HomeMy WebLinkAbout20012568.tiff RESOLUTION RE: ACKNOWLEDGING THE REQUEST OF THE WINDSOR-SEVERANCE LIBRARY DISTRICT TO SUBMIT TO THE REGISTERED ELECTORS RESIDING WITHIN THE LIBRARY DISTRICT A PROPOSITION TO INCREASE THE AD VALOREM PROPERTY TAX LEVY BY 1.0 MILLS TO A TOTAL LEVY OF 3.546 MILLS; SUBMITTING SUCH BALLOT ISSUE TO SAID ELECTORS AT THE 2001 GENERAL ELECTION; CALLING THE ELECTION; AND CERTIFYING THE BALLOT TITLE WHEREAS, Weld County, Colorado, (the "County") is a political subdivision of the State of Colorado (the "State"), duly organized and operating under the constitution and laws of the State and under the Weld County Home Rule Charter, and WHEREAS, the Board of County Commissioners of the County (the "Board"), pursuant to State statute and the Charter, is vested with the authority of administering the affairs of the County, and WHEREAS, pursuant to the Colorado Library Law, Title 24, Article 90, Part 1, Colorado Revised Statutes, as amended (the "Act"), the Town of Windsor, Colorado, in cooperation with the Weld County School District No. RE-4, Weld County, Colorado, heretofore merged its public library into, and established the Windsor-Severance Library District (the "District) in accordance with law, and WHEREAS, on September 4, 2001, the Board of Trustees of the District adopted a resolution requesting that the Board submit to the registered electors residing within the District a ballot issue at the November 6, 2001, general election proposing an increase in the ad valorem property tax levy by 1.0 mills to a total levy of 3.546 mills in order to pay for District operations, including expanded library hours and services, additional personnel, improvement of the library's collection, and maintenance and improvement of existing library facilities, and WHEREAS, Section 24-90-112 of the Act provides that, upon the receipt of such a request, the board shall submit to a vote of the registered electors residing within the library service area a proposition containing the desired maximum tax levy specified in the request, and WHEREAS, Section 24-90-112 of the Act also authorizes the Board, upon approval of a tax levy by the electors, to levy the tax for the operation and maintenance of library districts, and WHEREAS, Section 20 of Article X of the Colorado Constitution and Article 1 of Title 29 of the Colorado Revised Statutes, as amended, place limitations on revenue collection, retention, arid expenditure by governments, and WHEREAS, the resolution submitted to the Board requests that the revenues received by the District from the ad valorem property tax levy be excluded from such constitutional and statutory limitations, and 2001-2568 l C L�� e� GJ'ndxr �n y�C2') sfhef SD0091 RE: REQUEST OF WINDSOR-SEVERANCE LIBRARY DISTRICT PAGE 2 WHEREAS, the Board determines that the question of increasing the ad valorem property tax levy by 1.0 mills to a total levy of 3.546 mills shall be submitted to the registered electors of the District, along with the approval of such levy as a voter-approved revenue change permitting the proceeds of such levy to be collected and spent by the District without regard to any constitutional or statutory limitations. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF WELD COUNTY: Section 1. Election called. It is hereby determined that an election shall be held on November 6, 2001, for the purpose of submitting to the registered electors residing in the service area of the District the question set forth hereafter. The conduct of the election shall conform, so far as practicable, to the general election laws of the State of Colorado. Section 2. Election Official. The Weld County Clerk and Recorder is hereby designated as the County's "designated election official" as defined in Section 1-1-104(8), Colorado Revised Statutes, as the person responsible for running the election, and is directed and authorized to take any action as may be necessary to conduct the election in accordance with applicable law. Section 3. Ballot Title. This Resolution shall serve to set the ballot title. The ballot title shall be as follows and is hereby certified to the Weld County Clerk and Recorder for submission to the registered electors residing in the service area of the District in Weld County: "Shall the Windsor-Severance Library District taxes be increased $189,000.00 in 2002, and annually thereafter in such amounts as are received by the imposition of an increase in the existing ad valorem property tax levy by 1.0 mills, with the total amount of said levy not to exceed 3.546 mills, in order to pay for District operations, including expanded library hours and services, additional personnel, improvement of the library's collection, and maintenance and improvement of existing library facilities, and shall the proceeds of such taxes and investment income thereon constitute voter-approved revenue changes and be collected and spent by the District in 2002 and each year thereafter for any lawful purpose without regard to any spending, revenue raising, or other limitations in Article X, Section 20, of the Colorado Constitution, and without regard to the tax revenue limitations contained within Section 29-1-301, et seq., Colorado Revised Statutes? The Weld County Clerk and Recorder shall cause notices to all eligible electors of the County to be mailed in accordance with Article X, Section 20(3)(b) of the Colorado Constitution, Section 1-5-205, Colorado Revised Statutes, and other applicable laws. Such notices shall be in the form and contain the information required by law. In addition, such other notices of the election as shall be required by law or deemed by the County Clerk and Recorder to be necessary or appropriate shall be given in the time, form, and manner required by law. Section 6. Interpretation in Coniunction with IGA: The District and the County have entered into a Memorandum of Intergovernmental Agreement for Conduct of Coordinated Elections for the November 6, 2001, general election ("IGA"). In the event the terms of this Resolution are in conflict with the IGA, the terms of the IGA shall govern and control. Section 7. Severability Clause. If any provision of this Resolution or the application thereof to any person or circumstances is held invalid, such invalidity shall not affect other provisions or application of the Resolution which can be given effect without the invalid provisions or applications, and to this end the provisions of this Resolution are declared to be severable. Section 8. Recordation.
