HomeMy WebLinkAbout830149.tiff RESOLUTION RE : APPROVAL OF USE BY SPECIAL REVIEW FOR A CATTLE AND HOG FEED- LOT EXPANSION-LELAND CARLSON WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 7th day of December, 1983, at the hour of 2 : 00 o' clock p.m. in the Chambers of the Board for the purpose of hear- ing the application of Leland Carlson, 15274 Weld County Road 72 , Greeley, Colorado 80631, for a Use by Special Review for a cattle and hog feedlot expansion on the following described real estate, to-wit: Northwest a, Section 10, Township 6 North, Range 66 West of the 6th P.M. , Weld County, Colorado WHEREAS, Section 24 . 4 . 2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the re- quest of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence pre- sented in this matter, and having been fully informed, finds that this request shall be approved for the following reasons : 1. The submitted materials are in compliance with the application requirements of Section 24 . 7 of the Weld County Zoning Ordinance. 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24. 4. 2 of the Weld County Zoning Ordinance as follows: a. The proposal is consistent with the Comprehensive Plan policies in that the use does not infringe on the continued agricultural use in the vicinity or County. The proposal does not appear to have any adverse impacts on the agricultural interests of the County or the environment. b. The proposal is consistent with the intent of the Agricultural Zone District and is provided for as a Use by Special Review. c. The Greeley Planning Commission recommends approval of this proposal. Use by Special Review Operation and Design Stand- ards, as amended, provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the application for a Use by Special Review for a cattle and hog feedlot expansion on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions; 1. The attached Standards for Use by Special Review, as amended, be adopted and placed on the Use by Special Review plat prior to recording. 2. No building or electrical permits shall be issued for the Use by Special Review Permit area until the Stand- ards for the Use by Special Review have been placed on the Use by Special Review plat and the plat has been delivered to the Department of Planning Services Office. The uses permitted shall be a livestock confinement operation for a hog and cattle feedlot as described in the application materials on file with the Department of Planning Services. ** 2. The maximum number of livestock, as described in the submitted application materials, shall be three thousand (3,000) head. 3. The total area for stock-pens shall be approximately eight and one-half (8.5) acres. 4. All phases of the operation shall comply with all County and State Health Standards and Regulations pertaining to air quality, water quality, noise emission, and sanitary disposal systems. 5. The Use by Special Review Area shall be amended to show the retention pond area. Retention of feedlot run-off shall be accomplished in accordance with the Regulations for the Control of Water Pollution from Feedlots (April, 1974) and with the Guidelines for Design of Feedlot Run-off Containment facilities (May, 1978) as published by the Colorado Department of Health. The applicant shall be responsible for any additional requirements issued by the Colorado Department of Health, Water Quality Control Division. 6. There shall be no discharge of wastes into any streams, other bodies of water, or adjacent drainage systems without obtaining a National Pollution Discharge Elimination System Permit fran the Department of Health. 7. The applicant shall comply with the design standards for the Use by Special Review, Section 24.5 et seq. , of the Weld County Zoning Ordinance. 8. The applicant shall comply with the Operation Standards for Uses by Special Review, Section 24.6 et seq. , of the Weld County Zoning Ordinance. 9. Representatives or members of the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the site at any reasonable time in order to insure the operations carried out on the site comply with the Operation Standards stated hereon and all applicable Weld County Regulations. 10. The Use by Special Review shall be limited to the plans shown hereon and governed by the Standards as stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Standards as shown or stated above shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans and/or Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 11. The property owner and/or operator of this operation shall be responsible for complying with all of the above stated Standards. Noncompliance with any of the above stated Standards may be reason for revocation of the Permit by the Board of County Commissioners. ** Operation Standard #2 should be amended to read as follows: The maximum number of livestock as defined in the submitted application material shall be 3,000 head of cattle and 1,000 head of hogs. Russell Anson Planning Department Representative, James Mayerl The following business was transacted: I hereby certify that pursuant to a notice dated November 21, 1983, and duly published November 23, 1983, in the La Salle Leader a public hearing was con- ducted for the purpose of considering the request of Leland Carlson for a Use - by Special Review for a cattle and hog feedlot expansion. Russell Anson, Assistant County Attorney, read this request into the record. James Mayerl, Planning Department representative, read the favorable recommendation from the Planning Commission into the record. He also read the conditions and the Operation Standards recommended by the Planning Commission into the record. Mr. Mayerl said Operation Standard #2 should be amended to read: "The maximum number of livestock as defined in the submitted application material shall be 3,000 head of cattle and 1,000 head of hogs." Mr. Leland Carlson came forward to explain his request. Commissioner N. Carlson asked if there is adequate drainage at the site. Mr. Carlson explained that there is a slope and there will be a retention pond built to catch the runoff. After a short discussion, Commissioner N. Carlson said he would like to note for the record, that even though he and the applicant have the same last name they are not related. Commissioner N. Carlson then moved to approve, with the amended Operation Standards, Use by Special Review for a cattle and hog feedlot expansion as requested by Leland Carlson. Commissioner Brantner seconded the motion. The Chairman, C. Carlson, explained that he will abstain from voting on this matter because he and the applicant are related. The motion carried with Commissioners N. The application additionally includes expansion of our 700 - 800 head hog feeding operation to 1000 head capacity . Both are consistent with the Weld County Comprehensive Plan in that they will be helping to preserve Agriculture and the livestock industry in Weld County . This is in an area which is zoned for agriculture purpose . It is 3 1/2 miles from Eaton and 6 miles from the city of Greeley . The feedlot will be constructed on ground which is costly to irrigate in that the water has to be lifted up to get to the field . It is 1 /2 mile to the nearest neighbor ' s farmhouse. When both stages are completed it will require one shift of 4 employees working at the lot . The Plan is in 2 stages : 1 Stage 1 would allow for feeding capacity of 2000 head and would be constructed this fall . 2 . Stage 2 would allow for an additional 1000 head and would be constructed next year . The feedlot will be managed and cared for in a proper and efficient manner to insure protection of the health, safety and welfare of the inhabitants of the neighborhood and county . The feedlot already has a feedmill for processing grain, grain dryers and storage bins to facilitate feed handling requirements . Feed and livestock trucks will have easy access to the feedlot off of county road 72 . The feedlot is located between highways 31 and 33 . A collection pond for any and all waste material to the east of the lot will be constructed if deemed necessary . This is in a natural drainage area and is where the land is already non- productive . We plan to secure evergreen trees from the ASCS office in the spring of 1984 to plant on the north side, next to road 72, and or, the west side for wind protection and improved appearance . I have put together the following facts which I feel should satisfy Ms. Dolan' s requirements. The existing cattle pens and proposed feedlot expansion are located in the NE4 of the NWk of Section 10, T6N, R66W, of the 6th P.M. Most of the existing cattle pens and all of the proposed expansion lies within a 19-acre area that drains to the NE Corner of the NW4 Section 10. Historically, runoff from this 19-acres plus a small part of the S+ of Section 3 and the NW Corner of the NEk of Section 10 collected in a low area near the N'4 Corner of Section 10. Land leveling operations in the NEk of Section 10 have changed runoff flow patterns so that runoff from the NE4 normally flows to the South. (See attached map) . A drain line was installed from an irrigation tailwater pond in Section 3 that now allows overflow from the pond to flow one mile West to a natural drainage ditch. There have been very few instances when runoff from the 19-acre parcel has reached the tailwater pond according to Lee Carlson. In order to meet State and Federal regulations concerning runoff from feed- lots , drainage ditches will be constructed around the existing and proposed expansion. A holding pond will be constructed in the low area East of the proposed expansion that will collect and hold runoff from the feedlot area separate from runoff from the remainder of the 19-acre parcel . This holding pond would be constructed according to applicable State and Federal regula- tions. Adequate sedimentation ponds will be provided ahead of the holding pond. At this time, we are unable to make a determination on the project, due to insufficient information. According to Federal and State regulations, the feedlot must have adequate retention capacity to contain runoff from a 25-year, 24-hour precipitation event (3.3 inches at this facility). In order to determine whether or not the feedlot meets our requirements, we need the following information: 1) The total pen area acreage; 2) The total acreage that would drain into the retention area; 3) The volume of any other process waters generated (trough water, etc.) ; 4) The runoff drainage direction. Is it possible for feedlot runoff to reach the irrigation lateral? 5) The specifications of the planned retention pond. The application states that this is in a natural drainage area. In that case, the pond must be sized to hold the runoff from the entire drainage area, which is not usually the most practical course. Therefore, we recommend that you obtain additional information from the applicant prior to approving his application. If you have any questions, please give us a call.
