RE: CERTIFICATE OF DESIGNATION FOR A SOLID WASTE DISPOSAL SITE (COAL ASH
BURIAL PROJECT)IN THE A(AGRICULTURAL)ZONE DISTRICT-VARRA COMPANIES,
INC.
A public hearing was conducted on October 10, 2001, at 10:00 a.m., with the following present:

Commissioner Robert D. Masden

The following business was transacted:
I hereby certify that pursuant to a notice dated September 21, 2001, and duly published
September 26, 2001, in the Tri-Town Farmer and Miner, a public hearing was conducted to
consider the request of Varra Companies, Inc., for a Certificate of Designation for a Solid Waste
Disposal Site (coal ash burial project)in the A(Agricultural)Zone District. Lee Morrison,Assistant
County Attorney, made this a matter of record. Kim Ogle, Department of Planning Services,
presented a brief summary of the proposal and entered the favorable recommendation of the
Planning Commission into the record as written. He stated the Certificate of Designation is being
proposed in conjunction with 3rd Amended Use by Special Review Permit #248, which was
previously approved by the Board on September 19,2001,with Commissioner Jerke opposed. He
reviewed the reasons for approval and a Condition of Approval as indicated in his memorandum,
marked Exhibit D.
JobyAdams, Colorado Groundwater Resource Services, represented the applicant and stated this
is a research project for disposal of coal ash. He stated the project has been scientifically
researched, and various agencies have been used to come up with sound protocol. Mr. Adams
confirmed the County and State Departments of Public Health and Environment have both been
involved with this project from the beginning. No public testimony was offered concerning this
matter.
Commissioner Vaad moved to approve the request of Varra Companies, Inc., do Colorado
Groundwater Resource Services, for a Certificate of Designation for a Solid Waste Disposal Site
(coal ash burial project) in the A(Agricultural)Zone District, based on the recommendations of the
Planning staff and the Planning Commission, with the Condition of Approval as recommended by
staff in Exhibit D. The motion was seconded by Commissioner Masden, and it carried with
Commission Jerke opposed.
There being no further discussion, the hearing was completed at 10:15 a.m.
