
all necessary building inspection as required through their building permit
(PR-9930159) . Which will also bring their ZPMH-2156 back into compliance.
The Department of Planning also recommends that the County Attorney authorize
legal action against any other persons occupying the properties, any persons
claiming an interest in the properties, and any persons acting in active concert
with the identified parties.

Dear Mr. Gomez:
The property referenced above remains in violation of the Weld County Code. I have scheduled a meeting
with the Board of County Commissioners on July 10, 2001, at 10:00 a.m., to consider the violations
occurring on the property. As we discussed the above mentioned property is in violation of the following
Section(s) of the Weld County Code:
Chapter 23,Article III, Div 1 "A(Agricultural)Zone District"
Section 23-3-20 "Uses allowed by right"
Section 23-3-20.P "Mobile home subject to the additional requirements of Article IV,Division 3 of this
Chapter."
Chapter 23,Article IV, Div 3 "Mobile Homes"
-No mobile home may be located or relocated in the County after August 25, 1981,except in accordance with
this Division,including the issuance of any zoning permit which may be required by this Section. Each mobile
home located or relocated in the County after said date must have a building permit for a mobile home issued
pursuant to Chapter 29 of this Code.._

-No mobile,manufactured or factory-built home,as defined in this Building Code,may be located or relocated
within the County without a building permit issued by the Building Official.
To bring your property into compliance with the Weld County Code:
The Building Permit(PR-9930159)which has already been issued shall be"finaled." As a result of this Building
Permit not being completed,your Zoning Permit for a Mobile Home(ZPMH-2156)is now in violation of the
County Code as well. Please see the attached"Conditions of Approval"for ZPMH-2156. Specifically,see
conditions 2 and 3 of the Administrative Review report.
This meeting will take place in the County Commissioners' Hearing Room, First Floor, Weld County
Centennial Center, 915 10th Street, Greeley, Colorado. It is recommended that you or a representative be in
attendance to answer any questions the Board of County Commissioners might have about the violations.
Please also be advised that I will be taking video from the road or adjacent properties the day before the
Violation Hearing (indicated above).
The Department of Planning Services' and Building Inspections' staff will be recommending that the Board of
County Commissioners authorize the County Attorney to proceed with legal action to remedy the violation.
Our records indicate that you were made aware of the nature of the violation including the action necessary
to correct the violation, and that you were given sufficient time to remedy this violation. If you have any

2. Prior to the occupancy of the mobile home, the mobile home shall be connected to an legal
water and sewer supply.
3. The mobile home shall not be occupied until such time that the applicant has complied with
Conditions 1 and 2 stated above.
4. The applicant shall utilize the existing access. No additional accesses will be granted.

5. Approval of this application for a zoning permit application shall not be considered to
release the applicant from complying with any private covenants in place.

6. The applicant shall maintain compliance with section 43.2.2 at all times.

Dear Mr. Gomez:
It has come to the attention of the Department of Planning Services'staff that the uses on your property may not
be in compliance with the Weld County Zoning Ordinance. The potential noncompliance with the Zoning
Ordinance is a Mobile home which is being occupied; however, has not yet obtained the proper inspections to
validate the "Building Permit" (PR-9930159) which also places the property in violation due to the conditions
of approval of ZPMH-2156.
In addition, the Weld County Individual Sewage Disposal System Regulations state; "the owner of any structure
where people live,work,or congregate shall insure that the structure contains an adequate,convenient,sanitary
toilet and sewage disposal system in good working order." This is not the case in the above referenced property.
The East Eaton Water and Sewer Department has informed this Department that you have not paid for water or
sewer service.

PROMISSORY NOTE

1. FOR VALUE RECEIVED,the undersigned(borrower)promise(s)to pay
JULIAN GOMEZ
or order,(Note Holder)the principal sum of EIGHT HUNDRED DOLLARS(S800.00)
in U.S.Dollars,with interest on the unpaid principal balance at the rate of ZERO
PERCENT(0.00%)per annum.
Principal and interest shall be payable at 454 E.LINCOLN,EATON,COLORADO
80615 or such other place as the Note Holder may designate,in monthly payments equal
to TWO HUNDRED DOLLARS($200.00)per month beginning April 1,2001.
Monthly payments are due on the 1st day of each month until the entire indebtedness
evidenced by this Note is fully paid;provided,however if not sooner paid,the entire
principal amount outstanding and accrued interest thereon,shall be due and payable on
July 1,2001.
2. If any payment required by this Note is not paid when due,or if any default under any
Deed of Trust securing this Note occurs,the entire principal amount outstanding and
accrued interest thereon shall at once become due and payable at the option of the Note
Holder(Acceleration). The Nate Holder shall be entitled to collect all reasonable costs
and expense of collection and/or suit,including,but not limited to reasonable attorney's
.. -- fees. Note Holder can delay enforcing its rights under this agreement without losing
them.
3. Borrower may prepay the principle amount outstanding under this Note,in whole or in
part,at any time without penalty.Any partial prepayment shall be applied against the
principal amount outstanding and shall not postpone the due date of any subsequent
payments or change the amount of such payments.
4. Borrower and all other makers,sureties,guarantors,and endorsers hereby waive
presentment,notice of dishonor and protest,and they hereby agree to any extensions of

and be effective upon(I)delivery to Borrower or(2)mailing such notice by first-class
U.S.mail,addressed to Borrower at the address on file with the Note Holder,or to such
other address as Borrower may designate by notice to the Note Holder.Any notice to the
Note Holder shall be in writing and shall be given and be effective upon(I)delivery to
Note Holder or(2)by mailing such notice by first-class U.S.mail,to the Note Holder at
the address stated in the first paragraph of this Note,or to such other address as Note
Holder may designate by notice to Borrower.
6. The indebtedness evidenced by this Note is secured by a Deed of Trust dated

contains additional rights of the Note Holder. Such rights may cause Acceleration of the
