RESOLUTION
RE: APPROVAL OF AGREEMENT BETWEEN WELD COUNTY, COLORADO AND
CHARLES ARTHUR MILLER ALLOWING MR. MILLER TO REMOVE DOWNED
TREES FROM THE KOENIG GRAVEL PIT AND AUTHORIZATION FOR
CHAIRMAN TO SIGN SAME.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, an agreement between Weld County, Colorado and
Charles Arthur Miller has been presented to the Board of County
Commissioners of Weld County, Colorado for approval, and
WHEREAS, said agreement concerns allowing Charles Arthur
Miller to remove downed trees from the Koenig Gravel Pit for
his personal use, and
WHEREAS, the term of the Agreement shall be from January
15, 1981 through February 15, 1981, and
WHEREAS, the Board of County Commissioners has studied
said Agreement and deems it advisable to approve the same.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the agreement between
Charles Arthur Miller and Weld County, Colorado be, and hereby
is, approved.
BE IT FURTHER RESOLVED by the Board of County Commissioners
that the Chairman of the Board is hereby authorized to sign the
Agreement.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 19th day of
January, A.D. , 1981.

AGREEMENT
THIS AGREEMENT is made and entered into this 19th day of
January, 1981 by and between the BOARD OF COUNTY COMMISSIONERS OF
WELD COUNTY, COLORADO, hereinafter called "County" and CHARLES
ARTHUR MILLER, hereinafter called "Miller. "
FOR AND IN CONSIDERATION of the mutual promises and agree-
ments set forth herein, the parties hereto agree as follows :
1. Purpose.
The purpose of this Agreement is to allow Miller to
remove downed trees from the Koenig Gravel Pit for
his personal use.
2. Term of Agreement.
The term of this Agreement shall be from January 15,
1981 through February 15, 1981.
3. Rights Granted - Legal Description.
During the term of this Agreement, Miller shall have
the right to remove downed trees from the south par-
cel of the Koenig Gravel Pit which is more fully
described as :
All of that part of Lot 7 in the South Half
of the Southwest Quarter of Section 18 , Town-
ship 2 North, Range 66 West of the 6th P.M. ,
lying South and West of the South Platte
River according to The Lupton Meadows Land
Company map of Division No. 1 recorded in
Book 5 of Maps, Page 13 , Weld County records,
and Lots 7 and 8 in the flouth Half of the
Southeast Quarter of Section 13, Township 2
North, Range 67 West of the 6th P.M. , ac-
cording to Division No. 1, Man made by The
Lupton Meadows Land Company;
-and-
A strip of land 100 feet wide, containing
3. 04 acres, more or less, being 50 feet
wide on each side of the center line of
The Denver, Laramie and Northwestern Rail-
way Company (formerly a Wyoming corporation) ,
as originally located over, across and
through the Southwest Quarter of the South-
east Quarter of Section 13, Township 2 North,
Range 67 West of the 6th P.M. , as said strip
runs through Lots 7 and 8 described above.
4. Personal Use.
Any trees and firewood removed by Miller from the
subject property shall be for his own personal use
and in no event, shall he resell said wood for any
purpose.
5. Non-Interference.
When removing said trees from the subject property,
Miller shall not interfere in the normal operations
of Weld County in mining or using the subject pro-
perty.
6. Indemnification.
Miller agrees to indemnify and keep the County harm-
less from all claims and demands of whatsoever kind
and character resulting from any act, operation or
negligence of Miller on the subject property or in
connection with this Agreement.
IN WITNESS WHEREOF the parties hereto have duly executed
this Agreement on the day and year first above written.
