Box 758 Greeley, CO 80632 Subject: An,cnd Code Chapters 22 &26;Northeast I-25 Mud Amendment Dear Commissioners: We would like to make the following comments relating to the subject proposal: 1. The Comprehensive Plan Amendment Procedure requires Planning staff consideration of whether the existing Comprehensive Plan is in need of revision as proposed [El]. These lands are, and are surrounded by, agricultural lands remote from development. Permitting these lands to be developed will only result in more 3 urban sprawl An exception is Rangeview, north of Highway 66 that was 0 flag-poled into Mead, 4 miles away, which was one of the reasons that town citizens elected to vote on future annexations. Oak Meadows, two miles to the P south at CRS 13 & 24 was flagpoled into Firestone 3 miles away. The County shouldn't add to this sprawl by permitting development of this land. Permitting this land to be developed would interfere with the efforts of Firestone, Mead and Platteville to create agricultural buffers between those towns [including these land¢] to reduce sprawl and retain their local identities. In summary, there is no need for the public good of this MUD amendment. In fact, there is a need not to revise it as proposed. It merely is a device to serve the private financial goals of the applicants. 2. This proposal is not consistent with existing and future goals policies and needs of the County [E2]. It conflicts with the County's goal to support the agriculture industry and to preserve prime farmland. 3. This proposal will place a burden upon existing or planned service capabilities [E2b]. Specific information has not been provided to guarantee that there will not be unsupportable burdens placed on schools and other services, utility and transportation infrastructure. This concern is supported by the County rejection of the nearby Riverdance proposal, the intensity and size of which was determined to I be such as to overwhelm available services. 4. No specific needs in the public interest are demonstrated for the amendment by plamring or applicants except that the amendment would be in the applicants individual interests [O1]. 6. It has not been substantiated that the amendments for these properties are consistent with the goals, policies [MUD P,T and C goals and policies] and the needs of the County[G2] . 7. These lands lie within an area designated in the Firestone Comprehensive Plan Growth Boundaries, Tier 2, as being reserved for open space, agriculture and conservation use. Firestone, Mead and Platteville are currently studying creating agricultural buffers between those towns [including these lands] to reduce sprawl and retain their identities. Ordinance 191 Section 1.1 referring to the intent of the MUD area states: The presence of an interstate highway and state highway system and the external growth pressures from the Longmont Metropolitan area have added to interest in land development and population growth in the area . One fallacy in this intent is that, based on Weld County's dedication to the preservation of its agricultural lands and economy. County urbanization should only be tolerated based on need, not landowners or developers interest in development or population growth. Another fallacy is that these parcels are not subject to Longmont growth pressures [6 miles away] or from I-25 [2 miles away]. Less than 5% of the MUD Area land has been developed to date. The balance should be infilled before considering adding more land to the MUD Area. There are no growth pressures on these parcels to warrant there being included in the MUD Area Any pressures can easily be absorbed by vacant areas already in the existing MUD area or preferably [ref Municipal Annexation Code] by surrounding municipalities. The only pressures on these lands are from the desire for profits from development by the owners. The MUD Area has already been recently increased with the inclusion of the Doutbit, Hamlin, J Bar B and R&M Land properties. Is the MUD Area to be continuously increased based solely on the desire of land owners rather than any need for their development and further reducing the amount of available farmland? One of the reasons, unstated in Ordinance 191, for creation of the original MUD Area was to make it feasible for the formation of a sewer district so that the businesses at Del Camino would not have to rely on individual septic systems to handle waste. As servicing the existing Del Camino businesses alone would not support a central sewer service additional lands were included. Now, the St. Vrain Sanitation District is having to increase its capacity to serve area growth. Today,inclusion of additional lands in the MUD Area is not necessary to make the sewer district economically sustainable. Presentations as to the intended type of development are not formal proposals for change of zone, etc. We draw your attention to an example of how these proposals change from the alleged intent at time of request for inclusion in MUD Area to subsequent applications to the County for actual development. Glen Doutbit was reported in the Times Call as stating that inclusion of his property in the MUD Area would be for the benefit of his heirs developing the property. He is now in the process of seeking County approval for development. Additionally, the present plan is for a more intense use of the land than was originally proposed. i CAROL Hardinµ SVWCCMUDEXP:wpd w m Pale 3 Previous amendments to the MUD plan have added the Douthit, Hamlin, J Bar B and R & M properties, as mentioned above. When will these ill-planned increases in the MUD stop? Should a property owner have the right to develop his land as he wishes?We do live in a society where rules are established for the public good. There is no reason to have a planning department if there are no restrictions on land use and the ordinances controlling land use are not enforced. We, the St. Vrain Concerned Citizens Group, therefore ask that the request to amend the I-25 MUD Area be rejected. We ask that a formal dialogue be initiated between Weld County and all municipalities in the I-25 MUD Area regarding the creation of a land preservation program in the area that will create agricultural buffers between the southwest Weld municipalities to preserve each town's identity. We believe our application and proposal for inclusion into the Weld County MUD was developed using sound planning practices and clearly meets not only the requirements of the Weld County Comprehensive Plan,but also the needs for future growth and development in Southwest Weld County. Numerous studies, including the 2000 Census,project that the State of Colorado, and the Front Range in particular will experience significant new development and population increases over the next 10 to 20 years. We strongly believe planning for the inevitable growth in an orderly, comprehensive manner will greatly improve not only the quality of development, but the overall quality of life for both the current and future citizens of the area. Sound planning for the future simply does not happen by accident, and cannot be ignored hoping the growth will not occur, or that it will occur in an orderly manner. While we understand Mr. Elmquiest's desire for the status quo to remain,it is clear that change has occurred and will continue into the future in this busy corridor of the State and County. We feel the best approach to appropriately plan for change. We trust that the Commissioners understand this situation, and continue to support this well planned for, and logical extension of the I-25 MUD. LOCATIONS: South of and adjacent to State Highway 66, North of and adjacent to WCR 28, East of and adjacent to WCRs 11 and 13, and approximately 1-1/4 miles west of WCR 17. The Planning Commission recommends that this request be approved for the following reasons: Criteria I: MUD Plan, Chapter 26, Weld County Code That the application is consistent with Section 26-1-30 Weld County Mixed Use Plan (Chapter 26, Weld County Code, as amended)which establishes procedures for amending Chapter 26 in accordance to procedures established in Section 22-1-50 of the County Code. The procedures for submittal were met. II. Criteria II: Comprehensive Plan, Chapter 22, Weld County Code The following procedures are outlined in Section 22-1-50 of the Weld County Code: 22-1-50.B.1. "Comprehensive Plan amendment proposals shall be considered bi-annually with a public hearing process beginning in November or May of each year." The application was submitted on March 29, 1999. 22-1-50.6.2. "The petitioner shall pay for the cost of legal publication of the proposed amendment and all land use application fees." There is no charge to amend the Structural Land Use Map, #2.1. The applicant was informed that there is a fee for legal publication and will pay for the publication. 22-1-50.B.3. "A typewritten original and eleven (11)copies of the proposed Comprehensive Plan amendment must be submitted to the Department of Planning Services no later than October 1 or April 1 of each year to be considered for review and public hearings." The applicant met this requirement. 22-1-50.B.3.a "A statement describing why the comprehensive plan is in need of revision." The applicants have stated the desire to develop the properties at an urban scale density by complying with standards established in Chapter 26, Mixed Use Development area plan. Application materials also state the properties are within the St. Vrain Sanitation District boundary. Capability of serving these properties by St. Vrain Sanitation District does exist. Section 26-2-30.D.1 states that"Residential districts within the MUD area are encouraged to be cohesive, identifiable and diverse, while retaining the current agrarian lifestyle of residents in the area." The creation of residential units for 4,513 individuals on 635 of the proposed 1,100 acres will increase the population projects of the MUD area by approximately 11%. Similarly, the land mass of the MUD area will increase by approximately 8%. The creation of an expansion to the MUD area is of concern for surrounding land uses. It is important to note current agricultural uses occur on land under this application, including crop production and a confined animal feeding operation. Furthermore, adjacent land uses include current agricultural uses to the east, north, and south. According to the State Demographer, the population forecast of this amendment- 1,588 persons - is greater than the population of many Weld County communities. In fact, the projected population is comparable to the populations of Firestone and Frederick. [July 1999 population of Frederick was 1,892. July 1999 population of Firestone was 1,764. When developing the MUD Plan, a ratio of employment centers, residential areas, parks and transit centers were carefully planned in correlation to the total planned area. The applicants have carefully examined this mixture of uses and have proposed a similar mixture, keeping true to the intent of the MUD Area. 22-1-50.B.3.b. "A statement describing how the proposed amendment will be consistent with existing and future goals, policies, and needs of the County." Section 22-2-60,A.Goal.3 of the Comprehensive Plan states that,"Urban-scale residential, commercial, and industrial development which is not located adjacent to existing incorporated municipalities" shall be discouraged. A.Policy3 of the Comprehensive Plan further states that"Conversion of agricultural land to urban-scale residential,commercial and industrial development will be discouraged when the subject site is located outside of an approved Intergovernmental Agreement area, urban growth boundary area, or I-25 MUD area and urban development nodes." This proposal is located adjacent to the Urban Growth Boundary for the Town of Mead, and within the vicinity of current commercial and industrial activities taking place along State Highway 66. Section 22-2-170 R.Goal 2 of the Comprehensive Plan states that any proposed residential development shall,"Ensure that adequate public services and facilities are available to serve the residential development or district." R.Policy 2 further elaborates, "The land-use applicant will demonstrate, to the Board of County Commissioners, that adequate sanitary sewer and public water systems are available to all residential development, and that the street or highway facilities providing access to the property are adequate in width, classification, and structural capacity to meet the requirements of the proposed district or development." The Weld County Department of Public Works noted the following concerns in a referral response dated April 24, 2001: A. Weld County Road 13 is presently designated as an arterial. If this amendment is approved,the cross-section would have to be widened to a four-lane with a painted median. The right-of-way required for this arterial would be a minimum of 110 feet wide. Weld County Road 28 is presently designated as a collector. A collector requires 80 feet of right-of-way. B. Several properties in this area are presently within the review process. The most recent traffic study shows State Highway (SH) 66 must be widened to four lanes. Even with this improvement,SH 66 will operate a 18%over capacity(level of service "E") in the evening peak hour. One of the policies of the MUD is to maintain all intersections at a level of service"D". At present,there are no CDOT or Upper Front Range plans to widen SH 66. Without the widening,the roadway network will break down in the evening and morning peak hours. C. Since there are no CDOT funds to widen SH 66,and without widening the roadway the development in the area will devastate the present level of service, a portion of the widening costs for SH 66 should come from the developers in the area. The following procedures to amending the 1-25 Mixed Use Development Area Map are outlined in Section 22-1-50.5 of the Weld County Code, as amended: 22-1-50.5.a. "The proposed amendment must demonstrate the proposed amendment is adjacent to and contiguous with the existing I-25 MUD Area Map." The combination of these parcels create a 35%contiguity boundary with the existing MUD area. 22-1-50.5.b. "The proposed amendment must describe how the proposed amendment will not place a burden upon existing or planned service capabilities. This statement shall include how emergency services will be provided to the proposed area." The Department of Public Works noted in a referral response dated April 24,2001 that the distribution shown in the submitted traffic study were not acceptable. Further,Public Works noted,"It is unlikely that 42%of the over 40,000 daily trips generated by this development would go toward Platteville." 22-1-50.5.c. "The proposed amendment must delineate the number of people who will reside in the proposed area. This statement shall include the number of school-aged children and address the cultural and social service provision needs of the proposed population." Application materials indicate that 1,191 students will reside within the proposed amendment boundaries; 635 Residential units will be constructed; and 5,445 jobs will be created. Table 22.4 will also need to be amended should this amendment be approved. Table 22.4 reflects the land mass associated with proposed land distribution categories. Criteria I: MUD Plan, Chapter 26,Weld County Code That the application is consistent with Section 26-1-30 Weld County Mixed Use Plan (Chapter 26,Weld County Code, as amended)which establishes procedures for amending Chapter 26 in accordance to procedures established in Section 22-1-50 of the County Code. The procedures for submittal were met. 3 II. Criteria II: Comprehensive Plan, Chapter 22,Weld County Code The following procedures are outlined in Section 22-1-50 of the Weld County Code: 22-1-50.B.1. "Comprehensive Plan amendment proposals shall be considered bi-annually with a public hearing process beginning in November or May of each year. " The application was submitted on March 29, 1999. 22-1-50.B.2. "The petitioner shall pay for the cost of legal publication of the proposed amendment and all land use application fees. " There is no charge to amend the Structural Land Use Map, #2.1. The applicant was informed that there is a fee for legal publication and will pay for the publication. 22-1-50.B.3. "A typewritten original and eleven(11) copies of the proposed Comprehensive Plan amendment must be submitted to the Department of Planning Services no later than October 1 or April 1 of each year to be considered for review and public hearings." The applicant met this requirement. 22-1-50.B.3.a "A statement describing why the comprehensive plan is in need of revision. " The applicants have stated the desire to develop the properties at an urban scale density by complying with standards established in Chapter 26, Mixed Use Development area plan. Application materials also state the properties are within the St. Vrain Sanitation District boundary. Capability of serving these properties by St. Vrain Sanitation District does exist. Section 26-2-30.D.1 states that"Residential districts within the MUD area are encouraged to be cohesive, identifiable and diverse, while retaining the current agrarian lifestyle of residents in the area." The creation of residential units for 4,513 individuals on 635 of the proposed 1,100 acres will increase the population projects of the MUD area by approximately 11%. Similarly, the land mass of the MUD area will increase by approximately 8%. The creation of an expansion to the MUD area is of concern for surrounding land uses. It is important to note current agricultural uses occur on land under this application, including crop production and a confined animal feeding operation. Furthermore,adjacent land uses include current agricultural uses to the east,north,and south. According to the State Demographer, the population forecast of this amendment - 1,588 persons - is greater than the population of many Weld County communities. In fact, the projected population is comparable to the populations of Firestone and Frederick. [July 1999 population of Frederick was 1,892. July 1999 population of Firestone was 1,764. When developing the MUD Plan,a ratio of employment centers,residential areas,parks and transit centers were carefully planned in correlation to the total planned area. The applicants have carefully examined this mixture of uses and have proposed a similar mixture,keeping true to the intent of the MUD Area. 4 22-1-50.B.3.b. "A statement describing how the proposed amendment will be consistent with existing and future goals,policies, and needs of the County." Section 22-2-60, A.Goal.3 of the Comprehensive Plan states that, "Urban-scale residential, commercial,and industrial development which is not located adjacent to existing incorporated municipalities"shall be discouraged. A.Policy3 of the Comprehensive Plan further states that "Conversion of agricultural land to urban-scale residential, commercial and industrial development will be discouraged when the subject site is located outside of an approved Intergovernmental Agreement area,urban growth boundary area,or I-25 MUD area and urban development nodes." This proposal is located adjacent to the Urban Growth Boundary for the Town of Mead, and within the vicinity of current commercial and industrial activities taking place along State Highway 66. Section 22-2-170 R. Goal 2 of the Comprehensive Plan states that any proposed residential development shall,"Ensure that adequate public services and facilities are available to serve the residential development or district." R.Policy 2 further elaborates, "The land-use applicant will demonstrate, to the Board of County Commissioners, that adequate sanitary sewer and public water systems are available to all residential development,and that the street or highway facilities providing access to the property are adequate in width,classification,and structural capacity to meet the requirements of the proposed district or development." The Weld County Department of Public Works noted the following concerns in a referral response dated April 24, 2001: 1. Weld County Road 13 is presently designated as an arterial. If this amendment is approved, the cross-section would have to be widened to a four-lane with a painted median. The right-of-way required for this arterial would be a minimum of 110 feet wide. Weld County Road 28 is presently designated as a collector. A collector requires 80 feet of right-of-way. 2. Several properties in this area are presently within the review process. The most recent traffic study shows State Highway (SH) 66 must be widened to four lanes. Even with this improvement,SH 66 will operate a 18%over capacity(level of service "E") in the evening peak hour. One of the policies of the MUD is to maintain all intersections at a level of service"D". At present,there are no CDOT or Upper Front Range plans to widen SH 66. Without the widening,the roadway network will break down in the evening and morning peak hours. 3. Since there are no CDOT funds to widen SH 66, and without widening the roadway the development in the area will devastate the present level of service,a portion of the widening costs for SH 66 should come from the developers in the area. 5 The following procedures to amending the I-25 Mixed Use Development Area Map are outlined in Section 22-1-50.5 of the Weld County Code, as amended: 22-1-50.5.a. "The proposed amendment must demonstrate the proposed amendment is adjacent to and contiguous with the existing 1-25 MUD Area Map." The combination of these parcels create a 35%contiguity boundary with the existing MUD area. 22-1-50.5.b. "The proposed amendment must describe how the proposed amendment will not place a burden upon existing or planned service capabilities. This statement shall include how emergency services will be provided to the proposed area." The Department of Public Works noted in a referral response dated April 24, 2001 that the distribution shown in the submitted traffic study were not acceptable. Further,Public Works noted, "It is unlikely that 42%of the over 40,000 daily trips generated by this development would go toward Platteville." 22-1-50.5.c. "The proposed amendment must delineate the number of people who will reside in the proposed area. This statement shall include the number of school-aged children and address the cultural and social service provision needs of the proposed population." Application materials indicate that 1,191 students will reside within the proposed amendment boundaries; 635 Residential units will be constructed; and 5,445 jobs will be created. 6 Table 22.4 will also need to be amended should this amendment be approved. This proposal represents a highly coordinated and cooperative effort between all of the property owners within the amendment area. Each of the owners is a joint applicant. The property owners have worked to jointly create what we believe is a balanced, logical, and high quality proposal that will provide needed housing, employment, recreational, and educational amenities to the Southwestern portion of Weld County. The majority of the Property is farmed by families that have owned the land for multiple generations. Each of the land owners desire to have the opportunity at a future date to develop their property in accordance with County standards set forth in the MUD. Each of the owners is committed to quality development that will enhance the neighboring developments and be sensitive to properties that are not included within the MUD. We have discussed the proposed MUD amendment with staff from the Towns of Firestone and Mead. We believe in the value of a coordinated and mutually agreed to plan of development as opposed to the creation of multiple, less integrated planning efforts. We believe this application presents several unique and valuable enhancements to the County, as has been prepared to ensure quality and orderly development. The Weld County Comprehensive Plan is in need of revision. Although not included within either the I-25 MUD or any town planning area, the Property is largely an infill area that is contiguous to both the existing I-25 MUD and the Town of Mead. The Property therefore has logical, existing planning boundaries on both the west and north. The southern and eastern boundaries of the Property also provide for natural boundaries in the form of the St. Vrain River flood plain and existing feedlots and dairies. The Property is located within the 208 Water Quality Planning Area of the St. Vrain Sanitation District, which was one of the key criteria related to creation and boundaries of the existing I-25 MUD. The Property lies entirely within the service area of the St. Vrain Sanitation District, and can be provided gravity sewer service by District facilities. Northeast I-25 MUD Amendment March 2001 This proposed amendment is consistent with existing and future goals, policies, and needs of the County. The proposed amendment is a balanced development that provides a mix of housing, employment, recreation, and educational opportunities for existing and future residents of the southwest portion of the County. This proposal provides for unique trail connections and extensions along the St. Vrain River and properties to the north. The proposal protects and preserves sensitive riparian and wildlife areas adjacent to the St.Vrain River. This proposal is adjacent to and contiguous with the existing I-25 Mixed Use Development Area Map. The Property is adjacent to the existing I-25 MUD along the entire western boundary and over 1/2 of the southern boundary. Approximately 36% of the Property boundary is contiguous with the existing I-25 MUD. The Property is bounded on the north by the Town of Mead (Grand View Estes) as well as the Mead Planning Area. The Property is not located within the planning area of any adjacent town. The Property largely constitutes an infill area between the I-25 MUD and the Town of Mead planning area as shown on the attached Exhibit. This proposed amendment will not place a burden upon existing or planned service capabilities. • Roads: The Property is bounded by State Highway 66 on the north, Weld County Road 11 on the west, Weld County Road 28 along the south, and is bisected by Weld County Road 13. Please refer to the attached Exhibit. The Property is within the Southwest Weld Road Improvement Area. The existing roadways provide access to regional highways including State Highway 66, State Highway 119, and Interstate 25. As development occurs, impact fees will be accessed by the County to provide adequate funding to design and construct the necessary roadway improvements. This amendment also promotes alternate modes of transportation by providing for several trail and bikeways that connect with regional trail systems and allow for internal access to neighborhood commercial centers, parks, employment centers and schools from the residential areas. • Sewer: Sanitary sewer service will be provided by the St. Vrain Sanitation District facilities. The Property is located within the 208 Service Area of the St. Vrain Sanitation District. The District has recently installed a sewer trunk line that is sized to provide service to the portion of the district located north of the St. Vrain River. The line is capable of providing gravity service to the all areas of the Property that are planned for development. As development in the area proceeds it will be necessary to install extensions to existing lines to complete the sewer collection system. The District recently received approval to expand their treatment facilities as development proceeds within the District service area. Please refer to the attached letter from the St. Vrain Sanitation District manager concerning provision of sewer service to the Property. 2 Northeast I-25 MUD Amendment March 2001 • Water: The Little Thompson Water District will provide treated water service. The applicants have briefly discussed the proposal with the District Manager prior to making application to the County for the MUD amendment. Significant improvements have been made to the District's water transmission facilities that have increased the system capacities to the north of the Property in the vicinity of I-25 and Weld County Road 38. Additional water lines will be needed to the water distribution system to provide adequate capacity south of Road 38 as development in the MUD continues. The District has in place the necessary development fee structure to provide adequate funding as development proceeds in the general area. The Property is irrigated land, and has adequate Colorado Big Thompson and other native water rights to support the proposed development plan. The proposal anticipates the continued use and irrigation from the existing lakes and irrigation ditch systems for open space and outdoor watering needs. This approach to outdoor watering, known as a dual water system could significantly reduce the demand for treated water to the development. • Fire Protection: The Mountain View Fire Protection District serves the area. Specifically, the Property is most easily accessed by Fire Station 2 which is located 2 miles to the south of the property at the intersection of Weld County Roads 13 and 24. It is anticipated that additional fire stations and facilities may be needed in the overall MUD area as development proceeds. The existing response time from Station 2 is less than 5 minutes. • Law Enforcement: The Weld County Sheriff Department will provide police protection and law enforcement services. A substation is currently located at the intersection of Weld County Roads 13 and 24. It is anticipated that this substation will be relocated to the new County Administrative Service Center that is planned for construction north of the intersection of Weld County Road 24 and the I-25 Frontage Road. • Schools: The Property is located in the St. Vrain Valley School District. The District recently completed the construction of two new elementary schools that have provided additional capacity in the eastern portion of the District. The proposal includes land for an additional middle and elementary school. The District has voted to request voter approval to issue additional bonds in November 2001. The applicants have met with representatives from the St. Vrain Valley School District to present the proposal and receive pre-application comments from the District. • Parks and Open Space: The proposal includes 140 acres of open space, trail corridors, and parkland. The Property is bordered on the southeast by the St.Vrain River corridor and flood plain. Land for wildlife preservation areas is provided in sensitive areas along portions of the southern boundary as well as along two primary greenways. Land is provided for community or neighborhood parks that are centrally located in the proposal with trail connections to the proposed St. Vrain River trail system, the school site, residential areas as well as 3 Northeast I-25 MUD Amendment March 2001 the proposed business park sites. The proposal makes effective use of trail connections to provide alternative transportation modes for residents and employees. • Other Social, Health,and Cultural Services: Similar to the other properties currently within the MUD, the future residents of the proposed amendment area will patronize the variety of services located in the surrounding communities of Greeley, Longmont, Loveland, the Tri-Town area, and the Denver-Metro area. These surrounding communities are all within 30 minutes of travel time and provide for the full spectrum of cultural and social services. It is anticipated as development continues within the MUD that a population will be reached that is capable of supporting additional facilities. One such facility, an indoor sports complex, is currently planned to be built in the Vista Commercial Center near the Property. The development of the Property will also contribute additional tax funds to the Weld County Library that could result in the siting of a branch library at some point in the future within the MUD area. The following comments may not be all inclusive, as other concerns or issues may arise during the remaining process. External Roadways: WCR 13 is presently designated as an arterial. If this amendment is accepted, the cross-section would have to be widened to a four-lane with painted median. The right-of-way required for this arterial would be a minimum of 110 feet wide. WCR 28 is presently designated as a collector. A collector requires 80 feet of right-of-way. Several properties in this area are presently within the review process. The most recent traffic study shows State Highway(SH)66 must be widened to four lanes. Even with this improvement, SH 66 will operate at 18% over capacity (level of service "E") in the evening peak hour. One of the policies of the MUD is to maintain all intersections at a level of service of"D". At present,there are no CDOT or Upper Front Range plans to widen SH 66. Without the widening, the roadway network will break down in the evening and morning peak hours. Since there are no CDOT funds to widen SH 66,and without widening the roadway the development in the area will devastate the present level of service, a portion of the widening costs for SH 66 should come from the developers in the area. Traffic Impact Study: The distribution shown in this study is not acceptable. It is unlikely that 42%of the over 40,000 daily trips generated by this development would go toward Platteville. This does represent a departure from past responses, however,the Board believes it is a necessary response to help alleviate overcrowding in the schools. This particular development would negatively impact the capacity of Mead Elementary, Mead Middle School and Skyline High School in the current attendance area and would be expected to cause the 125% benchmark capacity to be exceeded in all three buildings within the next few years. Therefore,the District will oppose the approval of plats within this development proposal until there is capacity available in these schools or there are new schools available to serve this area. Should this proposal be considered for approval by the County the cash-in-lieu and land dedication requirements would still need to be satisfied. This development would require the dedication of almost 34 acres for school sites. The District has met with the developer and discussed the possibility of locating an elementary and a middle school site on the land use plan. The District wishes to continue working with the developer to verify the suitability of the proposed school sites in terms of any constraints and to coordinate the dedication at the appropriate time. The resident population and commercial use of this proposal at build-out will exceed the service resources currently planned for by the Sheriffs Office. I am estimating ten additional patrol, detective, and support positions will be necessary in addition to the staffing increases already identified annually through 2010. In today's costs,this will represent an additional $600,000 in personnel and overhead(vehicles, support equipment, etc.)annually. Adding development further east along the Hwy 66 corridor appears problematic. The traffic impact on the area, specifically Hwy 66, is a serious concern. Hwy 66 currently is one of the highest fatality locations in Weld County and it is my understanding highway use has exceeded current designed capacity. An additional 41,000 vehicle trips per day on this stretch of road cannot be accommodated by any transportation plan I'm aware of to date. I lack the ability to estimate if future assessed valuation for this project at build-out will add sufficient resources to provide the kind of high intensity law enforcement services required for such an urban scale. The property includes all of section 25 and the west% of section 30,township 3 north, range 68 west of the 6th principal meridian, County of Weld, State of Colorado. The perimeter of the site is bounded by Colorado Highway 66 on the north,Weld County Road (CR) 11 on the west, the Reynolds feed lots on the east, and CR 28 to the south. The purpose of this study is to determine a preliminary traffic count for site generated trips, review the anticipated distribution onto the adjacent roadways, and to discuss the site underlying concepts and assumptions. This study will be submitted as part of an application to join the I-25 Mixed Use Development. This study is prepared without collecting current traffic count data on the adjacent roads or in the area. Field data collection has been limited to the visual observation of traffic patterns in the area at various times. This base traffic count study data was taken from the Weld County Roadway Improvement Plan, prepared by Leigh, Scott, & Cleary, Denver, July 1999. Subsequent trip distributions were generated based on the traffic counts in said study. The proposed 1,110 acre mixed use tract is located at the northeast corner of the current I-25 MUD boundary. Adjacent development to the south and west is in MUD and will provide the contiguous boundary for this site to enter the MUD. CR 13 is designated as an arterial roadway in the current County transportation comprehensive plan. State highway 66 is currently a two lane paved road and forms the northern boundary of the site. County Road 112 is a two lane road that currently begins at CR28 and ends at Highway 66, and CR28 is a two lane gravel road that currently terminates at CR13. Access to the site will come from CR13, CR 11, CR28 and State Highway 66. The impact to CR28 will require paving the road from the intersection with CR13 to the site access. The daily rates from the ITE Trip Generation Manual for trip generation for a single family rural residential, office, retail, and restaurant were used for determining trip generation rates for daily, am, and pm peak hours. Trip distributions from the site are based on the traffic counts and the projections provided in the County Improvement Plan Study for the years 1999 and 2000. The traffic splits from the site are assumed as follows: CR 13 South from CR 119: 9% Colorado Highway 66 West to I-25: 48% East: 42% CR28 West to I-25 Frontage Road: 1% The generation of the traffic from this site is included on the attached summary sheet. Establishment of the site area roadway alignments and addition of future collector roadways will result in a more accurate localized impact to the adjacent roadways. A more concise traffic study should be completed after acceptance to the MUD that accounts for the concepts of the MUD transportation studies and the regional transportation plan and determines the specific impact to intersections and roadways in the area.
