The Weld County Department of Public Works has reviewed this PUD change of Zone application. Comments made
during this phase of the Planned Unit Development process may not be all inclusive, as other concerns or issues may
arise during the remaining application process.
COMMENTS:
External Roadways: WCR 40.5 is designated as a local roadway in the Weld County Transportation Plan. The plat
shows that the required 60 feet of right-of-way has been dedicated south of the section line (Book 43, Page 495). .
Internal Roadways: All PUD roadways are to be paved. The minimum paved roadway section is two 12-foot lanes
with two 4-foot shoulders. The shoulders should maintain the 2%cross slope. The alignment for the internal roadway
is based on the existing access easement for the property to the north. The road should extend to the north property
line. Since the roadway is less than 1500 feet long, the additional turn-around is not required. A stop sign and street
name sign will be required at the intersection with WCR 40.5.
Storm Water: Adrainage report was submitted and reviewed. The engineer has requested retention ponds;however,
because the development is so close to the Little Thompson river and because of the large size of the lots, retention
does not seem necessary. If he concurs, the engineer should amend his report accordingly.
Traffic Impacts: The existing counts provided by the engineer are lower than the average daily traffic counts(ADTs)
completed by the County in 2000. Using the County's numbers, this development, the Neal development, and the
existing recorded exemption will increase the traffic on the adjacent roadways above the 200 vehicles per day (vpd)
level. The developer has agreed to pay for a proportional share of paving these roadways.
RECOMMENDATION: Approval
DEVELOPMENT CONDITIONS (If Approved):
❑ The internal roadway will be paved to be consistent with the subdivision regulations. The cul-de-sac edge of
pavement radius shall be 50 feet.
❑ The right-of-way for the internal roadway will be dedicated to the County.
❑ A stop sign and street name sign shall be placed at all intersections.
❑ Landscaping and entrance signs within the intersection sight distance triangle shall be less than 3.5 feet high.
❑ The drainage study shall be revised and resubmitted.
❑ A proposal to share the cost of paving the nearby roads shall be submitted.

The Weld County Department of Public Health and Environment has reviewed this proposal.
The application has satisfied Chapter 27 of the Weld County Code in regard to water service. Water is
proposed to be provided by the Little Thompson Water District. A water service agreement from Little
Thompson Water District has been provided in the application materials.
The application has satisfied Chapter 27 of the Weld County Code in regard to sewer service.
Sewer will be provided by individual sewage disposal systems. The minimum proposed lot size of 2.6 acres
coupled with the overall density of one system per 4.7 acres meets the current Department policy. The septic
systems for Lots 4 and 5 must be located outside the boundary of the flood plain.
The initial impact plan submitted in the application materials appears to address all impacts as required by
Section 27-6-40 of the Weld County Code.
The Department recommends that septic envelopes be preserved in a manner that will allow it's future use in
the development covenants. Specifically, the development covenants should address activities such as
landscaping (i.e. planting of trees and shrubs) and construction (i.e. auxiliary structures, dirt mounds, etc.)
should be expressly prohibited in the designated septic envelopes.
The Department recommends approval with the following conditions:
1. Water service shall be obtained from the Little Thompson Water District.
2. A Weld County Septic Permit is required for each proposed septic system and shall be installed according
to the Weld County Individual Sewage Disposal System Regulations. Each septic system shall be
designed for site-specific conditions, including but not limited to maximum seasonal high groundwater,
poor soils, and shallow bedrock.
3. Language for the preservation and/or protection of the second absorption field envelope shall be placed in
the development covenants. The covenants shall state that activities such as landscaping(i.e.planting
of trees and shrubs) and construction (i.e. auxiliary structures, dirt mounds, etc.) are expressly
prohibited in the designated absorption field site.
4. The applicant shall obtain a storm water discharge permit from the Water Quality Control Division of the
Colorado Department of Public Health and the Environment,if required. Silt fences shall be maintained
on the down gradient portion of the site during all parts of the construction phase of the project.
5. During development of the site,all land disturbance shall be conducted so that nuisance conditions are not
created. If dust emissions create nuisance conditions, at the request of the Weld County Health
Department, a fugitive dust control plan must be submitted.
6. In accordance with the Regulations of the Colorado Air Quality Control Commission any development that
disturbs more than 5 acres of land must incorporate all available and practical methods which are
technologically feasible and economically reasonable in order to minimize dust emissions.
7. If land development creates more than a 25 acre contiguous disturbance,or exceeds 6 months in duration,
the responsible party shall prepare a fugitive dust control plan, submit an air pollution emissions notice, I'
and apply for a permit from the Colorado Department of Public Health and Environment. m

1. Building permits shall be obtained prior to any construction. Building permits are not
required for buildings that qualify for and receive a Certificate of Compliance, but an electrical
permit will be required for all buildings if electrical service is provided to the building.
2. A plan review will be required for each building. Two complete sets of plans are required
when applying for the permit.
3. Buildings shall conform to the requirements of the 1997 UBC, 1998 IMC, 1997 IPC, 1999
NEC and Chapter 29 of the Weld County Code.
4. Each building will require an engineered foundation based on a site-specific geotechnical
report or an open hole inspection performed by a Colorado registered engineer. Engineered
foundations shall be designed by a Colorado registered engineer.
5. A Flood Hazard Development Permit shall be submitted for all buildings constructed on
parcels that fall in the 100 year flood plain.

It is important the address range and road name for the PUD appear at the entry from CR
40.5. Dove Haven Lane is not duplicated in the street name geo-file and is acceptable. All
individual addresses must be prominently displayed, particularly during hours of darkness, at
each lot access to the internal road.
The Sheriffs Office would be significantly impacted by response to intrusion alarms at
any of these residences. If owners elect to install such property protection, alarms should be
audible/visible to deter perpetrators by noise/flashing lights and primary response to an alarm
should be included in a service contract with a private security company.
While this proposal may not appear significant by itself, the cumulative impact of this
type of residential growth will significantly impact law enforcement services over time for
everyone in the county. The Sheriffs Office is unable to absorb any additional service demand
without the additional resources requested in the multi-year plan provided to the Board of
County Commissioners in 1998. I have no other comments on this proposal.

Thompson School District R2-J Development Impact Report
DoveHaven PUD / Clinton Rockwell III (#S-575), dated 10-18-00 with 5 dwelling units, is located within the
current attendance bo-mdaries of Ivy Stockwell Elementary School, Turner Middle School, and Berthoud High
School. Construction is estimated to start in 18 months and build at an annual rate of 3 dwelling units per year
resulting in an expected growth in enrollment of 2 elementary, 1 middle school and 1 high school students by 2003.
According to Mister Plan 2000's five-year projection, the estimated student population from this development,
and others that have received final plat approval, should not cause district enrollment to exceed service level C.
Five years is the longest projection time frame considered reliable.

• Ills Stockwell Elementary is currently at service level A and is expected to remain at that level during the next five
rears. Turner Middle School (with its new addition) is currently at, and is expected to remain at, service level A
for the next five years. Berthoud High (with its new addition) is also at, and expected to remain at, service level A
for the next five years.
• The District's citizen-based Master Plan Committee (MPC) monitors capacity levels at each of the district
schools and makes annual recommendations for responding to projected enrollment changes. In consideration of
the probable impact(s) of this development, the MPC may recommend using one or more of the tools described on
the back of this report. The selection and timing of the most appropriate tool(s) will be determined by the Board
of Education. These tools do not affect class size or services available to students. The student-to-teacher ratio
is based on per pupil funding, which is determined by the State of Colorado legislature.
• The size and location of this development indicate that the school district land dedication requirement should be
made in the form ofpayment-in-lieu-of land dedication at the time of issuance of a new residence buildinz

expected to increase during the next twelve months.

Dear Mr. Anderson:
I have visited and reviewed the subject property and proposed development as to potential impacts on
wildlife. The area generally cannot be considered as critical habitat for any wildlife species. However, a
check with the Division's Denver office or with the U.S. Fish and Wildlife Service as to the Preble's
Meadow Jumping Mouse may be appropriate. Big Hollow Creek flows near the east property line. I
observed cattails and other wetland associated plants within what appeared to be the property boundaries
of this site. Therefore, under 6.3.1 Component one—Environmental Impacts, I would question the
statement regarding"Wetland Removal"where it was stated that the site does not contain any wetland
areas. The east side, and especially the northeast corner of the property appear to have wetland
associated species located on the property in question. Therefore, any disturbance of this area may
require consultation with the U.S. Fish and Wildlife Service for possible Preble's Meadow Jumping
Mouse concerns. The development calls for open space along this edge. This may or may not be
adequate in size for a buffer zone in this area. Again, further consultation with the U.S. Fish and Wildlife
Service and surveys may need to be completed.
Other than the northeastern and eastern edge,the parcel is currently agricultural land. Coyote, fox,
raccoon, skunk, deer, songbirds, raptors and herptofauna may frequent this area. Occasionally the Little
Thompson may serve as a corridor for black bears and mountain lions traveling east and west.
Homeowners should be made aware of the presence of native predators. Pets should not be allowed to
roam free. All domesticated livestock and farm animals should be secured with wildlife proof fencing
appropriate for the species being raised. Pets as well may negatively interact with wildlife even on the
home-sites and homeowners will be responsible for handling these problems. Homeowners should secure
pet and animal feeds, trash containers, and charcoal/gas grills. Pets should have current shots. All
control of nuisance wildlife will be the homeowner's responsibility with the possible exception of bears
and mountain lions.

Homeowners should also be aware that hunting would be an ongoing fall and winter activity on lands
surrounding the development. Shooting will occur normally in the early mornings until dark on these
areas. The sounds of gunfire may be somewhat distracting, yet should be noted to the potential owners
and developer.

Dear Mr. Anderson:
We have reviewed the above referenced proposal to subdivide a 26-acre parcel
into 5 single-family residential lots. The proposed water source is the Little Thompson
Water District and a letter of commitment for service was included. The letter from the
District obligates service for up to 5 residential lots.
The District will supply treated water to the development. As a condition of
activation of the taps, the applicant must transfer 1 unit of Colorado-Big.Thompson
(CBT) raw water (acre-foot per unit) for each lot, administered by the Northern Colorado
Water Conservancy District, to Little Thompson Water District. The applicant must
provide evidence that the CBT water has been transferred to the District prior to final
platting.
Pursuant to Section 30-28-136(1)(h)(II), C.R.S., it is our opinion the District has
submitted sufficient evidence documenting that the proposed water supply can be
provided without causing injury to existing water rights, and with the District serving the
• proposal, the supply is expected to be adequate.

Dear Mr. Anderson:
I met with Dave Hoskins today and reviewed the development plan for the above P.U.D. The
P.U.D. has a single access o11'uf Weld County Road 40 1/2. The District prefers multiple access,
however due to limited frontage we approve the single access with the stipulation that Mr.
Hoskins has constructed a second turnaround 600' from the single point ol'access.
In addition. Mr. Hoskins identified the approximate location of the two fire hydrants that he will
have installed.

Robert:
The Town of Berthoud has received a county referral for the Dove Haven KID. The proposed
development is located within the Community Influence Area and is also identified on the
Town's Land Use Plan as a "cropland support area". The Town's Land Use Plan states that in
the Community Influence Area, "properties should not be upzoned in the County, unless
associated with clustering and effective conservation measures". The intent of the cropland
support area is to maintain the viability of cropland east of the Town.
The proposed development does not appear to be designed with clustering in mind. Clustering
would result in the lots being smaller and larger areas left in open space. Septic systems could
either be located in common open space or on lots with a minimum lot size of 1.0 acres, as
required by Weld County. As currently planned, the open space appears to be area that is "left
over" and not otherwise useful. Clustering of smaller lots would result in larger areas of open
space. One alternative would be to strictly control what could be constructed outside the house
template and to designate a building envelope, leaving the remainder of the individual lots to
appear "visually open". However, as currently proposed,the Dove Haven PUD is not in
conformance with the Town of Berthoud's Land Use Plan and therefore, not supported by the
Town.
