SUBJECT: Continuance of USR-12 for STROMO LLC
DATE: November 28, 2000
The Department of Planning Services is requesting a further continuance of Site Specific
Development Plan and Special Review Permit for a Solid Waste Disposal Site and Facility (Class
III, Composting Facility), case number USR-1276 for the following reasons:
The Department of Planning Services still has not received a referral from the Colorado or
the Weld County Departments of Public Health and Environment. These referrals are
essential, as a majority of the Conditions of Approval and Development Standards are
derived from these referrals. Tom Haren, AgPro Environmental Services, LLC has been
retained by John Moser and has submitted all of the required information to State Health
Department. To date, the referral for the technical review has not been received by the
Department of Planning Services. It is the opinion of the Weld County Departments of
Public Health and Environment and Planning Services, as well as the County Attorney's
Office, that this technical review is required prior to proceeding with the Planning
Commission's or Board of County Commissioner's hearings.
The Weld County Planning Commission is scheduled to hear this case on February 6,
2001. The Department of Planning Services' staff is unable to give an adequate
recommendation to the Planning Commission without the above mentioned referrals.
The applicant is in agreement with a continuance of the Planning Commission hearing to
February 6,2001 and staff is recommending scheduling the Board hearing for February 28,
2001, in case there is further continuance of Planning Commission to February 20, 2001.
The applicant did request a pre-advertisement for the Board of County Commissioner's
hearing and would be agreeable to a continuance of the Board hearing,at the convenience
of the Board.

HS Resources, Inc. (HSR)understands this issue is on the docket for this afternoon. Just to bring you up
to date, HSR owns two pipelines and the oil and gas rights to drill future oil and gas wells on the property.
Last Friday, 2/20/01, HSR faxed a Surface Use Agreement to Stromo, LLC concerning this proposed
operations and HSR's rights. HSR requests that the final approval of the facility not be approved until this
Agreement is executed without any changes. HSR believes the Agreement represents the verbal
agreement between HSR and Stromo and expects the Agreement to be executed timely. S-
