WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Final Plat for Blehm Waterway Estates has been submitted to the Board of County Commissioners by Theador Blehm, et al . , for approval in accordance with the Subdivision Regula- tions of Weld County, Colorado , and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, and WHEREAS, the Board of County Commissioners has studied the request and studied the recommendations of the Weld County Planning Commission, as submitted, and finds that said Final Plat should be approved conditional upon the following being accomplished : 1. The applicant shall post a bond with the County for the amount stipulated in the submitted subdivision improvements agreement to ensure the completion of the improvements identified in the agreement prior to recording the final plat. 2. The maps being amended prior to recording the final plat to reflect the following: a. The title block of the filing plat shall be amended to show that Blehm Waterway Estates Subdivision is a Planned Unit Development. b. The widths of easements on the filing plat shall be clearly identified. c. Details of drainage swales and method of delivery from the street into the swale shall be included on the Street Plans . The "drainage swales along easements" and "drainage depres- sion street crossings" shall be sized to handle design flows and reviewed for approval by the Weld County Engineering Department prior to recording the filing plat. d. The following notes shall be placed on the filing plat: (1) No building permit shall be issued for a lot until a sewer tap has been issued for that lot by the Milliken Sanitation District. (2) Basements and foundations shall be restricted in accordance with the Final Soils and Founda- tion Investigation. (3) No building permits shall be issued on the property until a median left-hand turn lane is constructed on State Highway 257 . 000757 PL 1558' 3 . The applicant shall submit a Final Soils and Founda- tion Investigation to be submitted prior to the issuance of any building pertmis by the Weld County Building Inspection Department as per the recommenda- tions of The Preliminary Soils and Foundation Investi- gation Project No. 3828-79 by Empire Laboratories . WHEREAS, the Board of County Commissioners finds that the Final Plat conforms in all major aspects to the Preliminary Plat as previously reviewed and approved by the Board of County Com- missioners, and WHEREAS, the Board of County Commissioners further finds that the applicant has complied with the Final Plat submission requirements as set forth in the Weld County Subdivision Regula- tions. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the Final Plat of Blehm Waterway Estates described in "Exhibit A" attached hereto and incorporated herein by reference, be, and hereby is , approved subject to the conditions stated above. BE IT FURTHER RESOLVED by the Board of County Commissioners that the subdivision improvements agreement be, and hereby is , accepted. BE IT FURTHER RESOLVED by the Board of County Commissioners that the common open space provided by subdivision outlots in- cluded in the development shall be substituted for the park fee in this and subsequent filings. WITNESSETH: WHEREAS, Subdivider is the owner of or has a controlling interest in the following described property in the County of Weld, Colorado: WHEREAS, a final subdivision plat of said property, to be known as Blehm Waterway Estates has been submitted to the County for approval ; and WHEREAS, Section 11-1 of the Weld County Subdivision Regulations pro- vides that no final plat shall be approved by the Board of County Commissioners until the Subdivider has submitted a Subdivision Improvement Agreement guaranteeing the construction of the public improvements shown on plans , plats and supporting documents of the subdivision, which improvements , along with a time schedule for completion, are listed in Exhibits "A" and "B" of this Agreement. NOW, THEREFORE , IN CONSIDERATION OF the foregoing and of the acceptance and approval of said final plat , the parties hereto promise, covenant and agree as follows : 1 . Engineering Services : Subdivider shall furnish, at its own expense, all engineering services in connection with the design and construction of the subdivision improvements listed on Exhibit "A" which is attached hereto and made a part hereof by this reference. 1 . 1 The required engineering services shall be performed by a Professional Engineer and Land Surveyor registered in the State of Colorado, and shall conform to the standards and criteria established by the County for public improvements. 1 .2 The required engineering services shall consist of, but not be limited to, surveys , designs , plans and pro- files, estimates, construction supervision, and the submission of necessary documents to the County. 1 .3 Subdivider shall furnish drawings and cost estimates for roads within the subdivision to the County for ap- proval prior to the letting of any construction contract. Before acceptance of the roads within the subdivision by the County, Subdivider shall furnish one set of repro- ducible "as-built" drawings and a final statement of con- struction cost to the County. 2. Rights-of-Way, and Easements : Before commencing the construction of any improvements herein agreed upon, Subdivider shall acquire , at its own expense, good and sufficient rights-of-way and easements on all lands and facilities traversed by the proposed improvements. All such rights-of-way and easements used for the construction of roads to be accepted by the County shall be conveyed to the County and the docu- ments of conveyance shall be furnished to the County for recording. 3. Construction: Subdivider shall furnish and install , at its own expense, the subdivision improvements listed on Exhibit "A" which is attached hereto and made a part hereof by this reference, according to the construction schedule set out in Exhibit "6" also attached hereto and made a part hereof by this reference. 3. 1 Said construction shall be in strict conformance to the plans and drawings approved by the County and the speci- fications adopted by the County for such public improve- ments. Whenever a subdivision is proposed within three -2- � miles of an incorporated community located in the County or located in any adjacent county, the Subdivider shall be required to install improvements in accordance with the requirements and standards that would exist if the plat were developed within the corporate limits of that com- munity. If the incorporated community has not adopted such requirements and standards at the time the subdivision is proposed, the requirements and standards of the County shall be adhered to. If both the incorporated community and the County have requirements and standards , those re- quirements and standards that are more restrictive shall apply. 3.2 Subdivider shall employ, at its own expense, a qualified testing company previously approved by the County to per- form all testing of materials or construction that is re- quired by the County; and shall furnish copies of test re- sults to the County. 3. 3 At all times during said construction , the County shall have the right to test and inspect or to require testing and inspection of material and work at Subdivider's expense. Any material or work not conforming to the approved plans and specifications shall be removed and replaced to the satis- faction of the County at Subdivider' s expense. 3.4 The Subdivider shall furnish proof that proper arrangements have been made for the installation of sanitary sewer or septic systems, water, gas , electric and telephone services . 3. 5 Said subdivision improvements shall be completed, according to the terms of this Agreement, within the construction schedule appearing in Exhibit "B" The Board of County Commissioners, at its option, may grant an extension of the time of completion shown on Exhibit "B" upon application by the Subdivider. 4. Release of Liability:_ Subdivider shall indemnify and hold harmless the County from any and all suits , actions or claims of every nature and description caused by, arisina from, or on account of said con- struction, and pay any and all judgments rendered against the County on account of any such suit, action or claim, together with all reasonable expenses and attorney fees incurred by County in defending such suit, action or claim. All contractors and other employees engaged in construction of the improvements shall maintain adequate workman 's compensation insurance and public liability insurance coverage, and shall operate in strict accordance with laws and regulations of the State of Colorado governing occupational safety and health. 5. Acceptance of Streets for Maintenance by the County: Upon com- pliance with the following procedures by the Subdivider, streets with- in a subdivision may be accepted by the County as a part of the County road system and will be maintained and repaired by the County. 5. 1 If desired by the County, portions of street improvements may be placed in service when completed according to the schedule shown on Exhibit "B", but such use and operation shall not constitute an acceptance of said portions. 5. 2 County may, at its option, issue building permits for con- struction on lots for which street improvements detailed herein have been started but not completed as shown on Exhibit "B",ard may continue to issue building permits so long as the progress of work on the subdivision improvements throughout the development is satisfactory to the County; and all terms of this Agreement have been faithfully kept by Subdivider. 5. 3 Acceptance for Partial Maintenance: Upon the completion of the construction of streets within a subdivision according e to Weld County Specifications , the Subdivider shall request in writing that the County Engineer inspect said streets and accept them for partial maintenance by the County. Partial maintenance consists of all maintenance except for actual repair of streets , curbs and gutters and related street improvements. The County Engineer shall accept streets for partial maintenance for a period of one year. Nine months after initial acceptance, the County Engineer shall inspect the subject streets , and notify the Subdivider of any defi- ciencies. The County Engineer shall reinspect the streets after notification from the Subdivider that any deficiencies have been corrected. If the County Engineer finds that the streets are constructed according to County standards , he shall recommend the acceptance of the streets for full main- -4- tenance to the Board of County Commissioners . 5.4 Acceptance of Streets for Full Maintenance: Upon receipt of a recommendation from the County Engineer for acceptance of streets within the subdivision, the Board of County Commis- sioners shall accept such streets as public facilities and County property, and shall be responsible for the full main- tenance of such streets including repair. 6. Improvements Guarantee: Subdivider shall furnish to the Board of County Commissioners as guarantee of compliance with this Agreement, collateral such as , but not limited to, performance or property bonds, private or public escrow agreements , liens on property, deposit of certified funds or other similar surety agreements acceptable to the Board of County Commissioners . The amount of any of the above guarantees shall be set by the Board of County Commissioners and portions of the guarantee may be released upon completion of various portions of the improvements. All or any portion of the guarantee will be released upon completion of the guaranteed improvements according to County standards and the terms of the subdivision plans and plats and, in the case of the streets , upon acceptance of the streets by the County for full maintenance as a part of the County road system. 7. Public Sites and Open Spaces : The Planning Commission and the Board of County Commissioners , upon consideration of vehicular traffic and facilities and the particular type of development proposed in the subdivision, may require the dedication, development and/or reservation of areas or sites of a character, extent and location suitable for pub- lic use for parks , greenbelts or schools , other than subdivision streets and utility easements designated, in accordance with one of the following alternatives, or as specified in the PUD plan, if any: 7. 1 The required acreage as may be determined according to Section 8-15-B of the Weld County Subdivision Regulations shall be dedicated to the County or the appropriate school district, for one of the above purposes. EROSION CONTROL The concerns of the Soil Conservation Service pertaining to erosion control were largely based on the assumption that runoff would be flowing in roadside ditches . To eliminate this concern, final designs provide for asphalt depressions on each side of the roadways to handle drainage. All roadways are to be so constructed. Typical sections illustrating the construction are shown on Sheet 3 of the final design submittals . Water leaving the paved roadways is transported off the property in closed conduits ; consequently, there is no significant exposure to erosion within the subject parcel . GRADING PLAN The dwellings within Blehm Waterway Estates are not to be constructed by the developer . Lots will be sold to others for private construction of individual dwellings . The architectural style of dwellings will also be a matter of individual choice . Overlot grading must be coordinated with the type of dwelling construction to be used if it is to be of any value . For the aforementioned reasons , a meaningful development plan cannot be prepared at this time. The grading plan was recommended by the Soil Conservation Service at the time of preliminary platting as a tool for evalua- ting erosion control . Mr. Blehm agreed to: 1 . Provide a radius of curvature of at least 200 feet on all 8 inch lines. 2. Provide manholes at distances not to exceed 400 feet. 3. Locate the lift station above the 100 year flood plain. Mr. Blehm noted that the size of building sites are large enough to allow construction of permanent improvements and at the same time allow easy access by maintenance equipment on easements where the sewer main lies within the lot boundaries. It is our intention to pro- vide sewer service to the development. It is also our understanding that the owner prefers to have the District take over 0 & M of the sewer system after cons- truction. We have some concerns pertaining to the sewer as laid out on the preliminary plat. The large number of hori- zontal curves and the location of easements are of primary concern. Easy access by maintenance equipment must be pro- vided along the easement. It appears by the plat that this will not be possible where the easements are within the lot boundaries. Another point of concern is the location of the lift station within the 100 year floodplain. Also, the generally accepted design standards for the minimum horizontal radius and maximum distance between manholes have been violated in some places on the plat. We recommend that the plat be revised to eliminate the access restrictions, reduce the number of curves where possible, provide a radius of curvature of at least 200 feet on all 8 inch lines, provide a manhole at distances not to exceed 400 feet, and locate the lift station above the floodplain. If possible, drainage facilities are more effective when planned as part of the subdivision rather than "furnished as required. This tributary presently has no identified floouplain, but determination of the 2loodplair would be beneficial. The remaining property is presently drained by several small gulches in approximately one-quarter square mile of area. Greeley, CO 80631 re: Additional flow to the Milliken Wastewater Treatment Facility Dear Steve: As per our phone conversation, the Milliken Sanitation Wastewater Treatment Facility is currently experiencing problems with its treatment facility. The system is an extended aeration activated -sludge process with a design flow of approximately 95,000 gpd. High volumes of groundwater infiltrating the collection system cause flows to go over 200,000 gpd. This in turn causes severe operational problems. To date, the system has been able to meet effluent limitations however, they are having problems with sludge handling and process control. The district has applied for aid from local affairs to study their infiltration and the problems with their treatment plant. The ability of Milliken Sanitation District to treat any more flow is questionable. It is possible that they could handle the additional 35,000 gpd of flow that we discussed. My initial feeling is that they are not capable of treating this additional flow. Until a study of the system is made, we do not know if they can or cannot treat this flow. The final plat does not include the entire area covered in the preliminary plan presented in March, 1980. The main concerns with the preliminary plan were the need for an erosion control plan and an adequate surface drainage plan. Since only blocks 1, 2, 3, and 4 are included in this final plan, a _.._. comprehensive drainage final grade contour map is not needed to determine drainage adequacy. Roadside erosion will not be a problem as anticipated due to the proposed street gutter plan. The only concern found in the drainage plan as presented is the routing of storm runoff from area 4 through area 5. My interpretation of the plan is that a swale 10' wide and. 15" deep will be used to carry the runoff to a draw in area 5. A discharge of 22.1 cfs will require a flow depth of 1.4' at a velocity of 2.7 ft. /sec. This velocity greatly exceeds the maximum for a bare soil condition and will induce erosion. This swale should either be lined with erosion resis- tant material or vegetated. The retardance factor used for swale sizing does account for vegetated condition. The draw that the swale drops into should also have a good vegetative cover to retard erosion due to slopes ranging from 4 to 10 percent. If vegetative cover is not present, revege- tation is-essential to prevent erosion potential. I assume the runoff from areas 1, 2, and 3 will be discharged onto the sodded golf course after going through the conduit.
