A public hearing was conducted on February 14, 2001, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated January 19, 2001, and duly published January 24,
2001, in the Tri-Town Farmer and Miner, a public hearing was conducted on February 7, 2001, to
consider the request of Katharine Oliver for a Site Specific Development Plan and Use by Special
Review Permit#1199 for a Gravel Mining Operation in the A (Agricultural) Zone District. At said
hearing on February 7, 2001, Commissioner Glenn Vaad deemed it advisable to continue this
matter to Wednesday, February 14, 2001, at 10:00 a.m., due to the lack of a quorum. Lee
Morrison, Assistant County Attorney, made this a matter of record. Anne Best Johnson,
Department of Planning Services, presented a brief summary of the proposal and entered the
favorable recommendation of the Planning Commission into the record as written. She stated this
application requests 44.42 acres be amended out of the original mining permit, and added the
applicant has already been approved to develop a Planned Unit Development for Meadow Vale
Phase Two at this site. She further stated the Change of Zone and Final Plat approvals are
conditional upon the applicant amending this portion out of the mining permit. Ms. Johnson gave
a brief description of the surrounding uses, and stated the applicant received a release from the
Division of Minerals and Geology in December 1998. She further stated staff recommends
approval of this request for the reasons as listed in the Administrative Review. Diane Houghtaling,
Department of Public Works,stated she has not yet received roadway plans for Weld County Road
5.5; however, the applicant has indicated the plans are complete and will be submitted within the
next week. She indicated the location of Weld County Road 5.5 on the west boundary line, and
responding to Commissioner Masden, Ms. Houghtaling stated it will be a collector road with two
through lanes. She added the projected traffic count for 2020 is 2,600 vehicles per day.
Floyd Oliver represented the applicant and confirmed the roadway plans are complete and will be
submitted by the end of this week. Responding to Chair Geile, Mr. Oliver stated they paved Weld
County Road 5.5 in 1998 and reconstructed the access from Highway 119 to the end of the project.
He explained at that time they were not required to install curb, gutter and sidewalk, and they

relocated the entrance, and built the acceleration/deceleration lanes on Highway 119. Since that
time they have paved an additional one-quarter mile which leads to Meadow Vale Phase Two. He
stated because of new planning regulations they are now required to put in curb, gutter and
sidewalks on the east side of Weld County Road 5.5 and they will pave the additional 10-foot strip
between the existing asphalt and the curb, gutter and sidewalk. Mr. Oliver stated the roadway
plans will be submitted to the Department of Public Works for review and approval, and they intend
to begin construction in May if approved.
No public testimony was offered concerning this matter.
Chair Geile advised Mr. Oliver that he has the option of continuing this matter to a date when the
full board will be present. However, if he decides to proceed today, it will require three affirmative
votes, or in the case of a tie vote, Commissioner Vaad will listen to the record and make the
determining vote. Mr. Oliver indicated he would like to proceed today and added they are no longer
mining the area.
Commissioner Jerke moved to approve the request of Katharine Oliver for a Site Specific
Development Plan and Amended Use by Special Review Permit #1199 for a Gravel Mining
Operation in the A(Agricultural)Zone District, based on the recommendations of the Planning staff
and the Planning Commission, with the Conditions of Approval and Development Standards as
entered into the record. The motion was seconded by Commissioner Long, and it carried
unanimously.
This Certification was approved on the 21st day of February 2001.
