J. Geile, Chair Commissioner Glenn Vaad, Pro-Tem Commissioner William Jerke Commissioner David Long Commissioner Robert Masden Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Lauren Light Health Department representative, Trevor Jiricek Public Works representative, Don Carroll The following business was transacted: I hereby certify that pursuant to a notice dated November 16, 2001, and duly published November 21,2001, in the Tri-Town Farmer and Miner,a public hearing was conducted to consider the request of Lucerne, Inc., do Ralph Anders, for a Site Specific Development Plan and Use by Special Review Permit #1355 for an Agricultural Service Establishment (storage and distribution of bagged seed and equipment storage) in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Lauren Light, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. Ms. Light gave a brief description of the location of the site and surrounding uses. She stated the site is currently vacant and the applicant is proposing to construct a 4,000 square foot building, which will be accessed from Railroad Avenue. Ms. Light stated the Town of Eaton indicated it has no conflicts with the proposal. The City of Greeley stated the application does not comply with its 20/20 Comprehensive Plan because it proposes a high industrial use adjacent to residential uses. Ms. Light clarified this proposal is not industrial, there will be no animals on the site, and added six referral agencies responded with no comments, three submitted comments which have been addressed in the Conditions of Approval and Development Standards, and the Sheriffs Office did not respond. Don Carroll, Department of Public Works, stated Railroad Avenue is paved and will be used to load and unload the product. He stated Weld County maintains all of the streets in the Town of Lucerne. Responding to Chair Geile, Ms. Light stated Condition of Approval #2.B requires the applicant to provide landscaping as a buffer for the house to the south; however, the landscaping will not be as extensive as requested by the City of Greeley. 2001-3353 C(2 /9.2 )67./ PL1574 HEARING CERTIFICATION - LUCERNE, INC., C/O RALPH ANDERS (USR #1355) PAGE 2 Ralph Anders represented the applicant and stated the current site is too small due to increased business,and the proposed building will provide adequate grain and equipment storage. No public testimony was offered concerning this matter. Commissioner Vaad moved to approve the request of Lucerne, Inc., c/o Ralph Anders, for a Site Specific Development Plan and Use by Special Review Permit#1355 for an Agricultural Service Establishment (storage and distribution of bagged seed and equipment storage) in the A(Agricultural)Zone District,based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. The motion was seconded by Commissioner Jerke. In response to Chair Geile, Mr.Anders stated he has reviewed and agrees with the Conditions of Approval and Development Standards There being no further discussion,the motion carried unanimously,and the hearing was completed at 10:45 a.m. This Certification was approved on the 10th day of December 2001.
