1. Proper building permits shall be obtained prior to any construction, demolition, or excavation.
Part of the permit application process includes a complete plan review.
2. Building permits are required for construction trailers, scale houses, accessory buildings, etc.
3. Electrical permits are required for all electrical work including electrical services for dewatering
pumps, rock crushers, construction trailers, scale houses, site lighting, etc.
4. All excavation shall meet the requirements of Appendix Chapter 33 of the 1997 Uniform Building
Code. (Appropriate Colorado State agencies should be consulted for additional regulations or
requirements.)
5. Site drawings shall be submitted to the appropriate fire district.
6. Additional requirements or changes may be required when building applications or plans are
reviewed by the Weld County Building Inspection Department, the Fire District, or other State
agencies.

The Weld County Department of Public Health & Environment has reviewed this proposal for a
Gravel Mining Operation and Concrete and Asphalt Batch Plant. We have compiled numerous
conditions and standards and have attempted to simplify our referral by separating the proposed
conditions of approval and,development standards.
The following are recommended to be conditions of approval:
1. Prior to recording the plat:
A) The applicant shall permit the existing septic systems. Environmental Health
Services Division was unable to locate septic permits for the septic systems
serving the existing homes. The systems will require an I.S.D.S. Evaluation
prior to the issuance of the required septic permits(s). The review shall consist
of observation of the system and an evaluation of the systems ability to handle
the proposed hydraulic load. In the event the system(s) is found to be
inadequate, the system(s) must be brought into compliance with current
Individual Sewage Disposal System regulations.
If the systems are used for employees for the proposed use,the septic system(s)
shall be reviewed by a Colorado Registered Professional Engineer. The review
shall consist of observation of the system and a technical review describing the
systems ability to handle the proposed hydraulic load. The review shall be
submitted to the Environmental Health Services Division of the Weld County
Department of Public Health and Environment.In the event the system is found
to be inadequately sized or constructed the system shall be brought into
compliance with current regulations.
B) The applicant shall submit an NPDES Permit to the Water Quality Control
Division of the Colorado Department of Health for proposed discharge into
State Waterways. Evidence of approval shall be submitted to the Weld County
Department of Planning.
C) An Air Pollution Emission Notice (A.P.E.N.) and Emissions Permit shall be
obtained from the Air Pollution Control Division, Colorado Department of
Public Health and Environment for emissions from the mining operations. The
site shall operate in accordance with all applicable rules and regulations of the
Air Pollution Control Division.
D) A dust abatement plan shall be submitted to Environmental Health Services,
Weld County Department of Public Health&Environment, for approval prior

to operation.Evidence of Health Department approval shall be submitted to the
Department of Planning Services.
E) A Weld County Septic Permit shall be applied for the proposed office septic
system and shall be installed according to the Weld County Individual Sewage
Disposal regulations.
The following are recommended to be development standards:
1. All fuel tanks, septic tanks,temporary buildings, and any other hazardous items that might wash
away during flooding shall be securely anchored and adequately flood proofed to avoid creation
of a health hazard. Following completion of mining, all temporary buildings shall be removed.
2. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-
20-101, C.R.S., as amended) shall be stored and removed for final disposal in a manner that
protects against surface and groundwater contamination.
3. No permanent disposal of wastes shall be permitted at this site.
4. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust,
blowing debris, and other potential nuisance conditions.
5. The maximum permissible noise level shall not exceed the industrial limit of 80 dB(A), as
measured according to 25-12-102, Colorado Revised Statutes.
6. Adequate toilet facilities shall be provided for the employees.
7. The applicant shall remove, handle, and stockpile overburden, soil, sand and gravel from the
facility area in a manner that will prevent nuisance conditions.
8. An individual sewage disposal system for the proposed office facility shall be installed according
to the Weld County Individual Sewage Disposal Regulations. The septic system is required to
be designed by a Colorado Registered Professional Engineer according to the Weld County
Individual Sewage Disposal Regulations.
9. The installation of the septic system shall comply with the Weld County I.S.D.S. flood plain
policy.
10. The facility shall utilize bottled drinking water for employees.
11. The installation of the septic system shall comply with the Weld County I.S.D.S. flood plain
policy.
12. The facility shall operate in accordance with the approved dust abatement plan at all times. The
facility shall have sufficient equipment available to implement the dust control as required by the
Weld County Department of Public Health & Environment.
13. Fugitive dust shall be controlled on the site.
14. The operation shall comply with the Occupational Safety and Health Act (OSHA).

16. The site shall maintain compliance with all applicable rules and regulations of the
Colorado Division of Minerals & Geology.

The Weld County Public Works Department has reviewed this proposal. Our comments nt and r'quir_ ris are

COMMENTS:
The proposed mining operation borders WCR 6 and WCR 8. WCR 8 is designated on the Transportation Plan
Map as a local gravel road. A service access only from WCR 8 is planned with material being transported on a
conveyor bridge across the South Platte River to the main plant.
WCR 6 is designated on the Weld County Transportation Plan Map as a collector status road. This paved road
requires 80 feet of right-of-way at full build out. There is presently 60 feet of right-of-way. The applicant plans
to dedicate an additional 20 feet adjacent to the property. The average daily traffic count (ADT) indicates 1,277
vehicles in a 24-hour period utilizing WCR 6 at this location.
Weld County Bridge 6/25B, which spans the McCann Seep, is scheduled for replacement in April, 2000.
A traffic signal has been identified where WCR 6 intersects with US Highway 85 for a future interchange. There
are existing accel-decel lanes at this location. Please contact Tess Jones or Gloria Hice-Idler at the Colorado
Department of Transportation for any additional requirements.
REQUIREMENTS:
The applicant is identifying an entrance and an exit to the plant site. The entrance, which will be paved, includes
a deceleration lane. Both locations shall be elevated to the same height as WCR 6 to provide adequate sight
distance in both directions. 50 feet of paving shall be required at both approaches to WCR 6 with adequate
turning radiuses.
A Road Maintenance and Improvements Agreement with the Weld County Public Works Department shall be
required for any additional damage that may occur on the designated haul route east to US Highway 85.
All new residential developments with expected ADT>200 and all new commercial developments will be required
to submit a traffic study as part of the review process. This study shall include a description of the project, vehicle
trip generation and distribution, verification of adequate acceleration, deceleration and storage facilities at all
impacted intersections, review of bridge capacity, intersection level of service analysis for existing and proposed
conditions and recommendation for needed upgrades to transportation infrastructure to support the development.
State Highway 85 Access Corridor Plan: Segment 2a and Page 3 of the Access Phasing Worksheet identifies
the intersection of US Highway 85 and WCR 6 as a future interchange, long range, and future signalized
intersection, medium term improvement. Please require the Colorado Department of Transportation to respond,
through their referral, for any additional requirements that may be needed.

RE: USR-1259, Mobile Pre-Mix Concrete Batch Plant
Dear Shed:
This referral was presented to the Fort Lupton Planning Commission on February 8,
2000. The Planning Commission expressed concern at the number of gravel mining and
concrete batch plant operations proposed for the Highway 85 corridor. They are aware
that in this booming construction market the need for these facilities is great. There
greatest concern is trying to create and maintain an attractive entryway into southern
Weld County. This concern is also shared with the City of Brighton and the Weld
County Commissioners. The scenic beauty of the South Platte River Corridor is being
eroded with each new facility that goes online.
With this particular case the lack of screening of the operation from 85 was a concern
expressed by members of the Planning Commission. The previous referral we reviewed
in January for a gravel mining and batch plant operation north of the City had a plan in
place for the benning and screening of the operation from the Highway. That particular
operation was further from the Highway and was not perceived to have as much of a
visual impact as one enters the City from the north. The site in question at WCR 6 and
Highway 85 sits below the grade of the Highway. Most of the operations will take place
on the east side of the River-thus leaving no visual buffer. The Planning Commission
hopes that the future location and siting of these operations takes into account the visual
impacts from Highway 85 and what image Weld County is hoping to convey.
The Planning Commission would also like to stress the importance of the Flood Hazard
Mitigation Plan for the.concrete batch plant. The community most directly affected if a
large flood event was to occur would be Fort Lupton: We hope that all precautions will
be taken to assure that in the event of such a natural disaster that batch plant operations
would be stable and not send large amounts of debris down river.
