Weld County Public Works has reviewed this proposal; this project falls primarily under the purview of the Use
by Special Review Standards, Weld County Code, Chapter 23,Article II, Division 4, Section 23. Our comments
and requirements are as follows:
COMMENTS:
WCR 10 is designated on the Southwest Study Area Capacity Improvement Needs as a local gravel road,which
requires a 60-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained
by Weld County. Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23, Article III,
Section 23-3-50, the required setback is measured from the future right-of-way line.
The average daily traffic (ADT) count for WCR 10 is 94 vehicles, taken in a 24 hour period on March 28, 2001.
REQUIREMENTS:
- 'Access: The steel gate to the proposed access has been recessed to allow a vehicle to pull off WCR 10 prior
to opening the gate. The steel gate measures 18 feet in width. The applicant shall verify with the local fire
district/ emergency response that an 18 foot opening will be adequate to access the site for emergency
purposes. Verification of this request shall be provided to Planning Services. A standard emergency width
requirement is 20 feet. Adjacent to the access lane, there is a cedar hedge. There are some limbs encroaching
v upon the access lane. These limbs should be trimmed to accommodate access to the facility.
Off-Street Parking: The off-street parking spaces, including the access drive, shall be surfaced with gravel,
asphalt, concrete, or equivalent, and shall be graded to prevent drainage problems.
Storm Water Drainage: The applicant is indicating any water from the site will flow through historical patterns
and ditches to their existing pond located on lot five, owned by the applicant. '
Access Lane/Easement: The applicant owns lots 5, 6, 11, and 12. If any of the lots are sold, an
access/easement needs to be in place to access lots 11 and 12 in the rear, if access is not available from the
south property line./

✓1. Building permit shall be obtained prior to any construction.
2. A plan review will be required. Plans shall bear the wet stamp of a Colorado registered
architect or engineer. Two complete sets of plans are required when applying for the permit.
3. Buildings shall conform to the requirements of the 1997 UBC, 1998 IMC, 1997 IPC, 1999
NEC and Chapter 29 of the Weld County Code.
/4. Each building will require an engineered foundation based on a site-specific geotechnical
report or an open hole inspection performed by a Colorado registered engineer. Engineered
foundations shall be designed by a Colorado registered engineer.

Dear Mr. Gathman:
I have reviewed the submitted material pertaining to the Special Use Permit for the construction of
an indoor arena and horse boarding facility2700 Weld County Road 10 (Case Number: USR-
1348, Case Name: Abfalter). The Fire District has no objections to the project if the requirements
of the District can be met. Based on my review, I have the following comments regarding the
project:
• Building construction shall be in accordance with the provisions of the Uniform Fire Code, as
ratified by the Weld County Commissioners, and all other codes and ordinances, as enforced
by Weld County.
• Not enough information is known about the indoor arena to determine if water supply for fire
protection is needed. If the arena facility is open to the public for training, classes, competitive
events, public assembly, and/or horse shows etc., water supply for fire protection will be
required. If the arena is for private use by the owners for the training and housing of horses,
water supply for fire protection will not be required.
• Fire department apparatus access must be provided for structures in excess of 150 feet from a
public access road. Fire apparatus roads shall be extended so fire apparatus may reach to
within 150 feet of all portions of the building. Apparatus access roads shall be a minimum of
20 feet in width and be designed and maintained to support the imposed loads of fire apparatus
(60,000 pounds). Roads must have a surface that provides all-weather driving capabilities.
Roads in excess of 150 feet in length must be provided with approved provisions for the
turning around of fire apparatus.
• Two sets of final site plans and information regarding the proposed activities occurring within
the arena must be provided to the Fire District for review and approval prior to the issuance of
any building permit in order to assure compliance with the above requirements.

Environmental Health Services has reviewed this proposal for an animal training and boarding facility. We have no
objections to the proposal, however,we do recommend that the following conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be recorded:
1. Submit a dust abatement plan to the Environmental Health Services, Weld County Department of Public
Health& Environment, for approval prior to operation.
2. An individual sewage disposal system is required for the proposed facility and shall be installed according to
the Weld County Individual Sewage Disposal Regulations. The septic system is required to be designed by a
Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal
Regulations.
3. The applicant shall submit a manure and stormwater management plan to the Weld County Department of
Public Health and Environment fo review and approval. The plan should describe how manure
generated on site will be stored, managed, removed, land applied, etc. The plan should also describe
the fate of any stormwater that may come into contact with manure.
We recommend that the following requirements be incorporated into the permit as"development standards":
1. The applicant shall remove,handle, and stockpile manure from the livestock area in a manner that will
prevent nuisance conditions. The manure piles shall not be allowed to exist or deteriorate to a condition that
facilitates excessive odors, flies, insect pests, or pollutant runoff. The manure storage site shall have a water-
tight surface which does not permit seepage or percolation of manure pollutants into the ground.
2. Animal and food wastes, bedding, debris and other organic wastes shall be disposed of so that vermin
infestation, odors, disease hazards and nuisances are minimized. Such wastes shall be removed at least
weekly, or more frequently, from the facility and hauled by a commercial hauler.
3. The facility shall operate in accordance with the approved dust control plan. The facility shall have
sufficient equipment available to implement appropriate dust control. Additional control measures shall be
implemented as required by the Weld County Health Officer.
4. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5,
C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface

and groundwater contamination.
5. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes
specifically excluded from the definition of a"solid waste" in the Solid Wastes Disposal Sites and Facilities
Act, 30-20-100.5, C.R.S., as amended.
6. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing
debris, and other potential nuisance conditions.
7. Fugitive dust shall be controlled on this site.
8. This facility shall adhere to the maximum permissible noise levels allowed in the Residential Zone as
delineated in 25-12-103 C.R.S., as amended.
9. Adequate hand-washing and toilet facilities shall be provided for the boarders using the indoor arena.
10. All pesticides, fertilizer, and other potentially hazardous chemicals must be stored and handled in a safe
manner. Reference 25-8-205.5 Colorado Water Quality Control Act and Rules and Regulations thereof.
11. The facility shall utilize the existing public water supply. (Left Hand Water)
12. The facility shall comply with the Confined Animal Feeding Operation (CAFO) Regulations. (5CCR
1002-19)
