Location of Collision: 119th St., between Arapahoe Rd. and Isabelle Rd., Boulder County, Colorado Tort Notice Pursuant to C.R.S. 24-10-109 Dear Sirs &Madams: Since the exact governmental organizations are not known at this time,this Notice of Tort Claim is being provided to the above referenced parties. Please forward this notice to the appropriate parties. I have been retained to represent Susan Gonzales, and her husband Alfred Gonzales, in all matters stemming from injuries Susan Gonzales received in the above referenced collision. I am writing to provide Notice of Claim pursuant to C.R.S. 24-10-109. Mr. Gonzales has a Loss of Consortium Claim. A. Claimant¢ Alfred Gonzales and Susan Gonzales, 1981 Clark Ct., Erie, CO 80516. I am the attorney for Mr. Gonzales and Mrs. Gonzales, and my name and address appears at the top of this letterhead. B. &sic of Claim• On November 29, 2000, at approximately 12:55 p.m., Mr. Gonzales was driving a 1994 4 door Toyota Camry on 119th Street between Arapahoe Road and Isabelle Road. Susan Gonzales, Zackary Gonzales, and Zoe Gonzales were passengers in the vehicle. At that time, Alfred Gonzales was proceeding Northbound on 119th Street, when a tree fell across the road and collided with the Gonzales vehicle, in the County of Boulder, State of Colorado. The tree limb fell and crashed through the sun roof. The Gonzales vehicle traveled an additional 51 feet before coming to rest in the northbound lane of N. 119th Street. Attached is a copy of the Traffic Accident Report which is herein fully incorporated by reference. To Claimant's best knowledge, Claimant will assert that the appropriate governmental entities, and/or their contractors, agents, servants, employees, were negligent regarding failure to warn of the danger zone, danger of dead or damaged trees planted on the roadside, and dangerous condition of the roadway and roadside, and negligent design of the roadway and adjacent plantings, and negligent design and maintenance of the roadway and roadside plantings. Nature and Extent of Tnjury• The exact nature and extent of the injury is not fully realized. However, Mrs. Gonzales suffered temporary, total and permanent partial disabilities to her body, past and future pain and suffering, loss of enjoyment of life, negligent infliction of emotional distress, impairment of earning capacity, lost wages, medical, hospital, other health-care expenses, and property damage. Mr. Gonzales has a loss of consortium claim. E. Amnunt of Damage• The exact amount of monetary damages is unknown at this time. However, Claimant Susan Gonzales's claim, and Susan Gonzales's claim for loss of consortium will not exceed$150,000.00.
