RE: APPROVE CANCELLATION AND RELEASE OF COLLATERAL FOR SITE PLAN
REVIEW, SPR#302 - DANIEL AND DEBRA BAKER
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated August 26, 1999, the Department of Planning Services
did approve the application of Daniel and Debra Baker, dba Dirty Dan's Garage, 21042
Peckham Drive, LaSalle, Colorado 80645, for a Site Plan Review, SPR#302, on the following
described real estate, to wit:
Lot 1, Block 2, Hunt-Wiedeman Planned Unit
Development, located in part of the S1/2 of Section
14, Township 4 North, Range 66 West of the 6th
P.M., Weld County, Colorado, and
WHEREAS, on November 29, 2000, the Board of County Commissioner of Weld
County, Colorado, did approve an Improvements Agreement According to Policy Regarding
Collateral for Improvements (Private Road Maintenance) between the County of Weld, State of
Colorado, by and through the Board of County Commissioners of Weld County, and Daniel and
Debra Baker, dba Dirty Dan's Garage, with terms and conditions being as stated in said
agreement, and accepted Certificate of Deposit#8000749, drawn on the Weld County Bank,
3635 23rd Avenue, Evans, Colorado 80621, in the amount of$5,000.00, and
WHEREAS, on October 16, 2000, the Board cancelled and released Certificate of
Deposit#8000749, in the amount of$5,000.00, and accepted Certificate of Deposit #8001453,
drawn on the Weld County Bank, 3635 23rd Avenue, Evans, Colorado 80621, in the amount of
5,204.60, and
WHEREAS, at the request of the property owner, staff from the Weld County
Departments of Public Works and Planning Services has conducted visual inspections and
recommends release of said collateral.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Certificate of Deposit#8001453, drawn on the Weld County
Bank, 3635 23rd Avenue, Evans, Colorado 80621, in the amount of 5,204.60, be, and hereby
is, canceled and released.
BE IT FURTHER RESOLVED by the Board that the Clerk to the Board be, and hereby
is, directed to return said collateral to the appropriate issuing party.

On October 15, 2001, the Department of Planning Services preformed a site investigation of the
completed improvements for Dan's Garage located on Lot 1, Block 2 of the Hunt Wiedeman PUD,
situs address 21042 Weld County Road 33, LaSalle, at the request of Debbie and Dan Baker,
applicants.
The completed improvements includes the construction of a hard surface parking lot and approach
slab to the overhead doors. Non-transportation items include the installation of sixty Picea
Pungens 'glauca', Blue Spruce and the installation of fencing and a drip irrigation system for the
trees.
Don Carroll of Weld County Department of Public Works has inspected the items, and in his
memorandum of October 8, 2001, indicates he has no conflict with the release of funds.
The Department of Planning Services Code Compliance Division states that the property is in
Violation, Case number VI-0100106. To rectify the violation, the applicant is to submit an
Amended Site Plan Review application. On November 1, 2001 the application was submitted to
the Department of Planning Services.
Given that an application has been submitted for an amendment to the existing Site Plan Review
(SPR-302), the Department of Planning Services is recommending to the Board of County
Commissioners that the Certificate of Deposit be released.
Therefore, the Departments of Public Works and Planning Services recommends that five
thousand two hundred four and 60/100s($5204.60)dollars(Certificate of Deposit#8001453 drawn
on and held by the Weld County Bank, 3635 23rd Avenue, Evans, Colorado 80621) be released.

Therefore,the Departments of Planning Services recommends that five thousand two hundred four

determine that moving the garage from the West to the
East would NOT be considered a substantial change;
however, that since the property was in violation the
building permit would be placed on hold. I explained
that this is how we handle all permits when a
violation is present on the property. She stated that
they had (per the BOCC) until October. I told her
that was correct, however, the property was still in
violation.

called Ms. Baker to inform her of staffs
determination. She had requested me to take her case
to staff to find out what would need to occur so that
we would not have to do a whole new Site Plan Review.
I informed her that staffs determination was if the
site was restored to comply with all aspects (except
for the garage being moved for their personal
residence) of the existing Site Plan Review map
(SPR-302), then a new Site Plan Review would not be
required. I explained that currently vehicles are
parked all over the property. She said that they are
a repair shop and I explained that the Code requires
that the activity occuring on the site be screened
from all properties that do not share in the same
zoning. She said that it would look that way because
they take junk vehicles. I explained that they needed
to maintain the vehicles in the area currently shown
on their plot map. I explained that a reduction in
vehicles would be necessary in order for that to
occur. I will send a letter to Mr. & Mrs. Baker.

items were noted: numerous derelict vehicles,
automobile parts, a new dirt track. A few trees have
indeed been plated and a fence is now up on the South

a visual inspection of the property, the following
notes were taken: 1.) Vehicles parked all over the
property(not limited to the area shown on the plot
map) 2.) The screened storage area has been moved
from the East portion of the building to the Northern
portion of the building (per the plot map, this would
be located over an easement) 3.) 2 (two) accesses are
in use on the property. Additionally, the trees as
proposed on the plot map are not yet in place. Ms.
Baker indicated that they wanted to do a nice white
fence instead of the trees. I told her that I didn't
see a problem with doing that, but that I would have
to present it to staff and ask if they were okay with
that. I told her that I would get back to her on that

a visual inspection of the property, the following
items were noted: 1.) A white fence (instead of
trees) has been placed along the Western side of the
property. The fence is not opaque. 2.) The screened
storage area is still located along the Northern side
of the main structure. 3.) A storage shed is located
on the property(a tote-a-shed). 4.) Vehicles are
still parked all over the property. (They are still
not limited to the area shown on their recorded plot
map) 5.)Railroad ties are located on the property. I
have explained all of the above items in violation.

The individuals present: Robert Anderson, Bethany Salzman, Daniel & Debbie Baker and their son.
The following items were discussed:
-Site Plan Reviews are very specific (i.e. employee parking, etc...)
- How "substantial changes" work.
-The importance of an accurate SPR map to show what activities can occur and where.
Mr. Baker stated the following:
-he had to re-plant the trees twice.
-the fence is done on the West side.
-they used cement instead of blacktop (Mr. Baker said that it was okayed by Don Carroll).
-the screened storage area is 120 feet long by 20 feet wide and does not sit over the easement.
To bring the property into compliance:
-It was determined,unless the property is completely restored to coincide with the existing Site Plan Review
(SPR-302) map,an amended SPR application shall be submitted. Unfortunately, it appears that'Dirty Dan's
Garage'has already outgrown their existing SPR permit. Robert explained the importance of"thinking big"
to allow for future growth before submitting a new application.

I am submitting a new site plan review map as the following revisions have been
made to the site.
1) We would like to add another 18ft. driveway on the north side as when we get a
all the semi trucks and trailers in here it is hard for then to get turned around
and it just gets to congested. We felt the it would be to our advantage to add
another driveway so they can go around the back of the garage and out the side
if needed.
2) The 2 car garage on the mobile home we would like to move to the other side
of the mobile home.
3) The outdoor screened storage we moved to the back of the garage and we
enclosed the trash dumpster in there.
4) The landscaping across the front of the garage instead of trees we will be
putting up white plastic fence.

Based upon my inspection conducted on September 14, 2001, the following revisions have been made to the
site, but are not delineated on your current Site Plan Review map (SPR-302):
1.) 1 (additional) proposed access point.
2.) Relocation of the garage.
3.) Relocation of the outdoor screened storage area.
After speaking to staff regarding my findings, a new Site Plan Review map will need to be submitted showing
the above mentioned revisions. Additionally, staff asked me to have you draw the map to a 1 to 50 scale. I
would recommend that you speak to the Public Works Department prior to submitting your revised map (to
determine whether or not to show the additional proposed access point). However, it would be in your best
interest to supply this map as soon as possible,to allow us sufficient time to ascertain,what is required to bring
the property into compliance.

Subject: Release of Collateral for Dan's Garage
Case Number SPR 302, c/o Debbie and Dan Baker
On October 12, 2001, the Department of Planning Services preformed a site investigation of the
completed improvements for Dan's Garage located on Lot 1, Block 2 of the Hunt Wiedeman PUD,
situs address 21042 Weld County Road 33, LaSalle, at the request of Debbie and Dan Baker,
applicants.
The completed improvements includes the construction of a hard surface parking lot and approach
slab to the overhead doors. Non-transportation items include the installation of sixty Picea
Pungens glauca', Blue Spruce and the installation of fencing and a drip irrigation system for the
trees.
Don Carroll of Weld County Department of Public Works has inspected the items, and in his
memorandum of October 8, 2001, indicates he has no conflict with the release of funds. The
Department of Planning Services' in their memorandum of October 15, 2001 recommends the
release of funds associated with the non-transportation items of the Improvement Agreement.
Therefore, the Departments of Planning Services and Public Works recommend that five thousand
and no/100s ($ 5000.00) dollars (Certificate of Deposit#8000749) be released.
