RESOLUTION RE: APPROVAL OF USE BY SPECIAL REVIEW FOR A FARM EQUIPMENT REPAIR AND MAINTENANCE FACILITY - HAROLD ELAM WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 6th day of June, 1984, at the hour of 2: 00 o 'clock p.m. in the Chambers of the Board for the purpose of hearing the application of Harold Elam, 20453 Weld County Road 54 , Lreeley, Colorado 80631, for a Use by Special Review forafarm equipment repair and maintenance facility on the following described real estate, to-wit: Part of the SEi SWa, Section 21, Township 5 North, Range 65 West of the 6th P.M. , Weld County, Colorado WHEREAS, Section 24. 4. 2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS , the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations o₹ the Weld County Plan- ning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed, finds that this re- quest shall be approved for the following reasons : 1. The submitted materials are in compliance with the application requirements of Section 24. 7 of the Weld County Zoning Ordinance. 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 . 4 . 2 of the Weld County Zoning Ordinance as follows : a. The proposal is consistent with the Comprehensive Plan policies in that the use does not infringe on continued agricultural use in the vicinity or County. The proposal does not appear to have any adverse impacts on the agricultural interests of the County or the environment. b. The proposal is consistent with the intent of the Agricultural Zone District and is provided for as a Use by Special Review. 840331 LHR 349 Page 2 RE: USR - ELAM c. The proposal was reviewed by the Evans Planning Commission and was found to be compatible with their interests . d. The proposed Use by Special Review -Permit area is located in a floodplain district. Any future building development will require compliance with section 53 , Flood Hazard Overlay District Regulations of the Wald County Zoning Ordinance. e. Use by Special Review Operation and Design Standards provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado, that the application for a Use by Special Review for-a farm equipment repair and maintenance facility on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1. A revised mylar plat shall be submitted to the Department of Planning Services showing all existing and proposed structures in the Use by Special Review area. The revised mylar shall also show an area specified for equipment storage. 2 . The attached Standards for Use by Special Review be adopted and placed on the Use by Special Review plat prior to recording. 3 . The prescribed Use by Special Review activity shall not occur nor shall any building or electrical permits be issued on the subject property until the Use by Special Review plat has -been delivered to the Department of Planning Services office and the plat has been recorded in the office of the Weld County Clerk and Recorder. The uses permitted shall be a Farm Equipment Repair and Maintenance Facility as described in the application materials on file with the Department of Planning Services. 2. The applicant shall comply with the design standards for the Use by Special Review, Section 24.5 et seq. , of the Weld County Zoning Ordinance. 3. The applicant shall comply with the Operation Standards for Uses by Special Review, Section 24.6 et seq. , of the Weld County Zoning Ordinance. 4. Representatives or members of the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the site at any reasonable time in order to insure the operations carried out on the site comply with the Development Standards stated hereon and all applicable Weld County Regulations. 5. The Use by Special Review area shall be limited to the plans shown hereon and governed by the Standards as stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Standards as shown or stated above shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans and/or Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 6. The property owner and/or operator of this operation shall be responsible for complying with all of the above stated Standards. Noncompliance with any of the above stated Standards may be reason for revocation of the Permit by the Board of County Commissioners. The proposed special use is a farm equipment repair -and maintenance facility to be located on a small parcel of acreage in the "A" zoning district. The facility will make use of an existing structure currently used by the -appli- cant- for maintenance of his own farm equipment. Applicant feels that the proposal is consistent with the comprehensive plan as this facility does not infringe upon any continued prime agricultural use in the vicinity and will not have an adverse impact on agricultural interests or the environment. This maintenance facility will have a positive impact upon agricultural interests as the facility will provide a needed service to farms in the area. The proposal is consistent with the intent of the agricultural zoned district as such a use is allowed and provided for as a use by special review pursuant to the Weld County zoning ordinance. This facility will be compatible with existing uses and future development as future residential development is not expected. -Existing uses are agricul- tural with some of the surrounding area being used for wildlife refuge and other parts being in the flood plain. The comprehensive plan for the cities of Greeley and Evans do not apply to this property as their interests do not extend east of the South Platte River. The use and operation of the proposal is as a farm equipment repair and maintenance facility to provide minor repairs and routine and other mainte- nance for farm equipment belonging to the Applicant and other farm operators in the nearby area. The proposed use is located 45 feet from Applicant's residence, 350 feet more or less to the Gibbs' residence to the southeast, with no other residents within 1/4 mile. A total of three persons will work in the proposed operation with all of them being family members. There will be no other users or employees or animals located at the site except for occasional visits by other farm operators bringing equipment to the facility. No new structures will be constructed since the proposed use will be housed in a structure that is currently being used for a similar purpose with the owner's own farm equipment. Vehicular traffic will be minimal with farm equipment being brought in as needed for repair using Weld County Road 54, which is already used for the transport of farm equipment. Domestic sewage facilities will be utilized in the owner's residence 45 feet away. No stockpile or storage areas will be needed for the proposed operation and waste materials will be removed by a commercial trash service on an already: existing weekly basis. Since the proposed use will involve using an existing structure, no con- struction is planned for this operation. For the same reason, no landscaping is needed or planned for this site. When the planned activity will no longer be performed, the facility will revert to personal (owner's farm) use. Proposed fire protection measures will include the placing of two 10 lb. ABC fire extinguishers with 4A 60BC ratings appropriately mounted and indicated. The property lies within the Western Hills Fire Protection District. The proposed use lies within the flood plain of the South Platte River and all conditions for such locations will be met. The soil type on this property is compatible with the -proposed use, being deep, nearly level well drained • loams (Weld-Colby). Contrary to statements made in the application, the soils are not the General Soils of the Weld-Colby Association but rather Soil Map Unit 3, Aquolls-Aquents, gravelly substratum which is generally associated with bottom lands and flood plains. These soils are deep, poorly drained, formed in recent alluvium and located in flood plains where flooding and ponding are severe limitations. Definate on-site tests will be needed to determine proper design for foundations and footing plus a special design for the septic tank filter fields. This site is definitely in the flood plain of the South Platte River and all necessary precautions should be followed.
