Weld County Public Works has reviewed this proposal; this project falls primarily under the purview of the Use
by Special Review Standards,Weld County Code, Chapter 23,Article II, Division 4, Section 23. Our comments
and requirements are as follows:
COMMENTS:
WCR 6 is designated on the Transportation Plan Map as a collector status road,which requires an 80-foot right-
of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County.
Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-3-50, the
required setback is measured from the future right-of-way line.
The extension of Caroline Avenue is paved and WCR 4.4 remains a local gravel road. We presently have 60
feet of right-of-way at both locations. These roads are maintained by Weld County.
The average daily traffic (ADT) count for WCR 6 ranges between 250 and 300 vehicles, taken in a 24 hour
period on June 14, 2001.
REQUIREMENTS:
Future Right-of-Way:The applicant should reserve an additional ten feet of property parallel to WCR 6 right-of
way for future build out.
Setbacks: Setbacks to the mining operation are measured from future right-of-way line plus the standard
setback of 20 feet in an agricultural zone to the edge of the gravel pit berm, which is considered a structure.
Traffic Study:The Weld County Public Works Department is reviewing your submitted traffic study,which was
completed by Gene Coppola. This traffic study combined Mobile Premix Concrete, Aggregate Industries, and
Asphalt Paving, all located on WCR 6 and U.S. Highway 85. Diane Houghtaling, Traffic Engineer, memo will
reflect any additional item that need to be addressed prior to approval.
Improvements Agreement: The applicant has an existing Improvements Agreement for the Upgrade and
Maintenance of WCR 6 from the pit entrance east to U.S. Highway 85. If the traffic study identifies additional
intersection improvements associated with heavy hauling that are required,the existing improvement agreement
would be amended to reflect those items.
Storm Water Drainage: Storm water drainage will be controlled on the site by routing to the pit floors. The
applicant is identifying the discharge point and the appropriate routing to Platte River. This portion of the permit
falls under the jurisdiction of the State of Colorado as it discharges into waters of the United States.
Off-Street Parking: The off-street parking spaces at the main office/scale house parking lot, including the
existing access drive shall be surface with asphalt, concrete or equivalent, and shall be graded to prevent
drainage problems.

The Weld County Public Works Department has reviewed the Traffic Study for this Arnmended Special Use Permit.
Comments made during this phase of the USR process may not be all-inclusive,as other concerns or issues may
arise during the remaining application processes.
COMMENTS:
According to the accepted traffic study by Gene Coppola,dated May 10,2000,a left turn bay will be required on WCR
6 at the entrance to this development This requirement was based on a average trip of 260 trucks and 44 employees per
day. If the estimate of trips has changed the developer may revision the study and re evaluate the left turn lane warrants.
The study by Gene.Coppola also require a free right turn lane from eastbound WCR 6 to an acceleration lane for
southbound US 85 be installed by the developers. 1ias this improvement been completed?
Please resubmit the traffic study addressing the above concerns.

Environmental Health Services has reviewed this proposal for an open pit gravel mining
operation and asphalt batch plant. We have no objections to the proposal, however, in reviewing
the application we have observed that the applicant is proposing bottled water as the facility's
source of water. We do not believe that bottled water is an"adequate" source of water for this
type of operation. The facility plans to operate at this location for many years, thus we believe a
permanent water supply, i.e. well, community system, etc is more appropriate to serve the
sanitary needs of the staff and visitors to the facility.
We recommend that the following requirements be met prior to allowing the plat to be recorded:
1. Amend the existing dust abatement plan for the modification in the operation to the
Environmental Health Services, Weld County Department of Public Health&
Environment, for approval prior to operation.
2. Amend the existing Emission Permit for the modification in the operation if the Colorado
Department of Public Health and Environment determines that such a modification
represents a significant change in emissions or production.
3. The existing CPDS Permit must be amended for the increased operation if the Water
Quality Control Division of the Colorado Department of Public Health & Environment
determines that such a modification represents a significant change in the discharge.
4. The applicant shall submit a waste handling plan, for approval, to the Environmental
Health Services Division of the Weld County Department of Public Health&
Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should include
expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including the
facility name, address, and phone number).

5. The applicant shall provide evidence that the facility has an adequate water supply (i.e.
well or community water system).
6. The applicant shall submit an updated plan for monitoring groundwater wells to address
water quantity issues to the Weld County Department of Public Health and Environment,
for approval prior to operation.
We recommend that the following requirements be incorporated into the permit as "development
standards":
1. The property shall be maintained in compliance with the plan regarding ground water
monitoring wells, which has been approved by the Weld County Department of Public
Health and Environment.
2. The facility shall operate in accordance with the approved dust control plan. The facility
shall have sufficient equipment available to implement appropriate dust control.
Additional control measures shall be implemented as required by the Weld County Health
Officer.
3. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities
Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a
manner that protects against surface and groundwater contamination.
4. No permanent disposal of wastes shall be permitted at this site. This is not meant to
include those wastes specifically excluded from the definition of a"solid waste" in the
Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended.
5. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive
dust, blowing debris, and other potential nuisance conditions.
6. Fugitive dust shall be controlled on this site.
7. This facility shall adhere to the maximum permissible noise levels allowed in the Light
Industrial Zone as delineated in 25-12-103 C.R.S., as amended.
8. The applicant shall remove, handle, and stockpile overburden, soil, sand and gravel from
the facility area in a manner that will prevent nuisance conditions.
9. If applicable, the applicant shall obtain a stormwater discharge permit from the Colorado
Department of Public Health& Environment, Water Quality Control Division.
10. The operation shall comply with all applicable rules and regulations of the Colorado
Division of Minerals and Geology.
11. All fuel tanks, septic tanks, temporary buildings, and any other hazardous items that

might wash away during flooding shall be securely anchored and adequately flood
proofed to avoid creation of a health hazard.
12. Adequate hand washing and toilet facilities shall be provided for employees and visitors
to the facility.
13. The applicant shall have an adequate water supply for drinking and sanitation purposes.
14. The operation shall comply with the Occupational Safety and Health Act (OSHA).
15. The operation shall comply with the Mine Safety and Health Act (MSHA).
16. Portable toilets may be utilized on sites that are temporary locations of the working face
and portable processing equipment, etc. for up to six months at each location.
17. Any vehicle washing area(s) shall capture all effluent and prevent discharges from the
washing of vehicles in accordance with the Weld County Code, the Rules and
Regulations of the Water Quality Control Commission, and the Environmental Protection
Agency.

Dear Robert:
I have reviewed the project proposal and field checked the subject property
as to potential impacts to wildlife. The proposal indicates mining an
additional 10 acres within the project parcel. This extra excavation and
gravel extraction will probably not affect wildlife to any large extent, i.e.
noise, equipment, personnel, etc. I do have concerns as to the change in
designation following project completion, and lesser concerns as to a 50 acre
lake rather than 2 separate bodies of water. The separate lakes would
create additional shoreline and improve habitat conditions for wildlife,
The primary concern is rather the final designation - wildlife has been
eliminated from consideration. With the change in designation to water
storage rather than wildlife ponds and agricultural lands (see page 2 of the
Banks and Gesso, LLC document), I see that there may be some alternative
future in utilizing the water. Will the lake be de-watered? Will the storage
water be used for agriculture? Will the shorelines be utilized for public
recreation? Wildlife apparently has been eliminated as may also future

agricultural uses of the pond or ponds. Page 8 of the above noted document
still notes "some" shoreline wildlife habitat. What does some mean? Is the
original permit document more specific? I request that you not permit the
applicant a designation change, rather keep the original intent intact --
wildlife and agriculture.

Dear Mr. Olmstead:
This letter is in response to your comments and concerns regarding the Perry Pit
Amendment application. You were sent a referral copy of this application by the
Weld County Planning Department.
Your letter to Robert Anderson, Weld County Planner, dated July 31, 2001,
states that the Division of Wildlife's major concern is the change in end use from
ponds and agricultural lands to water storage. This change will allow for the
extraction of approximately 500,000 cubic yards of additional material and, after
reclamation, the resulting water storage facility will provide a serviceable
reservoir and a conveyance source for agricultural and/or municipal water supply.
While there will be some loss of shoreline, the reduction is, as you note in your
letter, minor, and the existing riverbank wetland areas to the east that provide
prime wiidiife habitat will remain undisturbed.
What is lost in shoreline going from two ponds to one will be to some extent
mitigated via a gain in water surface area, providing additional habitat for aquatic
species. Furthermore, Asphalt Paving is in the process of obtaining an amended
404 permit (from the US Army Corps of Engineers) and expects that, as a result,
the mitigation plan will provide for enhanced wildlife habitat on-site. Therefore,
the applicant does not believe that wildlife has been eliminated from
consideration as you stated in your letter.
Certainly the change in designation for the end-use is an artifact of the regulatory
agencies for land use and mining, and not the actual plans at the site. There
would be no substantive wildlife benefit to your suggestion of keeping the original

designation. Division of Wildlife concerns will be addressed during the current
federal, state, and local preview processes.
You also had some concerns about the future use of this water storage facility.
There are no plans to use this reservoir for public recreation purposes and it will
not be stocked with fish. The water retained in the reservoir will be used for either
agricultural or municipal use, depending on contract/obligations of the water
supplier using the reservoir.
In conclusion, the applicant, Asphalt Paving, would like to make it clear that a
change in "designation" does not correspond to a change in planning for wildlife.
The different end use will not have a major impact on wildlife in the area and
may, as a result of wetland enhancements under the 404 amendment, improve
habitat quality in the immediate area.

Dear Mr. Anderson:
We have reviewed the above referenced use by special review for an expansion of the
Perry Pit gravel mining operation to include an additional 10 acres of mining area. The Perry Pit
mining operation is located on a 118-acre parcel in unincorporated Weld County. The mining of
the additional 10 acres is proposed to begin in approximately 5 years and is estimated to add four
to six years to the life of the operation as currently permitted.
Aggregate Industries, Inc. is currently in the process of renewing their current Temporary
Substitute Water Supply Plan (TSSP)for the Perry Pit, with our office. Once the additional
acreage is added to the gravel mining operation, the TSSP will need to be amended to cover any
additional depletions to the stream system caused by the expanded use and a new well permit
will need to be obtained.
Although the additional mining will not commence for 5 years, the State Engineer's Office
recommends that prior to Weld County offering final project approval, the applicant must satisfy
this agency's potential concerns as they relate to water rights. The Colorado Division of Minerals
and Geology (DMG) referred this change to our office on July 16, 2001 for an opinion on the
potential for injury to other existing water rights. At that time, we recommended to the DMG that
a condition of approval should be resolving the water rights issues.

Dear Mr.Anderson:
In response to your request and in accordance with House Bill1041 (1974), I visited this property to
review the plat. A Weld Co. Special Use Review, Application for Amendment, prepared by Banks and
Gesso,was included in the referral.
The site is a working, wet operation, gravel mine located on the banks of the South Platte River. The
site's geology consists of flat lying sand and gravel alluvium deposits of the South Platte River
underlain by either the Denver or Arapaho formations.
The following condition was observed in the referral and during the site visit:
1) Floodplain. The majority of this site is located in the floodplain of the South Platte River. Since the
intended use of this property does not include any permanent residential structures,threat to public
safety, outside the mining personnel, is minimal. A hydrologic study of the site may reveal any
effect the mining operation and its reclamation plan may have the flow regime South Platte River.
2) Watertable. Excessive draw-down of the shallow water table resulting from the planned dewatering
procedure to change the present wet pit to a dry pit may influence water levels and water quality in
nearby wells. Groundwater levels in the area of the mine should be monitored to determine if any
nearby wells are effected by the operation.
In summary, there are no conditions on the site that preclude development of the proposed
amendment to the gravel mine. Please be advised that the Division of Minerals and Geology(DMG)will
be the regulatory authority on the site during all phases of mine operation. The owner shall be
responsible to follow all applicable regulations required by permit(s)issued by the DMG.
