RE: APPROVAL OF RECORDED EXEMPTION NO. 606 - CLINTON AND JULIA
WAREHIME
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners at a public meeting held in the Chambers of the Board,
that the division into two parcels of land, as shown on the plat
known as Recorded Exemption No. 606 , being the property of Clinton
and Julia Warehime, described as Part of the West i, Southwest a,
Section 13 , Township 4 North, Range 65 West of the 6th P.M. , Weld
County, Colorado, being more particularly described in the plat
which shall be provided by the applicants and known as Exhibit
"A" , said plat to be recorded, does not come within the purview
of the definition of the terms, "subdivision" and "subdivided
land" , pursuant to its authority under Section 30-28-101 (10) (d) ,
CRS 1973 , as amended.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove described
parcel of land owned by Clinton and Julia Warehime be, and hereby
is, exempt from the definition of the terms, "subdivision" and
"subdivided land" .
BE IT FURTHER RESOLVED by the Board that this approval is
conditional upon the applicants submitting a mylar plat to the
Department of Planning Services ' Office to be recorded in the
office of the Clerk and Recorder. The plat shall be drawn in
accordance with the requirements of Section 9-2 C. (4) of the Weld
County Subdivision Regulations . The plat shall be submitted within
ninety (90) days from the date of approval by the Board.

Re: Recorded Exemption #606
Dear Commissioners:
The attached application,Plat and related items are in reference to a
request from Clinton and Julia Warehime for a recorded exemption. The parcel
of land on which this request is being made is described as Part of the West
1/2, Southwest 1/4, Section 13, Township 4 North, Range 65 West of the
6th P.M. , Weld County, Colorado.
The property is located approximately 5 miles southeast of La Salle on
Weld County Roads 47 and 44. The property contains approximately 32.81
acres of Class Ile, IIIe, VIe irrigated and IVe, VIe nonirrigated soils.
The request is to divide the property into equal parcels of 16.4 acres and
16.4 acres, more or less. The intent of this recorded exemption is to sell
the southern parcel as a future homesite.
Based upon the submitted information and policies of the County, the Depart-
ment of Planning Services staff recommends the request be approved for the
following reasons:
1. The request complies with Section 9-2 C. of the weld County
Subdivision Regulations submission requirements.
2. The request complies with Section 9-2 E. of the Subdivision
Regulations as follows:

- The 32.81 acres, more or less, under consideration will allow
uses which are consistent with the intent clause of the
Agricultural Zone District. The uses will be compatible with
existing surrounding agricultural uses.
The proposal is in compliance with Section 1-3 of the Weld County
Subdivision Regulations and the proposed land division complies
with the Weld County Comprehensive Plan; therefore, the proposed
use is consistent with efficient and orderly development.
- The proposal does not exist in an overlay district area.
- The proposed lots meet minimum lot size requirements for land
division.
- Central Weld County Water District has indicated adequate water
service is available for this proposal.
- The proposed lots are not part of a recorded exemption within
the last five (5) years.
- The two lots proposed will have adequate access from Weld County
Roads 47 and 44.
The Weld County Health Department has indicated, in a letter
dated March 30, 1983, that both lots will have adequate sewage
capacity.
The Department of Planning Services staff's recommendation for approval is
conditional upon the applicant submitting a mylar plat to the Department of
Planning Services' office to be recorded in the office of the Clerk and Recorder.
The plat shall be drawn in accordance with the requirements of Section 9-2 C. (4)
of the Weld County Subdivision Regulations. The plat shall be submitted within
ninety (90) days from the date of approval by the Board.

Honorable Commissioners :
We are seeking approval for a recorded exemption on our
property, located in a portion of the West One-half of the
Southwest Quarter (W 1/2 SW 1/4 ) of Section Thirteen ( 13 ) ,
Township Four ( 4 ) North , Range Sixty-five ( 65 ) West of the
Sixth ( 6th ) P . M . , in Weld County, Colorado.
When we purchased the property we thought we would be able
to use all of the land for beneficial , productive purposes .
Since that time , we have discovered that water soaks a good
portion of the land during irrigation season to the extent
that we are unable to graze animals or drive in the pasture .
The dryland that is available is accessible from County
Roads 44 and 47 , not from our house.
We propose to divide the property along the south line of
our corrals to the Gilmore Canal , which is the eastern
boundary of our property. This will result in two ( 2 )
parcels of approximately equal size . We will remain on the
north parcel in our existing home and will sell the south
parcel as a homesite. There are approximately five ( 5 )
acres in the southern portion that are elevated and
consequently dry and buildable. This land is dry enough to
accommodate a septic tank and leach field for domestic waste
disposal . The property is eligible for service from the
Central Weld County Water District.
We will attend the meeting of the Board of County
Commissioners when our request is considered and will also
be represented by Mr. Thomas W. Rounds . Should you have any
