The action was removed to this Court by the United States of America on December 30, 1997. Only K.N. Frontrange Gathering Company, Panhandle Eastern Pipeline Company, United States of America on behalf of Western Area Power Administration,Great Western Railway Company,Public Service Company of Colorado and the County of Weld, State of Colorado claim an interest in the property. III. UNDISPUTED FACTS The only issues among active parties to the case are the extent of the various parties'interests in the subject property and the priority of each party's interest. IV. MOTION FOR DEFAULT JUDGMENT Plaintiff Asphalt Paving Co., by and through its attorneys, Banks & Imatani, P.C., hereby moves this Court for entry of default judgment against Defendant Rose Marie Barham Kitchel pursuant to Rule 55, F.R.C.P.,and in support thereof states as follows: 1. Plaintiff initially filed its Complaint against various defendants in the Fall of 1997 in the Weld County District Court, State of Colorado to quiet title to certain property located in Weld County,Colorado ("Property"), and the state court action was removed to this Court upon motion of Defendant United States of America on November 21, 1997. 2. On January 2, 2001,pursuant to Rule 4,Colorado Rules of Civil Procedure, Defendant Rose Marie Barham Kitchel was served with a Summons and a copy of Plaintiff's Complaint as evidenced by the Certificate of Affidavit of Service filed with the Court and certified as part of the record to this Court. 3. On January 5, 2001,pursuant to Rule 4,Colorado Rules of Civil Procedure, Defendant Ruth Elizabeth Barham Haas was served with a Summons and a copy of Plaintiff's Complaint as evidenced by the Certificate of Affidavit of Service filed with the Court and certified as part of the record to this Court. 4. Neither Defendants Rose Marie Barham Kitchel nor Ruth Elizabeth Barham Hass are infants or incompetent persons. 5. Neither Defendants Rose Marie Barham Kitchel nor Ruth Elizabeth Barham Haas have an interest, estate or claim of any kind whatsoever in the Property. 6. As to Defendants Rose Marie Barham Kitchel and Ruth Elizabeth Barham Haas, Plaintiff is the owner in fee simple and entitled to possession of the Property. 7. There is no just reason for delaying entry of default judgment against Defendants Rose Marie Barham Kitchel and Ruth Elizabeth Barham Haas.
