The comments follow your numbering of comments/questions in your letter to us dated February 18, 2000. 1) Topsoil and overburden stockpiles are located around the perimeter of the mining cells. These will be used for partial screening during the operation of the mine. Existing trees and shrubs immediately adjacent to the South Platte River will remain for some screening of the operations from adjacent landowners. Shrub and tree clusters will be planted along Weld County Road 6 as shown on the Reclamation plan map to help screen the operations. This site averages 15 to 20 foot lower elevation than U.S. 85. This makes it difficult to completely screen the operations from view. 2) The properties mineral owners and lessees of mineral interests have been identified through the Department of Planning Services forms submitted with the original application materials. The applicant is in the process of contacting applicable owners. 3) The access onto Highway 85, approximately 1,350 feet north of WCR 6, is an existing access. This may be used for minor access to the site. The primary access for all haul trucks and equipment is off of WCR 6. 4) All comments related to the vicinity map have been addressed. Some of the features are shown on the Mining Plan and/or Reclamation Plan map for clarity. Information on the determination will be forwarded to you when it is available. The U.S. Fish and Wildlife Service is determining if surveys for the presence or absence of the Ute Ladies-tresses orchid are needed. This determination will also be forwarded to you when it is available. If a survey is needed it will be conducted during the approved survey period of July 15 to August 15. 12) The maximum requested hours of operation are 6:30 a.m. to 10:00 p.m. Monday through Saturday. One shift would generally be from 6:30 a.m. to 3:30 p.m. and the second shift would generally be from 1:00 p.m. to 10:00 p.m. Two shifts would be utilized during the heavier summer and fall construction months. If only one shift were utilized, their hours would generally be from 7:00 a.m. to 4:30 p.m. Maintenance of the equipment would occur after the regular shift hours in the evenings. 13) Trees that are proposed to be removed due to the mining activities, have been deleted from the Reclamation Plan map. Consultants for Land, Mineral and Water January 18, 2000 Weld County Department of Planning Services 1555 N. 17th Avenue Greeley, Colorado 80631 RE: Use by Special Review (Mining Operation) Mobile Premix Concrete, Inc., Riverbend Operation To Whom It May Concern: Mobile Premix Concrete, Inc., a subsidiary of Lafarge Corporation, is applying for a Use by Special Review permit for a mining operation along with concrete and asphalt batch plants. This letter will supply the narrative portion of the application requirements. This letter is formatted in the same numerical order as the procedural guide for the application requirements. 1. The completed application form along with the application fee of$1,455 is attached. 2. A detailed description of the method of the mining operation follows: a. The types and numbers of equipment and facilities can be found in Exhibit D of the DMG application. b. Generally one shift will be used in the operation. The maximum number of employees is 60. Occasionally during the busy periods of the summer and fall construction season, two shifts may be employed. c. The operation will be a dry pit. d. Our trucks will exit from the property onto Weld County Road 6. The overwhelming majority of trucks will proceed east to US Highway 85. This intersection has full moving movements with acceleration and deceleration lanes for all movements. At this intersection the majority of the trucks will turn right and proceed south down the highway. A small number of trucks, in the range of 5% to 10%may turn left and proceed north up the highway. Occasionally a truck may travel westbound on Weld County Road 6 to serve customers in that rural area. The total permit area is 237 acres with 120 acres being affected by the mining operation. The phases and size of the phases can be found in Exhibit D of the DMG application. The size of the active mining area at any one time is 10 acres with a total disturbance at any one time of 61 acres. The aggregate processing area, located on the south side, is 27 acres. From time to time to meet specifications for public and private projects, aggregate may be imported into the processing plant for the production of concrete and asphalt. f. A time table giving periods of time for each of the mining phases can be found in Exhibit D of the DMG permit. Overall we expect the operation to last 10 years with 3 years for reclamation work. Production of sand and gravel depends on overall market demand, amount of material used in the concrete and asphalt plants, and the amount of outside sales. It may occur that the resource is exhausted slightly ahead of the term of this permit. In that case, the applicant plans to operate the concrete and asphalt plants with imported material. g. The sand and gravel deposit is 28 to 30 feet thick and the overburden is 3 to 4 feet thick. h. The proposed use of the reclaimed land is water storage reservoirs. A full explanation of the reclamation process can be found in Exhibit E of the DMG permit. i. The technical advice from the Soil Conservation Service, DMG, and Tuttle Applegate, Inc. was used to develop the reclamation plan. 3. A certified list of the names, addresses, and the corresponding parcel identification numbers of property owners within 500 feet of this site is attached. 4. A certified list of the names and addresses of mineral owners and lessees is attached. 5. a. A copy of the application submitted to the DMG is attached and includes a reclamation plan map. b. Water supplies for the mining operation will come from groundwater on the site. This groundwater will be augmented by the applicant's shares in the Fulton Ditch. See Exhibit G of the DMG application for discussion of these water rights. c. Drainage structures include two culverts in the roadside ditch along Weld County Road 6 for access into the processing plant and a culvert in the McCann Seep for access to the east. Cross sections of these drainage structures are included on sheet 1 of 3. d. A typical cross section of the hall road can be found on sheet 1 of 3. This Use by Special Review application for a mining operation and accessory uses is consistent with the Weld County comprehensive plan. The comprehensive plan allows for the extraction of a recognized sand and gravel deposit, and promotes the reasonable and orderly development of such. This application proposes to develop a commercial sand and gravel deposit and return the affected lands to a beneficial use of water storage. All activities at the mining site are guided by the regulations of the Mine Safety and Health Act (MSHA) and the Occupational Safety and Health Act(OSHA). These requirements along with Weld County policies help to minimize or eliminate the potential adverse impact of the operation on surrounding properties. By proposing setbacks, concurrent reclamation, and routing traffic to US Highway 85, the operation will comply with the policies and goals of the comprehensive plan. Instituting noise controls and dust controls complying with the State standards can also reduce any adverse impacts to neighbors. Reclamation activities will be concurrent with the mining operation and a predetermined number of acres will be disturbed at any given time. Wildlife habitat adjacent to the South Platte River corridor will be preserved with a 200 foot setback. 7. The proposal is located on lands that are within an agricultural district. The zoning designation allows for the extraction of sand and gravel as a use by special review. 8. Presently the south half of the permit boundary is used for grazing and the north half is a fallow hay field. The mining plan is limited to where the sand and gravel reserves are of known high quality and with a minimum amount of topsoil and overburden covering the resource. 9. Protection of the health, safety, and welfare of the inhabitants of the neighborhood of Weld County are being considered by the applicant. Possible fugitive dust emissions from the site will be minimized by watering, truck speed limits, and revegetation. Noise levels from the operation will fall within the requirements for the industrial zone. The site will be fenced and signed to help prevent trespassing and accidents. Access to the operation will be from Weld County Road 6 and most trucks will proceed directly to US Highway 85. 10. Surrounding land uses are primarily agricultural, with other permitted sand and gravel operations to the north, west, and south of the site. Being a business operation, the truck traffic will be limited to business hours. The operation will not require additional housing or support services to be located in this agricultural area. Compatibility with the surrounding uses will be assured by setbacks, noise limitations, and other restrictions on the operation. 11. The future development of this site and the surrounding area is projected by the comprehensive plan of Weld County to be agricultural and open space. The floodplain on this site further restricts any significant land development. The reclamation plan for water storage eliminates the possibility of housing or commercial development. Weld County Department of Planning Services January 18, 2000 Page 4 of 4 12. The site is not located in a geologic hazard area or the Weld County Airport overlaying district area. The site is located within the floodplain of the South Platte River. No permanent structures are proposed for this site. Equipment and stockpiles will be located in a manor to not significantly obstruct floodwaters. The creation of a permanent open water area will increase the potential for floodwater detention on this site. 13. Drinking water will be supplied to employees by delivered bottled water. Water needs for the operation will be supplied by groundwater that is augmented with water rights owned by the operator. Exhibit G of the DMG application discusses how replacement of consumptive uses will be achieved. 14. Copies of deeds identifying the landowners of the property are attached. 15. The applicant agrees to comply with industrial noise levels. No extraordinary methods are needed to obtain this noise level at the property line. 16. A-3 EXHIBIT I) MINING PLAN Mobile Pre-Mix Concrete, Inc., a subsidiary of Lafarge Corp. (herein Lafarge) proposes to mine the property situated north of Weld County Road 6. south of Weld County Road 8 and immediately west of State I Iighway 85. Lafarge supplies local, county, and state governments, as well private industry with aggregate. The site is bisected by the South Platte River. This mining operation will not disturb the South Platte River. The proposed permit area is 237 acres, of which 120 acres will be disturbed by mining. The remainder of the property will consist of setbacks and road right-of-ways. The site has been drilled and testing has verified that there are commercially marketable sand and gravel deposits on the property. The deposit has 3-4 lbot average depth of overburden and a 28-30 foot average depth of sand and gravel. Lafarge will mine to the elaystone bedrock. The mining face will be in the vertical to %z : I slope range. Phasing The Riverhend Operation will process approximately 800,000 tons of aggregate per year, and mine between 10-15 acres a year. At this rate of mining they expect to mine and reclaim the site in approximately 10 years. The rate of mining and overall life of the mine is dependent upon demand. Generally, we believe the mine will progress according to the following time table: Mining Phase Duration of Tinze(yrs)� Cell 1 1 Cell 2 Cell 3 2 Cell 4 4 Cells 2 Total 10 Mining in phases will limit the area of disturbance at any one time (see Fxhibit C). The phases depicted in !:xhibit C are used to indicate the direction of mining. These phases are neither representative of the maximum area of disturbance nor do they limit disturbance to a particular phase. Mining will commence by stripping \lining Cell 5 and the settling basin area (Mining Cal 1). Cell I will then be excavated and the sealing basin created. The settling basin kill be used to recycle wash water and remove lines. n-I The processing area contains the crushing and screening for the raw material. Some of the material will be washed for use in the on-site concrete plant. An on-site asphalt plant will also use some of the washed material. The processing area also includes a concrete casting facility where concrete forms are made for construction projects. The settling basin may be sectioned by berms. These berms will allow water accumulate in the each section before spilling over into the next section. This procedure allows a large amount of sediment to settle out of the water, so that the last section will have clean water. The clean water can be reused for processing. Mining will proceed to Cell 2 and progress as shown on Exhibit C. Before the remaining cells are mined a dewatering trench will be constructed around portions of their perimeters. A sump hole will he created at the lowest point of the dewatering trenches. The sump holes and dewatering trenches will allow sediment to settle before the water is pumped to the South Platte River using a groundwater discharge pump. Water may also be pumped into adjoining cells. Lastly, Cell 5 will be mined. As the area in Cell 5 is reduced in size, the processing equipment will he moved closer to the south border of the property and eventually moved off-site. During the life of the operation, the processing equipment will be a combination of portable and stationary pieces. Table D-1 outlines the maximum area of disturbance at any one time in the life-of-mine. Table D-1 is based on disturbance in Cell 2. See Exhibit I. for more detail. During these low runoff months there is little risk of high river flows and bank breaching. D-2 Methods of Mining LaFarge will use the same mining techniques as they have used at other mining operations. The operation will be open pit dry mining. Mitigation of groundwater impacts are discussed in Exhibit G. Dozers, scrapers, haul trucks and/or rubber tired front end loaders will be used to first remove the topsoil and overburden. 'they will strip enough land to keep ahead of the mining progress. The topsoil will be stockpiled so not to impede flood waters. The same equipment will he used to mine the sand and gravel. Field conveyors will transport the material from the mining face to the processing area. When mining in Cell 4, a bridge over the River will carry the conveyor. Material will be crushed, screened (sorted) and washed. A portion of the aggregate will he processed into asphalt or concrete. The processing facilities are portable and/or stationery and will be moved when Lafarge begins to mine Cell 5. An asphalt and concrete batch plant will be located on-site. Some of the processed material will he washed. "the settling basin will be located in the southeast portion of the property near the wash plant. Description of Equipment on Site The equipment used at this operation is typical of what is used at sand and gravel mining operations. 'the equipment will he placed on the south side or the property and includes but is not limited to the following: Processing Equipment -Crushers, screens, field conveyors, wash plant, asphalt batch plant, concrete batch and casting plant, and settling basin. Earth Moving Equipment -Tractor trailers, dozers, front end loaders, scrapers. Miscellaneous _ -Dewatering pumps, trailer/office. maintenance shop and equipment, sanitary facilities, water trucks, truck scale, full tank, outdoor storage. 0-3 EXHIBIT E RECLAMATION PLAN The reclamation plan for the Riverhead Operation is two water storage reservoirs. The access roads into the site from Weld County Road 8 and Weld County Road 6 and internal roads will remain and used by vehicles for maintaining the reservoirs and oil wells. The culvert over the McCann Seep will remain for access. An unimproved road around both reservoirs will also remain. Phasing Reclamation will be concurrent with mining and therefore will be completed in phases. Lafarge plans to mine to the claystone bedrock. The claystone is eroded on its surface and can be moved by a dozer. However, some areas might not contain marketable sand and gravel down to the bedrock. This area will remain exposed until the reservoir is filled with water. Scrapers will be used to place overburden and claystone bedrock material along the reservoir perimeter. Wheel compaction by scrapers will primarily be used to acquire the compaction specification. Quality control will be used during lining operations to determine that compaction is being achieved. This will include an evaluation and possible changes in the water applications, lift thickness, and compaction method (wheel rolling, sheep's foot compactor, etc.) _ During initial stages of the liner construction, several in-place tests will be done to determine if the compaction method is sufficient to meet the standard proctor design. Thereafter Lafarge will be conducting regular on-going compaction testing. Reclamation begins as Cell 2 is mined, the overburden will be used immediately to backfill the mined portion. As mining progresses, Lafarge will closely follow with backtilling of overburden, capping with topsoil, and vegetating to minimize the amount disturbed at any one time. Once the hackfilling gets to the proposed reservoir shoreline material will be graded to a 311:1V slope. After the two reserviors have been reclaimed any remaining overburden and topsoil will be used to cap the sediment basin. If there is not sufficient material to cap the settling basin, then the silts accumulated from the washing process in the basin will provide a growing medium for plants. Ground water may be exposed to encourage the development of wetlands in this area. Processing Plant Site/Equipment The processing plant equipment will be located on the south side of the property but will be progressively relocated towards the southern property boundary as Cell 5 is mined. The concrete foundations will be removed prior to mining. Al the final stage of mining Cell 5, ail die equipment will be removed and unprocessed material will be hauled off. As shown on Exhibit F. the oil well and power line poles along with the service roads will remain on the property after reclamation is complete. Unless the operator makes provisions with the owner of the property to remove the oil well or power line poles. Grading Grading will be done to provide stabilized shorelines around the reservoir. All hackfilling will be done using native overburden, topsoil, and claystone. There are no known toxic materials in the proposed backfill material. All grading will be done to prevent erosion. Final grading will be done immediately after topsoiling has been completed. Backfilling will be completed in phases after mining is completed. All slopes left by the mining operation will at a minimum be 311:I V and 211:1V at 10' below the " water line. Tot-moiling Sufficient topsoil will be stockpiled for the reclamation process. Stockpiles remaining in place longer than one growing season will be seeded with a fast growing cover to minimize erosion. Handling of topsoil will be minimized by efficient sequencing of the mining. Topsoil will be replaced at a depth of four to eight inches. Stripped topsoil will he stockpiled parallel to the flow of water in order to reduce the risk of inhibiting the flow of a flood. Throughout the mining phases, Lafarge will limit the amount of topsoil stockpiled at any one time by continuously using it to cap backfilled areas. Revegetation The reclamation plan will revegetate all disturbed areas with appropriate seed mixes to minimize erosion and reestablish natural terrain. Below is a seeding recommendation from the Soil Conservation Service (SCS). At the time of seeding, the SCS will be consulted for any necessary fertilizing. Reseeding of the property will be done after an acceptable seedbed is prepared. Grass seed will be planted with a drill equipped with depth bands and press wheels. The grass seed mix will included drought resistant varieties and will be planted in either early spring or fall to ensure germination. Grasses planted in early spring should be warm season cover crops. .1'he permanent grass seed should then be drilled into the cover crop in early fall without additional tillage. Grasses planted in the early fall should be permanent grasses and covered with straw mulch at a rate of 2,000 lbs. per acre immediately following seeding. The straw should then be crimped into the soil to control erosion until the grass becomes established. 1 -2 GRASSES Dryland mixture: Grenville Switchgrass 0.5 #PLS/Ac. Native Plum (Prunus americana) Siberian Peashrub (Caragana aborescens) Tartarian Honeysuckle (Lonicera) Common Purple Lilac (Syringa vulgaris) Rosa Rugosa If a significant invasion ot noxious weeds occurs, the area will he mowed periodically for control. Weeds will be mowed before they go to seed throughout the first growing season. Mechanical control will be used as a first priority. Chemical methods will only be used if no other alternative produces acceptable results. Wildlife All activities will be planned considering the safety and protection of wildlife on the property. Some species may be temporarily displaced by the mining activities. They are expected to re- establish with no difficulty after the reclamation has been completed. Bald Eagles are known to roost and feed along the South Platte River during the winter months. The mining will not disturb the existing trees and the wildlife habitat along the South Platte River. Water Disturbance of the area will be done to minimize the effect on the prevailing hydraulic balance as follows: a) The operator shall comply with all applicable Colorado water laws. b) The operator shall comply with all applicable Federal and State water quality laws and regulations. c) The operator shall comply with all Federal and State Requirements for dredge and fill. This activity is not anticipated on-site. L-t EXHIBIT G WATER INFORMATION The Riverbend Operation is located in Weld County along the South Platte River approximately three miles downstream of Brighton, Colorado. Highway 85 lies along the cast boundary of the site while W.C.R. 8 & 6 from the north and south boundaries of the property, respectively. The proposed mining operation will have minor impacts the South Platte River from depletions due to evaporation and operational losses. The impacts can be mitigated without injury to senior water rights. Exhibit C includes a pre-mining plan that shows water resources on the property. The South Platte River passes through the Riverbend Operation. No active irrigation ditches occur on the property. One irrigation well is located on the property. The mining of the Riverbend Operation will be completed in live phases and last approximately 10 years. As the material is removed, reclamation will follow with the construction of the reservoir liner proceeding immediately behind. In the long term, the reclamation of the mine will create two lined lakes with an approximate area of 113 acres. Lafarge also owns water rights in the Fulton Ditch Company in the South Platte Basin. These water rights can be used to fill the lined reservoirs created after reclamation. The available water rights are summarized in the following table: Ditch Company Number of Shares Owned by Lafarge Acre-feet per Share Fulton Irrigation Ditch Co. 25 1.75 The site will be dry mined, and groundwater will only be exposed in the dewatering trench, the collection area, and the wash pond. Prior to mining, a dewatering trench will be excavated around the perimeter of the mining cells. Groundwater will flow along the trench by gravity toward a collection basin where it will be allowed to settle out prior to pumping into the South Platte River. The property is located in the floodway of the South Platte River. All work in the floodplain will use best management practices and conform to the Weld County Flood Hazard Regulations. This will be documented in a Flood Hazard Development Permit. During the mining operation, overburden and topsoil strippings will be placed directly on side slopes to backfill to the proper slope configuration. Erosion caused by runoff from these stockpiles will be directed into the pit, and will flow into the dewatering trench before reaching the collection area and being pumped into the South Platte River. The project lies in the valley fill deposit of the South Platte River. This is an unconfined alluvial aquifer and consists of the sand and gravel that is being mined. the limns 01 the aquifer correspond roughly to the limits of the floodplain. The depth to groundwater ranges from approximately 4' to 5' depending on the formation of the underlying bedrock. :i-i It is estimated that sand and gravel underlying the overburden is between 28' to 30' thick. The underlying bedrock is composed of a shale and claystone formation that extends to greater depths. Water Consumptive Use Water use at the Riverbend Operation will include evaporation from exposed groundwater, water used for washing sand and gravel, and water pumped for dust control of haul roads and stockpiles, and water used in the hatching of concrete. The mining operation will intercept the alluvial aquifer that supplies water to the South Platte River. The evaporative losses at the site will consist of the exposed water within the dewatering trench, the collection area, and in the 2.0 acre wash pond. Approximately 0.5 acre of water will be exposed in the dewatering trench and collection area. Total exposed surface area will be approximately 2.5 acres and will result in a net annual evaporation of 7.4 acre-ft. _ There will be excavation and stockpiling of mined material on-site. The water contained in the material when mined is considered a consumptive use. The operator anticipates that 800,000 tons of material will he mined and washed from the area annually. The moisture in the aggregate would create a depletion of 17.7 acre-feet per year. In addition, 6.1 acre-feet will be used at the concrete batch plant. The operation will also use 1.0 acre-foot of water in the production of asphalt. Water will also be applied to haul roads and stockpiles for dust control from a 2,000 gallon capacity water truck three days a week during the year. This results in a consumptive use of 1.5 acre-feet per year. The total annual consumptive use associated with the mining operation is 33.7 acre-feet. All uses are summarized as follows: Evaporation 7.4 acre-feet Water Used in Concrete Production 6.1 acre-feet Water Used in Asphalt Production 1.0 acre-feet Moisture Retained in Product 17.7 acre-feet Dust Control 1.5 acre-feet Total 33.7 acre-feet G-2 Water Rights for Augmentation - The water losses will be accounted for in an approved Substitute Water Supply Plan (SWSP) submitted to the State Engineers office. As a component or the Substitute Supply Plan, the operator will provide the necessary water rights for all water losses during the operation. A copy - of the approved plan will be submitted to DMG when it is received. A court approved augmentation plan will not be required for this site because it will be lined for water storage. - Surrounding Water Rights Exhibit G-1 shows the permitted and/or adjudicated water rights within 1/2 mile of the Riverbend - Operation. Wells and water right tabulations obtained from the State Engineers Office were used to locate the surrounding water rights and well permits located on Exhibit G-1. Although there may be other wells in the area, they are not registered and permitted with The State Engineers - Office. These tabulations are included in Exhibit G-2. As required by the State Engineers Office, waiver agreements will be acquired from well owners - within 600 feet of the pit. If the dewatering of the Riverbend Operation creates an injury to the water rights of adjacent - wells, Lafarge will take all necessary actions to protect those water rights. Water Quality An application for a NPDES Permit has been submitted to the Colorado Health Department for the Riverbend Operation. EXHIBIT H WILDLIFE INFORMATION The Colorado Division of Wildlife (DOW) has been contacted to determine the potential impacts to wildlife habitat that this operation might have. Attached is the response letter from Michael Babler of DOW. The Riverbend site consists primarily of pastureland and fallow hay fields. There are prairie dogs on-site. Lafarge will do their best to humanely remove these animals from the site. Bald Eagles are known to roost and feed during the winter months near the South Platte River. The existing habitat will not be disturbed. Although this site is within their winter range,there are no documented roosting trees on this property. Species that might be expected to be seen on the site include the following: rabbits, ground squirrels, opossum,raccoons,fox, ducks, geese,meadow larks, magpies, robins,killdeer, and pheasants. It is not anticipated that the additional noise and human activity of the proposed operation will have any significant impact on wildlife in the immediate area. In fact, the reclamation plan for the property should enhance wildlife habitat when complete. Previous mining operations have demonstrated that the creation of an open body of water, with even minimal plantings of grasses and cover along the shoreline, will quickly attract a wide variety of wildlife, even while mining operations are in progress. However, the applicant will be performing reclamation and liner installation during the mining operation. Since it is intended that the liner design will achieve State Engineer design standards, the applicant wishes to use a cost estimate for the repair or replacement of 20 percent of the proposed liner in Exhibit L. In support of the liner design and lower cost estimate provided for contingency bonding, Attachment A provides a typical design drawing and specifications in addition to construction and quality assurance/quality control plans for the installation of a sealed liner. The applicant proposed the 200-foot setback with the intention of providing additional protective measures as required by the District. Comment 5 • To permit mining and backfilling within the river setback area, the low flow season will be defined as the period from October 1st to May 1st of each year as recommended by the Division. • The applicant will not mine within the 200-foot setback unless sufficient backfill material is available on-site. In addition, the applicant will not mine more than a total of 3 acres within the river setback area during any one year. • During each year that the Riverbend Operation is active, the applicant will provide to the Division a signed affidavit stating that the required 200-foot setback is established between the edge of the pit and the top of the riverbank. The affidavit will be submitted by May 1st of each year and will include a statement that the setback area will be maintained during the period from May 1st to October 1st Comment 6 Exhibit C has been checked to verify that all man made structures within 200 feet of the affected land were correctly illustrated. All permanent man-made structures within 200 feet of the affected land have been shown on the map. Comment 7 For structures discussed in the application and illustrated on Exhibit C, the applicant shall either (1) provide a setback distance of at least two times the pit depth from all structures or(2) provide a notarized agreement to the Division between the applicant and the person(s) having an interest in the structure. The agreement shall state that the applicant is to provide compensation for any damage to the structure caused by mining activities within 200 feet of the structure. Comment 8 The applicant will reclaim the entire reservoir bank, from the top edge of the bank to the bottom of the reservoir,with 3:1 slopes. Comment 9 • Armoring of the reservoir slopes shall be.accomplished with pit run or other engineering approved gravel as illustrated on the design drawing provided in Attachment A. The cost of this armoring has been added to Exhibit L. A revised Exhibit L is presented in Attachment C. Response to Mr. Gregg Squire Comments Submitted on April 20,2000: Comment I • The applicant plans to use the SCS seeding recommendation. • The applicant will plant trees and shrubs in areas where tree/shrub clusters are illustrated on Exhibit F. The tree and shrub species will be selected from the lists provided in Exhibit E, with no one species being more than 25 percent of the total species planted. The applicant hesitates to commit at this time to the exact species to be used. Availability and associated costs of specific trees and shrubs at the time of planting may make such a commitment unpractical. • The applicant is committed to planting 50 trees and 50 shrubs around the east/southeast side of Lake 1 and 30 trees and 30 shrubs around the north side of Lake 2. The success standard used will be 80% survival at the time of bond release. Comment II • The applicant does not anticipate that the lined reservoirs will affect alluvial ground water elevations up or down gradient of the site. However, to detect and mitigate potential impacts to the alluvial ground water elevation due to mining operations or reclamation activities, the applicant will monitor ground water levels. Eight (8) monitoring wells will be installed around the perimeter of the site to obtain baseline data and monitor ground water levels during mining operations and reclamation activities. The locations of the proposed monitoring wells are illustrated in a revised pre- mining/mining plan map provided in Attachment D. To provide timely and representative ground water elevation information, the eight (8) new monitoring wells will be completed, developed, and surveyed immediately upon permit approval. Well coordinates and top of casing (measuring point) elevation data will be collected upon well completion. Well coordinates, measuring point elevations, and water level measurements will be made to the nearest tenth of a foot. Ground water level measurements will be taken on a monthly basis starting at a minimum of 3 months prior to exposure of ground water at the site and will continue throughout the mine operation and reclamation activities. Data collected prior to mining below the ground water table will be used to establish baseline ground water elevations for the site. Baseline elevations will be established for a 12-month period. If an entire year of ground water monitoring cannot be completed before exposing ground water at the site, data collected at the site will be used with documented regional ground water data to extrapolate baseline ground water elevations for the entire 12-month period. The ground water data will be submitted to the Division along with other annual reporting requirements. Mr. Gregg Squire May 2, 2000 Page 3 of 4 Mitigation of potential impacts caused by changing ground water elevations will be addressed based upon the specific location and nature of the impact. If potential impacts are identified,monitoring data will be used to compare measured ground water elevations with ground water conditions observed prior to mining or reclamation activities. Changes in measured ground water elevations will be evaluated based on natural ground water fluctuations and changes in non-project related local conditions including precipitation, river flows, and land use. If, due to mining or reclamation activities, changes in ground water elevation create adverse impacts to adjacent properties, the impacts will be addressed to the satisfaction of the Division. • The applicant does not anticipate dewatering operations at the site to impact the water rights of adjacent well owners. However, once dewatering at the site has started, ground water levels in the immediate vicinity are expected to drop. If water levels are dropping in adjacent wells, due to dewatering at the Riverbend operation, such that well owners historic water production may be injured, the applicant will begin to implement one or more of the following measures. However, if the well has not been put to beneficial use prior to mining,the applicant should have no responsibility to provide mitigation. 1. Modify existing wells to operate under lower ground water conditions. This would include re-drilling existing wells to deeper depths or lowering the pumps. All work would be done at the applicants expense with the exception of replacing equipment that was non-functional prior to mining. 2. If existing wells cannot be repaired, the applicant will drill a new well for the owner to replace the damaged well. The new well will produce water of the same quantity and quality to support the historic use. Comment III The plan maps in Exhibit C and Exhibit F have been corrected to illustrate that mining will not extend beyond the permit boundary. As operations progress, the applicant will begin lining and sealing mined areas to form a portion of the reservoir. On-site overburden and the claystone bedrock will be used to seal the perimeter of the reservoir to isolate the site from the alluvial aquifer. As the reservoir shoreline is backfilled with claystone and overburden, these areas will be compacted to create the liner. The applicant will provide the Colorado Division of Minerals and Geology (Division) with a schedule for each phase of the liner construction. During construction, scrapers will be used to place claystone and overburden material along the shoreline perimeter. The material will be placed in lifts and the moisture content will be adjusted by water applications. Wheel compaction by scrapers and/or sheepsfoot rollers will primarily be used to acquire the compaction specification following the placement of each lift. Once the final 3:1 slope has been achieved with compacted overburden, pit run or other engineering approved gravel will be placed from the crest to the toe of the slope as an armoring for the liner. To provide for the beneficial end use of the site, the intent of the liner design is to achieve State Engineer design standards. The applicant will demonstrate that the constructed liner meets the requirements of the design by performing appropriate quality control observations and tests. Quality assurance/quality control checks will be used to determine that compaction is being achieved. This will include an evaluation and possible changes in the water applications, lift thickness, and compaction method (wheel rolling, sheepsfoot roller, etc.). During initial stages of the liner construction, several in- place tests will be done to determine if the compaction method is sufficient to meet the design standard. Thereafter, the applicant will be conducting regular on-going compaction testing to ensure standards are being met. Tests performed shall meet or exceed applicable ASTM standards. The applicant will provide written documentation of the work performed and results of quality control field and laboratory tests. A construction report detailing the installation of the liner will be provided to the Division along with other annual reporting requirements.
