A public hearing was conducted on September 26,2001, at 10:00 a.m.,with the following present:
Commissioner M. J. Geile, Chair
Commissioner Glenn Vaad, Pro-Tem
Commissioner William Jerke
Commissioner David Long
Commissioner Robert Masden
Also present:
Acting Clerk to the Board, Esther Gesick
Assistant County Attorney, Lee Morrison
Planning Department representative, Chris Gathman
The following business was transacted:
I hereby certify that pursuant to a notice dated August 31, 2001, and duly published September 5,
2001, in the Tri-Town Farmer and Miner, a public hearing was conducted to consider the request
of Colorado Elk Ranch, LLLP, for Change of Zone#557 from the A (Agricultural)Zone District to
the PUD(Planned Unit Development)Zone District to create 38 lots with residential uses and 32.12
acres of open space. Lee Morrison,Assistant County Attorney, made this a matter of record. Chris
Gathman, Department of Planning Services, stated the applicant's representative had a personal
emergency and was unable to attend today's hearing, therefore, they are requesting this matter
be continued to October 17, 2001, at 10:00 a.m.
Ric Hansen, Colorado Elk Ranch Manager, stated Mikal Torgerson has been their representative;
however,due to a family emergency,he was unable to attend today. Mr. Hansen submitted a letter
explaining the situation, marked Exhibit J.
In response to Chair Geile, Esther Gesick, Deputy Clerk to the Board, reviewed the Board's
schedule of upcoming land use hearings.
James Rhone, surrounding property owner, expressed concern with continuing this matter to mid-
October due to harvest, and a later date would be appreciated.
Bill Forte', surrounding property owner, concurred with Mr. Rhone's comments and stated late
October would be acceptable.
In response to Chair Geile, Ms. Gesick confirmed October 31, 2001,would be an acceptable date
with the Board's schedule. Mr. Hansen stated they would like to complete this process as soon as
possible; however, they are willing to work with the neighbors and accept the later hearing date.
Mr. Rhone indicated October 31, 2001, would be acceptable.

Commissioner Long moved to continue the request of Colorado Elk Ranch, LLLP for Change of
Zone #557 from the A (Agricultural) Zone District to the PUD (Planned Unit Development) Zone
District to create 38 lots with residential uses and 32.12 acres of open space, to Wednesday,
October 31, 2001, at 10:00 a.m. The motion was seconded by Commissioner Masden, and it
carried unanimously. There being no further discussion, the hearing was completed at 10:25.
This Certification was approved on the 1st day of October 2001.
