The Weld County Public Works Department has reviewed this Site Plan. This review assumes this is a new building.
COMMENTS:
American with Disabilities Act (ADA) Requirements: This site will be required to meet all requirements of the
Americans with Disabilities Act. ADA parking spaces are 20' x 8' with 5' aisles. At least one space must be van
accessible (8' wide aisle). An accessible path will be required from the building to the public right-of-way. These
requirements are valid, even if this is a remodel.
Storm Water: If this is a new building, the developer should address how he plans to deal with the increase in storm
runoff The calculations will need to be stamped by a licensed engineer from the State of Colorado. A complete drainage
study will not be required. The engineer should discuss the requirements with the Public Works Department.
Parking: Parking should not back into a public right-of-way.
Traffic Impacts: A
traffic study would normally be required. Due to the size of Stoneham, I will waive this requirement.
RECOMMENDATION: Approval
DEVELOPMENT CONDITIONS (If Approved):
Off-street parking shall be provided.

Environmental Health Services has reviewed this proposal for a Tavern. Our Department recommends
approval of the request.
Prior to recording the plat, the applicant shall:
1. Provide evidence that the well has been permitted for domestic and commercial uses.
Prior to commencing business, the applicant shall:
1. Show evidence of compliance with the Colorado Retail Food Establishment Rules and Regulations.
2. Show evidence of compliance with the requirements for a public water system as defined in the
Primary Drinking Water Regulations (5 CCR 1003-1).
The following conditions are recommended to be part of any approval:
1. All liquid and solid wastes(as defined in the Solid Wastes Disposal Sites and Facilities Act,
30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that
protects against surface and groundwater contamination.
2 No permanent disposal of wastes shall be permitted at this site.
3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust,
blowing debris, and other potential nuisance conditions.
4. This facility shall adhere to the maximum permissible noise levels allowed in the Commercial Zone
as delineated in 25-12-103 C.R.S., as amended.
5. Adequate toilet facilities shall be provided for the public.
6. The septic system shall be reviewed by a Colorado Registered Professional Engineer. The review
shall consist of observation of the system and a technical review describing the systems ability to
handle the proposed hydraulic load. The review shall be submitted to the Environmental Health
Services Division of the Weld County Department of Public Health and Environment. In the event
the system is found to be inadequately sized or constructed the system shall be brought into
compliance with current Regulations.
7. The water system shall maintain compliance with the requirements for a public water system as
defined in the Primary Drinking Water Regulations (5 CCR 1003-1).
8. The applicant shall maintain compliance with Colorado Retail Food Establishment EXHIBIT
Regulations.

Dear Heather:
I am enclosing a Public Drinking Water System Inventory Form for the well owned by David
Gillespie and used by several homes in the town of Stoneham. The inventory form lists 13 year
round_residents which are currently using this well. Mr. Gillespie indicated to me in an earlier
phone conversation that this well serves six homes, two churches, and a community center.
Our department has received some information that there may be interest itlon nin a r s a ant
in the area that woul also e served by this well. I have spoke with both Mr. Gillespie and
Margaret Samber, the owner of the proposed restaurant, about the possibility that this addition
would classify the well as a public water system. I have also explained to Mr. Gillespie that
should this well become a public system, as the owner, he would be the responsible party and
would need to comply with state drinking water regulations.

Subject: Bar and Grill in Stoneham
As a follow up to our conversation yesterday about the restaurant that Margaret Samber is proposing to
open in Stoneham, I called David Gillesby. David is the owner of the well that Margaret wants to use as
the water source. I explained to David that by putting the restaurant on the well it would probable increase
the number of people using the well enough to qualify it as a public water system through the state and
they would then need to comply with the drinking water regulations. I explained that this would be his
responsibility because he is the owner of the well and that our office would need to have information that
the water system was in compliance with the state regs in order to issue a food service licence to
Margaret.
I have talked with David before about this well. They currently have 9 building on this well, (6 homes, 2
churches, and a community center). David told me he thought that was about 15 people using the well
regularly. I believe that he has filled out the inventory form from the state before also so they should have
some information on that well. I am sending out another form for him to fill out. I will let you know when I
get that in and you can take a look at it. Thanks.

I have reviewed this application for a change of zone in the unincorporated Town of
Stoneham. I do not oppose a change of zone from agriculture to commercial for most uses. I am
concerned, however, that once a change of zone occurs, licensed use becomes the only means of
control. In this specific case, I oppose this application because of the proposed use.
A tavern requires a high level of law enforcement service than other liquor licensed
businesses. This location is remote from more densely populated areas of Weld County where
patrol and call response resources are concentrated. Service requests in this area are extremely
infrequent. As a result, reasonable response time and routine service levels for a commercial use
of this type would be a significant strain on present resources and service of this type is not
included in the multi-year improvement plan developed in 1998.
