The Department's complaint process is that when a complaint is received, the Department shall attempt to resolve it informally within thirty (30) days of receipt of the complaint. In your case, Richard Rowe, Assistance Payments Administrator, and Suzanne Cowan, Food Stamp Manager, will attempt to resolve your complaint regarding Food Stamps. If your complaint is not resolved to your satisfaction, you may transmit your complaint, within ten (10) working days, to Judy A. Griego, Director of the Weld County Department of Social Services. The Director will act upon the complaint within twenty (20) calendar days of receipt and issue a written decision. If you have a complaint concerning categorical program issues, the complaint must be appealed and resolved as outlined in the appropriate program state manuals. The Assistance Payments Administrator will provide you with necessary information on appeals if warranted. Your complaint regarding the Housing Authority has been forwarded to Tom Teixiera, Manager of the Greeley/Weld Housing Authority. He will respond to you directly. While our records are confidential, and we maintain strict _. confidentiality policies, we will respect her request of your office to look into her concerns. Therefore, this letter is response to your_letter. _ _ The Greeley-Weld Housing Authorities are—not =divisions of Social Services. The Housing Authorities are independent agencies-run by an Executive Director, under the direction of a Board of Commissioners, and overseen-by the United States Department of Housing and Urban Development. We can only respond to those items directly related to Ms. Lindsay's housing situation. Ms. Lindsay has been a participant of the Section 8 Program since 1995. She is currently receiving rental assistance through the Housing Authority of the City of Greeley. Thomas Teixeira, Executive Director, spoke with Ms. Lindsay on March 19, 2001 and explained to her in detail how her rent was figured. Ms. Lindsay indicated she understood at that time. Ms. Lindsay's household consists of herself and her daughter. She is eligible for rental assistance up to $ 643 per month. Rental assistance is the amount of rent paid to the landlord, as well as the Utility Allowance (UA) for utilities she is responsible to pay according to the unit size. Her contract rent is $550, her UA is $175 making her total tenant payments $725.00 per month. Her rental assistance from the Housing Authority cannot exceed $643 per month. This leaves her with the remaining $82.00 on top of the 30% of her income she is responsible for per HUD regulations. Currently, Greeley Housing Authority pays $279 to the landlord on her behalf; she pays $271.00 to the landlord, and she pays for all her utilities. Her income and expenses for childcare have been verified by third parties. She has received a deduction for her childcare and for having one dependant, leaving her with an adjusted monthly income of $1,214.00 The rent is calculated in this manner: 1. Monthly Adjusted income $1,214.00 x .30 = $364.00 2. 30% of income $ 364.00+ 3. Amount above payment standard $ 82.00= $446.00 subtract the UA 4. UA $ 175.00= $271.00 is her portion of the rent. There are many items that will increase rent. In Ms. Lindsay's case, she received a raise and since her portion is based upon her income, this caused an increase in her rent. She also moved to a larger unit, which had a higher rent and higher UA. The combination of these increases exceeded our payment standard and also resulted in an increase in her rent. Ms. Lindsay further states her previous rent to have been $202 per month. This amount was calculated using her reported income in July 2000, and was based upon a two- bedroom unit with a smaller UA. During her annual recertification with her technician, Ms. Lindsay provided verification of her new income. Her new income had increased $178.00 per month. This increase in her wages translates into a $53.00 increase in her rent. Again, Ms. Lindsay's increase in household income and her moving to a larger unit with increased utility needs led to the increase in her portion of her rent. ----Staff become very cautious any time a participant with a two-bedroom-voucher requests - — --to move--toaa three-bedroom unit because of the flags=it.raises, --Generally;-moving.to a larger than approved unit will result in-a_substantially large increase in rent and usually exceeds the payment standard. Staff members are not able to estimate the cost of a unit - until all the details have been submitted--in writing, because the payment standard is set based upon units having the utilities included. Ms. Lindsay chose a=unit where all utilities were the responsibility of the tenant. Since utilities are not included we must subtract the UA for that unit size from the total payment standard to arrive at our rental assistance limit. We are not certain with whom Ms. Lindsay, spoke, because the Section 8 Technician assigned to her is very experienced in these matters and is also very detailed in her dealings with our participants. Had she spoken directly with her Section 8 Tech, she would have been informed of the possibility of any increases. If I can be of further assistance, please do not hesitate to contact me.
