The submitted materials are in compliance with the application requirements of Section 23-2-360 of the Weld County Code. 2) It is the opinion of the Planning Commission that the applicant has shown compliance with Section 23-2-400 of the Weld County Code as follows: A. Section 23-2-400.A. -- Reasonable efforts have been made to avoid irrigated crop land or to minimize the impacts on such lands in those cases where avoidance is impractical. The proposed telecommunications facility is located in an area designated by the USDA as "prime farmground". Due to the small size of the lease parcel and the proximity of the parcel to the Weld County Road right-of-way, the impact on agricultural lands is minimal. B. Section 23-2-400.B. -- The facility will not have an undue adverse effect on existing and future development of the surrounding area as set forth in applicable Master Plans. There are no municipalities within the three mile referral area. The closest municipality is the Town of Kersey, which is approximately five miles west of the site. The proposal will not adversely effect existing or future development of the area. C. Section 23-2-400.C.--The design of the proposed facility mitigates negative impacts on the surrounding area to the greatest extent feasible. The proposed facility will be compatible with surrounding land uses. There are predominantly agricultural uses in the area. Section 23-2-400.D. --The site shall be maintained in such a manner so as to control soil erosion, dust, and the growth of noxious weeds. The Conditions of Approval and Development Standards will assure that there is no fugitive dust or erosion and will ensure the control of noxious weeds. E. Section 23-2-400.E. --The applicant has agreed to implement any reasonable measures deemed necessary by the Planning Commission to ensure that the health, safety, and welfare of the inhabitants of Weld County will be protected and to mitigate or minimize any potential adverse impacts from the proposed facility. F. Section 23-2-400.F. --The proposed facility will be supplied by an adequate water supply which has been evaluated with reference to the impacts of the use of such supply on agricultural uses. All reasonable steps have been taken by the applicant to minimize negative impacts on agricultural uses and lands. The proposal will not require additional water demands on the site. The proposed Telecommunications facility will be unmanned and will not require water or sewage disposal. The Conditions of Approval and Development Standards minimize negative impacts on the existing agricultural uses and lands of the area. G. Section 23-2-400.G. --All reasonable alternatives to the proposal have been adequately assessed and the proposed action is consistent with the best interests of the people of Weld County and represents a balanced use of resources in the affected area. H. Section 23-2-400.H. --This application will create limited, if any, demand for additional government services. Section 23-2-400.1. --The Conditions of Approval and Development Standards will ensure that the nature and location of the facility will meet Colorado Department of Health and Weld County air quality standards. J. Section 23-2-400.J. --Adequate electric, gas, telephone, water, sewage, and other utilities exist or can be developed to service the site. There is no continuous fuel requirement for the facility. K. Section 23-2-400.K. -- The nature and location or expansion of the facility will not unreasonably interfere with any significant wildlife habitat and will not unreasonably affect any endangered wildlife species, unique natural resource, historic landmark or archaeological sites within the affected area. There will be no significant impact on wildlife habitat. L. Section 23-2-400.L. --The proposed use will not significantly impact drainage of residential property, crop land or other land. This recommendation is based, in part, upon a review of the application materials submitted by the applicant, other relevant information regarding the request, and responses from referral entities. The Planning Commissions' recommendation for approval is conditional upon the following : 1. The attached Development Standards for the Special Review Permit shall be adopted and placed on the Special Review Plat prior to recording the plat. The access from Weld County Road 63 shall have an adequate turning radius into the site and shall enter onto Weld County Road 63 at a 90°angle to provide adequate sight distance in both directions. The easement shall be a minimum of 20 feet in width to accommodate any emergency equipment and shall be graded and drained to provide all weather access.The proposed gate shall be located at a minimum of 20 feet from the edge of the road to accommodate a vehicle to pull off before opening the gate. The access from Weld County Road 63 shall have an adequate turning radius into the site and shall enter onto Weld County Road 63 at a 90°angle to provide adequate sight distance in both directions. The easement shall be a minimum of 20 feet in width to accommodate any emergency equipment and shall be graded and drained to provide all weather access. The proposed gate shall be located at a minimum of 20 feet from the edge of the road to accommodate a vehicle to pull off before opening the gate. Proposal Consistent with the Intent of the Weld County Ordinance and the Zone District in which it is Located: This_structure will be using a minimal amount of land adhering to the intents of the Weld County Government to preserve prime farmland for agricultural use. The proposed telecommunications tower submitted in this application will also be a collocation site for other carriers, reducing the possible future impact of multiple facilities exploiting prime farmland. There will be no impact on mineral resources or on wildlife habitat. The visual impacts will be minimized by the utilization of a SST type of tower,which tends to blend into the background in the rural areas. Due to the fact that this tower is less than 200 ft.tall, lighting and marking will normally not be required by the FAA. Proposal Consistent with the Intent of the Weld County Comprehensive Plan: The small lease parcel that the proposed telecommunications tower submitted in this application will use, along with this facility's possible collocation abilities for future carriers coming into the Weld County area,will help to minimize the impact of development on agricultural lands. In addition,the plans for this telecommunications tower have tried to anticipate and aid in the future growth and land use of the Weld County area. As evidenced by the presence of other telecommunications towers in Weld County,this telecommunications tower will not substantially modify the Comprehensive Plan or the intent, purposes, or spirit of the resolution.The immediately surrounding properties have very little development as it is surrounded by primarily agricultural properties. Other towers and tall standing structures of similar natures cannot be easily sighted. Telecommunications towers do not pose public health,welfare, or safety hazards. The proposed telecommunications tower submitted in this application will be a collocation site for other carriers, improving the telecommunications infrastructure in the adjacent area,while minimizing the visual and facility impact of telecommunication towers in the area of Weld County. Type of Uses Surrounding the Site/How it is Consistent and Compatible With These Uses: TowerCom feels that by locating our tower facility in this area,and enabling it for collocation by multiple carriers, Weld County can keep their telecommunication towers grouped in one location. Our comments and requirements are as follows: COMMENTS: WCR 63 is designated on the Transportation Plan Map as a local gravel road,which requires a 60-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23,Article III, Section 23-3-50,the required setback is measured from the future right-of-way line. Weld County Public Works Department does not have a traffic count at this location for WCR 63. REQUIREMENTS: The Weld County Public Works Department recommends approval of this application. Access: The applicant is indicating a 14-foot gate to the facility. Most Fire Departments and emergency response teams require a 20-foot wide emergency opening. The applicant shall supply documentation from the local Fire and Emergency Response area that a 14-foot opening to the facility will be adequate. The access shall be placed in such a location to have adequate sight distance in both directions and not below the crest of a hill or where physical obstructions are present. If a drainage culvert is required, a 15-inch corrugated metal pipe is the County's minimum size requirement. If the applicant chooses to place a larger culvert, please contact the Public Works Department to adequately size your culvert. Parking and Circulation: Off-street parking including access drives shall be surfaced with gravel, asphalt, concrete, or equivalent and shall be graded to prevent drainage problems.
