HomeMy WebLinkAbout20010450.tiff RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST ERN LTD PARTNERSHIP CIO ERNEST ZARLENGO AND DARRELL JOHNSTON FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, ERN Ltd Partnership, c/o Ernest Zarlengo and Darrell Johnston, VI #0000161, is allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 13th day of February, 2001, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Darrell Johnston, representative for Ernest Zarlengo, was present at said hearing, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until April 13, 2001, to allow adequate time for the property owners to bring the subject property into compliance and for an inspection of the property by the Department of Planning Services staff. He stated that the brown derelict mobile home has been removed. I informed him that we needed both "zoning and building" permits. He said they cleaned up everything except the "building permit" for the mobile home. He asked if he would still have to attend the hearing. He stated that he had not yet turned either one in. I told him if he completed and submitted both permits and removed the last derelict vehicle by February 12, 2001, that he would not need to attend the violation hearing. He did not know for sure whether he could get all of that done by then so I discussed the violation hearing with him. I told him that he could request an extension from the Board. I also told him that he needed to make sure that someone came if the hearing went forward.
