RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH
LEGAL ACTION AGAINST MARY RUPERT AND GORDON RUPERT FOR
VIOLATION OF THE WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Mary Rupert and Gordon Rupert, VI #0100145, are allegedly in violation of
the Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 9th day of October, 2001, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation,
and
WHEREAS, Gordon Rupert, property owner, was present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said
violation to the Weld County Attorney's Office for legal action, with an instruction for delay of
action upon such referral until February 12, 2002, to allow adequate time for the property
owners to bring the subject property into compliance and for an inspection of the property by
the Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that VI #0100145 be, and hereby is, referred to the Weld County
Attorney's Office for legal action against Mary Rupert and Gordon Rupert to remedy the
violation of the Weld County Code, and any other persons occupying the properties, any
persons claiming an interest in the properties, and any persons acting in active concert with the
identified parties, with an instruction for delay of action upon such referral until February 12,
2002, to allow adequate time for the property owners to bring the subject property into
compliance.

Currently, there is a violation of Chapter 23, Article III (3) , Division 1,
Sections 23-3-20, 23-3-20 .P, 23-3-30, 23-3-30.1 and Article IV(4) , Division 3,
Sections 23-4-140 and 23-4-170 and Chapter 29, Article VII (7) , Section 29-7-10
of the Weld County Code. To bring the property into compliance with the Weld
County Code, the property owner shall remove or screen the Noncommercial Junkyard
consisting of numerous derelict vehicles, and camper/trailers, metal, trash,
wood, automobile parts and miscellaneous debris from all adjacent properties and
public right-of-way. Additionally, both the mobile home without a Zoning Permit
and the other mobile home without any permits shall obtain all necessary permits
or be removed from the property.
The Department of Planning also recommends that the County Attorney authorize
legal action against any other persons occupying the properties, any persons
claiming an interest in the properties, and any persons acting in active concert
with the identified parties.

items were noted: several derelict vehicles, 1+

forwarded to the Health Department (Phil Brewer on
05/16/01 and Cindi Etcheverry) due to the sileage pit
full of trash and occasional burning of the sileage
pit trash.

Phill Brewer (Health Department), Steve Wiatrowski
(Health Department), an intern (Health Department),
Trudy Halsey(Building Compliance), Mr. Rupert and
myself met on the property. Each person explained
their concerns to Mr. Rupert. He stated that the
stuff on the property had to do with being a trustee
in a will or something. Mr. Rupert allowed Steve
Wiatrowski to accompany him to the back portion of
the property. We were not allowed to follow. After
the meeting had ended. Trudy, Phill and myself
followed an oil and gas road (immediately to the West
of Mr. Rupert's property) back to see the extent of
the Noncommercial Junkyard.

The property referenced above remains in violation of the Weld County Code. I have scheduled a meeting
with the Board of County Commissioners on September 11, 2001, at 10:00 a.m., to consider the violations
occurring on the property. As we discussed the above mentioned property is in violation of the following
Section(s)of the Weld County Code:
Chapter 23,Article III,Div 1 "A(Agricultural)Zone District"
Section 23-3-20 "Uses allowed by right."
Section 23-3-20.P "Mobile home subject to the additional requirements of Article IV,Division 3 of this
Chapter."
Chapter 23,Article IV,Div 3 "Mobile Homes"
-No mobile home may be located or relocated in the County after August 25, 1981,except in accordance with this
Division,including the issuance of any zoning permit which may be required by this Section. Each mobile home located
or relocated in the County after said date must have a building permit for a mobile home issued pursuant to Chapter 29
of this Code....

To bring your property into compliance with the Weld County Code:
The"Noncommercial Junkyard"consisting of numerous derelict vehicles and camper/trailers, metal,trash,wood and
miscellaneous debirs.shall be removed or screened from all adjacent property owners and public rights-of-way.
Even though the mobile home located at the back of the property did obtain a building permit(M 04284),our records
indicate that a Zoning Permit for a Mobile Home was never obtained. For your convenience,I have enclosed an
application for a Zoning Permit for a Mobile Home. If you have any questions or would like assistance processing or
understanding this application,please feel free to speak to one of our"On-Call"Planners. They are available on a walk
in basis only. (Monday or Friday, 12:00 p.m.-4:00 p.m.or Tuesday-Thursday,7:30 a.m.-4:00 p.m.)
Additionally,a second mobile home is currently located on the property. A Temporary Storage of a mobile home permit
along with a building permit shall be obtained in order to temporarily store the mobile home on your property.

Please be advised that if the property is brought into compliance before the above mentioned date,then
this violation hearing date would be vacated; however,the Department of Planning Staff feels that this
allows more than adequate time to bring the property into compliance, based on our previous telephone
conversation.
This meeting will take place in the County Commissioners' Hearing Room, First Floor, Weld County
Centennial Center, 915 10th Street, Greeley, Colorado. It is recommended that you or a representative be in
attendance to answer any questions the Board of County Commissioners might have about the violations.
Please also be advised that I will be taking video from the road or adjacent properties the day before the
Violation Hearing(indicated above).
The Department of Planning Services' staff will be recommending that the Board of County Commissioners
authorize the County Attorney to proceed with legal action to remedy the violation. Our records indicate
that you were made aware of the nature of the violation including the action necessary to correct the

Additionally, Environmental Health Services' staff advise the dump site located on your property is being
considered a noncompliance with the "Regulations Pertaining to Solid Waste Disposal Sites and Facilities"(the
Regulations)(6 CCR 1007-2) as promulgated by the Solid Waste Disposal Sites and Facilities Ad,title 30, Article
20, part 1, C.R.S., as amended.
To bring your property into compliance with the Regulations:
The Regulation requires that you conduct certain activities prior to disposing waste on your own property. Title 30,Article
20,part 102(3)of the.Colorado Revised Statutes(C.R.S.),allows any person other than a governmental unit to dispose of his
own solid wastes on his own property,as long as the disposal site complies with the rules and regulations of the state board
of health and does not constitute a public nuisance.The rules and regulations of the state board of health for waste are known
as the "Regulations Pertaining to Solid Waste Disposal Sites and Facilities" (the Regulations)(6 CCR 1007-2). These
Regulations require that prior to disposing of your own waste on your property that you submit an engineered design and
operations report to the Colorado Department of Public Health and Environment for review and approval. An engineering
design and operations report must be prepared and submitted to the Colorado Department of Public Health and Environment
for review and approval. I have included relevant sections of the Regulations with this letter.
Or the unauthorized trash shall be removed and disposed of at a licensed solid wastefacility. Receipt of disposal at a license
solid waste facility shall be delivered to the Weld County Department of Public Health and Environment, and Zoning
Compliance Officer to demonstrated the waste has been properly disposed of.
It is the intention of our office to assist and cooperate with you without imposing undue hardships; however,we
have no discretion in this matter if you fail to correct this violation. You have 30(thirty)days from ,July 6, 2001,
to correct these violations. Failure to do so will result in this office scheduling the violations before the Board
of County Commissioners to consider whether to refer the violations to the County Attorney's Office for legal
action.

Dear Ms. Rupert:
It has come to the attention of the Department of Planning Services'staff that the uses on your property may not
be in compliance with the Weld County Code. The potential noncompliance(s)with the Weld County Code is
a"Noncommercial Junkyard"consisting of numerous derelict vehicles,wood,derelict camper/trailers,trash and
miscellaneous debris. Also, there were a couple of mobile homes, for which, I could not find any building or
zoning permits. Additionally,this case has been forwarded to the Department of Public Health and Environment
regarding the silage pit containing miscellaneous debris,the mobile home(septic/sewer concerns),the derelict
vehicles (possible leakage of oil, gas and other contaminates) and possible burning allegations.
For your convenience, I have added the appropriate definitions:
DERELICT VEHICLE: A vehicle that is inoperable(unable to move under its own power);or is partially or totally dismantled;or
has all or portions of its body work missing or is substantially damaged;or is not registered with the State of Colorado,as required
by Section 42-3-103,CRS,or by Sections 42-3-138 or 42-12-102,CRS,and/or the number plate assigned to it is not permanently
attached to the vehicle,as required by Section 42-3-123,CRS;or is lacking proper equipment to the extent that it would be unsafe
or illegal to USE on public road rights-of-way or otherwise not equipped with lamps and other equipment as required in Sections
42-4-202 to 42-2-227,CRS. This definition shall not include; implements of husbandry,farm tractors,or vehicles customarily
operated in a FARMING operation.
SCREENED: Construction and maintenance of fences,earth berms or the USE of LANDSCAPING materials or other materials
USED with the approval of the Department of Planning Services to lessen the noise, light, heat or visual impacts of a USE on
surrounding USES.
NONCOMMERCIAL JUNKYARD: An area where any waste, junk, or used or second hand materials are stored or handled,
including, but not limited to scrap iron and other metals, paper, rags, rubber tires, building materials, and bottles. A
Noncommercial junkyard may also include the storage or keeping of derelict vehicles. The Noncommercial Junkyard shall be
totally enclosed within a building or structure or visually screened from all adjacent properties and public rights-of-way.
JUNK:Scrap brass, iron, lead,tin,zinc;all other scrap metals and alloys;bones; rags; used cloth, rope, rubber,tinfoil,bottles,
old or used machinery of any type; used tools, used appliances; used lumber or crates; building materials; fabrication of any
material;used pipe or pipe fittings;used conduit or conduit fittings;used automobile parts;derelict vehicles;used tires and other
manufactured goods that are 5o wom,deteriorated, or obsolete as to make them unusable in their existing condition.

Subject: VI-0100145, Part of the W2SE4/SW4NE4 of Section 9, T4N, R65W of the 61h P.M., Weld
County, Colorado
Dear Ms. Rupert and Mr. Rupert:
The property referenced above remains in violation of the Weld County Code. I have scheduled a meeting
with the Board of County Commissioners on October 9, 2001, at 10:00 a.m.,to consider the violations
occurring on the property. As we discussed the above mentioned property is in violation of the following
Section(s) of the Weld County Code:
Chapter 23,Article 111, Div 1 "A(Agricultural)Zone District"
Section 23-3.20 "Uses allowed by right."
Section 23-3-20.P "Mobile home subject to the additional requirements of Article IV,Division 3 of this
Chapter."
Chapter 23,Article IV, Div 3 "Mobile Homes"
-No mobile home may be located or relocated in the County after August 25, 1981,except in accordance with this
Division,including the issuance of any zoning permit which may be required by this Section. Each mobile home located
or relocated in the County after said date must have a building permit for a mobile home issued pursuant to Chapter 29
of this Code....
Section 23-3-30 "Accessory uses."
Section 23-3-30.1 "Noncommercial junkyard."
Section 23-4-140 "Mobile homes permitted in the A Zone District."
Section 23-4-170 "Temporary accessory farm use."
Chapter 29,Article VII "Mobile,Manufactured or Factory-Built Home Permits"
Section 29-7-10 "Permit required."
-No mobile,manufactured or factory-built home,as defined in this Building Code,may be located or relocated within
the County without a building permit issued by the Building Official.
To bring your property into compliance with the Weld County Code:
The"Noncommercial Junkyard"consisting of numerous derelict vehicles and camper/trailers,metal,trash,wood and
miscellaneous debris shall be removed or screened from all adjacent property owners and public rights-of-way. As we
have discussed"hay"was not approved by staff as an appropriate screening material.
Even though the mobile home located at the back of the property did obtain a building permit(M 04284),our records
indicate that a Zoning Permit for a Mobile Home was never obtained. We did indeed discuss this portion of the
violation as well and while you indicated that you could not get all of the necessary signatures and wished to pursue the
application before the Board of County Commissioners,that application still shall be completed and submitted to this
office as soon as possible. If you have any questions or would like assistance processing or understanding this
application,please feel free to speak to one of our"On-Call"Planners. They are available on a walk in basis only.
(Monday or Friday, 12:00 p.m.-4:00 p.m.or Tuesday-Thursday,7:30 a.m.-4:00 p.m.)
Additionally,a second mobile home is currently located on the property and while you have indicated that it was to be
removed this morning,that has not been confirmed as of yet. Otherwise,a Temporary Storage of a mobile home permit
along with a building permit shall be obtained in order to temporarily store the mobile home on your property.

Please be advised that if the property is brought into compliance before the above mentioned date,then
this violation hearing date would be vacated; however, the Department of Planning Staff feels that this
allows more than adequate time to bring the property into compliance, based on our previous telephone
conversation.
This meeting will take place in the County Commissioners' Hearing Room, First Floor, Weld County
Centennial Center, 915 10th Street, Greeley, Colorado. It is recommended that you or a representative be in
attendance to answer any questions the Board of County Commissioners might have about the violations.
Please also be advised that I will be taking video from the road or adjacent properties for the Board as close
to the hearing date as possible.
The Department of Planning Services' staff will be recommending that the Board of County Commissioners
authorize the County Attorney to proceed with legal action to remedy the violation. Our records indicate
that you were made aware of the nature of the violation including the action necessary to correct the
violation, and that you were given sufficient time to remedy this violation. If you have any questions
concerning this matter, please call me.
