HomeMy WebLinkAbout20011335.tiff RESOLUTION RE: APPROVE ACCEPTANCE OF GRANT OF EASEMENT AND DEED OF DEDICATION AND AUTHORIZE CHAIR TO SIGN - REYNOLDS CATTLE COMPANY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Grant of Easement and Deed of Dedication between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Public Works Department, and Reynolds Cattle Company, do Tom Reynolds, P.O. Box 675, Longmont, Colorado 80501, with terms and conditions being as stated in said Grant of Easement and Deed of Dedication, and WHEREAS, after review, the Board deems it advisable to accept said Grant of Easement and Deed of Dedication, copies of which are attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Grant of Easement and Deed of Dedication between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Public Works Department, and Reynolds Cattle Company, be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said acceptance. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 21st day of May, A.D., 2001. Masden 2001-1335 �. . )eynods EG0041 GRANT OF EASEMENT c r (Reynolds Cattle Company-Weld County) This Grant of Easement, dated APR,L L-PR— , 2001, is from Reynolds Cattle Company, a Colorado company whose address is PO Box 675, Longmont, Colorado ("Reynolds") to the County of Weld, a body corporate and politic of the State of Colorado ("County"). For good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, Reynolds hereby grants, sells, assigns, conveys and quitclaims to County a non- exclusive easement for the purpose of installation and maintenance of a storm sewer line. The easement centerline extends between 1) a point on the easterly right of way of Weld County Road 9.5 and from which the Northwest corner of the Northeast One-Quarter of Section 23, Township 3 North, Range 68 West of the Sixth Principal Meridian, County of Weld, State of Colorado bears N05°50'44"W a distance of 1189.38 feet and 2) a point from which said Northwest corner bears N09°53'00"W a distance of 1107.58 feet. The location of the easement is more particularly described as follows: See Exhibit"A" and Exhibit Map The Easement hereby conveyed is for the sole purpose of carrying storm water under the above-described land and for the construction, repair and maintenance of said facilities. This conveyance shall be deemed to include sufficient land for the construction and maintenance thereof including rights of entry upon, passage over, deposit of excavated earth and storage of material and equipment on such area as may be necessary or useful for the construction, maintenance, cleaning out and repair of such storm sewer facility.
