Dear Ms. Hobday and Ms. Drawer:
Notice is hereby given that on Monday,April 16, 2001,at 9:00 a.m., or as soon thereafter as the agenda of the
Board of County Commissioners permits, the Board of County Commissioners of Weld County will hold a
Probable Cause public hearing pursuant to Section 24.8.1 of the Weld County Zoning Ordinance. This meeting
will take place in the Commissioner's Hearing Room,Weld County Centennial Center,915 10'"Street, Greeley,
Colorado.
The purpose of this public hearing will be to review case number "USR-768" for compliance with the
Development Standards as approved by the Board of County Commissioners on April 15, 1987 to determine if
probable cause exists to hold a hearing of revocation of USR-768.
Inspection by representatives of this office and the Department of Building Inspections have determined that you
are not in compliance with the following Development Standards:

Item #1 - 1.) The Use by Special Review permit is for a recreational train facility as submitted in
the application materials on file in the Department of Planning Services and subject to the
Development Standards stated herein.
Item #2 - 2.) The Use by Special Review area shall have two accesses, one from Weld County
Road 39 and the other from State Highway 52 as shown on the Use by Special Review plat. An
access permit from the State Highway Department shall be obtained prior to the construction and
use of the access onto State Highway 52. If Weld County Road 39 is to be constructed along the
east side of the property,the direct access to State Highway 52 shall be closed and permission shall
be obtained from the Weld County Engineering Department for access onto Weld County Road 39.
Item #3-3.) The owner and/or applicant shall implement and maintain the soil erosion control
and landscaping plans approved by the Platte Valley Soil Conservation Service.
Item#4-4.) The Use by Special Review site shall be maintained in a neat and orderly condition.
Inoperable equipment, materials, and parts shall be kept in the enclosed, six-foot-high wooden
fence identified on the Use by Special Review plat.
Item #5 - 7.) The food service establishment shall be constructed, equipped, and licensed
according to the State rules and regulations governing the sanitation of food service establishments.
Item #6 - 12.) All construction on the property shall be designed and built using the best
techniques available to prevent radon gas from entering the structures. All buildings constructed
and maintained on the property shall be in accordance with the requirements of the Weld County
Building Code Ordinance.
Item #7 - 13.) At such time as the facility is open to the public, the applicant shall supply
evidence to the Department of Planning Services that liability insurance for a minimum amount of
$500,000.00 has been purchased and shall be kept in force.
Item #8 - 14.) The applicant shall be responsible for complying with the Design Standards of
Section 24.5 of the Weld County Zoning Ordinance.
Item #9- 15.) Three years following approval of the Use by Special Review permit by the Board
of County Commissioners, the recreational facilities shall be in operation. If the facility is not
operating, it shall be considered discontinued as identified in Section 24.1.5 of the Weld County
Zoning Ordinance.
Item #10 - 16.) The applicant shall be responsible for complying with the Operation Standards
of Section 24.6 of the Weld County Zoning Ordinance.
Item #11 - 18.) The Use by Special Review area shall be limited to the plans shown herein and
governed by the foregoing Standards and all applicable Weld County Regulations. Any material
deviations from the plans or Standards as shown or stated shall require the approval of an
amendment of the permit by the Weld County Planning Commission and the Board of County
Commissioners before such changes from the plans or Standards are permitted. Any other changes
shall be filed in the office of the Department of Planning Services.
Item#12- 19.) The property owner or operator shall be responsible for complying with all of the
foregoing Standards. Noncompliance with any of the foregoing Standards may be reason for
revocation of the permit by the Board of County Commissioners.

✓ I explained the process for the Probable Cause and the Show Cause.
✓ I gave them both 7 copies of the USR packet from my file($8.75)-Brent Coan paid-Jennifer will send
a check.

Dear Ms. Saltzman:
On January 2, 2001, a letter was sent to Ms. Drawer and Ms. Hobday outlining a
number of concerns that the Zoning Department had with the buildings, railroad cars and
other vehicles located at 6900 Weld County Road 39, Fort Lupton, Colorado 80621. On
January 19, 2001, you instructed the parties to submit an inventory of items currently located
on the property, a proposed solution for each item, and a preliminary estimate of the date by
which such solution would be completed.
Over the last two weeks, Ms. Drawer and her family have compiled the attached
inventory, proposed plan and proposed dates for each plan. Ms. Hobday, who lives out of
state, was unable to participate in this process. The dates on the inventory sheet are based on
the fact that Ms. Hobday is 50% responsible for any cost and/or time expenditures required to
effectuate the proposed plan. These proposed dates are also contingent upon the weather
permitting such action.

Dear Ms. Salzman:
Thank you for meeting with me and the other parties involved with the above referenced property.
Based on our meeting, it is my understanding that the Drawers will complete an on-site inventory
and prepare a map identifying each building,railroad car, abandoned vehicle, miscellaneous wood
pile and metal pile,etc. Along with that on-site inventory and map,the Drawers will propose a plan
of remediation and abatement for the County's consideration. You have indicated that the inventory,
map and plan must be provided to your office on or before February 2, 2001.
It is also my understanding that the dogs that were the subject of part of the zoning violation have
now been removed from the property and are no longer an issue. There was discussion of using the
existing building constructed for housing the dogs as a chicken coop. In order to utilize said
building,the parties need to submit a COC to the County for approval. Please forward a copy of the
COC application to my office so that I can forward the same to the Drawers' attorney.
Finally, it is my understanding that you will discuss the status of the use by special review permit
for the property with Lee Morrison. Once you discuss the status of the USR and all other relevant
aspects related to the same with Mr. Morrison, you will provide the County's position to me which
will hopefully include an outline of alternatives, if any. If Mr. Morrison has any questions,
comments or concerns I will be available to discuss the matter with him or meet with you and Mr.
Morrison to discuss the issue.
My client takes the zoning violation notice very seriously. We will do our best to remedy the
situation and we ask that the County assist us by being patient and by helping us come up with and

The uses on the above described property are being considered as a zoning code violation of Sections of the
Weld County Zoning Ordinance. Currently your property is in violation of the following Section(s)of the Weld
County Zoning Ordinance:
31.3.9 "NONCOMMERCIAL JUNKYARD"consisting of derelict vehicles,wood,metal,tires and miscellaneous debris.
31.4.8 "KENNELS,subject to the additional requirements of Section 45.6, Kennels."
24.1.5 "If the use by Special Review has not commenced from the date of approval or is discontinued for a period of
three(3)consecutive years it shall be presumed inactive. The County shall initiate an administrative hearing to consider
whether to grant an extension of time to commence the use or revoke the Use by Special Review. If the Use by Special
Review is revoked,it shall be necessary to follow the procedures and requirements of this Section in order to re-establish
any Use by Special Review." - I enclosed a copy of the DEVELOPMENT STANDARDS
24.5.1 "An applicant for a Use by Special Review shall demonstrate compliance with the following design standards in
the application and shall continue to meet these standards if approved for development."
24.6.1 "An applicant fora Special Review Permit shall demonstrate conformance with the following operation standards
in the Special Review Permit application to the extent that the standards affect location, layout and design of the Use by
Special Review prior to construction and operation. Once operational,the operation of the uses permitted shall conform
to these standards." - I enclosed a copy of the OPERATION STANDARDS
For your convenience, I have added the appropriate definitions:
DERELICT VEHICLE: A vehicle that is inoperable (unable to move under its own power); or is partially or totally
dismantled;or has all or portions of its body work missing or is substantially damaged;or is not registered with the State
of Colorado,as required by Section 42-3-103,CRS,or by Sections 42-3-138 or 42-12-102,CRS,and/or the number plate
assigned to it is not permanently attached to the vehicle,as required by Section 42-3-123, CRS; or is lacking proper
equipment to the extent that it would be unsafe or illegal to USE on public road rights-of-way or otherwise not equipped
with lamps and other equipment as required in Sections 42-4-202 to 42-2-227,CRS. This definition shall not include;
implements of husbandry, farm tractors, or vehicles customarily operated in a FARMING operation.
SCREENED: Construction and maintenance of fences, earth berms or the USE of LANDSCAPING materials or other
materials USED with the approval of the Department of Planning Services to lessen the noise,light,heat or visual impacts
of a USE on surrounding USES.
NONCOMMERCIAL JUNKYARD: An area where any waste, junk, or used or second hand materials are stored or
handled, including, but not limited to scrap iron and other metals, paper, rags, rubber tires, building materials, and
bottles. A Noncommercial Junkyard may also include the storage or keeping of derelict vehicles. The Noncommercial
Junkyard shall be totally enclosed within a building or structure or visually screened from all adjacent properties and
public rights-of-way.
- JUNK:Scrap brass, iron, lead,tin,zinc;all other scrap metals and alloys;bones; rags; used cloth, rope, rubber,tinfoil,
bottles, old or used machinery of any type; used tools, used appliances; used lumber or crates; building materials;
fabrication of any material; used pipe or pipe fittings; used conduit or conduit fittings; used automobile parts;derelict
vehicles;used tires and other manufactured goods that are so worn,deteriorated,or obsolete as to make them unusable
in their existing condition.
KENNEL: Any place other than a PET SHOP or veterinary clinic or HOSPITAL, where five(5)or more HOUSEHOLD
PETS of one (1) species, or a total of eight (8) or more HOUSEHOLD PETS of two (2) or more species are kept or
maintained. Property that is zoned Agricultural (A)and not part of a platted subdivision or unincorporated town and
which is larger than ten(10)acres shall be permitted to keep or maintain eight(8) HOUSEHOLD PETS of one species
or sixteen (16) HOUSEHOLD PETS of two(2)or more species without being considered a KENNEL.
To bring your property into compliance with the Weld County Zoning Ordinance:
1.) The"Noncommercial Junkyard"must be removed or screened from all adjacent property owners and public rights-of-
way.
2.) An amended Use by Special Review"USR"application should show the dog kennel currently on the property or the
number of dogs shall be reduced within the guidelines established through the Weld County Zoning Ordinance.
3.) The current condition of the property shall be restored to meet the original intent of the approved Use by Special
Review "USR-768" or the "USR-768" shall be taken to a Probable Cause hearing in front of the Board of County
Commissioners to decide if revocation proceedings should follow.
Currently, your property is also in violation of the Weld County Building Code; however, the severity of the
violation has not yet been decided. Please be advised that I have enclosed a "Building Permit" for the Dog
Kennel. Please also be advised that there are other issues in addition to the "Dog Kennel" Structure.
Please call our office as soon as possible so that we may meet with someone on the property to advise them
of the current violations. Be advised that this violation affects many aspects of Weld County (Zoning
Compliance, Building Compliance, Department of Public Health and Environment, etc....)
I understand that there is a dispute as to ownership of the property. Weld County takes the position that the
violations need to be corrected regardless of the dispute and that since both parties claim ownership they are
both obligated to comply with County Ordinances.Mr Drawer also has an obligation to comply with zoning and
building codes as a tenant in possession. The dispute is a complicating factor in any amendment to the USR but
will not be accepted as an excuse for failing to remove the violation from the property.
It is the intention of this office to assist and cooperate with you without imposing undue hardships; however,we
have no discretion in this matter if you fail to correct this violation. You have 30 (thirty) days from ,January 2,
2001, to correct this zoning violation. Failure to do so will result in this office scheduling the violation before

the Board of County Commissioners may condition the decision to approve the
Special Review Permit upon implementation of such methods or techniques and
may require sufficient performance guarantees to be posted with the COUNTY to
guarantee such implementation.
24.4.4 Upon the Board making its final decision, a resolution setting forth that decision will
be drafted and signed. A record of such action and a copy of the resolution will be
kept in the files of the Clerk to the Board
24.4.5 If the Special Review Permit is approved, the Board shall arrange for the
Department of Planning Services to record the Special Review Permit Plan map
with the Weld County Clerk and Recorder.
24.5 Design Standards for Use by Special Review
24.5.1 An applicant for a Use by Special Review shall demonstrate compliance with the
following design standards in the application and shall continue to meet these
standards if approved for DEVELOPMENT.
24.5.1.1 Adequate water service in terms of quality, quantity, and dependability is available
to the site to serve the USES permitted.
24.5.1.2 Adequate sewer service is available to the site to serve the USES permitted.
24.5.1.3 If soil conditions on the site are such that they present moderate or severe limitations
to the construction of STRUCTURES or facilities proposed for the site, the applicant
has demonstrated how much limitations can and will be mitigated.
24.5.1.4 Adequate fire protection measures are available on the site for the STRUCTURES
and facilities permitted.
24.5.1.5 USES shall comply with the following storm water management standards:
24.5.1.5.1 Storm water retention facilities shall be provided on site which are designed to retain
the storm water runoff from the fully developed site from a one hundred (100) year
storm or as otherwise required by the Weld County Department of Public Works .
In the case of a LIVESTOCK CONFINEMENT OPERATION (L.C.O.), wastewater
collection, conveyance and retention facilities shall be designed and constructed in
accordance with the Confined Animal Feeding Operation Control Regulations (5
CCR-1002-19).
24.5.1.5.2 The drainage facilities shall be designed to release the retained water at a quantity
and rate not to exceed the quantity and rate of a five year storm falling on the
UNDEVELOPED site.
24.5.1.6 All parking and vehicle storage shall be provided on the site; parking shall not be
permitted within any public right-of-way.An adequate parking area shall be provided
to meet the parking needs of employees, company vehicles,visitors, and customers.
24.5.1.7 The USE shall comply with all the SETBACK and OFFSET requirements of the zone
district.
24.5.1.8 The access shall be located and designed to be safe; ingress and egress shall not
present a safety hazard to the traveling public or to the vehicle accessing the
property. For USES generating high traffic volumes and large number of large, slow
accelerating vehicles, acceleration and deceleration lanes may be required to
mitigate a potential traffic hazard.
24.5.1.9 New Accesses to Public Rights-of-Way shall be constructed using the following as

minimum standards:
Size of drainage structure twelve inch (12") diameter
Length of drainage structure twenty feet(20')
Depth of cover over pipe twelve feet(12") 12"
Width of access fifteen feet (15')
Maximum grade of access fifteen percent(15%)
Flare radius twenty feet(20')
Depth of surfacing four inch (4")
Standards exceeding these minimums may be required depending on the type and
volume of vehicles generated by the type of USE proposed.
24.5.1.10 Buffering or SCREENING of the proposed USE from ADJACENT properties may be
required in order to make the determination that the proposed USE is compatible
with the surrounding USES. Buffering or SCREENING may be accomplished
through a combination of berming, landscaping, and fencing.
24.5.1.11 Uses by Special Review in the A(Agricultural) District shall be located on the least
prime soils on the property in question unless the applicant can demonstrate why
such a location would be impractical or infeasible.
24.5.2 If the Special Review Permit for a MAJOR FACILITY OF A PUBLIC UTILITY OR
PUBLIC AGENCY is approved, the Planning Commission shall arrange for the
Department of Planning Services to record the appropriate Facilities Plan, Utility
Line, or Selected Route Map with the Weld County Clerk and Recorder.
24.6 Operation Standards for Uses by Special Review
24.6.1 An applicant for a Special Review Permit shall demonstrate conformance with the
following operation standards in the Special Review Permit application to the extent
that the standards affect location, layout and design of the Use by Special Review
prior to construction and operation. Once operational, the operation of the USES
permitted shall conform to these standards.
24.6.1.1 The operation of the USES shall comply with the noise standards enumerated in
Section 25-12-101 C.R.S. as amended.
24.6.1.2 The operation of the USES shall comply with the air quality regulations promulgated
by the Colorado Air Quality Control Commission.
24.6.1.3 The operation of the USES shall comply with the water quality regulations
promulgated by the Colorado Water Quality Control Commission.
24.6.1.4 The USES shall comply with the following lighting standards:
24.6.1.4.1 Sources of light, including light from high temperature processes such as
combustion or welding, shall be shielded so that light rays will not shine directly onto
ADJACENT properties where such would cause a nuisance or interfere with the USE
on the ADJACENT properties, and
24.6.1.4.2 Neither direct or reflected light from any light source may create a traffic hazard to
operators of motor vehicles on PUBLIC or private STREETS and no colored lights
may be used which may be confused with or construed as traffic control devices.
24.6.1.5 The USES shall not emit heat so as to raise the temperature of the air more than five
(5) degrees Fahrenheit at or beyond the LOT line.
24.6.1.6 Property shall be maintained in such a manner that grasses and weeds are not

permitted to grow taller than twelve(12) inches. In no event shall the property owner
allow the growth of NOXIOUS WEEDS.
24.7 Application Requirements for a Use by Special Review
24.7.1 The purpose of the application is to give the petitioner an opportunity to demonstrate
through written and graphic information how the proposal complies with the
standards of this Ordinance. The following supporting documents shall be submitted
as a part of the application except for those items determined by the Director of
Planning Services, in writing, or the Board of County Commissioners, on the record,
to be unnecessary to a decision on the application:
24.7.1.1 A statement which explains that the proposal is consistent with the COUNTY
COMPREHENSIVE PLAN and any other applicable Weld County Ordinance in
effect.
24.7.1.2 A statement which explains that the proposal is consistent with the intent of the
district in which the USE is located.
24.7.1.3 A statement which explains that the USES which would be permitted will be
compatible with the existing surrounding land USES.
24.7.1.4 A statement which explains that the USES which would be permitted will be
compatible with the future DEVELOPMENT of the surrounding area as permitted by
the existing zone and with future DEVELOPMENT as projected by the
COMPREHENSIVE PLAN of the COUNTY and any other applicable Weld County
Ordinance in effect, or the adopted MASTER PLANS of affected municipalities.
24.7.1.5 A statement which explains that the application complies with the Weld County
Zoning Ordinance, Section 50, Overlay District Regulations if the proposal is located
within any Overlay District Area identified by maps officially adopted by the COUNTY.
24.7.1.6 A statement which explains that if the USE is proposed to be located in the A
(Agricultural) District, that the applicant has demonstrated a diligent effort has been
made to conserve prime agricultural land in the locational decision for the proposed
USE.
24.7.1.7 A statement which explains that there is adequate provision for the protection of the
health, safety and welfare of the inhabitants of the NEIGHBORHOOD and the
COUNTY.
24.7.2 The following general information shall be submitted:
24.7.2.1 Name, address, and telephone number of the applicants.

Upon returning her call. She stated that Mr. Coan
(Hobday's Attorney) was away on vacation. She asked
that I forward all correspondence to them via fax
(330-2969).
12/28/2000 By: BJS Action: TEL Comments: Mr.
Brian Drawer called. (Tenant) He did not give me any
return phone number. He stated that he is aware of
some concerns on the property; however, the property
owner is in dispute right now. I stated that the
property owner did not matter. The County viewed the
tenant and owner at fault. He stated that he would
make progress on the property. He asked me to send
him a "Building Permit" for the "Dog Kennel". I sent
a copy of the "24.5 Design Standards", "24.6
Operation Standards" and a "Building Permit" to each
party involved. I told him that we needed to schedule
a meeting on his property, to go o\.. everything
exactly which we considered to be in violation. He
said he would call back to schedule a time.
