HomeMy WebLinkAbout20011508.tiff RESOLUTION RE: ACTION OF BOARD OF COUNTY COMMISSIONERS OF WELD COUNTY, COLORADO, CONCERNING APPLICATION FOR SITE APPROVAL FOR CONSTRUCTION OF A NEW DOMESTIC WASTEWATER TREATMENT PLANT AND AUTHORIZE CHAIR TO SIGN -TOWN OF LOCHBUIE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has received an Site Application from the Town of Lochbuie, 703 Weld County Road 37, Lochbuie, Colorado 80603, concerning the construction of a new domestic wastewater treatment plant, located on the following described parcel of land, to-wit: NW1/4 NW1/4 of Section 29, Township 1 North, Range 65 West of the 6th P.M., Weld County, Colorado WHEREAS, the regulations for site applications require review of the site application by the Board of County Commissioners, and further, that various local and state agencies be given the opportunity to review and comment on said site application, and WHEREAS, the site application from the Town of Lochbuie was submitted to the Board of County Commissioners of Weld County for review and comment, a copy of said application being attached hereto and incorporated herein by reference, and WHEREAS, after study and review, the Board finds that said site application is not in conflict with the Weld County Code, and that it is in the best interest of Weld County to recommend approval of said application. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the site application submitted by the Town of Lochbuie be, and hereby is, recommended favorably to the Colorado Department of Public Health and Environment, subject to the following conditions: 1. The Town of Lochbuie shall reach an agreement with The Farmers Reservoir and Irrigation Company (FRICO) prior to expanding the plant to a point that would allow for discharge levels above the current agreement limits. 2. The Town of Lochbuie will apply for a Use by Special Review permit prior to constructing the new wastewater treatment plant, in order to comply with the requirements of the Zoning Chapter (Chapters 23A and 23B) of the Weld County Code, and approval of the Site Application does not indicate approval of said Use by Special Review Permit. 2001-1508 PL0079 SITE APPLICATION - TOWN OF LOCHBUIE PAGE 2 BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said site application. Ches(ler, Lead Pl9p r, Weld County Department of Planning Services and Connie O'Neili-ittpervisor,Environmental Division of the Weld County Department of Public Health and Environment SUBJECT: Site Application and Facility Plan for the Lochbuie Wastewater Treatment Facility located in the NW4 of Section 29, Ti N, R65W of the 6'h P.M., Weld County, Colorado The Weld County Department of Planning Services' and Department of Public Health and Environment staff have reviewed the Site Application for the Town of Lochbuie for a New Wastewater Treatment Facility. The review was done according to the Regulations for the Site Application Process (5 CCR 1002-22). During this review it was determined that the Town of Lochbuie has not yet reached an agreement with The Farmers Reservoir and Irrigation Company (FRICO) for the discharge levels that will be produced when the proposed plant reaches full capacity. However, the Town's current agreement with FRICO will allow for continued discharge for several years prior to exceeding the agreed upon limit. With this information, we would recommend that the Board sign the application with the condition that an agreement be reached between the Town of Lochbuie and FRICO prior to expanding the plant to a point that would allow for discharge levels above the current agreement limits. In addition, we have the following comments about the application: • The proposed facility does not lie within the 100 year floodplain, as shown on FEMA panel map #080266-1025C, dated September 28, 1982. • The site is located in unincorporated Weld County and will require a Site Specific Development Plan and Special Review Permit (USR)for a Major Facility of a Public Utility. The planning issues will be addressed through Conditions of Approval and Development Standards for the permit. Building permits will be required for any construction on site and for electrical service. All applicable permits must be completed to the satisfaction of the Department of Planning Services and Building Inspection, prior to construction of the facility. • Good planning practices merit investigation into screening the proposed site from adjacent land uses for improved compatibility. • Currently, there are many State Endangered and Threatened Species found in riparian areas of Weld County. This site may be located within an environmentally sensitive area and the Town of Lochbuie is encouraged to contact the Division of Wildlife to mitigate any potential negative impacts. • As this proposal is considered a new facility, the Board of County Commissioners are required to sign the Site Application for the State Department of Public Health and the Environment. The Weld County Departments of Planning Services and Public Health and Environment are recommending that the Commissioners sign the application to allow the Town of Lochbuie to proceed with the State process. The County application processes can run concurrently. Dated8 G.2.�i o`.(it SZ: 19.5%- Signature of Applicant Typed Name WQCD-3a(Revised 1/01) Page 3 of 4 APPLICATION FOR SITE APPROVAL FOR CONSTRUCTION OF: A NEW DOMESTIC WASTEWATER TREATMENT PLANT ATTACHMENT TO SITE APPLICATION In accordance with C.R.S. 1981,25-8-702 (2)(a),(b),and(c),and the"Regulations for Site Applications for Domestic Wastewater Treatment Works",the Water Quality Control Division must determine that each site location is consistent with the long range, comprehensive planning for the area in which it is to be located, that the plant on the proposed site will be managed to minimize the potential adverse impacts on water quality,and must encourage the consolidation of wastewater treatment works whenever feasible. In making this determination,the Division requires each applicant for a site approval for a domestic wastewater treatment works to supply an engineering report describing the project and showing the applicant's capabilities to manage and operate the facility over the life of the project to determine the potential adverse impacts on water quality. The report shall be considered the culmination of the planning process and as a minimum shall address the following: Service area definition including existing and projected population, site location,staging or phasing, flow/loading projections,and relationship to other water and wastewater treatment plants in the area. Proposed site location,evaluation of alternative sites,and evaluation of treatment alternatives. Proposed effluent limitations as developed in coordination with the Division. Analysis of existing facilities within the service area(s). Analysis of opportunities for consolidation of treatment works in accordance with the provisions of 22.3(1)(c),including those recommended in the water quality management plan,unless the approved water quality management plan recommends no consolidation. Evidence that the proposed site and facility operations will not be adversely effected by floodplain or other natural hazards. Where such hazards are identified at the selected site,the report shall describe means of mitigating the hazard. Evidence shall be presented in the form of a report, containing soils testing results and design recommendations and prepared by a Professional Geologist and a Geotechnical Engineer,or by a professional meeting the qualifications of both Professional Geologist and Geotechnical Engineer,with an appropriate level of experience investigating geologic hazards, stating that the site will support the proposed facility. Detailed description of selected alternatives including legal description of the site, treatment system description,design capacities,and operational staffing needs. Legal arrangements showing control of site for the project life or showing the ability of the entity to acquire the site and use it for the project life. Approval by the Division of an application for site approval shall not be deemed to be a determination that the proposed treatment works is or is not necessary,that the proposed site is or is not the best or only site upon which to locate such a treatment works, or that location of a treatment works on the site is or is not a reasonable public use justifying condemnation of the site. Approval by the Division shall only be deemed to be a determination that the site application meets the requirement of this regulation 22(5 CCR 1002-22). Institutional arrangements such as contract and/or covenant terms which will be finalized to pay for acceptable waste treatment. Management capabilities for controlling the wastewater loadings within the capacity limitations of the proposed treatment works,i.e.,user contracts,operating agreements,pretreatment requirements and or the management capabilities to expand the facilities as needed(subject to the appropriate, future review and approval procedures). Financial system, which has been developed to provide for necessary capital and continued operation, maintenance, and replacement through the life of the project. This would include, for example, anticipated fee structure. Implementation plan and schedule including estimated construction time and estimated start-up date.
